RESOLUTION TO VACATE NO. 04-1400682 (California Streets and Highways Code Section 8324and 8325, and 8340)

Vacation of 1) George Burns Road from Gracie Allen Drive to approximately 205 feet southerly thereof, and 2) Gracie Allen Drive from San Vicente Boulevard to approximately 240 feet easterly of Robertson Boulevard - Ordinance of Intention No. 174,849 - Street Vacation Map No. VAC-2002-1400682.

Pursuant to Ordinance of Intention No. 174,849 and after notice was posted as required by law and the said ordinance was publi~hed, the Council considered the evidence submitted regarding said vacation and detennined that said streets should be vacated subject to the reservations and exceptions as contemplated by said ordinance and subject to the conditions of vacation having been complied with.

From all of the evidence submitted, the Council also found that 1) George Burns· Road from Gracie Allen Drive to approximately 205 feet southerly thereof, and 2) Gracie Allen Drive from San Vicente Boulevard to approximately 240 feet easterly of Robertson Boulevard proposed for vacation in the said Ordinance of Intention were unnecessary for present or prospective public street purposes; and

The particular portion of the public streets which are to be vacated and said pennanent easements and rights for sanitary sewer, stonn drain, and public utility facilities to be reserved therefrom were described by reference in said Ordinance of Intention and are described herein as follows:

Vacation Area No.1:

George Burns Road, fonnerly known as Hamel Road, 60 feet and variable width, as ·shown adjoining Parcel A, Parcel Map L.A. No. 2277, as per map filed in Book 33, Page 14, of Parcel Maps, in the office of the County Recorder of Los Angeles County, bounded on the north by the easterly prolongation of the northerly line of said Parcel A; and bounded on the south by the easterly prolongation ofthe southerly line of said Parcel A. •

IT IS THEREFORERESOLVED that from and after the recordation of this Resolution, the-areas described hereinabove are vacated, subject to the reservations and exceptions ofsai<;l pennanent easements.

RESOLUTION TO VACATE NO. 05-1400731 (California Streets and Highways Code. Section 8331) Vacation of Carl Street from Foothill Boulevard to its northeasterly terminus. The Council of the City of Los Angeles hereby finds and determines that Carl Street from Foothill Boulevard to its northeasterly terminus is unnecessary for present or prospective public street purposes; and That the vacation thereof will· not cut off all access to any of th~ real properties adjoining said public street; and the public interest, convenience and necessfty require the summary vacation of said public street pursuant to Section 8331 of the California Streets and Highways Code .. The City Council hereby elects to proceed under this provision of said Code Section; and hereby resolves that said public street be and the same is vacated; and The particular portion of the public street which is to be vacated is described herein as follows: Carl Street . (formerly Carl Avenue), 30 feet and variable width, adjoining Lots 50 and 51, Tract No. 7826,· as per map recorded in Book 91, pages 23 and 24, of Maps·, in the office of the County Recorder of Los Angeles County, bounded on the southwest by the southeasterly prolongation of the southwesterly line of said Lot 51 and bounded on the northeast by a direct line connecting the most easterly corner of said Lot 50 to a point on the southeasterly line of said Carl Street, distant 240 feet northeasterly measured along said southeasterly line of Carl Street from the northeasterly line of Foothill Boulevard (formerly Mulholland Street), 60 feet wide, as shown on said map of Tract No. 7826. Vacation of Tower Grove Drive (hammerhead apron east side) approximately 500 feet north of Shangri-La Drive.

The Council considered the evidence submitted regarding said vacation and determined that said street should be vacated subject to the conditions of vacation having been complied with. Therefore, from all of the evidence submitted, the Council finds that Tower Grove Drive (hammerhead apron east side) approximately 500 feet north of Shangri-La Drive proposed for vacation is unnecessary for present or prospective public street purposes; and The particular portion of the public street which is to be vacated is described herein as follows:

That portion of "Future Street Part Lot 14" of Lot 14 in Tract No. 23859, in the City of Los Angeles, County· of Los Angel~s, State of California, as per map recorded in Book 630, pages 24 to 28 inclusive of Maps, in the Office of the County Recorder of said County, described as follows:

DISCUSSION:

Resolution to Vacate: At the meeting ofthe City Council on November 22, 2002, no protests were filed against this vacation. All conditions ofthe Council's action of March 13,2002, under Council File No. 00-0281 have been fulfilled. The Resolution to Vacate is being presented pursuant to Council instructions of March 13,2002.

