REGULAR SESSION OF THE DAYTON CITY COUNCIL Wednesday, June 13, 2012 202 1st Ave. SW Dayton, IA 50530

Mayor Richard Travis called the meeting to order at 7:03 p.m. Roll Call-Present: Council members Diehl, Gallentine, Skoglund, Weiland and Wickwire. Absent: none. Also present: Randy Danielson, Frank Fischer, Craig Johnson, Matt Johnson, Shelly Johnson, John Larson, Larry McCabe, Dixie McClure, Geri Roe, Dianna Satterlee, and Rob Stapp.

AGENDA: Council member Weiland moved to approve the agenda as printed. Second by Wickwire. Motion carried unanimously.

MINUTES: Council member Wickwire moved to approve the May 9 regular meeting minutes as printed. Second by Diehl. Motion carried unanimously.

BILLS: Council member Diehl moved to approve the bills as presented. Second by Wickwire. Motion carried unanimously.

COMMENTS FROM THE FLOOR: None.

WATER TOWER PAINTING: Mayor Travis reported that the antennae, wind and rain had caused some delays in the painting project. A recent water bacteria test showed satisfactory results.

STREET PROJECT: Street Committee members Skoglund and Wickwire reported that MER Engineering had looked at the drainage on the east ½ block of 1st Avenue SW, just west of South Main Street, and felt that it can be adequately improved by replacing some curb and gutter. After discussion, Wickwire moved to accept the proposal from Ulicki Construction to install 8” of concrete in this area for $26,700 and to hire Fort Dodge Asphalt to mill out the existing asphalt. Second by Gallentine. Ayes: Gallentine, Skoglund, Weiland, Wickwire. Nays: Diehl. Motion carried.

ALLEY SALE: Council member Gallentine introduced Resolution 2012-10, “Resolution Proposing Vacation and Sale of an Alley” and moved its adoption. Second by Wickwire. Roll call vote-all ayes. Resolution carried. The public hearing concerning the sale of the north-south alley in the north 700 block of 1st Avenue SW will be held on July 11th.

PROPERTY CLEAN UP: The Council was informed that there had been no response to a letter mailed to the owner of the property located at 26 East Skillet Avenue. Council member Diehl moved to contact the City Attorney and ask him to begin legal proceedings for clean up. Second by Gallentine. Motion carried unanimously.

SPECIAL USE PERMIT: At 7:21 p.m., Mayor Travis opened the public hearing regarding the special use permit for Jeremiah Mohr for a barber shop at 304 5th Avenue NW. No comments had been received and none were voiced. After the hearing was closed at 7:22 p.m., Council member Wickwire moved to approve the permit. Second by Gallentine. Roll call vote-all ayes. Motion carried.

RABGRAI VENDOR WATER CHARGES: After discussion, Council member Wickwire moved to include a vendor fee of $25 to non-residents requesting water service for RAGBRAI. Second by Gallentine. Motion carried unanimously.

LAGOON PROPERTY RENTAL: After review of the one bid received, Council member Diehl moved to accept the bid of $275 from Craig Johnson for rental of the lagoon property for haying for 2012. Second by Weiland. Motion carried unanimously.

RESERVE POLICE POSITION: Mayor Travis reported that applicant interviews will be held on June 16th. Council members Skoglund and Weiland will also be on the interview committee. BUILDING PERMITS: Council member Diehl moved to approve a permit for a storage shed and concrete pad for Bella on Main, located at 37 South Main Street. Second by Gallentine. Motion carried unanimously. Council member Diehl moved to approve a permit for landscape block for Rob Stapp, located at 406 3rd Street NE. Second by Wickwire. Motion carried unanimously. Council member Weiland moved to approve a permit for a lean-to for Robert and Nancy Hansen, located at 29 West Skillet Avenue. Second by Weiland. Motion carried unanimously. Council member Gallentine moved to approve a building permit for a deck for Joan Lambert, located at 401 2nd Avenue NE. Second by Diehl. Motion carried unanimously. Council member Diehl moved to approve a permit for a patio, parking pad and privacy fence for Rob Shipley, located at 27 East Skillet. Second by Wickwire. Motion carried unanimously.

BEER PERMIT: Council member Gallentine moved to approve renewal of a Class C Beer Permit with Sunday Sales for Casey’s General Store. Second by Weiland. Motion carried unanimously.

LIQUOR LICENSE: Council member Gallentine moved, contingent upon meeting all legal requirements, to approve a new Class C Liquor License with Outdoor Service and Sunday Sales for Iron Saddle Saloon located at 39 South Main Street. Second by Wickwire. Motion carried unanimously.

ALLEY SALE: Following discussion, Council member Wickwire introduced Resolution 2012-11, “Resolution Proposing Vacation and Sale of an Alley”, and moved its adoption. Second by Weiland. Roll call vote-all ayes. The resolution is contingent upon fire department and police department approval and involves the possible sale of the north- south alley in the north 200 block of 4th Avenue NE.

ALLEY SALE: Rob Stapp reported that his mother is negotiating to purchase property in west Dayton for possible construction of a new house. She is interested in purchasing the alley dividing this property before proceeding further. Council member Gallentine introduced Resolution 2012-12, “Resolution Proposing Vacation and Sale of an Alley”, and moved its adoption. Second by Diehl. The resolution is also contingent upon fire department and police department approval and involves the possible sale of the east- west alley in the south 700 block of 1st Avenue SW.

CAR WASH WATER: Danny Hansen had informed the Clerk that he was satisfied with the manner in which his water concerns were being handled.

BRIDGE INSPECTIONS: The Council reviewed inspection reports for 3 City bridges.

NARROW BAND RADIO: The Council directed the Clerk to obtain another bid for replacement of the City’s base radio.

VETERAN’S MEMORAL: Council member Weiland reported that someone had approached him regarding the need for a local veteran’s memorial. They are willing to donate 3 flagpoles and flags for this. Chris will check with other interested persons about this.

SNOWPLOW DAMAGE: The Council agreed to replace 2 landscape timbers at 201 1st Street NE which were apparently damaged by a City snowplow.

2ND STREET NW STOP SIGNS: After discussion, Council member Gallentine introduced Ordinance #251, “An Ordinance Amending the Code of Ordinances of the City of Dayton, Iowa, 2005, by Adding New Paragraphs Concerning the Addition of Stop Signs”, and moved to pass the first reading. Second by Weiland. Roll call vote-all ayes. First reading passed. The proposed ordinance will install stop signs for north and south bound traffic at the intersections of 1st Street NW and 4th Avenue NW; and 2nd Street NW and 4th Avenue NW.

COMMUNITY SERVICE AWARD: The Council agreed to contact community groups concerning a meeting to select the 2012 Community Service Award recipient. The meeting is to be held at City Hall on July 10th at 7:00 p.m. OTHER BUSINESS: Maintenance Foreman Craig Johnson discussed the need for a computer and internet access. Chris Weiland will look into this.

ADJOURN: Council member Diehl moved to adjourn. Second by Gallentine. Motion carried unanimously. The meeting was adjourned at 8:21 p.m.
