The 172nd Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 17th June, 2014 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 172nd ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

A Public Interest Litigation vide W.P. (PIL) No.327 of 2011 has been filed by Shiv Shankar Munda - Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-45/2014/NCTE/Insp/A86669 dated 01.05.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 28.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of NCTE Hqrs as well as representation submitted by the institution, the matter was discussed in detail and decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 40/2014/NCTE/Insp/A85689 dated 14.03.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 09.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 09.06.2014 submitted by the institution, the matter was discussed in detail and observed as under:

1. The institution is required to appoint one more lecturer in Mathematics and submit a fresh faculty list duly approved by the Registrar of the concerned University adding the name of newly appointed lecturer and his/her educational/professional certificates.

In view of the above, the committee decided as under: A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 108/2014/NCTE/Insp/A87021 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 03.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 03.06.2014 submitted by the institution, the matter was discussed in detail and observed as under:

1. Staff room, common room for boys and girls, Principal room are not available, 2. Multipurpose hall is 1430 sq.ft. only which is less than the required 2000 sq.ft. 3. The list of faculty duly approved by the Registrar of the concerned university is not submitted. 4. The institution must intimate the change of staff to ERC, NCTE for information. 5. Affiliation order issued from the concerned university is to be submitted.

In view of the above, the committee decided as under: A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision.

Jawaharlal Nehru College, Chakradharpur, West Singhbhum, Jharkhand- 4. 172.2(ii).4 833102 (Course:B.Ed.) (Consitutent Unit) () (Code No.APE00312) A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 63/2014/NCTE/Insp/A86389 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 06.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 06.06.2014 submitted by the institution, the matter was discussed in detail and observed as under: 1. The following deficiencies are still exist : (i) The institution is deficient in respect of both infrastructural and instructional facilities. (ii) The institution has violated the prescribed norms relating to the appointment of teaching and non-teaching staff. All the staff members are appointed on a contractual basis for a limited period of less than one year. They are not entitled to the service benefits admissible to regular employees of the University, The HOD is also appointed on contact basis in the pay scale of a lecturer. (iii) The institution does not fulfill the norms of maintaining Reserve Fund and Endowment fund in joint account with Regional Director, ERC, NCTE.

In view of the above, the committee decided as under: Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act 1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision.

A copy may also be sent to the concerned university and State Govt.

Tathagat Teachers Training College, Plot No. 498, 500, Vill- Jorapipal, Po- 5. 172.2(ii).5 Kalyanpur, Dhanbad, Jharkhand-826004 (Course: B.Ed.) (Private) (Vinoba Bhave University) (Code No. APE00508) A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 106/2014/NCTE/Insp/A87013 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 26.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 26.05.2014 submitted by the institution, the matter was discussed in detail and observed as under: 1. The following deficiencies are still exist : (i) The faculty list duly approved by the Registrar of the concerned university is to be submitted. (ii) The teaching faculty must be appointed on regular basis. (iii) Service condition/ salary both teaching and non teaching staff must be paid as per university/UGC/state government rules . (iv) The institution is required to submit the statement of salary as per pay scale prescribed by the university/UGC/ State Government alongwith bank statement.

(v) The institution does not fulfill the norms of maintaining Reserve Fund and Endowment fund in joint account with Regional Director, ERC, NCTE. In view of the above, the committee decided as under: A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision.

The committee considered the report of the NCTE Hqrs as well as reply dated 05.06.2014 submitted by the institution, the matter was discussed in detail and observed as under: 1. Salary both teaching and non teaching staff must be paid as per university/UGC/state government rules . 2. The institution is required to submit the statement of salary as per pay scale prescribed by the university/UGC/ State Government alongwith bank statement. In view of the above, the committee decided as under: A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision. Godda College, PO/Dist.-Godda, Jharkhand-814134 (Course: B.Ed.) 7. 172.2(ii).7 (Constituent College) (Ranchi University) (Code No.APE00437) A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 80/2014/NCTE/Insp/A87031 dated 17.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 05.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 05.06.2014 submitted by the institution, the matter was discussed in detail and observed as under: (i) In the VT report dated 02.07.2005 of the inspection conducted prior to grant of recognition indicated that the proposal of the institution was to conduct the B.Ed course for the present identified classrooms, hall, office room of the present Godda College alongwith other courses, and from the next session, it will be function in the new building of the Science Block. (ii) During special inspection of the institution, it is revealed that B.Ed course is still being conducted in a portion of the building of Godda College. The available built up area for the B.Ed college is only 3500 sq.ft. as against the requirement of a minimum of 16146 sq.ft or 1500 sq. mts. (iii) The size of Psychology lab, ET lab is inadequate. (iv) There is no Multipurpose hall, Science lab, Mathematics centre, Art and Work Experience room and common room for boys in this institution. (v) Teaching facilities are appointed on contractual basis. (vi) The post of HOD and two lecturers are vacant. (vii) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is not submitted towards endowment fund and reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE, Bhubaneswar. In view of the above, the committee decided as under: Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act 1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 51/2014/NCTE/Insp/A86381 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 28.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 28.05.2014 submitted by the institution, the matter was discussed in detail and observed as under:

1. The institution has not submitted any application for shifting of premises before conducting the special inspection and has shifted the institution in the new premises without getting permission from the ERC, NCTE which is violation of clause 8(11) of the NCTE Regulation. 2. The regular HOD, lecturer in Mathematics and full time Librarian have not been appointed. 3. Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh are not submitted towards endowment fund and reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE, Bhubaneswar.