Resolution to Vacate No. 04-1400682 has been approved as to form and legality by the City Attorney.

Environmental Considerations: The City Council, on March 13, 2002, found that this . project is exempt from the California Environmental Quality Act of 1970 pursuant to the categorical exemptions included in the City's Environmental Guidelines under Article VII, Class 5(3). City Council - 2 - C. D. No.5

Los Angeles City Charter: The Council's action of March 13, 2002, complies with the requirements of Section 556 of the City Charter.

An Ordinance of the City of Los Angeles declaring the intention of the City Council to order the vacation of 1) George Bums Road from Gracie Allen Drive to approximately 205 feet southerly thereof, and 2) Gracie Allen Drive fonn San Vicente Boulevard to approximately 240 feet easterly of Robertson Boulevard; and electing to proceed under Chapter 3 of the Public Streets, Highways and Service Easements Vacation Law, and that any easements needed for the protection of drainage, sanitary sewer and public utility facilities be allowed to be reserved in the Resolution to Vacate. THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS: SectioIi 1. The City Council of the City of Los Angeles hereby declares its intention to order the vacation of 1) George Burns Road from Gracie Allen Drive to approximately 205 feet southerly thereof, and 2) Gracie Allen Drive from San Vicente Boulevard to approximately 240 feet easterly of Robertson Boulevard; and allowing the reservation of any needed easements in the Resolution to Vacate for the protection of . drainage, sanitary sewer and public utility facilities, pursuant to Chapter 5 of said Vacation Law. For·further particulars as to the proposed vacation, reference is hereby made to the map as Map No. V AC-02-1400682 on file in the office of the City Engineer, 201 North Figueroa Street, Suite 200, Los Angeles, California. Sec. 2. The City granted a developmental agreement and certified the environmental impact report for that expansion. In connection with that, Cedars-Sinai will undertake a series of major improvements both above and below the street, including tunnels, access ways, and so forth. The vacation of this street is, therefore, a pro forma vacation in that the streets will always remain open.

Cedars-Sinai requested deletion of Condition No. 12 and 3c. Recommendation No. 3c, which essentially requires the widening of a portion of the street. The Council District Five concurs with the requests.

Public comment letters were discussed, inasmuch as they were in opposition of the vacation. The Committe.e concluded, with input from Council District Five, that their opposition was based on misinformation. Councilmember LaBonge requested that the opponents be apprised of the true nature of the vacation.

This vacation was approved by the City Planning Director under City Plan Case No. 2000-1312 PWA on April 20, 2000. The PW Committee approved the City Engineer report as amended and forwarded the matter to Council for its consideration.

This Association represents the residents and homeowners living to the west and south ofthe Cedars-Sinai Medical Campus. We are directly and immediately impacted by this proposed street vacation.

As presently descnbed in the Revised Staff Report dtd. Jan 30, 2002 this action is NOT acceptable. As proposed by the City Engineer the vacation violates existing city ordinance and is not in the best interest of this badly tra.8ic impacted community.

1. Violation of City Ordinance No. 168,847.

Condition No. 2.k.i ofOrdiDance 168,847 requires " ... the free "avelo/emergency vehicles,

vehicles driven by the public and/or public use. II (Emphasis added). The City Engineer, for some reason not stated in the report, wouJd replace the ordinance's laDguage by conditions 11 and 12 which significantly reduce city oversight and protections to the community by leaving final determination ofstreet closure to the Planning Department withoutforther public input. This is simply not acceptable as a matter of good and responsible government as it amends a legislative action by administrative fiat.

2. Impact on the Community.

The Director ofPJannmg on April 20, 2000 in CPC No 2000-1312 PWA and CPC 92-0530 ZC coDCluded as Conclusion 2. and quoted on Page 9 on this report that : "They are nol needed for vehiculal' circulation or access. ".(Emphasis added).

