Telecom District Engineer Phulbani SPECIAL CUM COMMERCIAL CONDITIONS OF TENDER:

1. Name of the Work : Painting & writing of BSNL plans and services on Departmental & rented Telephone Exchange Building Walls in Phulbani SSA. Maximum Painting area will be 10,000 sq. ft..

2. Approximate cost: Standard Rate Rs. 5/ - per sq. ft.

3. N.I.T. No. : Mktg/Wall-Paintings/Ad/13-14 Dt. 12/08/2014

4. SCOPE & SPECIFICATION OF WORK :

(a). To clean the wall with sand paper & thereafter painting with primer. (b). To paint the background of the wall as per colour specified in sample advertisement (c). To sign writing the walls with BSNL’s Scheme and Logo after painting the background. (d). The Oil paint / Primer must be used with ISI Mark Company. (e). The Walls are to be cleaned and painted with primer 2 or more coat paint and the logo & scheme of BSNL is to be drawn as enclosed in Annexure-A. (f). The work is to be completed within one month of the issue of work order. (g). Coloured painting with Logo of BSNL whose sample is enclosed at Annexure-A. However actual design may vary as per site requirement. In beginning oil bound based Cement Primer should be place on wall afterwards oil painting will be done by using oil paint of the reputed Company. (h).Sample design will be provided by SDE(CM & EB) to the successful bidder while issuing work order. (i).Paint and other material like Spray, Painting Machine, Brush etc. will be arranged by the contractor. (j). Painting to be done at sites in consultation with local SDOs of this department.

5. EARNEST MONEY-DEPOSIT : The EMD of amount of Rs.2000/- to be furnished in the form of Account Payee Bank Draft payable to Accounts Officer (Cash), BSNL, O/o TDE, Phulbani , drawn on any Nationalized Bank along with the tender. Unsuccessful tenderers will be refunded the EMD after finalization of the tender without any interest.

6. ELIGIBILITY CRITERIA: - Eligibility criteria for the above works are: The firms should have similar work experience for at least five years. Experience certificates issued by the executive/ officer for whom such works have been done may be attached.

7. SECURITY: a) 10% of the order value shall be furnished as Security Deposit either in the form of the Bank Guarantee or Demand Draft from any nationalized/scheduled bank. b) The security deposit shall be refunded after 6 months from the date of last work completed. c) No interest will be paid to the contractor on security deposit.

8. PENALTY CLAUSE : The successful bidder has to finish all the jobs within a time frame of 30 days of issue of the Draft, failing which the order shall be treated as cancelled and the Security Deposit will be forfeited and the vendor shall be barred from participating in future tenders of BSNL.

Signature of the Tenderer 9. The near relative of employees of BSNL are prohibited from participation of this tender (either directly recruited or on deputation). The near relatives for this purpose are defined as, a) Members of Hindu undivided family b) They are husband & wife c) The one related to other in the manner as father, mother, son(s) & son’s wife (daughter in law), daughter(s) & daughter’s husband (son in law), brother(s) & brother’s wife, sister(s) & sister’s husband (brother-in-law).

10. DOCUMENTS TO BE SUBMITTED WITH THE TENDER a) Experience Certificates as per Clause No.5. (self attested xerox copy) b) Pan Card ( Self Attested Xerox Copy) c) Service Tax Registration No. ( Self Attested Xerox Copy) d) Bank draft of amount Rs . 2,000/- drawn in favour of the Accounts Officer (Cash), BSNL, O/o the TDE, Phulbani towards EMD. e) Tender document duly signed on each page. f) Declaration as a proof of not a near relative of BSNL employee (description given in clause no- 9 of this document) as given in the annexure of the tender document.

11. Modification & Withdrawal of Bids.

a) The bidder may modify or withdraw his bid after submission and before opening provided that the information is deposited by the bidder in a properly sealed envelope (With WAX) in tender box, before the scheduled time & date of closing of tender. b) No bid shall be modified subsequent to the deadline for submission of bids.

