BOARD OF VETERINARY MEDICINE INFORMAL CONFERENCE JUNE 10, 2010 DEPARTMENT OF HEALTH PROFESSIONS HENRICO, VA

CALL TO ORDER: An Informal Conference before a Special Conference Committee (SCC) of the Board was called to order at 11:03 a.m.

MEMBERS PRESENT: Jim DeBell, DVM – Chair Henry McKelvin, DVM

STAFF PRESENT: Leslie Knachel, Executive Director Terri Behr, Operations Manager Peter Opper, Administrative Proceedings Division

OTHERS PRESENT: John McGavin, Esq. Sasha Ward Paul Wallace

MATTER SCHEDULED: Anita Wallace, DVM License #.: 0301001737 Case No. - 129501

DISCUSSION: Dr. Wallace appeared before the SCC in accordance with a Notice of Informal Conference dated April 23. 2010. Dr. Wallace was represented by counsel, John McGavin, Esq. The SCC fully discussed the allegations contained in the notice with Dr. Wallace.

CLOSED SESSION: On properly seconded motion by Dr. McKelvin, the SCC recessed Open Session and convened in Closed Session pursuant to §2.2-3711(A)(28) of the Code of Virginia for the purpose of deliberation to reach a decision in the matter regarding Anita C. Wallace, DVM. Additionally, it was moved that Peter Opper, Administrative Proceedings Division, Leslie Knachel, Executive Director, Board of Veterinary Medicine and Terri Behr, Operations Manager, Board of Veterinary Medicine, attend the closed meeting because their presence in the closed meeting was deemed necessary and would aid the SCC in its deliberations. Having certified that the matters discussed in the preceding closed session met the requirements of §2.2-3712 of the Code, the SCC reconvened in open session and announced its decision.

DECISION: Based on the Investigative Report and discussion of

- 1 - the case with Dr. Wallace, the SCC dismissed the case with a finding of no violation. The hearing adjourned at 12:00 noon.

MATTER SCHEDULED: Christine L. Dixon, DVM License No.: 0301005318 Case No.: 103449

DISCUSSION: Dr. Dixon appeared before the SCC in accordance with a Notice of Informal Conference dated April 27, 2010. Dr. Dixon was not represented by counsel. The SCC fully discussed the allegations contained in the notice with Dr. Dixon.

CLOSED SESSION: On properly seconded motion by Dr. DeBell, the SCC recessed Open Session and convened in Closed Session pursuant to §2.2-3711(A)(28) of the Code of Virginia for the purpose of deliberation to reach a decision in the matter regarding Christine L. Dixon, DVM. Additionally, it was moved that Peter Opper, Administrative Proceedings Division, Leslie Knachel, Executive Director, Board of Veterinary Medicine and Terri Behr, Operations Manager, Board of Veterinary Medicine, attend the closed meeting because their presence in the closed meeting was deemed necessary and would aid the SCC in its deliberations. Having certified that the matters discussed in the preceding closed session met the requirements of §2.2-3712 of the Code, the SCC reconvened in open session and announced its decision.

DECISION: Based on the Investigative Report and discussion of the case with Dr. Dixon, the SCC ordered that Dr. Dixon’s practice be subject to one unannounced inspection within 9 months of the entry of the Order. The hearing adjourned at 2:10 p.m.

MATTER SCHEDULED: William B. Ley, DVM License #.: 0301200666 Case No. – 124166 & 126998

DISCUSSION: Dr. Ley appeared before the SCC in accordance with a Notice of Informal Conference dated May 4, 2010. Dr. Ley was not represented by counsel. The SCC fully discussed the allegations contained in the notice with Dr. Ley.

CLOSED SESSION: On properly seconded motion by Dr. McKelvin, the Special Conference SCC recessed Open Session and convened in Closed Session pursuant to §2.2-3711(A) (28) of the Code of Virginia for the purpose of deliberation to reach a decision in the matter regarding William B. Ley, DVM. Additionally, it was moved that Peter Opper, Administrative Proceedings Division, Leslie Knachel, Executive Director, Board of Veterinary Medicine, and Terri Behr, Operations Manager, Board of Veterinary Medicine, attend the closed meeting because their presence in the closed meeting was deemed necessary and would aid the SCC in its deliberations. Having certified that the matters discussed in the preceding closed session met the requirements of §2.2-3712 of the Code, the SCC reconvened in open session and announced its decision.

DECISION: Based on the Investigative Report and discussion of the case with Dr. Ley, the SCC ordered that Dr. Ley be reprimanded and assessed a monetary penalty of $1750. The hearing adjourned at 4:10 p.m.