This is simplY not true.

The streets traversing Cedats--Sioai Campus are an integral part of the traffic patterns ofthe. Beverly Center area' and must remam so .. Anything less would no~ only grievously impact the . residential and business cOmmunity bUt also emergency services.

We, who live here, know allt00 wen that during the bUsy hours ofthe day, which stretch from about 10:30 AM to 7:00 PM. 81J1bu1ances and other emergency vehicles can only pass along 3td Street and Beverly Blvd. with the greatest difficuhy. By forcing traffic away from Cedars-Sinai Campus this would greatly increase traffic on surrounding streets and exacerbate the deliveiy of such serVices and diminish access to the emergency selvicesofrered by the hospit8L .

In conclusion we· urge you to reject this report and instead iDstruct the City Engineer and the Director of Planning to enforce the requirements of Ordinance No. 168,847.

My name is Bruce Corwin and I am Chairman of the Board of Metropolitan Theatres. Our offices are located at 8727 West Third Street. directly in baok of the Cedars-Sinai parking lot and complex. I also own property on Robertson Boulevard.

I am a great supporter of the hospital having been born there. served on its Board of Directors and having been a life long contributor to this great hospital. I dOl however. have great reservations conceming the Cedars proposal. Are the Metropolitan employees going to be able to enter the alley and have access to our parking lot? Is the traffic on Robertson Boulevard going to be Increased significantly that it will reduce business and property value?

Once the vacation request has been approved. Cedars will have the 60le say as to what happens in the future, I am truly concerned as the hospital gets bigger that the rest of us who have interests in the area will not have a leg to stand on. RECOMMENDATIONS:

A. That the City Engineer's report dated November 1,2001 not be considered. Additional names have been added to the notification list. The environmental detennination statement was revised to show the appropriate environmental document and findings for this project.

B. That street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public rights-of-way indicated below and shown colored blue on the attached Exhibit "A (REVISED)":

1. George Burns Road from Gracie Allen Drive to approximately 205 feet southerly thereof.

2. Gracie Allen Drive from San Vicente Boulevard to approximately 240 feet easterly of Robertson Boulevard.

G. That, in conformance with Section 556 of the City Charter, the Council make the findings that the vacation is in substantial conformance with the General Plan.

H. That, in conformance with Section 892 of the California Streets and Highways Code, the Council determines that the vacation areas are not needed for nonmotorized transportation facilities .

. I. That the requirement for the recordation of a new tract map be waived.

J. That the City Engineer be instructed to present an Ordinance of Intention for this vacation when the procedural requirements for such presentation have been satisfied. Vacation proceedings not completed within 2 years of the date of the Public Hearing, yet to be conducted, shall be terminated, with no further action by the Council.

K. That the Resolution to Vacate be presented after the conclusion of the Public Hearing and Council's instruction to proceed with this vacation and upon compliance with the conditions established for this vacation.

L. That the petitioner be hereby notified that the vacation eliminates public easements, and no findings are officially made as to the underlying fee interest in the vacation areas.

FISCAL IMPACT STATEMENT:

The petitioner has paid a fee of $2,861.25 for the investigation of this request pursuant to Section 7.42 of the Administrative Code. An additional processing fee to recover the cost pursuant to Section 7.44 ofthe Administrative Code will be required of the petitioner. Maintenarice of the public easement by City forces will be eliminated.

CONDITIONS:

1. That the processing fees for the vacation proceedings be paid. If this fee is not paid within 45 days of the date on the City Engineer's Processing Fee letter, this vacation proceeding will.be terminated. - .