In view of the above, the committee decided as under: Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on the above points. VTR and reply received on 24.01.2014 in response to clarification issued after notice u/s 17, the Committee discussed the matter in detail and observed as under:

As per submitted faculty list, there is no principal in the institution. In view of the above, the committee decided as under: The institution is required to appoint a regular principal and submit the fresh faculty list duly approved by the Registrar of the concerned university alongwith his/her educational/professional certificates within 30 days from the issue of letter.

A copy may be sent to the Vice Chancellor of the concerned university and State Government. Women’s Training College, Patna University, Patna, North Gandhi Maidan, 14. 172.2(i).2 Patna - 800001 (B.Ed.) (Govt.) (Patna University) (F.No.BR-S/E-5/96) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs. VTR and reply received on 08.01.2014 in response to clarification issued after notice u/s 17, the Committee discussed the matter in detail and observed as under: 1. As per submitted faculty list, all faculty members are appointed on adhoc basis. 2. The teaching faculty must be appointed on regular basis as norms. 3. The institution is required to submit a fresh faculty list appointing the faculty on regular basis and duly approved by the Registrar of the concerned university alongwith their educational/professional certificates. In view of the above, the committee decided as under: The institution is required to appoint all faculty on regular basis and submit a fresh faculty list duly approved by the Registrar of the concerned university within 30 days from the issue of the letter. ER-172.2(ii). Court Case: ER-172.2(ii). Inspection conducted by the NCTE Hqrs. U/S 13 on the basis of direction given by the Hon’ble High Court of Jharkhand. Govt. Women’s Teachers Training College, Gautam Budha Marg, Bariyatu 15. 172.2(ii).13 Road, Ranchi, Jharkhand– 834009 (Course:B.Ed.) (Govt.) (Ranchi University) (Code No.APE00101) A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93- 46/2014/NCTE/Insp/A86397 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide letter dated 09.06.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 09.06.2014 submitted by the institution, the matter was discussed in detail and observed as under:

1. The institution is functioning in the premises of the Government High School building. 2. There is no multipurpose hall, 3. No laboratory facilities are available. 4. Books in the Library are only 853 which is less than the required 3000. 5. The ICT resource Centre and Psychology resource centre are not existent. 6. The Art & Craft Resource Center and Physical Education Resource Centre have not been set up. 7. The appointed faculty members are not qualified as per norms. 8. Qualified librarian, Lecturers for Physical Education and Art & Craft have not been appointed.

In view of the above, the committee decided as under: Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act 1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision. A copy may be sent to the Vice Chancellor of the concerned university and State Govt. Court Case: ER-172.2(iii). Inspection conducted by the NCTE Hqrs. U/S 13 on the basis of direction given by the Hon’ble High Court of Jharkhand. (Present Status) F. No. ERC/NCTE/JH (Insp. U/S 13)/2014 The 95 institutions in the State of Jharkhand had been inspected under section 13 by the NCTE Hqrs. Out of which the ERC office has received only 69 deficiency letters from the NCTE Hqrs. till date and 49 institutions have submitted 16. 172.2(iii).1 their reply in reponse to the deficiency letter and same were placed before the ERC in the 171st & 172nd Meeting. However, as per available record out of which 69 institutions, the rest 20 institutions have not been submitted their reply so far and the stipulated time of 30 days has already been over. The details of the above 20 institutions are placed on the table. The 95 institutions in the State of Jharkhand had been inspected under section 13 by the NCTE Hqrs. The deficiency letters were issued to 87 institutions out of which the reply from 49 have been received and reply from the remaining following 38 institutions have not been received till dated and the stipulated time of days for submission of reply has already been expired. Accordingly, the Vishvavidyalaya was granted recognition on 13.08.2012 fov B.Ed course.

The Vice-Chancellor of the University vide their representation dated 07.05.2014 has submitted that the university had applied for the course SHIKSHA SHASTRI but the word that is suffixing B.Ed was inadvertently not added as a result of which the pass out students are facing problems in getting jobs in different Govt organization. Further, requested to allow this University to add SHIKSHA SHASTRI suffixing the B.Ed., so that the ongoing degree shall be entitles as SHIKSHA SHASTRI-B.ED.

The committee considered the request and decided as under: The request of the Vice-Chancellor to allow the university to add Shiksha Shastri suffixing B.Ed that is SHIKSHA SHASTRI B.ED. is accepted.

The Secretary, Bihar School Examination Board, Patna vide its Representation No. 970 dated06.06.2013 informed the irregularities in the admission of students for D.El.Ed course in the session 2011-2013 and requested for withdrawal of recognition of the institution.