12. ADDRESSING THE TENDER

(i) The Tender should be addressed in the name of “Telecom District Engineer,BSNL, PHULBANI . (ii) Tenders can be dropped in the Tender Box available in the chamber of the TDE Phulbani within 13 Hours of 28.08.2014. (iii) Wax sealed envelope containing tender must be super scribed with “Painting and writing BSNL Plans and services on Departmental & rented Telephone Exchange Building Walls in Phulbani SSA. 13. Agreement will be done with the successful bidder after finalization of the tender. 14. The successful bidder is required to submit all original documents as on 10 (a), (b), (c) for verification before agreement. 15. No extra charges will be paid other than quoted rates. 16. The rate will be quoted inclusive of all taxes and exclusive of Service Tax. Service Tax if applicable should be indicated separately. While raising the bill it should bear Service Tax Registration No. printed on the bill. The bill should be submitted in triplicate with printed bill no. 17. The conditional and incomplete tenders are liable for rejection. 18. The tender shall be evaluated by a committee to be appointed by the Competent Authority.

The TDE, Phulbani reserves the right to forfeit the E.M.D. of the approved firm who refuses/fails to supply; also reserves the right to withhold payment, if any, for the said reason. 20. TDS as applicable from time to time will be recovered from bill preferred by the contractor. This is subject to change as and when required under statutory rules. 21. The bills are to be submitted in triplicate duly certified by the concerned SDO, Telegraphs/ SDO Phones Phulbani for places outside Phulbani. For places within Phulbani the bills in triplicate are to be submitted through SDE (CM & EB), Phulbani. 22. 100% payment will be made through A/c payee cheque on completion of entire work after observing usual formalities. The BSNL will not bear any collection charges for the cheque. In case, the bidder has SBI A/c in any core banking branch details thereof may be forwarded so that payment can be made through e-payment. 23. The TDE, Phulbani reserves the right to accept / reject any or all the tender without assigning any reason thereof. 24. In case any dispute the decision of the TDE, Phulbani will be final and binding. 25. If the performance, in whole or part of any obligation under this contract is not satisfactory BSNL reserves the right to terminate the contract.

26. ARBITRATION :

In the event of any question, dispute or difference arising under this agreement or in connection there with except as to matter the decision of which is specifically provided under this agreement, the same shall be referred to sole arbitration of the Telecom District Engineer, BSNL, Phulbani or in case his designation is changed or his office is abolished then in such case to the sole arbitration of the Officer for the time.

a. Being entrusted whether in addition to the functions of the Telecom District Engineer BSNL, Phulbani or by whatever designation such officers may be called (hereinafter referred to as the said officer) and if the Telecom District Engineer, BSNL, Phulbani or the said officer is unable or unwilling to act as such the sole arbitration or some other person appointed by the Telecom District Engineer, BSNL, Phulbani or the said officer.

The agreement to appoint an arbitrator will be in accordance with the Arbitration and Conciliation Act, 1996.

There will be no objection to any such appointment that the arbitrator is Government Servant or that he has to deal with the matter to which the agreement relates or that in the course of his duties as Government Servant he has expressed views on all or any of the matter under dispute. The award of the arbitrator shall be final and binding on the parties. In the event of such arbitrator to whom the matter is originally referred, being transferred or vacating his office or being unable to act for any reasons whatsoever such, Telecom District Engineer, BSNL, Phulbani or the said officer shall appoint another person to act as arbitrator in accordance with terms of the agreement and the person so appointed shall be entitled to proceed from the stage at which it was left out by his predecessors.

Signature of the Tenderer b) The arbitrator may from time to time with the consent of parties enlarge the time for making and publishing the award. Subject to aforesaid Arbitration and Conciliation Act; 1996 and the Rules made there under, any modification thereof for the time being in force shall be deemed to apply to the arbitration proceeding under this clause. c) The venue of the arbitration proceeding shall be the Office of the Telecom District Engineer, Phulbani or such other places as the arbitrator may decide.

27. SET OFF :

Any sum of money due and payable to the contractor (including security deposit refundable to him) under this contract may be appropriated by the Department or the Government or any other person or persons contracting through the Govt. of India and set off the same against any claim of the Department or Govt. or such other person or persons contracting through Government of India.

The terms and conditions enumerated in the above as different clauses shall be binding and the bidder shall have to accept them in writing along with the tender. Also other terms and conditions enumerated in the bid document shall be binding on bidder.