2. That the petitioner provides for the following dedications adjoining his properties in a manner satisfactory to the City Engineer:

3. That the petitioner complete the following improvements adjoining his properties in a manner satisfactory to the City Engineer:

a. , Widen the northerly side of3rd Street from San Vicente Boulevard to Sherbourne Drive to complete a 35-foot wide half-roadway (secondary highway standards), including integral concrete curb and gutter, a lO-foot wide concrete sidewalk together with suitable transitions to the existing improvements. Construct a 25-foot radius curb return with handicapped access ramp at the northeasterly comer of the intersection of3rd Street with Sherbourne Drive.

b. Repair and/or replace broken and off-grade asphalt concrete pavement along the north-south alley easterly of Robertson Boulevard adjoining the petitioner's property, including the removal of existing trees. Reconstruct the alley intersection with Alden Drive.

c. Widen the southerly side of Alden Drive from the alley to Robertson Boulevard to complete a 20-foot half-roadway, including concrete curb, gutter, and sidewalk together with suitable transitions to the existing improvements.

4. That arrangements be made with the Department of Water and Power, Pacific Bell, Southern California Gas Company, Media One and the Los Angeles County Department of Public Works for the removal of affect~d facilities or the providing of easements or rights for the protection of affected facilities to remain in place.

5. That satisfactory arrangements be made with the City Engineer for the relocation or abandonment of the existing sewer and stonn drain facilities located within the areas to be vacated, unless easements are reserved from the vacation for their protection.

6. That notarized written consents to the vacation be secured from the owner of Lot No.2, Tract No. 29854.

DISCUSSION:

Request: The petitioner, Orest L. Dolyniuk of Planning Associates, Inc., representing the Cedars-Sinai Medical Center, owner of the properties shown outlined in yellow on Exhibit "A (REVISED)", is requesting the vacation of the public streets shown colored blue. The vacation was requested to allow for the expansion of the existing medical center complex.

Zoning and Land Use: The properties surrounding the proposed vacation areas are zoned [T][Q]C2-2D-O and are developed with the Cedars-Sinai Medical Cente"r's facilities.

Description of Areas to be Vacated: The areas sought to be vacated are George Bums Road from Gracie Allen Drive to approximately 205 feet southerly thereof and Gracie AllenDrive from San Vicente Boulevard to approximately 240 feet easterly of Robertson Boulevard. George Burns Road is designated as a local street dedicated 60 feet and variable width and improved with concrete curb, gutter, asphalt concrete pavement, and Public Works Committee - 7 - C.D. No.5

sidewalks. Gracie Allen Drive is also designated as a local street dedicated 94 feet and variable width and improved with concrete curb, gutter, asphalt concrete pavement and sidewalks. Portions of the vacation area in the airspace and subsurface were previously vacated by separate Council Actions.

Adjoining Streets: San Vicente Boulevard is an improved divided major highway dedicated 109 feet wide and variable width with a 42-foot wide asphalt concrete roadway, concrete curbs, gutters, and concrete sidewalks. Third Street is an improved secondary highway dedicated 80 feet and variable width with a 25-foot wide asphalt concrete roadway, concrete curbs, gutters, and sidewalks.

Effects of Vacation on Circulation and Access: Since the petitioner states that the vacation is requested only for development below and above street grades, there should be no impacts on traffic circulation or access. However, the vacation of surface level of the public streets may have a significant effect on vehicular circulation or access since the streets are used for public circulation (vehicles, pedestrians, and bicycles) and the proposed expansion ofthe medical center will have the potential to generate additional vehicular traffic to the area. However, condition no. 11 outlined herein requires the existing public streets to remain open to free travel of emergency vehicles, vehicles driven by the public and for public use.

Objections to the vacation: Charlotte L. Cohen, a property owner within the vicinity of the proposed vacation areas states: "I strongly object to Cedars Sinai having carte blanche over City property. Councilman Michael Feur's office has indicated to me the possibility of Cedar's constructing bridges over the streets. If this is the case, let Cedars get City permission, they do not have to own the streets. This area's streets are congested now, and if Cedars owned the streets, there would be nothing anyone could do if Cedars decided, at some future time, to close the streets as public thoroughfares". .

Robert H. Schwab ofR & L Properties, also a property owner in the vicinity states: "I am opposed to the proposed vacation, even if Cedars agrees to grant public access after said proposed vacation; our streets are congested enough! I sUrely do not want Cedars to have any flexibility or City approval regarding a vacated street; who knows what they could do with this right in the future!"

