1 [4089-1] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 42-1-360, CODE OF LAWS OF SOUTH 12 CAROLINA, 1976, RELATING TO EXEMPTIONS OF 13 EMPLOYEES FROM THE WORKERS’ COMPENSATION 14 LAW, SO AS TO INCLUDE CERTAIN EMPLOYEES OF A 15 RESIDENTIAL CONSTRUCTION COMPANY AS BEING 16 EXEMPT. 17 18 Be it enacted by the General Assembly of the State of South 19 Carolina: 20 21 SECTION 1. Section 42-1-360(2) of the 1976 Code is amended to 22 read: 23 24 “(2) Any a person who has regularly has employed in service 25 less than four employees in the same business within the State or 26 who had a total annual payroll during the previous calendar year of 27 less than three thousand dollars regardless of the number of 28 persons employed during that period. Notwithstanding another 29 provision of law, sole proprietors, partners, officers of 30 corporations, and their employees, regardless of the number or 31 amount of their annual payroll, or both, that practice or offer to 32 practice residential building as defined by Section 40 - 59 - 20(6), 33 residential specialty contracting as defined by Section 40 - 59 - 20(7), 34 or related home building services, are not eligible for the 35 exemptions from the requirement to carry workers’ compensation 36 insurance, unless their job responsibility does not require them 37 specifically to visit or perform work on a residential building site;” 38 39 SECTION 2. This act takes effect upon approval by the 40 Governor. 41 ----XX---- 42
