Executive Summary

1. The LGED has awarded 323 subprojects of different categories (small, medium and large) in 12 costal districts in three regions (Barisal, Khulna and Madaripur).Meanwhile; Due Diligence Reports (DDRs) for 320 (99.7%) sub-projects have already been prepared by the Implementing NGO (CCDB), and submitted to the PMO. 2. As of December 2018, CCRIP is dealing with 26 (twenty six) sub-projects for planning and implementing the land acquisition and resettlement program. Among those sub-projects, 06 ( six ) are identified as road sub-projects, and 20 ( twenty) are market sub- projects which considered for land acquisition and resettlement programs dealing with the social safeguard policy of ADB 2009. It is further to be mentioned that among 06 road sub- projects, land acquisitions are required only for 04road subprojects. In addition, PAPs are identified for the remaining 02road subprojects those who have already been compensated for losing business and other properties like shops, trees etc. 3. The process of the identification for the Project Affected Persons (PAPs) and payment of compensation to the entitlements have been started since March 2016. Thus, the significant amounts of compensation dealing with the land acquisition, relocation of business and loss of incomes are claimed to be paid to the entitlement persons by following the Social Safeguard Policy of the ADB 2009, and the Land Acquisition Acts of the Government of Bangladesh. An international NGO is called CCDB has been assigned to assist the LGED in the whole process of the land acquisition and resettlement programs of the sub-projects for determining the price assessment, and ensure to pay compensation to the Affected Households by following the Govt. policy and ADB SSP, 2009. Following steps and achievement have been obtained during the period of July – December 2018. 4. As of December 2018, compensation was provided to the entitlements /Project Affected Persons in dealing with the land acquisition and resettlement issues for 22 Sub- projects out of 26 sub-projects in the three regions of CCRIP. The progress status and action plan for those sub-projects have been mentioned in the annexure 01 in details. The CCDB personnel in the respective regions have been working to identify and screening losses and impacts, reinforcing the land acquisition process of the Deputy Commissioners offices (DCs) in respect of the identified sub-projects(For the status of progress/ compensation in details please see the tables in chapters6.3, 6.4 & 6.5) 5. As per agreement with LGED, INGO (CCDB) has been conducting socio-economic household’s survey for the assigned sub-projects for preparing Due Diligence Reports (DDRs) in which it is responsible for identifying Project Affected Persons (PAPs), subsequently list of Affected/ Entitlement Persons are determined for paying compensation by following the appropriate process of the Government of Bangladesh and ADB‘s Social Safeguard Policy Statement (SPS), 2009. 6. As per ADB Social Safeguard Policy Statement 2009, a proposed project is classified as category ‘A’ if it is likely to have significant impacts on Indigenous Peoples. An Indigenous Peoples plan (IPP), including assessment of social impacts, is required. Sub-projects under

4 CCRIP are classified category ‘A’. However, due to project’s intervention, no negative impacts are observed on the living of the indigenous people those who are settling in and around of sub-projects area under the Barguana and Patuakhali districts; therefore, IPP is not required for those sub-projects. Moreover, indigenous people, who live in and around of those sub-projects area, will get benefits of the sub-projects in case of marketing and social mobility due to constructing rural markets and roads. Please see in details in the chapter 14- 15 of this report. 7. As per project guideline, CCDB has already formed the Joint Verification Team (JVT) and Property Valuation Advisory Team (PAVT), Grievance Redress Committee (GRC) for each selected sub-projecting involving representatives of the Deputy Commissioners, LGED, PAPs and Local Government of the respective district as well as . These committees have been functioning by following the Terms of Reference (ToR) given by the administrative ministry in this connection. Meanwhile, these committees (JVT, GRC & PAVT) completed field investigation /survey for determining the appropriate Entitlement Persons (EPs) which were identified by NGO during social mobilization. Moreover, the committees performed assessment of compensation package in sharing with the affected households and local community for all Market sub-projects, subsequently compensation was paid to them as per the recommendation of the committees. 8. Since from the beginning, CCDB personnel at the sub-projects level have been providing continuous support to Entitlement Persons (EP)/Project Affected Persons (PAPs) for opening the bank account to be deposited their compensation for the acquired lands and others affected properties. LGED and Resettlement Consultant took initiatives to reinforce the land acquisition processes at the district level by mobilizing the officials concerned of the DC offices like the District Land Acquisition Officer (DLAO), Additional Deputy Commissioner (Land/Revenue) etc. 9. Progress of Market sub-projects: In case of market sub-projects, progress for the payment of compensation is found satisfactory despite having delay of the assessment taken by the different committees like PVAT and JVT. It is to be noted that a significant numbers of days/months are required to perform the payment of the compensation to the appropriate entitlement persons. Finally, the information shows that the total cost is estimated BDT 5,760,403.00 for paying compensation to the 386Affected Persons (APs).Of them, 346 (90%) Entitlement Persons (EPs) have already received compensation from CCRIP forn18nmarket sub-projects by June 2018. However, some vested interest groups wanted to be involved in receiving compensation illegally, therefore, remaining02 sub- projects are not being in progressed for finalization of the compensation package.(For details status, please see the table in chapter 6.3 & 64 &, page No-19-21& annex-01). 10. Progress of Road Sub-projects: As of 31 December 2018, among the 06 Road Sub-projects, 04 (fours) are being dealt with the Land Acquisition (LA) process exclusively for which Resettlement Plans (RPs) were approved by the ADB in March 2017. And, the remaining 02 (two) sub-projects have been identified for the resettlement of the affected properties/structures/trees without land acquisition. Meanwhile, full compensation has already been paid to the entailment persons under 4 road sub-projects among the 6 sub- projects. Only 02 sub-projects in dealing with the land acquisition has been being delayed in finalizing the administrative process of the government for paying the compensation to the

