Reason for Change: City Council, at their August 4, 2011 City Council meeting, initiated the review of the proposed Comprehensive Plan Amendment. Planning Commission staff is requested to review the proposed language and modify as needed.

Consistency: The proposed Amendment will establish more definitive development limits in the Public/Semi-Public Land Use category to ensure compatibility with adjacent uses.

Fiscal Impact: None

Regulatory Impact: The proposed amendment will require the review of land development regulations to ensure that public and semipublic uses are located and designed in a manner compatible with neighboring uses. .

PROPOSED POLICIES

Policy 21.1.7: Non-Conforming Public/Semi-Public Uses: Such uses have been legally established and in existence within the Public/Semi-Public land use category, prior to February 9, 2009, and shall be considered non- conforming to the City of Tampa’s Comprehensive Plan. The development and redevelopment of any non- conforming use within the Public/Semi-Public land use category may be considered for an increase of intensity or density of use, up to the maximum intensity/density of the FLU categories on immediately adjacent lands. A higher intensity (FAR) and density may be considered by Tampa City Council, through a site plan rezoning, provided it is shown that the proposed intensity/density is in the overall public interest and mitigation is provides for any adverse effects to the surrounding neighborhood. Any increase of intensity or density must follow requirements set forth in the City’s land development regulations.

Policy 21.1.8: Location of Public/Semi-Public Developments: Development and redevelopment criteria in the City of Tampa’s Land Development Regulations must ensure that public and semipublic uses are located, and designed in a manner compatible with neighboring uses.

Public/Semi-Public Land Use Category Study

I. Purpose of Study

The intent of this study is to determine if changes are needed to the Public/Semi- Public Future Land Use designation or to the Comprehensive Plan Policies to insure residential neighborhoods are protected against potential conflicts in the development of those properties.

City Council requested the study after the public hearing concerning TA/CPA 10-04 Map Amendment for St. John’s Parish Church and School at 902 & 918 S. Orleans Ave.

II. Existing Plan Provisions for P/SP Land Use

Public Land Use Category

Public/Semi-Public City Form Guidelines Building forms vary due to the variety of activities, though most buildings tend to be fairly large floor-plate, multi-story structures containing meeting rooms, classrooms, offices, and research space. Generally, automobile access and parking are limited to the periphery of an activity in order to create a park-like pedestrian zone. Similarly, recreation facilities such as parks, greenways, stadiums, track, ball fields, and tennis courts are located on the perimeter of the public use.

Public Land (provisions concerning public/semi-public uses)

Goal 21: The Public Realm: A Celebration of Our Identity As An Inter-connected, Engaging and Safe Public Environment.

Objective 21.1: Provide governmental services, institutional, educational, cultural, and social, facilities that are located and designed to complement Tampa’s neighborhoods, centers, and corridors.

Policy 21.1.2: The City shall seek to ensure that schools, government administrative and operational facilities, fire stations and police facilities, schools, cultural facilities, museums, hospitals are located throughout the City to provide places that serve the varied needs of the community, provide for community meeting places, and provide community and neighborhood landmark buildings and places.

Policy 21.1.3: The City shall lead by example, demonstrating design excellence in City projects, including buildings, parks, public rights-of-way, and City- subsidized redevelopment projects.

Policy 21.1.4: The City shall ensure that the City-owned public buildings, sites, and infrastructure are designed to be compatible in scale, mass, character, and architecture with the district or neighborhood in which they are located.

Policy 21.1.6: The City shall promote the co-location of parks, schools, police and fire facilities, health services, and other community facilities to support community interaction, enhance neighborhood identity, and leverage limited resources.

Properties carrying the Public/Semi-Public Future Land Use designation are scattered throughout the City. The nature of the Land Use category is to support uses that are public or semi-public/institutional (e.g. hospital, church, school, university, cemetery) in nature. The following map shows the location of P/SP FLU parcels within the City of Tampa.

The Hillsborough County Aviation Authority owns substantial acreage encompassing the Tampa International Airport and Peter O’Knight Airport. The University of South campus is also designated P/SP.

P/SP parcels which are non-governmental owned include churches, private university and schools, hospitals, cemeteries, community center/clubs and elderly housing development.

As illustrated in the above map, a large percentage of parcels designated P/SP are vacant. The vacancy status was determined by Hillsborough County Property Appraiser records which indicated parcels as unimproved or vacant. It should be noted that the focus of this study was to find the most intensive use of P/SP properties to determine if a Floor Area

REVIEW of FLOOR AREA RATIO

A review of existing Floor Area Ratio (the ratio of floor area to land area) was conducted on each parcel of land designated Public/Semi-Public, which includes all 326 parcels (folio #). Hillsborough County Property Appraiser records were used to obtain the existing gross building area for each parcel (folio #). For a development having a zoning lot that included multiple parcels and, potentially multiple Future Land Use designations, the land area were calculated based on the entire zoning lot.

