Limitations of Legal Justifications .............. 555 Conclusion ....................................... 558 INTRODUCTION This Article challenges the claim that law plays a significant role in legitimating1 the standing social and political order within the oppressed groups or classes in society.2 The claim rests on an assumption, occasionally explicit, that a dominant class could not rule, or at least could not rule as efficiently, without the consent of the dominated. In other words, a distribution of power that leaves the dominant group with less than complete control of society compels the resort to legality.' By the logic of this view, one should not 1. In another variation, Unger suggests that the legal order in liberal societies is a sort of compromise, a "class stand-off," brought about by the incapacity of any one class to impose its hegemony over all the others. UNGER, supra note 2, at 69. 19941 LAND, LAW, AND LEGITIMACY IN ISRAEL expect to find a legalistic style of governance in societies characterized by extreme imbalances of power, wherein one group or class thoroughly dominates all others, and the support of the dominated is therefore inessential to the regime. Yet heavy reliance on law is characteristic of many colonial societies that are typified by precisely such extreme imbalances of power.4 The use of law by colonizers to execute and rationalize oppressive policies, notably the acquisition of native lands for European settlement, is poorly explained as an effort to gain the consent of thoroughly dominated indigenous populations.5 Rather, it is argued 4. Conquests of other peoples have by no means been limited to this era or to European powers. Both the size and the sweep of modem European colonialism, however, are unprecedented, doubtless because of the "unique alliance of the state and private enterprise which characterized the late modem period and distinguished it from its predecessors." Although colonialism is a tremendously variable phenomenon, classical colonialism, if there is such a thing, involved domination of a non- European country by a European one, with political control often exercised from the European metropole. The term "colonial society," on the other hand, denotes a society in which relatively sharp social distinctions persist between a settler population established via a colonial project and an indigenous population. These distinctions give rise to differential access to economic, political, military, cultural, and other tangible and intangible power resources, whether or not the society remains under the political control of a European metropole. The interaction between settler and indigenous populations tends to constitute a prominent social dynamic only when the indigenous population maintains a numerical "critical mass"; thus, to constitute a "colonial society," the indigenous population should represent some minimum of the society's total population. Other scholars, in describing "multi-ethnic societies," have fixed upon the necessarily arbitrary figure of ten percent, and that figure will be adopted here.     26 July 2021 The Pegasus Project: MENA Surveillance Coalition demands an end to the sale of surveillance technology to the region’s autocratic governments We, the undersigned human rights organizations, call for an immediate halt to the use, sale and transfer of surveillance technology to autocratic oppressive governments across the Middle East and North Africa (MENA). In light of revelations exposing the staggering scale of surveillance targeted at human rights defenders including journalists, bloggers and Internet activists facilitated by Israeli NSO Group Pegasus spyware, we urge all states to enforce a moratorium until a clear human rights regulatory framework is established. Since the 2016 investigation by Citizen Lab identifying one of the early uses of Pegasus by the United Arab Emirates (UAE) to spy on prominent Emirati human rights defender Ahmed Mansoor, now serving 10 years in prison in inhumane conditions, the surveillance industry has only flourished, undeterred. Amnesty International and Forbidden Stories’ breaking investigation, the Pegasus Project, exposed the leaked data of 50,000 phone numbers identified as potential surveillance targets, including four NSO Group government clients from the MENA region — Bahrain, Morocco, Saudi Arabia and the UAE. Journalists and activists are being targeted Amongst the Pegasus Project’s shocking revelations, the mass scale surveillance operations by the Moroccan authorities with a target list of 10,000 phone numbers including those of world leaders, activists and journalists, stood out. The analysis identified at least 35 journalists who were targeted with Pegasus by the Moroccan government, and later prosecuted under questionable circumstances or subjected to state-sanctioned campaigns of intimidation and harassment, including Taoufik Bouachrine and Soulaimane Raissouni, Akhbar El-Youm newspaper editors.

Opposing accounts downplay the fact of antisemitism and tend to treat the charge as an instrumental attempt to de-legitimize criticism of Israel. I address the central relationship both conceptually and through a number of empirical case studies which lie in the disputed territory between criticism and demonization. The paper focuses on current debates in the British public sphere and in particular on the campaign to boycott Israeli academia. Sociologically the paper seeks to develop a cosmopolitan framework to confront the methodological nationalism of both Zionism and anti-Zionism. It does not assume that exaggerated hostility to Israel is caused by underlying antisemitism but it explores the possibility that antisemitism may be an effect even of some antiracist forms of anti- Zionism.

The establishment of the Jewish state seemed to force people on the left to choose between competing nationalisms - Israeli, Arab and later, Palestinian. Over time, a number of key developments sharpened the dilemma. My central focus is the evolution of thinking about Israel and the Middle East in the British Labour Party. I examine four critical periods: the creation of Israel in 1948; the Suez war in 1956; the Arab-Israeli war of 1967 and the 1980s, covering mainly the Israeli invasion of Lebanon but also the intifada. In each case, entrenched attitudes were called into question and longer-term shifts were triggered in the aftermath.

    A CASE OFLIMITED VISION: JABOTINSKY ON CANADA AND THE UNlTED STATES* From its inception in 1897, and even earlier in its period of gestation, Zionism has been extremely popular in Canada. Adherence to the movement seemed all but universal among Canada's Jews by the World War I era. Even in the interwar period, as the flush of first achievement wore off and as the Canadian Jewish community became more acclimated, the movement in Canada functioned at a near-fever pitch. During the twenties and thirties funds were raised, acculturatedJews adhered toZionism with some settling in Palestine, and prominent gentile politicians publicly supported the movement. The contrast with the United States was striking. There, Zionism got a very slow start. At the outbreak of World War I only one American Jew in three hundred belonged to the Zionist movement; and, unlike Canada, a very strong undercurrent of anti-Zionism emerged in the Jewish community and among gentiles. The conversion to Zionism of Louis D. Brandeis-prominent lawyer and the first Jew to sit on the United States Supreme Court-the proclamation of the Balfour Declaration, and the conquest of Palestine by the British gave Zionism in the United States a significant boost during the war. Afterwards, however, American Zionism, like the country itself, returned to "normalcy." Membership in the movement plummeted; fundraising languished; potential settlers for Palestine were not to be found. One of the chief impediments to Zionism in America had to do with the nature of the relationship of American Jews to their country.
