Information with respect to the Motor Accidents Claims Tribunal, under Section 4(1)(b) of the Right to information Act, 2005

1. Organisation, functions and duties

Motor Accidents Claims Tribunal, Kottayam is established under the MV Act, 1988 for considering the application for compensation claimed under different provisions of Motor Vehicle Act. The tribunal is presided over by a Judicial Officer of the rank of District Judge.

Territorial jurisdiction of Motor Accidents Claims Tribunal, Kottayam is available in Appendix A.

The Ministerial staff of this tribunal consist of one Junior Superintendent, one Bench Clerk Gr. I, four Clerks, one Confidential Assistant, three Typists, four Office Attendants, one Driver.

The Function and duties of the Tribunal are mainly to entertain and adjudicate claims and pass award on proper application for compensation under different provisions of Motor Vehicle Act and petitions for Execution of awards will be entertained as per the Civil Procedure Code.

2. The powers and duties of officers and employees

After proper verification the applications and petitions by the registry, serve process will be issued to the respondents under the order of the presiding officer. The documents submitted by the applicants, written statement filed by the respondent, will be received. Reception of documents and evidence is done as per the provisions of Civil Procedure Code and Motor Vehicle Rules. Evidence will be recorded. Arguments will be heard. The claim petition will be disposed by judgment answering all issues raised. Presiding Officer will have the powers of a District Judge.

The Ministerial staff members are the crew of the Judge. The appointment of transfer of ministerial staff are under the administrative control of the District Judge. The administration is governed as prescribed in the manual of office procedure, Various Rules of practices in Civil Courts and State, Service Rules etc.

3. The procedure followed in the decision making process, including channels of supervision and accountability

In the Judicial side, proceedings are channeled through Junior Superintendent → Court Fees/Inward Section Clerk → Bench Clerk → Judicial Officer. In the administrative side, files are channeled through Clerks/Junior Superintendent → Judicial Officer.

4. The norms set for the discharge of functions

This Tribunal is the quasi judicial forum. The functions of this tribunal is discharged in accordance with the various rules and regulation constituted for the purpose Motor Vehicle Act. Issues are dealt with on priority basis, expeditiously taking into account, the various instruction issued from superior courts from time to time. 5. The rules, regulations, instructions, manuals and records held or under the control or used by the employees for discharging the functions.

There is no arrangement to solicit the views of the members of the public in relation to the formulation of policies or implementation there of.

An internal complaint committee has been constituted in terms of preventing prohibition and Redressal of sexual harassment of women employees at work place.

The monthly remuneration is likely to change depending on the grant of increments and variation in the dearness allowance sanctioned by the Government from time to time. The sanction strength and pay scales of the officers and employees of this establishment are furnished at Annexure-B.

 Public can directly access the Touch-Screen (E-Kiosk) facility or enquiry can be made at the counter for information on status of cases filed.  Public can access the search facility in the District Court website to avail information in cases pending/disposed  Information on other matters can be obtained from the public Information Officer as per provisions of the RTI Act, 2005.  No library is maintained for public use.  The parties can apply the copy of documents and award as per the provisions of the CPC.
