1. This permit application is for video game and computer game rental in the C-S-C Zone. Would the proposed use be limited to video games and computer games only? Will there be any rental/sales of adult videos? 7/13/12 - I received the emailed description of the proposed use. If the primary use is where a business is offering computers available for customers to use for general business (i.e., checking e-mail and other internet related things) and also online gaming, arcade/games, etc on the computer the use is going to be called an amusement arcade. Your submitted document must indicate if the proposed use will allow any type of sweepstakes or any other form of gambling. 7/24/12 – Per submitted letter detailing the proposed use and my meeting with Matt Mills Associate General Counsel and his discussion about this case with Alan Hirsch the proposed use is ok to approve as an office not amusement arcade.
2. An updated parking and loading schedule must be submitted that demonstrates all uses on the property by address or unit number, the square footage of each use, the parking and loading spaces required for each use, and the parking and loading provided for each use. Vacant units must be included in the schedule and can be listed as “vacant”. 7/13/12 - Amusement arcade: (A) Not exceeding 2,500 square feet of gross floor area, with adult supervision on the premises during all hours of operation; provided the use is located either within a wholly enclosed shopping mall, or within the main group of stores of an integrated shopping center having a minimum gross floor area of 150,000 square feet is permitted. The plaza has a gross floor area of only 22,400 therefore would not meet the requirements to be permitted outright. (B) All others would require a Special Exception. The applicant should contact Edward Holley at 301-952-3215 for information on this process. The parking for an amusement arcade is 1 parking space required per 80 square feet. The proposed use would require 15 parking spaces along with the remaining units (hair salon, required is 114.54 parking spaces barber shop, carryout, convenience store, thrift store, dry cleaners). The total parking less 20% joint use reduction which would have a total of 91.64 parking spaces required. There are 87 provided parking spaces on the site per submitted site plan therefore there is not adequate parking for the site. A departure (parking waiver) is required. Parking for an office is 1 parking space required for every 250 square feet up to the 1st 2,000 square feet and 1 parking space required for every 400 square feet above the 1st 2,000 square feet. All the uses for the site will have adequate parking.
