The amounts set out on this schedule are to be inserted by you in the appropriate space on the citation. A defendant who does not care to contest guilt may prepay the fine in that amount. The fine schedule is applicable whether the charge is made by citation, a statement of charges, or by way of criminal information. For some violations, a defendant must stand trial and is not permitted to prepay a fine or penalty deposit. Additionally, there may be some offenses for which there is no fine listed. In both cases, you should check the box which indicates that the defendant must appear in court on the offense. I understand that this fine schedule has been approved for legal sufficiency by the Office of the Attorney General, Department of Natural Resources. This schedule has, therefore, been adopted pursuant to the authority vested in the Chief Judge of the District Court by the Constitution and laws of the State of Maryland. It is effective July 16, 2020, replacing all schedules issued prior hereto, and is to remain in force and effect until amended or repealed. Morrissey Chief Judge District Court of Maryland Attachment (Rev. 07/16/2020 ) DCAR XVIII Natural Resources Fine Schedule Effective July 16, 2020 The prepayable fine amounts listed below are to be utilized by all law enforcement officers and District Court Commissioners when issuing charging documents in the District Court which charge a violation of any of the provisions of the Natural Resources laws listed below. The fine listed below is mandatory and cannot be altered by the officer or a commissioner. If no prepayable fine amount is listed for a statutory or regulatory section, the charging document must require the defendant to appear. If a violator is charged with a second or subsequent violation, the charging document shall require the defendant to appear. Court costs are included in the prepayable fine amount listed below, but not in the maximum penalty amount. This schedule is effective July 16, 2020. OFFENSE CODE DESCRIPTION PREPAYABLE FINE AMOUNT MAXIMUM PENALTY Criminal Law Articles Note: Because most of these violations are not petty offenses, charging document shall be by a statement of charges to be served by summons or warrant. For sections that have a fine of $500 or less and/or incarceration of 3 months or less, charging document may be citation. (For CR violations the wording of the charging document should be copied from Part II of the Commissioner's Manual.) NOTE: NR 4-1201(d)(1) allows for the following additional penalties (above those listed in the Maximum Penalty column) for a violation of any provision of Title 4 or regulations adopted pursuant to Title 4 concerning the taking of or creel limits for striped bass (rockfish): 1st offense $1500 per fish 2nd offense within 2 years $2500 per fish and revocation of fishing license for one to two years 3rd offense within 4 year period $2500 per fish and revocation of fishing license for two to five years 4-1201(d)(2) Additional penalty of certain violation results in capture of over $20,000 of striped bass - 2 years imprisonment. NOTE: NR 4-1201(F) ALLOWS FOR THE FOLLOWING ADDITIONAL PENALTIES (ABOVE THOSE LISTED IN THE MAXIMUM PENALTY COLUMN) FOR A VIOLATION OF ANY PROVISION OF TITLE 4 OR REGULATIONS ADOPTED PURSUANT TO TITLE 4 CONCERNING THE TAKING OF OYSTERS FROM A DESIGNATED OYSTER SANCTUARY OR OYSTER RESERVE, OYSTER LEASE, OR CLOSED AREA: A FINE NOT EXCEEDING $3000 NOTE: NR 4-1201(H) allows for, in addition to any other penalty or fine provided in this title, any person who commits a separate commercial fishing violation while their license or authorization is suspended or revoked or engages in commercial fishing activity w/out holding the appropriate license or authorization to be subject to a fine not exceeding $25,000 and/or 1 year imprisonment. Tayloe Murphy, Jr., Chair Chesapeake Bay Program Principals’ Staff Committee Subject: Summary of Decisions Regarding Nutrient and Sediment Load Allocations and New Submerged Aquatic Vegetation (SAV) Restoration Goals For the past twenty years, the Chesapeake Bay partners have been committed to achieving and maintaining water quality conditions necessary to support living resources throughout the Chesapeake Bay ecosystem. In the past month, Chesapeake Bay Program partners (Maryland, Virginia, Pennsylvania, the District of Columbia, the Environmental Protection Agency and the Chesapeake Bay Commission) have expanded our efforts by working with the headwater states of Delaware, West Virginia and New York to adopt new cap load allocations for nitrogen, phosphorus and sediment. Using the best scientific information available, Bay Program partners have agreed to allocations that are intended to meet the needs of the plants and animals that call the Chesapeake home. The allocations will serve as a basis for each state’s tributary strategies that, when completed by April 2004, will describe local implementation actions necessary to meet the Chesapeake 2000 nutrient and sediment loading goals by 2010. This memorandum summarizes the important, comprehensive agreements made by Bay watershed partners with regard to cap load allocations for nitrogen, phosphorus and sediments, as well as new baywide and local SAV restoration goals. Nutrient Allocations Excessive nutrients in the Chesapeake Bay and its tidal tributaries promote undesirable algal growth, and thereby, prohibit light from reaching underwater bay grasses (submerged aquatic vegetation or SAV) and depress the dissolved oxygen levels of the deeper waters of the Bay.

It was also modified in 1954. TYPE OF PROJECT: Navigation PROJECT PHASE: Operation and Maintenance CONGRESSIONAL INTEREST: Senators Van Hollen and Cardin (MD), Representatives Harris (MD-1) NON-FEDERAL SPONSOR: Worcester County, Maryland BACKGROUND: The location of the Ocean City inlet is on the far eastern boundary of Maryland along the Atlantic Coast. The project provides for an inlet channel 10 feet deep from the Atlantic Ocean through West Ocean City harbor. The inlet channel width varies from 100 to 200 feet. The inlet channel is protected by two stone jetties at the entrance from the Atlantic Ocean. The project also includes a channel 6 feet deep and with widths that vary from 100 to 150 feet in Sinepuxent Bay from the inlet to Chincoteague Bay. The project also includes a channel 6 feet deep with widths that vary from 75 to 125 feet from the inlet into the Isle of Wight Bay. STATUS: The Ocean City inlet has a history of shoaling rapidly, especially near the entrance to the West Ocean City harbor. Limited maintenance dredging of the Ocean City inlet via one of the Corps’ special purpose dredges will be accomplished with fiscal year (FY) 2019 funds. It continues to serve as a model of comprehensive and sustained effort with important lessons learned. Extensive improvements to nutrient management, pollution control, and stormwater management appear to have led to measurable improvement in water quality and habitat. Yet, in the main stem of the River, sustained water clarity, restored underwater grass habitat, and reduced algae are yet to be realized outcomes.

This resource provides the opportunity for the marine industry to flourish, providing services to the commercial and recreational boaters. In 1980, the first Boating and Marina Study was completed in the County. At that time, the County had 57 marinas and 1,767 boat slips.1 Since that time the County has experienced significant growth in all aspects of its economy including the marine industry. As of June 2018, there are a total of 303 marinas containing at total of 12,035 boat slips (Table 1). This report was prepared as an update to the 1997 and 2010 marina inventories2 and includes an updated inventory and mapping of marinas in the County.