Reversionary Interest: No determinations of the underlying fee interest of the vacation areas have been made as to title or reversionary interest.

. Dedication and Improvements: It will be necessary that the petitioner provides for the dedications and improvements as outlined under Conditions. Public Works Committee - 8 - C.D. No.5

Sewers and Storm Drains: There are existing sewer and storm drain facilities within the areas proposed to be vacated.

Public Utilities: The Department of Water and Power, Pacific Bell, Southern California Gas Company, Media One, and the Los Angeles County Department of Public Works maintain facilities in the areas proposed to be vacated.

Tract Map: Since the required dedications can be acquired by separate instruments and the necessary improvements can be constructed under separate permit processes, the requirement for the recordation of a new tract map could be waived. However, it will be necessary that the petitioner records an agreement satisfactory to the Bureau of Engineering to hold each adjoining parcel of land under the one ownership and its adjoining portion of the areas to be vacated, as one parcel to preclude the creation of landlocked parcels. This is to remain effective until such time as a new subdivision map . is recorded over the areas, a parcel map exemption is permitted or until released by authority of the City of Los Angeles.

City Department of Transportation: The Department of Transportation states that based on traffic considerations, the vacation is not opposed if through the requirements of a tract map or by other means, provisions are made for 1) lot consolidation, 2) driveway and access approval by the Department of Transportation and 3) any additional dedication and improvements necessary to bring all adjacent streets into conformance with the City's standard street dimensions. Cedar-Sinai Medical Center has indicated that they have no immediate plans to close any of the vacated streets. Ifin the future that should change, then Cedar-Sinai Medical Center should submit any plans for the installation of gates or guard booths to the Department of Transportation, the Bureau of Engineering and the Fire Department for review and approval as well as providing a suitable turn around at the terminus of any street that is not being vacated.

Since the west leg of Gracie Allen Drive at San Vicente Boulevard is also proposed to be vacated and since there is an existing traffic signal at the intersection of Gracie Allen Drive and San Vicente Boulevard, the Department of Transportation recommends that Cedar-Sinai Medical Center provide a "right-of-entry" to our Department for the modification, maintenance and/or operation of the traffic signal equipment and detector loops within the vacated portion of Gracie Allen Drive. Furthermore, the Department of Transportation recommends that the applicant submit any future plans for the closure, modification and/or installation of guard booths or gates at this location which could restrict traffic flow or the operation of the traffic signal to the Department of Transportation for review and approval and that the applicant be responsible for all costs associated with closing Gracie Allen Drive including any required modification of the traffic signals, striping, signing or pavement markings. City Fire Department: The Fire Department did not respond to the Bureau of Engineering referral letter dated February 15,2000.

Department of City Planning: The Director of Planning, on April 20, 2000, under City Plan Case No. 2000-1312 PWA, recommended that the vacation be approved with the following conditions:

1. That either:

a. The areas vacated shall be left open at all times for public motorized traffic access and circulation; or

b. Should the vacated portions become closed to the public, the applicant shall install appropriate traffic turn-around facilities at the northern end of George Burns Road and at the east end of Gracie Allen Drive, which respectively abut the vacated street segments, in accordance with plans prepared by the applicant and approved by the City Engineer.

2. That all conditions of approval imposed pursuant to the approval of CPC 92-0530 ZC shall be upheld and complied with.

Conclusion: Since the vacation is requested for only development below and above street grades and condition no. 11 outlined herein requires the current public streets to remain open for public use, the vacation of the public streets as shown colored blue on attached Exhibit "A (REVISED)" could be conditionally approved based upon the following:

1. They are unnecessary for present or prospective public use.

2. They are not needed for vehicular circulation or access.

3. They are not needed for nonmotorized transportation purposes ..

Environmental Determination: The City Engineer has determined that potential development associated with this vacation may have an adverse effect on the environment. However, the effects on the environment are analyzed in EIR No. 90-0463 (ZC)(HD), which was certified by City Council on June 23, 1993, under C.F. 88-0046 and S 1. The City Engineer recommends that the City Council re-certify the EIR and the associated required findings at the time adoption of this report.

