1 [3771-1] 1 2 3 4 5 6 7 8 9 A JOINT RESOLUTION 10 11 TO APPROVE REGULATIONS OF THE DEPARTMENT OF 12 HEALTH AND ENVIRONMENTAL CONTROL, RELATING 13 TO STANDARDS FOR LICENSING COMMUNITY 14 RESIDENTIAL CARE FACILITIES, DESIGNATED AS 15 REGULATION DOCUMENT NUMBER 2541, PURSUANT TO 16 THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF 17 THE 1976 CODE. 18 19 Be it enacted by the General Assembly of the State of South 20 Carolina: 21 22 SECTION 1. The regulations of the Department of Health and 23 Environmental Control, relating to standards for licensing 24 community residential care facilities, designated as Regulation 25 Document Number 2541, and submitted to the General Assembly 26 pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 27 1976 Code, are approved. 28 29 SECTION 2. This joint resolution takes effect upon approval by 30 the Governor. 31 ----XXX---- 32 33 SUMMARY AS SUBMITTED 34 BY PROMULGATING AGENCY. 35 36 This amendment will extricate applicability to facilities that treat 37 those with chemical dependency and addiction from R.61-84. 38 Concurrently, the department has proposed to consolidate the 39 standards for all of the alcohol and drug abuse treatment facilities 40 which DHEC now licenses into one regulation(R.61-93); alcohol 41 and drug abuse treatment programs within existing hospitals will 42 continue to be licensed under the hospital regulation (R.61-16).
1 [3771] 1 1 The department proposes to amend R.61-84 to update and enhance 2 the regulations. In addition, this amendment will: update and 3 expand definitions/interpretations; clarify licensing change 4 requirements; update licensing fee amounts; describe inspection 5 reporting requirements; add reference to department consultations; 6 update and clarify and update classification of standards and 7 enforcement action procedures; update staffing standards; update 8 physical plant/structural requirements; add quality improvement 9 standards; reword sections related to care and services; reword 10 sections regarding resident record content and maintenance; update 11 infection control and tuberculosis screening requirements; update 12 medication management requirements; update meal service 13 requirements; add reporting requirements; enhance resident 14 rights/assurances requirements; reword sections regarding resident 15 record content and maintenance; expand/update emergency 16 preparedness requirements; enhance fire prevention requirements, 17 and add a severability clause. The proposed amendment will 18 rewrite the regulation in its entirety. 19 ----XX----
