Coach Squared Coaching Agreement

WIND BENEATH YOUR WINGS COACHING AGREEMENT

WHO BETWEEN:

This agreement is between WIND BENEATH YOUR WINGS and (company).

WHAT IT COVERS:

This agreement covers the coaching services that Wind Beneath Your Wings is providing to the Employer.

CONFIDENTIALITY:

When Wind Beneath Your Wings is brought into a company to coach employees, confidentiality for the persons being coached (PBCs) is essential. This means that everything a PBC says is totally confidential and not shared with anyone else in the company (unless the PBC chooses to share it). The PBC will meet tri-monthly (or other determined schedule) in a joint session with the Coach and with the PBC’s supervisor or other designated coaching sponsor (this can be in person or in a conference call) about how coaching is proceeding, benefits, concerns, etc. The Coach will not divulge information to the person hiring the Coach that the PBC wants kept confidential (see paragraph 3 of this section for exceptions).

Wind Beneath Your Wings recognizes that the Employer may have the following: future plans, business dealings and other proprietary information. Coach will not at any time, either directly or indirectly, use any such information for the Coach’s own benefit. Coach will not give out the name of any Employee without that Employee’s consent (for a reference)--and the coaching relationship is confidential unless the Employee chooses to tell someone about it).

This confidentiality statement shall be as confidential as the applicable state or federal laws-- and the Employer’s own company policy (if applicable)-- allows. The coaching relationship is not privileged and, as such, a Coach’s records regarding work with an Employer can be subpoenaed.

NATURE OF RELATIONSHIP:

An Employee enters into Coaching with the understanding that s/he alone is responsible for creating his/her own decisions and results. The Employer also agrees not to hold WIND BENEATH YOUR WINGS liable for any actions or results for adverse situations created as a direct result of a specific referral given by the coach. Each party agrees to indemnify, defend, and hold harmless the other party and its agents, officers and employees from and against any and all liability expense, including but not limited to, bodily injury, death, personal injury, financial or business losses, or property damage arising from such party’s performance or failure to perform its obligations hereunder.

The Coaching relationship is in no way to be construed as psychological counseling or any type of psychotherapy.

BEGINNING AND TERMINATION:

The agreement is effective as of the date that it is signed by the Wind Beneath Your Wings representative and the Employer representative and is subject to change until the day that it has been signed by both of them.

The Employer may cancel at any time. Cancellation must be in writing, fax or e-mail. Payment made for current project shall be considered full payment for coaching agreement unless there is an unpaid balance. In the event of fees owed at the time of cancellation, full payment is due and payable.