5 entailments persons who lost their lands and other assets due to land acquisition. 11. Landowners of the road sub-project of the 90 meter of Gopalgonj refused to receive the money as they claimed the price is lower than the actual price determined by the DC. Landowners appealed to the DC to increase the compensation based on the existing market price. On the other hand, ADC ( revenue) told the landowners that the price of the acquired land was determined by following the govt. Land Acquisition Regulation (LAR) , therefore DC office was not in a position to change the price that already been finalized after following the rule of business of the government. 12. On 25 September 2018, a meeting was held with the agitated landowners, who were noticed by the DC to receive compensation, to know their grievances, and causes for not receiving compensation from DC office. During the discussion, they (affected landowners) informed that landowners would not receive the compensation if the DC/ Govt. does not pay them by following actual market price of the land that already determined the Sub- registry office of Gopalgonj. In this connection, they produced the price list of the Sub- registry Office of Gopalgonj. 13. Meanwhile, ADB asked the Project Director on November in writing to pay additional compensation to the affected landowners in addition to the payment assessed by the DC. PD is going to take initiative in line with the ADB request, and by following the project guideline / loan agreement and DPP. 14. In the beginning, the Project Director took a proactive role in submitting the Land Acquisition (LA) proposal to the administrative ministry and obtained final LA approval which generally had got delayed. However, after obtaining Administrative Approval from the Ministry of the Local Government, LGED submitted the proposals of LA to the respective Deputy Commissioners (DCs) for the approval and subsequent to complete the whole process of fixing the land-price and arranging for payment to the affected landowners/ households as per Government rules of business in this connection. However, in receiving the LA proposal, the respective District Land Acquisition Committees (DLAC) administered by the Deputy Commissioners (DCs) have already approved all LA proposals which are being in the process of paying the compensation to the respective landowners as per the Land Acquisition and Immovable Property Acts, 1982 amended 1992 of the Government of Bangladesh. 15. In case of Jhalokati Bermohal Road Sub-project, Section-7 under LA was has already been imposed on the landowners immediately after determining the price of the acquired lands and other affected properties, accordingly DC asked the PD in August 2017 to pay the compensation to his account within 60 days of the notification. In receiving the advice from the DC, immediately PD office paid the amount to XEN’s account for DC office, but XEN of Jhalokati failed to pay the money to DC’s account within the stipulated time. Consequently, DC dropped out the LA case after60 days as per Rule of Business of the Government, and inform of the matter to the all concerned in writing. Eventually, DC office asked the XEN of Jhalokati in writing to submit the new LA proposal further along with all documents to revive the new LA case under the new price of the land acquisition of the Government that approved very recently by the Cabinet as the price has been increased comparing to the earlier in which landowners will get more benefits. However, finally XEN of Jhalokati resubmitted the LA proposal to DC on 12 March by completing all the legal procedure including obtaining the environmental clearance certificate from the DoE. Due to

6 further submission of the LA proposal to DC, the whole process for this sub-project is being delayed for about 6 months in moving forward to completing the whole LA process of paying the compensation to the entitlements. Virtually, DC office is yet to complete the payment of the compensation to the entitlements 16. Virtually, the whole land acquisition process dealing with the DC office is found complex in nature required to be maintained the different steps of the Land Acquisition Acts of the Government of Bangladesh. Therefore, a significant number of months are further required for paying the final compensation to the Project Affected Persons (PAPs) by completing the land acquisition process as per the rule of business of the government in maintaining different steps of the land acquisition. Despite having good progress in case of Land Acquisition, nevertheless, the land acquisition process is being delayed as per planned schedule for90 Meter Bridge, Gopalgonj and Jhalokati RDH-Bermohal Himandakati. Firstly, Executive Engineer of Gopalgonj had to resubmitting the Land Acquisition (LA) proposal to DC office repeatedly since DC office had returned the LA proposal in finding some anomalies after the feasibility study/ investigation conducted by the ADC (Land).It is expected that the whole Land Acquisition process, including payment to the entitlement persons will be performed by December 2018 for these road sub-projects; consequently necessary resettlement/ payment of top-up will also be started since then. (For details Please see tables in chapter-6.5, page No.22)

