Dracut Conservation Commission Minutes of November 7, 2012 Dracut Historical Society

Commissioner’s Present: Victor Olson, James Jendro, John Hassan, Tami Dristiliaris, Elizabeth Martin, Conservation Agent Lori Cahill, and Recording Secretary Shannon Rowe Beaulieu

Commissioner’s Absent: Stephen Graham and Paul Mercier, Jr.

Mr. Olson opened the meeting at 7:00 p.m.

Approval of Minutes: Motion made by Mr. Hassan to approve the minutes of October 3, 2012 as written. Motion seconded by Mrs. Martin. Motion passed 3 to 0. Mr. Olson and Mrs. Dristiliaris abstained from voting.

Public Hearing/Notice of Intent/ Rear of 1300 Methuen St 145- Mr. Mark O’Hara from O’Hara Engineering Services, LLC appeared before the Board and presented plans titled Definitive Open Space Subdivision Plan Farm Gate Extension dated September 28, 2012 prepared by O’Hara Engineering Services, LLC proposing to construct a 12 lot subdivision, roadway, wetland crossing and sewer main. Mrs. Cahill stated that the DEP has appealed the first filing for this project which was the conventional subdivision plan. Mr. O’Hara stated that he has been working with the DEP regarding the appeal. Mr. O’Hara stated that Norse Environmental Services, Inc. delineated the wetland in January 2011 to determine the number of buildable lots for the conventional plan. Mr. O’Hara stated that the Planning Board has approved the open space plan. Mr. O’Hara discussed the proposed wetland crossing for the proposed gravity fed sewer line. Mr. O’Hara explained that the sewer line would be back filled when the pipe is laid in the ground and the proposed sewer work should only take a few days. Mr. O’Hara discussed only needing a path wide area enough for the machinery for the sewer work and it would be temporary disturbance. Mr. Jendro asked if there was a specific area set aside for stockpiling? Mr. Jendro stated that the Board usually requires before and after photographs, specific procedures for clay dams, etc, specific clearing areas and construction sequences for the proposed wetland crossing on plans. Mr. Olson discussed sheet 5, and stated that the clay dams needed to be added to the plans. Mrs. Martin discussed the insulated pipes on sheet 5. Mr. Jendro stated that the stockpiling area, cleared areas, clay dams and construction sequence around the wetlands needed to be shown on revised plans.

Motion made by Mr. Hassan to close the public hearing. Motion seconded by Mrs. Dristiliaris. Motion passed unanimously. Motion made by Mr. Hassan to issue an Order of Conditions with the following conditions: 1. Revised plans 2. Motion seconded by Mrs. Dristiliaris. Motion passed unanimously.

Public Hearing/Notice of Intent/ 61 Silva Lane 145- Attorney John Cox and Mr. Joseph Danubio from A-Plus Construction Services, Inc. appeared before the Board and presented plans titled Proposed Site Plan dated October 19, 2012 prepared by A-Plus Construction Services, Inc. to construct an office and rental sales building. Attorney Cox stated that the parcel is the last undeveloped lot on Silva Lane and the project does have a Special Permit from the Board of Selectmen. Attorney Cox stated that the wetland was delineated in November and December 2007. Attorney Cox discussed the proposed minor grading and stated that there is an Owner’s Association that maintains the detention pond on the property. The Board stated that they would like the Town Engineer to review the drainage calculations for the property. Mr. Jendro discussed having the wetland line to the south of the property reviewed. The Board discussed the temporary erosion control mat to the rear of the property closest to the wetland near the south slope. Mr. Danubio discussed the floor drains and stated that they tie into the proposed sanitary system.

Motion made by Mrs. Dristiliaris to close the public hearing. Motion seconded by Mr. Jendro. Motion passed unanimously. Motion made by Mr. Hassan to issue an Order of Conditions with the following conditions: 1. No additional structures, filling or grading within the 50’ buffer zone 2. Certified foundation plan 3. Drainage calculations to be reviewed by the Town Engineer 4. Erosion control mat on south slope shown on revised plans

Motion seconded by Mrs. Martin. Motion passed unanimously.

Continuation of Notice of Intent/ 35 & 54 Frank St 145-918 Mr. Olson read the email provided to the Board from Matt Hamor of Hancock Survey Associates, Inc, dated November 7, 2012 requesting to withdraw the Notice of Intent without prejudice.

Motion made by Mr. Hassan to accept the withdrawal of the Notice of Intent without prejudice. Motion seconded by Mrs. Martin. Motion passed unanimously.

Continuation of Notice of Intent/ Right of Way, between Methuen St & Broadway Rd 145-922 Mr. Tim Sullivan from Vanasse Hangen Brustlin, Inc. appeared before the Board and presented plans titled Y151 Reconductoring Project dated August 28, 2012 prepared by Vanasse Hangen Brustlin, Inc. to replace ten existing transmission structures. Mr. Sullivan stated that the proposed project was a maintenance project on existing power lines on between Methuen St and Broadway Road. Mr. Sullivan stated that they would be replacing the conductors and lines and replacing the poles with steel structures and moving some of them 20’ to 30’. Mr. Sullivan discussed the proposed work on Sheet 3, Dracut Conservation Commission- Minutes of November 7, 2012 3

Methuen St and stated that structure 46 is a double wooden pole that would be replaced with a double steel pole. Mr. Sullivan discussed the timber mats being used to allow the maintenance vehicles to get to the structures that are being replaced. Mr. Sullivan stated that appropriate erosion controls are being used. Mr. Sullivan stated that all existing material would be removed from the sites. Mr. Sullivan discussed the new 3’ culvert with a gravel foundation and stated that the existing holes would be back filled with stone where the poles are removed. Mr. Sullivan reviewed Sheet 4, Sheet 5, Sheet 6 including the wetland crossing on Farmers’ Dave property and the wetland crossing on Sheet 7. Mr. Sullivan discussed how the wires would be replaced and stated that the vernal pools on the properties would be avoided. Mr. Sullivan stated that they would be working with the gas companies to coordinate the work along the gas lines. Mr. Sullivan stated that he would provide documentation regarding the siltation protection installation. Mr. John Niemaszyk, 435 Old Parker Rd, appeared before the Board and stated that he has already had poles removed on this property in 1998 and they did damage and just left. Mr. Niemaszyk stated that they did not fix his property until 1999. Mr. Niemaszyk stated that there should be a release when they access people’s property. Mr. Olson explained to Mr. Niemaszyk that his property issue is not a wetland issue and if he has any additional issues to contact the applicant directly.

Motion made by Mr. Hassan to close the public hearing. Motion seconded by Mrs. Dristiliaris. Motion passed unanimously.
