Public Hearing: Discussion and possible action on vacating and discontinuing South 18th Avenue from South 17th Avenue to South 18th Avenue

Bill Schofield, 1425 North 12th Avenue, Apartment 219, is representing the Lindell family who are the owners of property on both sides of the street and are in favor of the vacation. This is the first part of a three step process where they will be dedicating some new land for the street and working on financing support through the TIF.

No one further came forward and the public hearing was closed.

Rasmussen moved to approve vacating and discontinuing South 18th Avenue from South 17th Avenue to South 18th Avenue. McElhaney seconded and the motion carried unanimously 3-0.

Discussion and possible action on no overnight parking restrictions on the 600 and 700 blocks of South 6th Avenue and the 600 block of South 7th Avenue

Wesolowski stated a petition was received to rescind overnight parking restrictions on 7th Avenue from Garfield Avenue to Pardee Street and on 6th Avenue from Garfield Avenue to West Street. Parking and Traffic approved the overnight parking restrictions in February of 2015 as recommended by DPW. There was no public comment at that time and the restrictions were approved.

Rasmussen believes the original motivation for the parking restriction was due to difficulty removing snow in these areas during the night when vehicles were parked there. Barring the declaration of a snow emergency, there has not been a whole lot that has happened that would make that situation different. If we restore overnight parking in the areas where blocks are narrow, the same snow removal issues would resume. We have talked about overnight parking, snow removal and snow emergencies before and she is hoping to have options to consider before the snow flies again. There was talk about allowing the Police Chief and the Public Works Director some leniency in suspending overnight parking as needed without having to call a snow emergency. She feels less is more when it comes to overnight parking. There are areas that have it now and we will have to manage those areas. If there are areas that do not have overnight parking now and DPW is able to get snow out, she does not feel going backwards and restoring parking is a smart idea.

Thao asked if currently there is no parking year round and Wesolowski confirmed. She understands that in the west side of that neighborhood they do not have large garages. Citizens are forced to find street parking. We have had some inclement snow storms but Thao wonders if we can entertain lifting this restriction. She asked if DPW or the UW had concerns or feedback. Wesolowski was unable to reach Mohelnitzky but he does not believe their stance has changed. Wesolowski did not hear from the UW.

Rasmussen stated there are a couple areas in her district that had similar problems. A compromise was reached that restricted parking during the snow season; from November 1 to May 1. McElhaney agrees with a compromise but questioned November 1 versus December 1 as typically there is not a lot of snow in November.

Jim Lehman, 636 South 6th Avenue, stated the sidewalk is beautiful but they never had a sidewalk behind their house before. He had 11 ½ feet of parking in front of his garage before the sidewalk was installed. Now he has 6 feet. His wife, son and himself live there. In the summer he has a convertible so there are 4 cars. He is looking at putting another pad but he would still only be able to park 3 cars. The petition was signed by all the homeowners. The renters at 628 South 6th Avenue only have 8 feet behind their garage to park. The upstairs renter does have a carport but if she has company she would have to pull onto the lawn. This is causing a problem. He loves the sidewalk but it took a lot of parking space away. He added that by the parking lot for the Park Department there was a sign no parking from here to the driveway. This sign is now in the middle of the block. He is hoping the sign could get moved to the south end where it was originally. Wesolowski stated staff can look at that independently. Lehman added that if Mohelnitzky is asked he would probably prefer no overnight parking throughout the City during the winter.

Rasmussen moved to restore overnight parking between May 1 and November 1 with leaving the overnight parking restriction in place during the winter months. McElhaney seconded and the motion carried unanimously 3-0.

Discussion and possible action on amending Section 1.01.025 (c)(1)(B) Schedule of cash deposits

In Alfonso’s absence, Thao explained that under the penalty section truck routes did not exist and the bond schedule had a $50 deposit. The recommendation from staff is for the traffic route to be deleted from the bond schedule.

McElhaney moved to approve amending Section 1.01.025(c)(1)(B) Schedule of cash deposits. Rasmussen seconded and the motion carried unanimously 3-0.

Discussion and possible action on State/Municipal Agreement for Scott Street Intersections Improvements

Wesolowski indicated the State/Municipal Agreement outlines the financial commitment. The City is responsible for $71,000. This will upgrade the overhead signals and lighting at 5th Street, 3rd Street and 2nd Street along Scott Street. This is related to a Hazard Elimination Grant, which is a good program and the cost share is beneficial to the City.

Rasmussen moved to approve the State/Municipal Agreement for Scott Street Intersections Improvements. McElhaney seconded and the motion carried unanimously 3-0.

Discussion and possible action on Jurisdictional Transfer Agreements for McIndoe Street, 5th Street, 6th Street, 1st Street and Scott Street (STH 52 and USH Business 51 Reroute)

Wesolowski explained this would rescind the connecting highway designations on McIndoe Street and 1st Street and would add the connecting highway designation on 5th Street and on Scott Street as shown on the map included in the packet. This is basically an even swap and just a different route through the downtown. The agreements were drafted by the DOT. As part of this an environmental study and a traffic study were completed. Both were approved by the DOT. Rasmussen added that this was expected and is linked to the last item to facilitate the expansion of the YMCA and the Aspirus Clinic.