17. DC office only compensates the payment for acquired land based on the record rate in the Local Land Registry Office which is generally less than the actual market rate that does not cover the replace cost appropriately. The Resettlement Framework (RF) for CCRIP outlined that the land valuation process would consist of two different values – 1) the sale deed record, 2) expected price. However, only “sale deed record’ is considered to determine the price assessment done by the DC through land registry office. Therefore, initiative will be taken to pay the ‘Replacement Cost as additional cost of compensation after paying by the respective DC office to the entitlements for the acquired lands, and NGO/CCDB is advised to find the list of the Entitlements under Land Acquisition. 18. CCDB deployed field staff at the region level to assist the SMO/XEN at the district and Upazila for implementing the land acquisition programmes effectively. However, to some extent, inefficiency of the field staff of CCDB is observed that hampers the program in Barisal region mainly. 19. ADB Review Mission visited the CCRIP at the sub-projects level on13-15 May 2018, and found few observations in the sub-project of 90 meter Gopalgonj. The mission identified that so far, RPs have been prepared only for Road SPs. As there were no land acquisitions for the market shades, the project has arranged negotiated settlements for these components and paid compensation to the non-title holders only in case of grievances. The PMU is therefore requested to identify all such impacts and prepare a supplementary RP including all unidentified impacts. 20. Some grievances have been identified in the Masbari 90 m bridge, Gopalganj site by the ADB Mission from the business land owners. As per affected landowners ‘statement, the site has been wrongly classified as null land in the DC list instead of commercial lands. The

7 mission would therefore request the ministry to send a letter to DC office by 30 May 2018 to re-estimate the land value through a new JVT and revise the BS sheet as per practical findings.

Required Actions & Status

8 1 Introduction 21. Coastal Climate Resilient Infrastructure Project (CCRIP) financed by Asian Development Bank (ADB), KreditanstaltfürWiederaufbau (KfW) and International Fund for Agriculture Development under Local Government Engineering Department (LGED) formally started in January 2013 to increase rural incomes and reduce rural poverty through sustainable economic growth, rural development, social & gender development and improved infrastructure in the project area re-scheduled to be completed by December 2019. This project will promote overall development of the transportation system by constructing, improving, and rehabilitating Upazila & Union roads and road structures (brides/culverts), development of growth centers and Cyclone Shelters. 22. The key components of the projects are: (a) Improved Road Connectivity; (b) Improved Market Services and (c) Enhanced climate change adaptation capacity. 23. CCRIP is specially designed for the development of climate resilient infrastructure including roads, bridges and culverts, cyclone shelters and killas, ghats and markets. The project is contributing 24. Significantly in employment creation and poverty alleviation especially for LCS members. CCRIP has made substantial progress towards achieving its targets. All the activities of the project are expected to be completed within the stipulated timeframe.

2 Purpose of the Report and Land Acquisition & Resettlement Framework 25. The ADB Public Communications Policy (PCP 2011) refers the Safeguard Policy Statement (SPS 2009) with respect to information disclosure related to project safeguard documentation states that ADB shall post on its website the safeguard documents submitted by the borrower and/or client. These are safeguard documents include Resettlement & Indigenous Peoples Plan (RP & IPP), and the social safeguard and environmental monitoring reports. 26. To comply with ADB, the CCRIP, LGED submits Semi-Annual& Annual monitoring report periodically over the total implementation period of the project, covering Land Acquisition & Resettlement issues. The CCRIP commenced on 01 January 2013, but starting of actual works was delayed due to hiring of consultants in 27 January 2014. 27. The current report is the Semiannual Social Safeguard Monitoring Report prepared to comply with the loan covenants covering the period from July-December 2018. This report covers resettlement and social safeguard monitoring results to comply with the spirit of AD policy to “enhance stakeholders trust” in and ability to engage with ADB, and thereby increase the development impact [of projects]” in which disclosure of safeguard monitoring is a prominent aspect. Besides, Land Acquisition & Resettlement Framework (LARF) of CCRIP expresses the Government’s commitment to avoid any negative impacts due to the project interventions or to mitigate them ensuring that the DPs are able to maintain or improve their livelihood at the end of the project.

