Information Commissioner : Mrs. Annapurna Dixit ___________________________________________________________________ In the Central Information Commission at New Delhi File No: CIC/AD/A/2011/001985 ORDER Background 1. The Applicant filed an RTI Application dt.4.4.11 with the PIO, DRM Office, Eastern Railway, Howrah seeking information against six points including the identification Nos. and details of sub-ways and bridges / underground bridges within Howrah station to Memari station in Howrah-Burdwan Main Line under Howrah Division, and also the exact position of subway/bridge No.77 near RPF Barrack, Bandel Station, Bandel, Hooghly. Shri Anjani Kumar, PIO replied on 8.4.11 stating that information sought is not readily available and requested the Applicant to contact the office with an intimation well in advance for detailed information. The Applicant filed an appeal dt.12.5.11 with the Appellate Authority stating that no reply has been received by him. On not receiving any further response the Applicant filed a second appeal dt.28.7.11 before CIC. Decision 2. The Commission on review of the documents placed on record observed that there was no response either from the PIO or the Appellate Authority. Hence the Commission feels it fit to remand the case back to the Appellate Authority with the direction to give a personal hearing to both parties and to pass a speaking order within twenty days of receipt of this order. The Appellant is at liberty to approach the Commission if he is not satisfied with the order of the Appellate Authority.
