AGENDA ITEM NO. 8.8 CITY OF ELK GROVE CITY COUNCIL STAFF REPORT AGENDA TITLE: Adopt resolution authorizing the submittal of an application to the California Department of Housing and Community Development for funding under the Housing Related Parks Program MEETING DATE: January 28, 2015 PREPARED BY: Sarah Bontrager, Housing Program Manager DEPARTMENT HEAD: Darren Wilson, Planning Director RECOMMENDED ACTION: Staff recommends that the City Council adopt a resolution authorizing the submittal of an application to the California Department of Housing and Community Development (HCD) for funding under the Housing Related Parks Program (HRPP). In addition, staff recommends that the City Council authorize the City Manager to execute the HRPP application and a Standard Agreement (along with any other necessary documents) with HCD if awarded HRPP funds. This is a time-sensitive item for which the City Council must take action to submit the HRPP application to HCD. In order to remain eligible to apply for HRPP funds, the City Council must approve submittal of the application prior to the application due date of February 5, 2015. BACKGROUND INFORMATION: HRPP funds are made available by HCD and were funded by Proposition 1C, the Housing and Emergency Shelter Trust Fund Act of 2006. Funds are awarded on a per-bedroom basis for certain residential units affordable to very low- and low-income households that were permitted between 2010 1 Elk Grove City Council January 28, 2015 Page 2 of 3 and 2014. The City previously received funding for affordable housing units permitted in 2011. Up to $35 million is available in this round of funding. The grant opportunity is not competitive, but in the event the program is oversubscribed, the per- bedroom award amount may be reduced. HRPP funds may be used for parks and recreation projects that benefit the community and improve quality of life for Elk Grove residents. Eligible projects include outdoor recreation areas, non-motorized recreational trails, play structures, community gardens, youth and senior centers, and other similar types of uses. The projects do not need to be tied to the affordable housing development that allowed the City to qualify for funding. Projects must be implemented directly by the City or by a recreation and park district, although the City could lease a funded facility to a nonprofit to operate as an eligible use. Eligible costs include construction, rehabilitation, or acquisition of capital assets, and costs directly related to completing the project (e.g. surveying, design). Grantees must spend their funds by June 2017. ANALYSIS: The City’s HRPP application is for $250,450, plus any additional Regional Housing Needs Allocation bonus funds as determined by HCD. The projected grant award is based on the 63 eligible affordable housing units in the Avery Gardens project. City staff identified a Civic Center Community Park project for use of the funds. This approximately half-acre park/open space will be located adjacent to the planned Veterans Hall and will be designed to complement the landscape design at the Veterans Hall. Amenities will include an open grass area, paved area for small gatherings with picnic tables and shade trees, and a paved walking trail. This project is estimated to cost $250,450. In the event more funding is awarded, the project could incorporate additional elements (such as covered picnic areas) to expend the full grant award. 2 Elk Grove City Council January 28, 2015 Page 3 of 3 ENVIRONMENTAL ANALYSIS: No environmental analysis is necessary at this time as this action is the approval of a grant application and is not associated with the approval of any specific project at this time. Projects implemented with final funding awards will be reviewed for compliance with the California Environmental Quality Act (CEQA). FISCAL IMPACT: If awarded, the project funded by HRPP is not expected to require additional funding from the General Fund. Although the HRPP grant does not allow reimbursement for administrative costs, the administrative burden is minimal and is expected to be met using existing staff resources. Grant funds may be used for costs directly related to the construction project, such as surveying and design. ATTACHMENTS: 1. Resolution 2. Application 3 ATTACHMENT 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE AUTHORIZING APPLICATION FOR THE HOUSING RELATED PARKS GRANT PROGRAM WHEREAS, the State of California Department of Housing and Community Development (Department) has issued a Notice of Funding Availability dated December 10, 2014 (NOFA), under its Housing-Related Parks (HRP) Program; and WHEREAS, the City of Elk Grove (Applicant) desires to apply for a HRP Program grant and submit the 2014 Designated Program Year Application Package released by the Department for the HRP Program; and WHEREAS, the Department is authorized to approve funding allocations for the HRP Program, subject to the terms and conditions of the NOFA, Program Guidelines, Application Package, and Standard Agreement. NOW, THEREFORE, BE IT RESOLVED THAT: 1) Applicant is hereby authorized and directed to apply for and submit to the Department the HRP Program Application Package released in December 2014 for the 2014 Designated Program Year in an amount not to exceed $250,450, plus any additional Regional Housing Needs Allocation bonus funds as determined by the Department. If the application is approved, the Applicant is hereby authorized and directed to enter into, execute, and deliver a State of California Standard Agreement (Standard Agreement) in an amount not to exceed that noted above, and any and all other documents required or deemed necessary or appropriate to secure the HRP Program Grant from the Department, and all amendments thereto (collectively, the “HRP Grant Documents”). 2) Applicant shall be subject to the terms and conditions as specified in the Standard Agreement. Funds are to be used for allowable capital asset project expenditures to be identified in Exhibit A of the Standard Agreement. The application in full is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. Applicant hereby agrees to use the funds for eligible capital asset(s) in the manner presented in the application as approved by the Department and in accordance with the NOFA and Program Guidelines and Application Package. 3) The City Manager is authorized to execute in the name of Applicant the HRP Program Application Package and the HRP Grant Documents as required by the Department for participation in the HRP Program. 4 4) The City Manager is authorized to increase the Planning Division’s and/or Public Works Department’s revenue and expense budget by the actual amount received.