10 3 Social Safeguard / Resettlement Categorization

ADB's classification system 28. Prior to civil works implementation, all the subprojects selected for construction or development are to be Screened and Classified using ADB's classification system as follows: 29. Category-A: Subprojects proposed for construction or development, will fall under this category, if, it caused a significant involuntary resettlement impacts with a physical displacement of 200 or more persons from their residences, or 200 or more persons lose 10% or more of their productive or income generating assets, or more persons or 200 or more persons experience a combination of both. 30. Category-B: Any proposed subproject that includes involuntary resettlement impacts but are not deemed significant considering loss of shelter/houses or productive or income generating assets will be considered for category B. 31. Category-C: A proposed subproject that has no involuntary resettlement impact. Subprojects Categorization for CCRIP 32. Although there will be only a small number of land acquisition and resettlement impacts on each subproject, it is expected that the roads component as a whole, comprising up to 100 individual subprojects, will have more than 200 people suffering significant involuntary resettlement. It is also noted that ADB SPS 2009, SR2 Para 5 states:

33. “Resettlement is considered involuntary when displaced individuals or communities do not have the right to refuse land acquisition that result in displacement.” Accordingly the project is deemed to be in Category A for resettlement.

4 Institutional Arrangements 34. The LGED under the Ministry of LGRD & C, Rural Development Division is the Executing Agency (EA) responsible for implementing the RPs. LGED has established a Project Management Unit (PMU) for the Project, headed by a Project Director (PD) who is responsible for the overall execution of the Project. The EA also has set up a Sub-projects Management Office (SMOs) headed by the Executive Engineer of the concerned district under the PMU. The SMOs will prepare land acquisition (LA) plan for the land to be acquired with the assistance from consultants for each subproject found with land acquisition & resettlement impacts and shall submit to concern DC. M/S Christian Commission for Development in Bangladesh (CCDP), an experienced implementing NGO (INGO) has been hired by LGED to assist EA in implementation of resettlement program. To expedite the process, the RP implementing NGO will assist the DC office and EA in the process of land acquisition. A Management Support Consultant (MSC) engaged by project are assisting to carry out a range of activities including implementing and monitoring the safeguards aspects of the project. The Resettlement Specialist (RS) of the MSC is responsible for arranging or carrying out the activities of preparation/updating/finalizing the RPs for the subprojects with IR impacts based on information from the detailed engineering design documentation prepared by the Design & Supervision Consultant (DSC).

35. Under the project, LGED has set up a Project Management Office, (PMO) based in Dhaka. In the project area, there are three Regional Project Offices (RPO) located at Barisal, Madaripur and Khulna which will coordinate the physical works at the districts and Upazila level in their respective regions. Beside that there will be 12 PIU’s at district level by the respective Executive Engineer and supported by the Upazila Engineers. 36. To assist LGED in achieving these objectives and physical targets there are four consultancy services: • Design and Supervision Consultants (DSC). HIFAB International (Sweden) has Lead Firm of a Joint Venture. • Management Support Consultants (MSC). 38. The Ministry of LGRD through Gazette Notification has constituted required committees i.e. Joint Verification Team (JVT), Property Valuation Advisory Team (PVAT), Grievance Redress Committee (GRC) etc. with the involvement of representatives from LGED, INGO, DC, LGI and DPs. To ensure effective execution of all IR related tasks, capacity development trainings both at the PMU and SMO level is needed.

5 Appointment of Implementing NGO for Safeguards 39. The Local Government Engineering Department (LGED) appointed Christian Commission for Development in Bangladesh (CCDB) for the preparation and implementation of Resettlement Plans (RP) of Coastal Climate Resilient Infrastructure Project (CCRIP). An agreement was signed between the Local Government Engineering Department (LGED) and the Christian Commission for Development in Bangladesh (CCDB) on January 19, 2014.

13 6 Overview of Major Safeguard Related Activities – July –December 2018 40. So far, the LGED has awarded 323 subprojects of different categories (small, medium and large) in 12 costal districts, in three regions (Barisal, Khulna and Madaripur). M/S CCDB has completed the reconnaissance visits followed by Socio-Economic Survey and DDRs of 308 subprojects and submitted to LGED by December 2018.

41. LGED has demanded early submission of IFAD-Market (small Markets, Connecting Roads and Ghats) related to Due Diligence Report (DRRs) and Resettlement Action Plan (RAPs) of ADB (Growth centers, Roads and Bridges). CCDB has been submitting DDRs (list is given in the Annexture-03) & RAPs as the Socio-Economic Surveys have been completed. The following tables show the sub-project wise activities done by CCDB as of December 2018