Rasmussen moved to approve the Jurisdictional Transfer Agreements for McIndoe Street, 5th Street, 6th Street, 1st Street and Scott Street. McElhaney seconded and the motion carried unanimously 3-0.

Discussion and possible action on a Relocation Order for establishing an access road off Thomas Street in order to repair/maintain the River Wall

Lindman explained that staff has been working with a consultant to redesign the river wall, which has failures. There is a landlocked parcel that extends into the river. The parcel is privately owned but the owner is unknown. In order to have access to reconstruct and maintain the wall, we need to extend a road. Staff has been working with the Attorney’s Office and outside counsel on the condemnation process. In order to obtain right-of-way and get the road in, a relocation order is needed.

Thao will vote no for this item to stay consistent with what citizens in the district have been concerned with.

Rasmussen moved to approve a Relocation Order for establishing an access road off Thomas Street in order to repair/maintain the river wall. McElhaney seconded and the motion carried 2-1 with Thao the dissenting vote.

Discussion and possible action on an initial resolution to vacate right-of-way at the intersection of West Thomas Street and South 15th Avenue

Wesolowski was contacted by the owner of 1406 West Thomas Street. When the first phase of Thomas Street was completed, the north side of 15th Avenue was shifted to align it with the south side. In doing so, an excess parcel of right-of-way was created. The property owner of 1406 West Thomas Street is interested in obtaining the excess parcel. This would put an excess piece of right-of-way back on the tax roll.

Rasmussen moved to approve an initial resolution to vacate the right-of-way at the intersection of West Thomas Street and South 15th Avenue. McElhaney seconded and the motion carried unanimously 3-0.

Construction update for 2019 Projects

Wesolowski stated Townline Road should open next Friday depending upon weather. Curb and gutter is being completed on Thomas Street. Asphalt has not been placed yet. The railroad is still on schedule to replace the crossing surface the week of October 21st. Final pavement will be placed when the railroad crossing is completed. The road is anticipated to be open the first week of November. 1st Avenue is the project that is the furthest out and scheduled for completion mid-November. A lot of concrete pavement is yet to be poured and then there is cure time.

Curb and gutter was placed today on 2nd Street and the contractor will continue with installing sidewalk next week. The underground utility work for 1st Street is completed. Curb and gutter is scheduled for next week.

Work on 5th Street and Scott Street under the Concrete Pavement Repair project is completed. There are some patches on Thomas Street that are curing before they pour the other half. Stewart Avenue has some patches as well as STH 52/Stewart Avenue. He noted that these patches need to cure five to seven days before being open to traffic. Repairs will also take place on 7th Street from Forest Street to the north for about 3 blocks. The Asphalt Paving projects have been completed.

West Wausau Avenue was anticipated to be paved today. Work on Sturgeon Eddy from Memorial Park Road to Wisconsin Street has started for the Sewer Siphon Crossing Project. This project is anticipated to take six weeks.

Rasmussen asked if there are any projects that are still open where we have experienced delays because a project was left unattended on workable days. Wesolowski replied no and indicated that the contractors, especially on Townline Road, have worked a lot of hours and at points have had three crews working. They are running into concrete shortages as there are too many projects going on at once and contractors are fighting for concrete trucks. Wesolowski visited the four major projects today and all four were pouring concrete. Wesolowski said 2nd Street is taking longer than expected as there was not good cooperation from Frontier and Charter to move their facilities. The contractor wanted to start the project a month earlier but could not as the facilities were not relocated.

Discussion and possible action on petition for annexation – Kern, 4605 Stettin Drive (076-2907-294-0982, Town of Stettin)

Wesolowski indicated this petition was received this week. The Kern’s have a failing septic system and would like to annex. Sewer and water was installed in Stettin Drive in 1993 or 1994. Assessments would be levied when annexed.

McElhaney moved to approve the petition for annexation of 4605 Stettin Drive. Rasmussen seconded and the motion carried unanimously 3-0.

Discussion and possible action on the dedication of right-of-way of South 18th Avenue from South 17th Avenue to South 18th Avenue

BACKGROUND

A conceptual development plan for the redevelopment of Wausau Crossroads Center was received by the Engineering Department. Part of this proposal would require the roadway to be shifted to the north. The attached CSM would dedicate the right-of-way required to move the roadway.

FISCAL IMPACT

The preliminary estimate to build S. 18th Avenue in the new location is approximately $300,000.

STAFF RECOMMENDATION

Staff recommends approving the dedication of right-of-way as shown on the attached CSM.

Discussion and possible action on renaming East Rib Mountain Drive to Flieth Street

BACKGROUND

A portion of East Rib Mountain Drive, between S 12th and S 11th Ave, is located in the City of Wausau. This street is proposed to change names to Flieth St. This was proposed back in June and Marathon County has already changed the name of the town road to Flieth St. This would make Flieth St. continuous west of 11th Ave.

There is one owner along this section of roadway. The owner and the post office will be notified of the address change once approved by the city.

