Resolution T-16892. Revocation of 166 Authorities Issued to Competitive Carriers for Failure to Comply with Commission Decisions.

Summary

This resolution revokes 166 competitive carrier authorities held by the companies listed in the Discussion Section for failure to comply with Decisions 93-05-010, Ordering Paragraph 4 and 95-12-056 and the wireless registration process.

Background

Decisions 93-05-010 Ordering Paragraph 4 and 95-12-056 and the wireless registration process state that the Commission will consider the revocation of competitive carriers that are more than 90 days late in filing annual reports and remitting surcharges.

The carriers were delinquent in filing one or both of the following:

1. Telecom Division (TD) researched the carriers’ record of reporting and surcharge payments. It was determined that some of the carriers are at least 90 days late in reporting or remitting some or all intrastate end-user billing subject to surcharge on the form Combined California PUC Telephone Surcharge Transmittal (Surcharge Transmittal).

2. TD has also determined that some of the carriers that are late filing surcharge transmittals are also at least 90 days late in filing annual financial reports with the Commission.

The following steps were taken to contact the carriers and inform them of their delinquencies: 1. TD sent warning letters to all the carriers on this list. 2. Notice of company names was placed in the Commission Calendar for 30 days. Interested parties were invited to contact TD staff with questions or comments on these carriers’ locations, but TD was not contacted by the companies currently on this list.

3. TD checked the Secretary of State’s file on its website for a carrier’s agent when TD received returned mail from the carrier’s last known address.

Discussion

This resolution lists authorities granted to various firms. In several cases, a single firm possesses more that one authority to operate in California. The authorities revoked by this resolution are the following:

According to TD records, these companies have not remitted surcharges and/or submitted transmittal forms for the last 90 days. Therefore, the Legal Division may, if it chooses, pursue the companies for any owned surcharges.

Telecommunications Division’s draft resolution in this matter was noticed in the Commission’s Daily Calendar beginning on October 10, 2004, in accordance with PU Code Section 311(g)(1). Holders of 124 authorities contacted TD and have at least partially complied with the reporting and remitting requirements.

Findings

1. The companies on the above list were certificated or registered by the Commission as telephone carriers.

2. Proper measures were taken by Telecom Division staff to locate these companies. .

3. The companies on the above list have not timely either remitted surcharges and submitted surcharge forms or filed annual financial reports or both for at least the past 90 days.

4. These companies may owe additional surcharges. The Legal Division may pursue the companies, if it chooses, for any owned surcharges.

5. The companies’ authorities should be revoked and their Utility Identification Numbers should be cancelled for failure to comply with D.93-05-010 Ordering Paragraph 4, D.95-12- 056, and the wireless registration process.
