COUNTY IN THE PROVINCE OF am“ ' 5" ‘”' BYLAWNO. 682.2016

BEING a bylaw of , in the Province of Alberta, for the purpose of authorizing the installation of a Texas Gate.

WHEREAS pursuant to Section 18(1) of the Municipal Government Act, being Chapter M-26 of the Revised Statutes of Alberta, 2000, and amendments thereto, a municipality has the direction, control, and management of all roads withinthe municipality;

AND WHEREAS pursuant to Section 7(h) of the Municipal Government Act, being Chapter M-26 of the Revised Statutes of Alberta, 2000, and amendments thereto, a municipality may pass bylaws respecting wild and domestic animals and activities in relation to them;

ANDWHEREAS pursuant to Sec ion 7(c)[iv] of the Municipal GovernmentAct, being Chapter M-26 of the Revised Statutes of Alberta, 2000, and amendments thereto, a council may pass bylaws that impose terms and conditions on any license, permit, or approval;

AND WHEREAS the Council of Cardston County has received a request from Randy Still for the installation of a Texas Gate across the municipal road allowance located west of NW 27-2-26-W4M.

NOW THEREFORE, under the authority of the Municipal Government Act, being Chapter M-26 of the Revised Statutes of Alberta, 2000, and amendments thereto, the Council of Cardston County, in the Province of Alberta, duly assembled, hereby enacts as fol ows:

1. General Terms and Conditions a) That the Texas Gate be installed on concrete or good-treated lumber and that the Texas Gate be at least 22' in width. b) That a regular-type wire gate be installed adjacent to the Texas Gate and an approved-style fence on the other side. c) That proper signage be installed at Randy Still or the successor(s) to the land's expense for the purpose of warning the travelling public of the existence of the Texas Gate and of livestock running at-large. d) That Randy Still or the successor(s) to the land be responsible for all costs, and for all future maintenance of the same. e) That Cardston County be absolved of any and all legal liability in connection with the installation or use 0 the Texas Gate. f) That Randy Still or he successor(s) to the land shall be responsible for the cost and removal of dirt, gravel, snow, or any other material that settles beneath the Texas Gate. 9) That Randy Stillor the successor(s) to the land carry liabilityinsurance as follows: i. Comprehensive General Liability Insurance with insurable limits of no less than two million($2,000,000) for each incident or occurrence. ii. Such insurance shall name Cardston County as the insured part and shall contain a Waiver of Subrogation against Cardston County. iii. Randy Still shall provide proof of such insurance to the satisfaction of Cardston County upon demand. h) That Randy Still or any successor(s) to the land involved agree to remove said Texas Gate, either temporarily or permanently, at their expense if the Council of Cardston County should request the same be done for road improvements or another municipal purpose. i) That Randy Still or any successor(s) to the land involved understand that if the Council of Cardston County updates the criteria for the exas Gate, that Randy Still or the successor(s) to the land may be asked to comply with the new criteria at their expense. j) Cardston County reserves the right, at any time, to rescind this bylaw and the corresponding approval for the installation of the Texas Gate if the same be deemed to be in the public interest. k) Randy Still shall be responsible for the removal, or the cost of removal, of the Texas Gate, all association fencing 0 structures, and for the repair of the road after removal of the Texas Gate.