Findings: In compliance with Section 556 of the City Charter, this vacation is in substantial conformance with the purpose, intent and provisions of the General Plan as Public Works Committee --10 - c.o. No.5

Effects of Vacation on Circulation and Access: Since the petitibners~ates that the vacation.is requested oruy for development below and above stre<:;t grades, there should be no impacts oft traffic circulation or access. However, :the vacat~on of surface level of the public streets may have a significant effect on vehicular circulation or access since the streets are used for public circulation (vehicles, pedestrians, 'and bicycles) and the 'proposed expansion of the medical center will have the potential to: generate additional . vehicular traffic to the area. However, condition no. 11 outlined herein requires the Public Works Committee -7- C.D. No.5

existing public streets to remain open'to free travel of emergency vehicles, vehicles driven by the public and for public use.

Objections to the vacation: Charlotte L. Cohen, a property oWner within the vicinity of the proposed vacation areas states: "I strongly object to Cedars Sinai having carte blanche over City property. Councilman Michael Feur's office has indicated to me the possibility of Cedar's constructing bridges over the streets. If this is the case, let Cedars get City permission, they do not have to own the streets. This area's streets are congested now, and if Cedars owned the streets, there would be nothing anyone could do if Cedars decided, at some future time, to close the streets as public thoroughfares".

Robert H. Schwab of R & L Properties, also a property owner in the vicinity states: "I am opposed to the proposed vacation, even if Cedars agrees to grant public access after said proposed vacation; our streets are congested enough! I surely do not want Cedars to have any flexibility or City approval regarding a vacated street; who knows what they could do with this right in the future!"

Reversionary Interest: No determinations of the underlying fee interest of the vacation areas have been made as to title or reversionary interest.

Dedication and Improvements: It will be necessary that the petitioner provides for the dedications and improvements as outlined under Conditions.

Sewers and Storm Drains: There are existing sewer and storm drain facilities within the areas proposed to be vacated.

Public Utilities: The Department of Water and Power, Pacific Bell, Southern California Gas Company, Media One, and the Los Angeles County Department of Public Works maintain facilities in the areas proposed to be vacated.

Tract Map: Since the required dedications can be acquired by separate instruments and the necessary improvements can be constructed under separate permit processes, the requirement for the recordation of a new tract map could be waived. However, it will be necessary that the petitioner records an agreement satisfactory to the Bureau of Engineering to hold each adjoining parcel of land under the one ownership and its adjoining portion of the areas to be vacated, as one parcel to preClude the creation of landlocked parcels. This is to remain effective until such time as a new subdivision map is recorded over the areas, a parcel map exemption is permitted or until released by authority of the City of Los Angeles.

City Department of Transportation: The Department of Transportation states that based on traffic considerations, the vacation is not opposed if through the requirements of a Public' W.orks .Committee - 8 - C.D. No.5

Since the west leg·ofGracieAllen Drive at San Vicente Boulevard is'also proposeq to be vacated and since there. is an existing traffic signal at the intersection of Gracie Allen Drive and San Vicente Boulevard; the Departmt!nt of Transportation recommends that , Cedar-Sinai Medical Center provide a "right-of-entry" to oUrDepartnlent for the . modification, maintenance and/or operation of the traffic signal equipment and, detector loops within the vac~ted portion of Gracie Al'len Drive. Furthemiore, the Department of Transportation recommends that the applicant submit any future plans for the closure, ino,jification and/or installation of guard booth~ or gates,at this location which could restrict traffic flow or the operation of the traffic signal 'to .the DepartInent of Transportation for review and approval and that tl),e applicant be .responsible for all costs associated with closing Gracie Allen Drive including any required modification of the traffic signals, striping, signing or pavement markings.

City Fire'Department: The Fire Department did not respond to the Bureau of Engineering referral letter dated February 15, 2000 .

. Debartment of City Planning: The Director of Planning, on April'20, 2000, under City Plan Case No~ 2000-13 t'2 PWA, recommended thatthe vacation be approved with the " following conditions: .

