ABA2014-00288)

RECOMMENDATION:

That the City Council, following a Public Hearing, by Resolution, approve the applicant’s request to vacate/abandon an alley at 1001 – 1021 North Magnolia Avenue extending westerly from Magnolia Avenue to Felicidad Street, and authorize the Mayor to execute a quitclaim deed conveying the City’s interest to applicant.

DISCUSSION:

This abandonment has been requested by the applicant in conjunction with Conditional Use Permit No. 2014-05759 (CUP) in order to renovate and reconstruct an aging retail center to include a drive-through pharmacy and new drive-through restaurant. This alley had been temporarily closed to vehicular traffic by the Public Works Department due to complaints from neighboring residents regarding cut-through traffic and vehicles traveling at high speeds. If vacated/abandoned, the alley would be utilized as the landscaped setback area for the proposed drive-through restaurant as per the CUP, and an easement would be reserved for public utilities.

IMPACT ON BUDGET:

The market value of the City’s interest in the alley would be offset by the property owner’s dedication of street right-of-way along Magnolia Avenue, La Palma Avenue, and Felicidad Street, resulting in no net impact on the budget.
