WOODBROOK FINE SCHEDULE APPROVED BY THE BOARD OF DIRECTORS 9-12-02

The following list of fines is issued and approved by the Woodbrook Board and Directors in accordance with the Condominium documents of the Woodbrook Camp and Tennis Club, a Condominium and Woodbrook Camp and Tennis Club Association, subject to change and revision at the Board’s sole discretion at any time. All identified fines are in addition to (1) any required reimbursement by lot owners to Woodbrook Camp and Tennis Club, A Condominium and/or Woodbrook Camp and Tennis Club Association for any damage or destruction of property, etc. and (2) any legal and other fees/costs to enforce these fines. Other fines may be assessed by the Board of Directors.

1. Speeding or reckless driving such as driving without proper headlights, driving with a child in your lap or otherwise distracted, driving an overloaded golf cart with more passengers than the number of seats, etc. FINE: First a warning with no fine, 2 nd violation – $ 25.00 fine, and then a $ 100 fine for subsequent violations and other actions as deemed appropriate.

2. Failure to come to a complete stop at a stop sign with a car, golf cart, etc. FINE: First a warning with no fine, 2 nd violation - $ 25 fine, and then a $ 100 fine for subsequent violations and other actions as deemed appropriate.

3. Unlicensed or under-aged driver of golf cart, car, etc. – FINE: First, a $ 50 fine, and then a $ 100 fine for subsequent violations and other actions as deemed appropriate.

4. Failure to pick up after pets or unleashed pets – FINE: First a warning with no fine, 2 nd violation - $ 25 fine, 3 rd violation - $ 50 fine and then permanent removal of the pet from Woodbrook, and other actions as deemed appropriate.

5. Discharge of firearm, b-b gun, paint ball guns, bow and arrow, etc. – FINE: First a $100 fine, 2 nd and subsequent violations a $ 200 fine, and other actions as deemed appropriate.

6. Violation of DRB Regulations – FINE: Dependent on the Board’s evaluation of the extent of the violation – minimum fine is $ 10 per day with a maximum of $ 100 per day , and other actions as deemed appropriate (see DRB regulations for additional specifics).

7. Pool Violations – FINE: First a warning, followed by a $ 25 fine, 2nd and subsequent violations - $ 100 fine.

8. Tarmac Violation- FINE: 1st day – warning, second day $ 100.00 fine

9. Misuse of the dumpsters including dumping anything other than household trash or bringing trash from home – FINE: $100.00 first time offense, subsequent violations a $ 200.00 fine, and other actions as deemed appropriate 10. Failure to comply with Board’s request to clean up lot – FINE: First a warning by written letter, 2nd request will be a $ 75.00 fine along with a $ 75.00 charge to hire someone to clean up the lot.

Other Violations – Dependent on the Board’s evaluation of the extent of the violation.

This fine schedule is done in accordance to Article III of the By-Laws,(g), “The adoption of a fine system for the violations of the Condominium Declaration, and/or the Condominium By-Laws, and/or the Rules and Regulations of the Board of Directors, and/or the Rules and Regulations of the Design Review Board. Said fines, if unpaid, shall be deemed assessments pursuant to RSA 356 B:46 as amended from time to time or any successor statute.” Additionally under Article VII, Section 1c, the Board has the authority to impose a fine, have the fine attain the status of an additional assessment if unpaid, have the additional assessment become a lien if unpaid, and have the lien enforced, perfected, and collected.
