TITLE OF CABINET NOTE

PROPOSAL Example: Cabinet note the intention to recommend that His Excellency the Governor in Executive Council appoint members to the (name of board or committee).

BACKGROUND Include details on: - the functions of the board or committee quoting the relevant sections of the legislation - the terms and conditions of appointment quoting the relevant sections of the legislation, and - the permitted number of members of the board or committee.

DISCUSSION

Existing membership Include details on: - who the existing members of the board or committee and when their appointments expire - why the appointment is being made (eg. due to a resignation or the expiry of a term of appointment or an increase to the number of members on the board or committee), and - is a current member being re-appointed or is this a new appointment.

Criteria for filling position Include details on: - who is to be appointed or reappointed - give the full name of the proposed appointee including middle names (nicknames or preferred names cannot be used) and brief reasons for their appointment - what the term of appointment will be - specify the commencement date and (unless imposed by law) the expiry date of the appointment - what the statutory qualifications are for the position - if there are any preconditions to the appointment (eg nomination by particular bodies or individual or election by a particular group), and - what qualifications and relevant experience does the proposed appointee have - have all relevant statutory qualifications and any preconditions been met, notably including any required consultation with third parties.

Gender balance Outline the gender balance of the board. The board currently has ____ men and ____ women. The proposed appointment includes ___ men and ____ women. The proposed new composition of the board will be ____ men and ___ women.

Remuneration Give full details of the remuneration, entitlements and conditions that the board or committee are entitled to (Chair, Members and Deputy Members, etc). Note: if the appointee is not entitled to remuneration, this will need to be stated however, the remuneration entitlements for the board/committee members must still be stated.

Consultation Who has been consulted about the appointment and what have they said?

Resources required to implement this proposal What resources are required to support the appointment? Where will these resources come from?

Communications strategy Include details on: - Statement that the appointment will be published in the Government Gazette on the day it is made by the Governor in Executive Council. - What other steps will be taken to inform the appointee and other interested parties? Attach any draft media releases and associated publicity.

Executive Council Include details on: - When the recommendation for appointment should be made to the Governor in Executive Council. - Any special processing requirements should be fully explained.

SUMMARY

That Cabinet note:

1. The summary section of the Cabinet Note must include:

- reference to Cabinet noting the proposed appointments - reference to His Excellency the Governor in Executive Council making the appointment - the full name of the proposed appointee, including middle names (nicknames or preferred names cannot be used) - the full title of the position, as set out in the legislation, not with familiar or local or colloquial titles - if this is a deputy’s position, the name of the person for whom the nominee will deputise - the full name of the board or committee, as set out in the legislation - the commencement date and (unless fixed by law) the expiry date of the proposed appointment or the proposed term of the appointment where the actual dates are uncertain - the precise provisions and full name and year of the Act under which the appointment is to be made, and - any relevant terms and conditions of appointment - essential where these must be approved by the Governor.

Example 1: That Cabinet note the intention to recommend that His Excellency the Governor in Executive Council appoint (insert full name of appointee) and (insert full name of appointee) as (insert title of positions to be held) of the (insert full name of body), for a term commencing on 18 February 2017 and expiring on 16 February 2018, pursuant to Section 9 of the Full Title Act 1982.

Example 2: That Cabinet note the intention to recommend that His Excellency the Governor in Executive Council appoint (insert full name of appointee) to the position of (insert title of position to be held) of the (insert full name of body), for a term of two years commencing from the date of Executive Council approval, pursuant to the Object Protection Act 1993.

Example 3: That Cabinet note the intention to recommend that His Excellency the Governor in Executive Council appoint the following persons to the (insert full name of body), for a term commencing from the date of Executive Council approval and expiring on 30 June 2018, pursuant to Section 5 of the Cheese Funding Act 1993:  (insert full name of appointee) (Member)  (insert full name of appointee) (Deputy Member to [insert full name).