14 6.1 Land Acquisition and Resettlement Issues of Road sub-projects

42. Project Director, CCRIP submitted 04 Resettlement Plans (RPs) of the land acquisition to the ADB which were approved by the Country Director, ADB in March 2017 in which details schedule and budget have been spelt out. LGED and Resettlement Consultant along with INGO are dealing with the officials of district land acquisition and other concerned agencies as well as the PAPs representatives to implement RPs on schedule by considering the appropriate issues and concerns of the landowners identified during the socio-economic survey. 43. In dealing with the social safeguard issues related to land acquisition resettlement, sub-projects have been established and circulated to all concerned agencies as well as steps have also been taken to perform the activities on schedule in this connection. Meanwhile, a significant number of progress has already been achieved during July to December 2018 in case of obtaining progress of the different steps of approval for land acquisition and the placement of fund for paying to affected persons. Subsequent to the Administrative Approval from the administrative Ministry by 2016 for all road sub-projects dealing with the land acquisition, several steps of the land acquisition processes are being continued which essentially required to be performed dealing with the District Land Acquisition Officers administered by the respective Deputy Commissioner (DC). In order to completing the whole land acquisition process for the remaining two road sub-projects, out of four, quite a significant numbers of months are further needed as per the rule of business of the government for maintaining different steps of the land acquisition to be done by the DC office. However, the Resettlement Specialist and the Project Director as well as Project Management Offices have been working with the respective DC office proactively to reinforce the process of paying compensation to the affected landowners in performing the whole LA process on schedule. Meanwhile, payment was given to the affected landowners for land acquisition of two road sub-projects and the remaining sub-project is found in progressing to be completed the whole processes of the Land Acquisition Acts. It is expected that the whole Land Acquisition process for the remaining sub-projects will be completed by December 2018; thereafter payment of compensation to the entitlements and necessary resettlement will also be started immediately. However, the entire land acquisition processes at different steps are being monitored by the Resettlement Specialist for achieving the expected outputs on schedule from the different levels of the government. 44. Monthly progress reports and the quality of Due Diligence Reports (DDRs) submitted by CCDB, implementing NGO is not found satisfactory although CCDB has been advised repeatedly to improve the quality of reports. It is further to be mentioned that to some extent, the resettlement programs at the sub-projects level have been suffered due to lack of skills and knowledge of staff deployed at the field level by CCDB. Therefore, CCDB is advised to deploy skills staff at the field level to maintain liaises and work with the respective PMOs/XEN and the officials concerned of DC offices in an efficient manner. Secondly, employees of the CCDB deployed in the project could not build a good understanding and relationship with the SMO/ XEN offices at the district level for which access of the CCDB staff to the SMO/XEN offices are found inactive which hampers the progress of the prevailing land acquisition and resettlement activities.

LGED, through the Design & Supervision Consultant (DSC) optimizes the detailed designs for all road subprojects to avoid and minimize impacts on existing buildings and land as far as practicable. The locations where resettlement impacts are unavoidable, the project will be completely abided by ADB’s SPS 2009 to ensure adequate mitigation measures and fair compensation. Voluntary land donations will be only accepted if it is willingly donated accompanied by written consents. Any subproject that entails land acquisition (either through voluntary or involuntary means) or physical displacement will be subjected to a resettlement plan (RP). The compensation will be handed over prior to moving assets or relocation. Any negotiated settlement will require adequate and meaningful consultation with affected persons, including those without legal title to assets, with such consultation fully documented. A negotiated settlement should ensure an adequate and fair price for affected land and/or other assets i.e. replacement cost of the affected properties. 46. Programs for Land Acquisition (LA) and resettlement for both roads and markets sub- projects have been found in progressing since July to December 2018 in three regions. Nevertheless, progresses are not being found adequately in case of two Road Sub-project (90 meter, Gopalgonj& Jhalokati RHD Bermohal) dealing with the Land Acquisition in which LA processes are being delayed in the DC office. However, initiatives are being taken to achieve the expected results at different steps with the DC office for performing the Land Acquisition process in view of completing the payment of compensation to the entitlements. The Indicative Milestones for various activities / processes and progress of the summery of the Road Sub-projects and Market Sub- projects are described in the following tables which are being monitored by the Resettlement Consultant, MSC. 47. Immediately after determining the Entitlement Persons (EPs), assessment of the compensation package was completed by JVT and PAVT of the respective district by visiting the sub-project areas physically and exchanging views with the persons concerned and the members of civil society as well as shared views with the GRC. Subsequent to the determination of the compensation, CCDB had taken several steps in finalizing the payment procedure like finalize the list of the EPs with ID card, opening the Bank Account, forwarding the proposal to the PD through SMO/XEN for final approval and placement of fund for payment etc. GRCs were found active in all the above sub-projects but no major grievances were found to be recorded in taking into account. This is because of conducting discussions with the affected persons, civil society on the key issues of the compensation and resettlement organized by CCDB in which affected persons have had the opportunity for bargaining or good-deal with their demand.

