Learned counsel appearing for the applicants sought

time for arguments submitting that report of the Central

Pollution Control Board (CPCB) in respect of the same

company has been filed in another case and that report is

relevant to be considered in these applications and that fact was not brought to the notice of the Tribunal so far in the appeal and therefore, it is necessary to argue on that aspect also.

Learned counsel appearing for the contesting respondents submitted that it is only a reply to the arguments of the respondents and in any case, if a new point is to be argued, the learned counsel appearing for the applicants may submit written submission in advance, so that, the learned Senior counsel, who comes from Kerala can avoid the travel, if not warranted.

It is made clear that written submissions of the learned counsel appearing for the applicants shall be furnished 3 days in advance, to the learned counsel appearing for the contesting respondents, so that he could decide whether to personally to argue or not.