Conclusion: Since the vacation is requested for only development below and above street grades and condition no. 11 outlined herein requires the current public streets to remain open for public use, the vacation of the public streets as shown colored blue on attached Exhibit "A (REVISED)" could be conditionally approved based upon the following:

1. They are unnecessary for present or prospective public use.

2. They.are not needed for vehicular circulation or access.

3. They are not needed for nonmotorized transportation purposes.

Environmental Determination: The City Engineer has determined that this vacation may have an adverse effect on the environment and an Environmental Impact Report is required to address all potential environmental issues.

Findings: In compliance with Section 556 of the City Charter, this vacation is in substantial conformance with the purpose, intent and provisions of the General Plan as determined by the Director of Planning on April 20, 2000 under City Plan Case No. 2000-1312 PWA.

This project proposes to vacate public portions of George Burns Road and Gracie Allen Drive for use by the adjacent hospital. This project is in conformance with the purposes, intent, and provisions of the City's General Plan by conforming to the Wilshire Community Plan, a portion of the Land Use element of the City's General Plan. The Wilshire Community Plan states that, "The Plan is intended to promote an arrangement of land use, circulation, and services which will encourage and contribute to the economic, social and physical health, safety, welfare, and convenience of the people who live and work in the District.. ." Approval ofthis project will enable the adjacent hospital to expand and to provide improved health services. It will also allow the development of the Medical Campus Facilities below and above the street grades.

It is recommended that the following conditions of approval be applied to this case: 1) That either: a. The areas vacated shall be left open at all times for public motor.ized traffic access and circulation; or b. This is with reference to your letter of February 15,2000, regarding the proposed vacation of George Burns Road & Gracie Allen Drive - Vacation District - VAC-E1400682.

According to our Engineer, Mr. Jim Yanda, (323) 224-3206, Pacific Bell currently maintains communication facilities within the subject area, as shown on the attached map, and asks that an easement be obtained over the entire area to be vacated. Therefore, we do object to this proceeding until a reservation for our facilities can be included within the Resolution.

Our suggestion for the appropriate language is:

"An easement for Pacific Bell to from time to time construct, maintain, operate, replace, remove, and renew such aerial and underground communication facilities (including ingress thereto and egress therefrom) consisting of poles, anchors, guys, cables, wires, crossarms, conduits, manholes, handholes, markers, pedestals, terminal equipment cabinets, electrical conductors and necessary fIXtures and appurtenances."

We will require a copy of the recorded Resolution once the vacation is completed in order to maintain our records.

Date: 6 April 2000 -~~a <.~() fTI rT"I Dear Mr. Viado: ~ ~~ S< It is my understanding that Ceda~s Sinai Medical Center, through-· Planning Associates Inc., wants the City of Los Angeles to give over to Cedars Sinai the abovementioned City owned streets, "so that they, Cedars Sinai, will not have to go to the City every time they want to put the City streets to private ~." This is a direct quote from Mr. Orest Dolyniuk of Planning Associates, Inc., with whom I had a telephone conversation on April 4.

As a property owner in the immediate area, I strongly object to Cedars Sinai having carte blanche over City property. Councilman Michael Feuer's office has indicated to me the possibility of Cedars' constructing bridges over the streets. If this is the case, let Ceda~s get City permission, they do not have to own the streets. This area's streets are congested now, and if Cedars owned the streets, there would be nothing anyone could do if Cedars decided, at some future time, to close the streets as public thoroughfares.

I believe you have a duty to inform the business owners in the immediate vicinity of this take-over request. I received the information from a neighbor.

A neighbor of mine advised me of this proposed procedure. I subsequently obtained from Planning Associates, Inc. The attached transmittal letter of March 23rd. As an owner and manager of property in this area, I would be grateful for your answers to the following questions:

1. If Cedars agrees to keep these existing streets open for public use after they are vacated, can they, at a later date, revoke that agreement to allow public use?

2. With reference to the procedures required for the vacation of these streets, is there a requirement at this stage or at a later date that property owners within a certain radius must be advised of the proposed vacation? If so, what radius would be involved?

We have an active owners and merchants association which would be very interested in the answers to the above questions. May I have your early r~ply?