48. In general, fund’s releasing from the District Accountant General (DAG) Office to the respective XEN is being delayed although Project Director of CCRIP places funds immediately receiving proposals from XENs for compensation. It has been observed, during the whole process of paying the compensation for affected persons, difficulties were faced in dealing with the Accountant General Office to release the fund by XEN Offices after placing the fund by the Project Director. Secondly, account department of the SMO/XEN offices were found reluctant to arrange the payment procedure which delayed significantly in paying the payment to the Affected Persons. NGO personnel at the field level get troubled in the whole process of paying the compensation to the entitlement/ affected persons on schedule.

16 6.2 Steps for Paying Compensation to the Affected Persons 49. Following steps have been taken to pay the compensation to the Affected/Entitlement Persons for the Market sub-project:

7 Assessment of Compensation & Payment of Replacement Cost 50. It is outlined in the Resettlement Framework (RF) for CCRIP that all lands proposed to be acquired under this project will be compensated as per replacement cost consistent with both Government and ADB policies, and which will be called as the current market rate, and it is also agreed with DPP. It is to be noted that DC office only compensates the payment for acquired land based on the record rate in the Local Land Registry Office which is generally less than the actual market rate that does not cover the replace cost appropriately. The RF of CCRIP further mentioned that the land valuation process would consist of two different values – 1) the sale deed record, 2) expected price. However, only “sale deed record’ is considered to determine the price assessment done by the DC through land registry office. Therefore, initiative is going to be taken to pay the ‘Replacement Cost’ as ‘Top-up of Compensation in addition to the payment given by DC office to the entitlements for the acquired lands.

8 Grievance Redress Mechanism

51. The project has already addressed establishment of Grievance Redress Mechanism to receive and facilitate resolution of AP’s concern, complaints, and grievance about the safeguards performance of the subproject. The necessary notifications in this regard have already been issued by the LGED and the Ministry. If anybody losses assets, livelihoods or any things else due to subproject but it does not properly address, how it can be claimed to Grievance Redress Committee for proper compensation. 52. Since 2015, CCDB has been in the process of facilitating the grievances to be taken into account by establishing GRCs for various sub-projects. However, GRC have been formed in accordance with the gazette notification by the Ministry of LGRD&C for 26subprojects which have been already considered for resettlement program. 53. For the above sub-projects, GRCs have started functioning and the hearing of the objections raised by the landowners has already been addressed after imposing Section-3 of the LA by the respective Deputy Commissioner in which grievances issues will be resolved under the LA acts. And the remaining grievances with respect to compensation and resettlement issues will be brought to the attention of the GRC for taking measures to be resolved the raising matters. 8.1 Grievance Redress Committees (GRC): 54. GRCs will be formed for each subproject or group of subprojects to deal with grievances involving resettlement benefits, relocation, and other assistance. A gazette notification on the formation and scope of the GRCs will be required from the Ministry of LGRD. The GRC for a subproject will be comprised as follows:

29 11 Activities of Implementing NGO 11.1 Development of MIS 57. CCDB developed MIS for determining the losses, disbursing the compensation payment, and affected households. The data generated by the field offices are being used as technical inputs of the MIS. The MIS Specialist and the Database Manager have been developing the MIS at the central office of Dhaka. 11.2 Formation of Focus Group 58. The Focus Groups are formed in involving the affected persons who will be received Notices under the different sections of Land Acquisition Acts. These Notices are imposed on the landowners under Section-3, 4, 5, 6, & 7 of the Land Acquisition of the Govt. Such as Notice of the information of Land Acquisition, Objections given by the Landowners, Objections Hearing and resolving the Objections, determination of the acquired land price and payment to the entitlement persons by the Deputy Commissioner concerned. Focus Group consists of about 20 members headed by a Chairman and assisted by a Secretary nominated by the members themselves. 59. The Chairman conducts the meetings. The Secretary convenes the meetings preferably once in two months. Records the minutes of the meetings are maintained by the Secretary. The Resettlement Workers of CCDB facilitate the meetings by providing necessary information and technical assistance. In addition, CCDB is starting the formation of focus group in different subproject sites.