FISCAL IMPACT

None.

Eric,

We have a portion of E. Rib Mountain Drive in the city. One property has an address off of this street. When Marathon County renamed streets in the Town of Rib Mountain this month, they changed the town portion of the road to Flieth Street.

Can you add this item to the next CISM meeting? CISM reviewed changes back in August 2017 for street name changes with roads shared by Town of Wausau and Town of Stettin previously.

Marathon County Conservation, Planning, and Zoning is advising City of Wausau to change E Rib Mountain Drive to Flieth Street. Marathon County has already made this change for the portion that is located in the Town of Rib Mountain. Flieth would become a complete/continued street west of S 11th Avenue.

RESOLUTION

WHEREAS, in 2017 the Marathon County Conservation, Planning and Zoning Department began an effort of uniform addressing to eliminate duplicate road names and to increase consistent naming conventions from one municipality to the next; and

WHEREAS, your Capital Improvements and Street Maintenance Committee met on August 10, 2017 to review the proposed street name changes and postponed the renaming of East Rib Mountain Drive due to pending litigation between Marathon County and the Town of Rib Mountain pertaining to uniform addressing; and

WHEREAS, according to the Marathon County Conservation, Planning and Zoning Department, Marathon County has now renamed the portion of East Rib Mountain Drive located within the Town of Rib Mountain to Flieth Street; and

WHEREAS, your Capital Improvements and Street Maintenance Committee met on November 14, 2019 and recommends changing the portion of East Rib Mountain Drive located within the City of Wausau to Flieth Street to be consistent; now therefore,

BE IT RESOLVED the Common Council of the City of Wausau does hereby authorize the renaming of East Rib Mountain Drive to Flieth Street, and the City of Wausau Inspections Department is directed to notify the property owners and appropriate agencies of the street name change.

Discussion and possible action on amending Section 10.20.030 All night parking prohibiting overnight parking during winter months

BACKGROUND

The parking ordinance that governs parking city wide is WMC 10.20. In general, with some exceptions or where streets are otherwise posted, vehicles may be parked on either side of the street from 6am to 2:30am. Parking between 2:30am and 6am is restricted to odd/even parking year round.

 Currently the Chief of Police or the Director of Public Works “may declare a snow removal emergency…” which prohibits vehicles from parking on the streets.

 Currently the Chief of Police or the Director of Public Works “may, as winter conditions call for it, POST temporary odd/even parking restrictions…”

Every winter we have significant issues with plow drivers being able to plow and remove snow due to parked cars. Some boulevards, with a parked car, will not accommodate a plow truck to pass. On the hills in the city it makes it significantly more difficult to clear the streets when cars are parked along the street. Every plow event the drivers plow around vehicles, this increases the potential for them to damage the vehicles and creates liability for the city and the drivers.

I am very cautious about declaring Snow Emergency’s and typically only do so when there will be visibility issues, long sustained snow/ice storms or very heavy snow. Typically we will declare 2-3 snow emergencies on average each winter season. This practice will continue even with this proposed parking prohibition, but the Snow Emergency’s will be kept to emergencies only.

In order to restrict parking temporarily the ordinance requires that those streets be posted, it is not practical to post a large number of streets if it is necessary to temporarily restrict parking for snow plowing/removal. There is no provision in the ordinance to restrict parking temporarily without issuing a snow emergency.

This item proposes to prohibit parking overnight from December 1 through February 28 (or 29 during a leap year). See attached memo from the City Attorney’s Office.

Comments on Proposed Ordinance W.M.C. §10.20.030 All Night Parking

 In April, 2015, the City amended its all night parking ordinance, W.M.C. §10.20.030, removing a prohibition concerning on-street parking between 2:30 a.m. and 6:00 a.m. for the winter period of December 1 through March 31. The revised ordinance (which remains in effect at this time) contains the current provisions concerning all night parking and provides for alternate side parking regulations on all streets between 2:30 a.m. and 6:00 a.m. for the entire calendar year.  During winter snow storms, the City has been declaring snow emergencies as needed, resulting in the prohibition of on-street parking (day and night) during the period of the snow emergency to facilitate snow removal.  The City has been looking to achieve more efficient ways to manage overnight parking and snow removal in the winter as an alternative to, or in addition to, declaring a snow emergency on a storm by storm basis. The declaration of snow emergencies alone has not been sufficient to enable the City to deal with significant storms such as those experienced last year, where City crews needed to undertake not only plowing, but also significant snow removal and clearing activities.  The draft ordinance proposes to reinstates an overnight parking ban on City streets between the hours of 2:30 a.m. and 6:00 a.m. for the winter period of December 1 through February 28 (or February 29, in the case of a leap year).  Wisconsin statute §349.13(1e)(c) 1. & 2. authorizes municipalities to restrict parking during any hours between 12 midnight and 7 a.m. upon a two-thirds vote of its governing body and when official traffic signs have been placed or erected at or reasonably near the corporate limits of the municipality on all state and county trunk highways and connecting highways informing motorists that night parking regulations are in effect in the municipality.
