1 1Introduced by the Land Use and Zoning Committee: 2 3 2014-142.tif 4 ORDINANCE 2014-142 5 AN ORDINANCE REZONING APPROXIMATELY 24.6 ACRES 6 LOCATED IN COUNCIL DISTRICT 11 AT 2630 STATE 7 ROAD A1A, BETWEEN MAYPORT ROAD AND SPOKANE 8 AVENUE (R.E NO. 168369-0020), AS DESCRIBED 9 HEREIN, OWNED BY JDB REAL PROPERTY INVESTORS, 10 LLC, FROM PLANNED UNIT DEVELOPMENT (PUD) 11 DISTRICT TO PLANNED UNIT DEVELOPMENT (PUD) 12 DISTRICT, AS DEFINED AND CLASSIFIED UNDER THE 13 ZONING CODE, TO PERMIT A SCHOOL AND ACCESSORY 14 USES TO A SCHOOL AS AN ALTERNATE DEVELOPMENT 15 OPTION TO RESIDENTIAL USES, AS DESCRIBED IN 16 THE APPROVED WRITTEN DESCRIPTION AND SITE PLAN 17 FOR THE CREEKSIDE PUD; PROVIDING AN EFFECTIVE 18 DATE. 19

20 WHEREAS, JDB Real Property Investors, LLC, the owner(s) of 21approximately 24.6 acres located in Council District 11 at 2630 22State Road A1A between Mayport Road and Spokane Avenue (R.E. No. 23168369-0020), as more particularly described in Exhibit 1, attached 24hereto (Subject Property), has applied for a rezoning and 25reclassification of that property from Planned Unit Development 26(PUD) District to Planned Unit Development (PUD) District, as 27described in Section 1 below; and 28 WHEREAS, the Planning Commission has considered the 29application and has rendered an advisory opinion; and 30 WHEREAS, the Land Use and Zoning Committee, after due notice 2 1and public hearing, has made its recommendation to the Council; and 2 WHEREAS, the Council finds that such rezoning is: (1) 3consistent with the 2030 Comprehensive Plan; (2) furthers the 4goals, objectives and policies of the 2030 Comprehensive Plan; and 5(3) is not in conflict with any portion of the City’s land use 6regulations; and 7 WHEREAS, the Council finds the proposed rezoning does not 8adversely affect the orderly development of the City as embodied in 9the Zoning Code; will not adversely affect the health and safety of 10residents in the area; will not be detrimental to the natural 11environment or to the use or development of the adjacent properties 12in the general neighborhood; and will accomplish the objectives and 13meet the standards of Section 656.340 (Planned Unit Development) of 14the Zoning Code; now therefore 15 BE IT ORDAINED by the Council of the City of Jacksonville: 16 Section 1. Property Rezoned. The Subject Property is 17hereby rezoned and reclassified from Planned Unit Development (PUD) 18District to Planned Unit Development (PUD) District, as shown and 19described in the approved site plan dated December 17, 2013, and 20written description dated February 6, 2014 for the Creekside PUD. 21The PUD district for the Subject Property shall generally permit a 22school and accessory uses to a school as an alternate development 23option to residential uses, as more specifically shown and 24described in the approved site plan and written description, both 25attached hereto as Exhibit 2. 26 Section 2. Owner and Description. The Subject Property 27is owned by JDB Real Property Investors, LLC, and is legally 28described in Exhibit 1. The agent is Michael J. Saylor, Black Dog 29Planning, Inc., 1450 Flagler Avenue, Jacksonville, Florida 32207; 30(904) 635-9940.

1 2 2 1 Section 3. Effective Date. The adoption of this 2ordinance shall be deemed to constitute a quasi-judicial action of 3the City Council and shall become effective upon signature by the 4Council President and the Council Secretary. 5