11.3 Stakeholders’ Meetings 60. During the period of July to December 2018, CCDB conducted 26 stakeholders meetings in the 03 regions in which 557 stakeholders attended those meetings. These stakeholders are mainly found in the respective LGED officials’ and Project Affected Persons/ Entitlements. Besides, formal and informal meetings held with the District Land Administration and other related government agencies. Among the participants, 530men and 27 women took part in the consultation meetings. The stakeholders / Focus Group Meetings are given opportunity to discuss on the issues related to resettlement, assessment, and valuation of properties, determination of compensation package, payment of compensation to the APs /EPs, relocation, gender, project assistances and grievances. In general, participation of women in the meetings for land acquisition and resettlement program is found very insignificant as women are not owned the properties in comparing with men. The following table reflects the status of the stakeholders meetings:

11.4 Distribution of Booklets/Brochures 61. The Information Booklets developed by the project in Bangla and other brochures are being distributed among stakeholders / beneficiaries/ UP Chairman / UP members of subproject sites at the Focus Group / stakeholders’ meetings. The entitled persons are addressed with this instrument. Through the booklets / brochures, entitlements of the EPs are disclosed. The EPs are concerned about their Payment of Compensation both from the Deputy Commissioner and CCDB / LGED office. The above booklet reflects detail guidelines how to address their concern. 12 Gender Development 62. In the perspective of the gender development and gender mainstreaming in the development, CCRIP has taken several steps to improve the women status in the sub-projects area of the 3 regions. These initiatives are: involving them in the institutional framework likes Landless Contracting Society (LCS) and Women Market Section (WMS) in which they received different training to build their capacity for creating incomes earned from the LCS program under the CCRIP. As of December 2018, in all, 4631 LCS members received orientation on Operation and Management of Landless Contracting Societies (LCS), of them 3830 (83%) were found women. Workshops on market management were conducted by LGED for MMC members where 14 women, among 125 participants, received orientation on building their capacity. Moreover, orientation was provided to 10 women on specialized Income Generating Activities (IGA) covering production, management, and market linkage. Through involving sub-project activities, pro-poor women have got the opportunity for creating dynamism in the perspective of income generation, livelihoods promotion, hygienic behavior in case of health, water, and sanitation, awareness of gender discrimination, women friendly use of cyclone shelter etc. A new era of women in the field of development in the sub-project area has been created through these trainings and incomes generated from LCS and WMS groups under the sub-projects. 63. In case of land acquisition and resettlement activities for road and market sub-projects, women are given due attention to get equal opportunities for obtaining entitlement of acquired lands and constructing markets and growth centers and providing compensation and resettlement to them if they are affected in this connection. 64. Despite organizing the formal training, CCDB has taken initiatives to invite women in the stakeholders meetings at the sub-project level although the participation was found unsatisfactory despite all out efforts taken by CCDB. However, women participants were encouraged to sit in the Stakeholders / Focus Group meetings to raise their voices alongside with man over the issues of land acquisition and resettlement particularly apart from other gender issues. However, issues of gender discrimination and the oppression of the society in different forms over women were also discussed in the stakeholder’s meetings in which they took part in sharing their grievances. Women mainly emphasized on getting opportunity for involving them in the development activities for raising incomes as women of coastal areas are suffered for getting those opportunities in comparing with their male counterpart as they have been backward in dealing with the poverty.

33 13 Indigenous Peoples Impact (IPI)

65. The Asian Development Bank (ADB) determines the rights of Indigenous people to assist them in the way of improving their livelihoods and own development. In general, Indigenous people are being suffered and threatened due to their exiting social stratification that violate into areas they traditionally own, occupy, use or view as ancestral domain. Therefore, special efforts are required to engage Indigenous people in the planning process of development programs that affect them for fulfilling their specific needs and aspiration. 13. ADB categorically outlines in the Safeguard Policy Statement (SPS) that a proposed project is assigned to one of the following categories depending on the significance of the potential impacts on Indigenous Peoples:

(i) Category A: A proposed project is classified as category A if it is likely to have significant impacts on Indigenous Peoples. An Indigenous Peoples plan (IPP), including assessment of social impacts, is required.

(ii) Category B: A proposed project is classified as category B if it is likely to have limited impacts on Indigenous Peoples. An IPP, including assessment of social impacts, is required.

(iii) Category C: A proposed project is classified as category C if it is not expected to have impacts on Indigenous Peoples. No further action is required.

14 Background of the settlement of the indigenous people in the coastal districts of CCRIP area 66. Few sub-projects under CCRIP are located in the Kalapara of Patuakhali, Taltoli, and Amtoli Upazila of where Tribal people are found. They are belonging to Rakhain/Mag tribe settled in the area about 150 to 200 years ago who came from Myanmar. They used to clean forests and turning those lands for habitable as well as took agriculture and fishing as main occupation. 67. The Rakhain tribes identify themselves as distinct ethnic community in the society in which the Bangalee community recognizes them. In the past, they had distinct settlements, forest, and fishing ground however gradually it has been declined. It is observed that now-a-days, they are very much accommodated with the local community who can speak Bangla, read Bangla and English in the schools. They have nearly similar and quite diversified occupation, tend to lease out land that cultivating themselves, nearly 100% literate and have involved them in entering into urban jobs/ services and business. Nevertheless, they maintain a distinct cultural heritage who are still wearing clothes in the handlooms and have own religious festivals. They also maintain own religious education based in the community temples. 68. Local informants said that tribal population in Patuakhali and Barguna is being decreased gradually as they are migrating to cities for better employment opportunities. Some of them are migrating to Myanmar, the place of their ancestors. The reason is however economic rather than cultural. It is observed that selling of land at high price in Bangladesh and buying land at cheap rate in Myanmar. Migration of the Indigenous Peoples lives in Patuakhali and Barguna is observed. They are interested in cultivating land as owner or cultivator. Most of them have homestead land and are engaged in homestead gardening, cattle poultry and goat rearing and aquaculture. Tribal women