Accordingly a show cause notice was issued to institution as per decision of 166th ERC meeting mentioning that the Management of the institution is divided in two parts and the matter for conducing examination to the session 2011-2013 is disputed.

The institution submitted its representation dated 22.01.2014 and 03.03.2014 regarding constitution of Governing body of the society Rauf Muslim Jamia alongwith a copy of order of the Hon’ble High Court of Patna of C.W.J.C. No. 1983 of 2014 dated 14.02.2014.

The committee considered the reply of the institution and decided as under:

A copy of the order of the Hon’ble High Court of Patna of C.W.J.C. No. 1983 of 2014 dated 14.02.2014 alongwith all representations dated 22.01.2014 and 03.03.2014 of the institution may be sent to the Secretary, Bihar School Examination Board, Patna with a request to inquire the matter in detail and submit the report to ERC, NCTE within 30 days so that appropriate action may be taken in the matter.

Ehiapur B.Ed. College, Vill-Ehiapur, PO-Ehiapur, PS-Ketugram, 20. 172.12.3 Dist-Burdwan, West Bengal-713129 (Code No.ERCAPE00901)

The Sub Division Officer, Katwa vide letter dated 17.05.2013 had forwarded a complaint dated 05/06/2013 submitted by Suman Ghosh and Arpita Roy of Vill-Pindira, P.S. Mongalkote, Dist- Burdwan against the authority of Ehiapur B.Ed College, Vill+PO-Ehiapur, P.S. Ketugram, Dist-Burdwan, West Bengal regarding admitting them as candidates under Management quota against donation and refused to take examinationafter the completion of the course as they admitted excess students as well allowed under rule.

As per decision of 170th ERC Meeting, a show cause notice was issued to the institution on the above points. The institution in its reply dated 18.03.2014 informed that the said students were absent from classes. When they failed to attend their classes they were willing to cancel their course for that session 2012-13. They have moved the concerned university have arranged Sonartar College of Education for their admission for the session 2013-14.

In view of the above, the committee decided as under:

1. The Complainer students may be asked to submit an affidavit/undertaking clearly stating that they have satisfied with the arrangement/settlement made by the alleged institution. 2. The institution be asked to submit an affidavit that they will abide by the norms of NCTE and not admit more students in future.

The committee considered the complaint and decided as under:

A copy of the complaint may be forwarded to the District Magistrate of the concerned District with a request to inquire the matter and submit the report within 30 days. Shri Bhagwat Prasad Singh Memorial B.Ed. College, At/Po-Deo, 25. 172.12.8 Dist.-Aurangabad, Bihar-824202 (B.Ed.) (Private) (Magadh University) (Code No. APE00825) The institution was granted recognition for B.Ed course on 30.08.2008.

It is observed that a High level committee headed by Ex-Member Secretary of the NCTE was constituted to assess the land and building, instructional facilities, staff position etc as per the order dated 19.01.2010 of Hon’ble Hight Court of Patna. During the inspection conducted as per the direction of Hon’ble High Court Patna the institution was deficient certain grounds.

Accordingly, the institution was inspected on 09.032014 was conducted under section 17 of the NCTE Act 1993 for verification of compliance of the deficiencies pointed during the special inspection conducted as per the direction of the Hon’ble High Court of Patna.

As the institution has submitted their application for shifting of premises and same was considered by the ERC along with the compliance of the deficiency letter in its 165th meeting held on 05th -06th December 2013 and decided to conduct the inspection of the institution for shifting of premises under clause 14 of the NCTE Act 1993. Accordingly VT letter was issued on 07.01.2014. The VT expert namely Dr. Prasanna Kumar Mishra vide letter dated 25.03.2014 has informed to ERC that the authority of the institution has informed that the inspection of the institution has already been conducted on 09.03.2014 and ignored for further inspection.

In view of the above, the committee decided as under: The institution is directed to cooprate the VT experts for conducting inspection for shifting of premises which

has already been shifted in to the new premises without getting permission from ERC, NCTE which is clear cut violation of the Clause 8(11) of NCTE Regulation. The previous VT letter was issued on 07.01.2014 is cancelled and new inspection for shifting of premises will be conducting as per new norms.

Ashu Kisku Memorial and Rabi Kisku Teachers Training Institute, Plot No. 327/147, Vill-Lupungdih, Po- Tankacha, Tehsil/Taluka-Chandil, 26. 172.12.9 City- Chandil, Dist.-Paschim Singhbhum, Jharkhand-832401 (B.Ed.) (Private) (Kolhan University) (Code No. ERCAPP656) The recognition was recognized dated 14.05.2013 for B.Ed course from academic session 2014-15 as per ERC order dated 14.05.2013.

The Secretary of the institution send a representation dated 26.05.2014 to the Registrar of the Kolhan University and a copy of the same forwarded to the RD,ERC, NCTE. As per representation the Secretary of the institution has requested to the University to grant affiliation to the institution for the academic 2014-15 without further loss of time and not later than 30th May 2014 failing which the institution shall be constrained to initiate appropriate legal steps.

In view of the above, the committee decided as under: A copy of the representation of the institution may be sent to the Registrar of the Kohlan University for taking appropriate action as per rules.
