2. TheAdministrativeReviewBoardwill conduct a comprehensivereviewofallreasonably availableandrelevantinformationregardingyourcase . At the conclusionofthis reviewthe Boardwillmakea recommendationto : ( 1) releaseyou to homestate; ( ) transfer you to your homestate, with conditionsagreeduponbythe UnitedStatesandyour homestate; or ( 3 ) continueyourdetentionunderUnitedStatescontrol.

3. The followingprimary factors favor continued detention :

a ) Commitment

1) InMarchor April 2001, the detainee attended Masjid al Shobada Mosque, also known as, Mosque ofthe Martyrs, and the Al Khair Mosque, both in The detainee stated Saudi religious leaders issued fatwas calling forjihad and an Egyptian imam speaking outside the Mosque of the Martyrs said jihad was a good, thing to do and a duty of all Muslims. The detainee wanted to join the fight against Russians in Chechnya .

2) The detainee stated purchaseda Chechnyajihadrecruitmentvideoandwatchedit before goingto .

3) Afterbeinginspiredby the heroicstories aboutthe fightersin detainee statedhe consulted an individualwho hadbeenan Afghanfighter. The individual suggested detainee go to Afghanistanfortrainingand obtaineda Pakistanivisa for the detainee. The detainee chose to travel at his own expense.

4 ) The detainee stated he intended to to Afghanistan and then go fight in Chechnya. The detainee stated he departedYemenwith his Yemenipassportand 1,000 States dollars, travelingwith an individualfrom the Mosqueofthe Martyrs. The detainee's travel route was by planc from Sanaa, Yemento Dubai, UnitedArab Emiratesto Karachi,

Pakistan and by bus to Kandahar, Afghanistan.

5) AfterarrivalinKandahar, Afghanistan, the detaineestatedhe stayedat the al Nibras guest house for one week, during which time Usama bin Laden and two senior al Qaida associates visited the house

6) The detainee was identified as having traveled to thefront lines inAfghanistan, including Konduz Afghanistan. The detaineewas identifiedas havingtwo trainingvideo cassettes that the detainee about minefields. The detaineewas alsoidentifiedas havinga bagfull ofvariouscurrenciesandpassportsfrom severalcountries.

b) Training

1) The detaineestatedhetraveledbybusfromKandahar, Afghanistanto the alFarouq Training Camp and trained for 57 days.

2) The detainee statedhewas trainedon AK -47, pistols, M16's, Uzi's, G -3's, Kalaco , rockct propelled grenades and land .

3) The detainee stated he heard the following training courses were available at al Farouq training camp and other training camps intelligencecollection, mountainwarfare, artillery, topography, landnavigation, anti-aircraft such as Stingermissiles and SA - militaryleadership, urbanwarfare, building and plantingexplosivedevices, poisons

4) Becausethe detaineedidwell at al FarouqTrainingCamp, the detaineestatedhe and seven other students were picked fromthe group offighters and given special treatment. The detainee's special group was taken to sec the fighting at the front lines, and given the opportunityto sit with al Qaida leaders. The detainee stated although he was leader of any group, the al Qaida leaders did respect him .

5) The detainee stated all nineteen 11 September 2001 hijackers trained at al Farouq Training Camp

6) The detaineewas identified as beingthe ofhis group of trainees at al Farouq Training Camp

) Connections/ Associations

2) The detainee stated he sat with Usama bin Laden more than ten times. The detainee stated he had informationregarding future attacks against the UnitedStates and interests inKuwait, Jordan, Qatar and Oman.

3) The detainee stated al Qaida's plan was to restart in Yemen after the government was overthrown by the Americans. The detainee stated his was to go to Yemen to set up the base and they would bethe base of the , or the Qaida of the al Qaida.

4 ) Thedetainee'sname appearedon a listofal QaidaMujahedinaccounts duringa raid ofan al Qaida safe house in Rawalpindi,

5) The detainee's name appeared on a computer floppy disk seized during a raidof an allegedal QaidaresidenceinKarachi, Pakistan

6) The detainee's appearedon a listofkilledor wounded foundon the driveofa laptopcomputerscized duringraids Pakistan.

7) The detainee stated he knew that Usama bin Laden was preparinga big strike on the UnitedStates and several smaller attacks

d ) Other Relevant Data

1) The detaineestatedhewas capturedby GeneralDostum'sForcesinMazar- e -Sharif, Afghanistan , and was about 24,000 Pakistani Rupees and 500 United States dollars

2) After his capture, detainee stated he was imprisonedinMazar- e Sharif, Afghanistan for 52 daysandwas duringthe failedprisonuprising.

4. The followingprimaryfactors favorreleaseor transfer:

a ) The detainec stated he believes Usama bin Laden is a heretic who goes against the teachings of the Koran. The detainee stated he does not agree with Qaida because they target the innocent, which the Koranforbids.

b ) The detainee stated was the 11 September 2001 and did not consider them jihad . The detainee believes jihad is man fighting man not man fighting innocents . The detainee stated hehas no issues with America .

The detainee denied possessing any regarding the World Trade Center attacks, the bombing of the USS COLE , the embassy bombings or any other attacks.

While at al Farouq, the detaineestatedhe was against some ofthe policies ofal Qaida, includingsuicidemissions and killinginnocentpeople. After the detaineevoicedhis objections, he was suspendedfrom trainingfor two days and told to keep silent on the issueif he wishedto continuetraining.

e) The detainee stated he did not go to train to fight United States Forces. Instead the detaince went to fulfill his religious duty to protect himselfand his honor. He did not consider his trainingto be offensive in nature.

) The detainee stated he was not a part of al Qaida or the Taliban

g ) The detainee denied having any knowledge of the attacks inthe United States prior to their execution on 11 September 2001, and also denied knowledge of any rumors or plansof future attacks onthe United States or United States interests.

h ) After trainingat al Faroug, thedetainee spent three months at an Arab houseinKabul, Afghanistan, waitingfor others to travel to Chechnyawith. The detainee stated he refusedto stay inAfghanistanto fight with the Taliban.