34 are very active to be involved them in home based agriculture and cottage craft. 15 Description of Indigenous People in the sub-project area 69. Road and Markets sub-projects are being implemented in the 12 coastal districts under CCRIP in the Barisal and Khulna Divisions. The socioeconomic studies conducted by the CCDB reveals that indigenous people are found in the three sub-projects areas only under in which very a few percentage of indigenous people are living within the sub-projects areas. However, the socioeconomic studies for different sub-projects are ascertained that adverse impacts would not be reflected directly or indirectly on the livings of the respective indigenous people due to the implementation of sub-projects. 70. Bangladesh Population Census, 2011 reveals that a total of 526 tribal people belong to 117 households are living in the entire Patuakhali district, of them 104 households consist of 474 people live in Kalapara Upazila. Highest population is observed in Lota Chapli Union of Kaalapara Upazila where 422 people belong to 91 households are found. Total tribal population of Barguna district is found 667 who are belonging to 156 households, of them 460 people belong to 104 households are living in Amtali Upazila. Highest number population is found in Boro Bogi Union of Amtali Upazila where 101 households are found in consisting of 450 tribal people. Furthermore, 183 tribal people belong to 83 households live in Dautola Union of Bamna Upazila. Following are sub- projects under CCRIP where indigenous people are observed:

71. Impacts on the Indigenous People: CCDB, implementing NGO, has conducted study for the proposed sub-projects in connection with the preparation of Due Diligence Report (DDR) for each sub-project. As of December 2018, CCDB prepared 320 Due Diligence Reports (DDRs), and submitted to PMO, CCRIP. Among the 320DDRs, only three market sub-projects have been found in the Patuakhali and Baruguna District under Barisal Division where Indigenous People are living. The study reveals that people of the indigenous community have been living in and around the above three sub-projects area. Among them, about 5% from Rakhine community in the Dublagonj Bazar, 15% from Rakhine community in Kabirajpara Hat and 5% from Mog community are found in Harta- Rajapur-Saltamarket-Chowmohani. However, in any circumstances, these indigenous people are not affected due to the implementation of the sub-projects as Indigenous People Impact Plan is not essentially required to be prepared in this connection. It is to be noted that these growth

35 center/markets were established on the government acquired land as additional private lands are not required for the newly reconstruction. Even, no people are required to be resettled or compensated due to the implementation of those sub-projects. 72. Positive impact: Similar to other local communities, indigenous people who are living in the above areas will get benefits economically from those newly constructed market sub-projects which are located nearly their residential area. They will get facilities for marketing in terms of buying and selling commodities in which their social and economical mobilization will be enhanced.

73. Till December 2018, CCDB submitted 320 DDRs but the quality has not been yet improved despite repeatedly it was advised them by LGED. Please see annex-04

17 Way Forward – Proposed Activities

• Monitor the remaining land acquisition and resettlement process in dealing with the DC offices in order to completing the compensation to the entailments / project affected persons • Ensure pro-active role of DC offices & different committees like PAVT/JVT for reinforcing the resettlement activities in the field. • Monitor the function of different committees for Land Acquisition and Resettlement • Determine the compensation package for the land acquisition and resettlement that are being paid to the right persons • Determine and finalize the Entitlement Persons (EPs) in case of land acquisition and resettlement for market and road subprojects • Preparation of Identity Cards for the Entitlement Person/Affected People • Monitor the Grievances raised by the Affected Households/Persons and give attention to GRC for final resolution. • Monitor the opening of Bank Account for the EPs • Monitor the payment procedure of the compensation to the Entitlement Persons • Monitor the evidence of compensation to the Bank Account of EPs • Proper documentation of the payment of the compensation to be done by CCDB. • Ensure proactive role of CCDB in dealing with the DC and SMO offices by deploying professional personnel at the field. • Ensure the quality of the reports of CCDB. • Ensure the monitoring activities of CCDB by Resettlement Specialist by visiting sub- projects as and when required. • Following up the Land Acquisition & payment of compensation process as per the approved Resettlement Plan (RPs) • Taking initiatives to start resettlement/compensation program (top-up payment) for affected properties in addition to the payment compensation for land acquisition. • Following up the recommendations of the last ADB Review Mission.