As indicated by the description in the Future Land Use Summary Table, the predominant uses of the parcels were governmental public uses, Hillsborough County Aviation Authority, schools, universities, churches and hospitals. Ninety (90) percent of the parcels are vacant tracts or have a FAR of less than .35.

The range of FAR’s are illustrated in the following pie chart and attached as Appendix A:

Hillsborough County History Museum FAR = 1.01 801 Old Water Street

There are 16 developments having at least a portion of their zoning lot in the P/SP designation with a FAR of 0.5 or greater. All but 2 of these developments are located adjacent to FLU designation allowing a 1.5 FAR development potential (CBD, CMU-35, CC-35, LI, RMU-100 and UMU-60). Of developments with FAR greater than .5, only 2 are entirely surrounded by residential future land use designations.  Folio # 185856.0000 and 185857.0000 – St. John’s Church and School at 902 S. Orleans Avenue (1.03 FAR) is surrounded by R-10 FLU designation.  Folio # 116930.0000 – Mitchell Elementary School located at 205 S Bungalow Park Avenue (0.69 FAR) is surrounded by R-20 FLU designation.

The R-10 allows for a development potential of 0.35 FAR and the R-20 allows for a development potential of 0.50 FAR.

The existing church/school building is 2 stories with a church tower element. The church/school site is approximately one acre. The Church is in a single family detached neighborhood in the Historic District. The houses are one and two-stories and the streets are tree lined. The trees cause a heavy canopy along Orleans Ave.

Mitchell Elementary School (205 S Bungalow Park Avenue)

Mitchell Elementary School building is 3 stories. The front of the school is on Bungalow Park Avenue, which has a landscaped median in the center of the right-of-way. The school campus is fairly large at 2.32 acres. The surrounding zoning district allows for single family detached, attached and semi-detached. The single family houses and duplexes are primarily single story. The townhouses are primarily 2 stories.

Chapter 3: Structuring Growth for Livability: Urban Design and Land Use

Urban Design Goals, Objectives and Policies

Policy 13.1.3: Relate new buildings and development to the context of the neighborhood and community.

Policy 13.3.8: Design Review - In the Central Business District, , Zoning Districts, Historic Districts, Overlay and form based districts, the City shall require design review that focuses on achieving appropriate form and function for all new and redevelopment projects to ensure creativity, innovation, and design quality.

Urban Village Goals, Objectives and Policies

Policy 15.1.2: Urban villages contain most of the following uses which typically make up what is considered a traditional and livable community: single and multi-family residential, neighborhood serving commercial, schools, parks, a central gathering place, mass transit and safe, walkable pathways that connect people to all areas of the village. Work towards creating a mix and placement of these uses that works for the character of the village and creates a vibrant community setting.

Neighborhood Goals, Objective and Policies

Policy 18.1.1: Recognize that every neighborhood has assets that identify that neighborhood and contribute to the well-being of the people who live there. Understand what those are and look for opportunities to enhance them and leverage them for neighborhood improvement. Assets include trees, large yards, schools, people and independent businesses.

Policy 18.2.2: Encourage sensitive design and site planning in urban neighborhoods that mitigates the scale of larger buildings through careful use of building massing, setbacks, facade articulation, fenestration, varied parapets and roof planes, and pedestrian-scaled architectural details.

Policy 18.2.4: Encourage the vertical and horizontal integration of a complementary mix of commercial, service and other non-residential uses that address the needs of families and other household types living in urban neighborhoods. Such uses may include daycare and school facilities, retail and services, parks, plazas, and open spaces.

Public Land

Policy 21.1.2: The City shall seek to ensure that schools, government administrative and operational facilities, fire stations and police facilities, schools, cultural facilities, museums, hospitals are located throughout the City to provide places that serve the varied needs of the community, provide for community meeting places, and provide community and neighborhood landmark buildings and places.

Chapter 4: Building Sustainable Neighborhoods

City of Neighborhoods

Policy 22.1.7: Modify land use regulations to ensure flexibility to accommodate changing demographics and lifestyles. Allow, and in some places encourage, a diverse mix of housing types and affordable units, essential services, recreation, business and employment, home-based businesses, schools, transportation and open space networks.

Protect and preserve Tampa’s historical, architectural, and archaeological resources.

Policy 30.1.2: Review development requests that may have an adverse affect on the historic character of the historic district, building, site or object, including those requests along the periphery of an historic district due to the fact that development that is in close proximity to historic resources and is incompatible with those resources can have a negative impact on the historic integrity of the resource.

V. Conclusions and Recommendations

 Most parcels that are designated P/SP FLU are fairly large tracts of land which makes the intensity of the use, measured by FAR, relatively small.  Development of properties designated P/SP FLU are subject to compliance with the Zoning District regulations and land development regulations established in City Code.  In the Residential Single Family Zoning Districts, Schools; Churches; Cemeteries; Private Recreational facilities are Special Uses and area subject to criteria for the specific type of special use.  Policies in the current Comprehensive Plan provide guidance and protection to surrounding properties.
