LIST OF QUALIFYING LAW DEGREES & QUALIFYING FOUNDATION DEGREES/HNDs

This statement, and the list of degrees which follows it, is issued by the Bar Standards Board in respect of degree courses commencing on or after 1 September 2001. This list should be considered together with this statement.

The Bar Standards Board recognises the law degrees listed below as “Qualifying Law Degrees”, i.e., law degrees which meet the requirements for completing the Academic Stage of training for intending Barristers, provided that the degrees have been awarded on the basis of the student having passed within the degree course the examinations and assessments for the foundations of legal knowledge set out in schedule two of the Joint Statement 1999. These subjects are; Public Law (including Constitutional Law, Administrative Law and Human Rights), Law of the European Union, Criminal Law, Obligations (including Contract, Restitution and Tort), Knowledge of the English Legal System, Property Law and Equity & the Law of Trusts. Students will also be expected to have appropriate expertise in Legal Research.

The award of a law degree which complies with the above requirements entitles the student to proceed to the Vocational Stage of training for The Bar of England and Wales (i.e the BPTC), subject to the regulations then in force and providing at least a II (ii) honours degree has been obtained.

In some of the degrees listed, the foundations of legal knowledge are not compulsory within the course of study. Students should be aware that failure to take all of the foundations of legal knowledge within their degree studies and/or additional legal subjects in order to have completed 240 credits in legal subjects, will result in a delay of at least 12 months in commencing the Vocational Stage of training for the Bar. This is in order to allow time to prepare for and then take and pass the outstanding subjects in the Common Professional Examination or an approved Graduate Diploma in Law course. Students in this position must apply for and obtain a Certificate of Partial Exemption from the Academic Stage of training from the Bar Standards Board before commencing either the Common Professional Examination or an approved Graduate Diploma in Law course for completion of the Academic Stage of training for the Bar.

Students who plan to complete their degree studies by distance learning should be aware that it is the policy of the Bar Standards Board that distance learning courses are normally deemed to be part-time courses.

The Bar Professional Training Course (BPTC) must be commenced within five years of completion of a Qualifying Law Degree. Updated: June 2015

LLB UPGRADES/TOP UPS

The LLB upgrades/top ups to the Graduate Diploma in Law programmes offered by some institutions are not recognised by the BSB as Qualifying Law Degrees as commonly understood, or as set out in the Joint Statement on Qualifying Law Degrees; however, this does not affect the status of the Graduate Diploma in Law which, if successfully completed, will satisfy the regulatory bodies’ requirements of the Academic Stage of training. Please contact the institution(s) concerned if you have any queries about these awards.

AWARD OF LLB AFTER COMPLETION OF THE GRADUATE DIPLOMA IN LAW AND THE BAR PROFESSIONAL TRAINING COURSE

A number of institutions award an LLB to students who have successfully completed their Graduate Diploma in Law together with the Bar Professional Training Course. These awards are not recognised by the BSB as Qualifying Law Degrees as commonly understood, or as set out in the Joint Statement on Qualifying Law Degrees; however, this does not affect the status of the Graduate Diploma in Law which, if successfully completed, will satisfy the regulatory bodies’ requirements of the Academic Stage of training, or the status of the Bar Professional Training Course, which, if successfully completed, will satisfy, in part, the BSB's requirements of the Vocational Stage of training. The Bar Standards Board recognises for qualifying purposes the LLB of the Open University in which graduates have passed the assessments and examinations set in the four 60 credit modules:

 Understanding Law;  Law - the Individual and The State;  Law - Agreements Rights and Remedies; and  Law Ownership and Trusteeship Rights and Responsibilities.

Students should note that if they wish to use their degree to qualify as a Barrister, they must undertake all four law courses as part of their OU degree and all of the degree studies should be completed within six years, including study from elsewhere being used i.e., credit transfer. In addition, a lower second class honours level or above must be obtained.

The Solicitors Regulation Authority and The Bar Standards Board recognise the law degree of the University of London International Programmes as a Qualifying Law Degree provided the period of study involved is not more than six years and the graduate has passed the written assessments in the seven foundations of legal knowledge (please refer to the course provider for further information). Students commencing this degree in or after September 2001 are required to undertake and pass European Union Law for Qualifying Law Degree status; furthermore, for the Bar, the minimum entry requirement of a lower second class honours level or above must be obtained.

In the case of students registering on or after 1 September 2007, for the purposes of obtaining a QLD, it is a University of London requirement that a Law Skills Portfolio (which satisfies one or other of the sets of criteria for such portfolios which are contained in the regulations for the degree and on the presence of a statement to this effect on a Bologna compliant transcript) be submitted within the maximum six-year period from registration, of a Skills Portfolio. Students must refer any enquiries regarding this requirement directly to The University of London.
