Council motion 0633/17 on June 6th, 2017 directed Administration to prepare an update report on Road Use Agreements (RUA) for the quarterly report meeting on July 27th, 2017; and Further, Council requested at July 18th, 2017 Council to provide an update on RUA. 20 16 RUA Process and Affiliation with Development Permit (DP)

 Bylaw 939/17 dictates the completion of a DP application by the applicant. Businesses that require a RUA are provided with a copy of the RUA Application Form (next slide) to be completed and received by PWI to evaluate conditions of road use and prepare the agreement to be signed by the applicant.  Upon completion, the RUA is issued with the DP.  The RUA is a condition of the DP, but it is not mandatory to sign/complete RUA before issuance of DP. 21 17 22 18 Categories of RUA

There are four (4) categories of RUA:

Essentially all the conditions (1 to 15) of first three (3) RUAs are same except the Security amount in Schedule ‘B’ for each RUA:

1. HEAVY TRUCK STORAGE - $7,000/km** 2. LIGHT DUTY STORAGE - $500/km** 3. OIL COMPANY - $1,500/km** 4. GRAVEL/AGGREGATE - $10,000/km** For Gravel/Aggregate RUA the differences include: (depending on the DP), open house responses, resident concerns, school bus routes, conditions for hours of operations, maintenance schedule etc. are included for gravel/aggregate haul RUA; (next few slides) **Please note: Adjoining Counties charge between $5,000 to $10,000/km for RUA, in addition to cost/load up to $20,000/km bond on a ban road. 24 20 Conditions of RUA BRAZEAU COUNTY Heavy Truck Storage Haul Agreement

THIS AGREEMENT entered into this ___ day of _____, 2017

BETWEEN: BRAZEAU COUNTY A Municipal Corporation, in the Province of , (hereafter referred to as “BRAZEAU”)

‐and‐

COMPANY NAME (hereafter referred to as the “HAULER”)

WHEREAS, Brazeau by statute is responsible for the control and management of certain public highways, roads, streets, lanes, alleys and bridges (hereinafter referred to as “BRAZEAU ROADWAYS” within Brazeau and the Hauler has applied to Brazeau for permission to haul certain goods and materials of the Brazeau Roadways; and

WHEREAS, the Hauler is intending to commence and/or continue a ______operation located at ______, that will involve hauling of materials or movement of heavy trucks on Brazeau Roadways; and

WHEREAS, Brazeau is prepared to permit the Hauler to haul the goods and materials requested by the Hauler on the Brazeau Roadways, for as long as the terms are adhered to and subject to the conditions hereinafter set forth;

NOW THEREFORE THIS AGREEMENT WITNESSTH that, in consideration of Brazeau permitting the Hauler to haul certain goods and materials, as specified in Schedule “A” hereto attached, over the Brazeau Roadways during the period of ___ year Brazeau and the Hauler agree as follows:

1. The Hauler agrees to indemnify and save harmless Brazeau from and against any claims, demands and actions for loss, injury or damage of any kind, which may be suffered by any party arising out of the use of the Brazeau Roadways by the Hauler, its agents, servants, employees, contractors and subcontractors.

2. Forthwith upon the execution of the Agreement by the Hauler and Brazeau, the Hauler shall supply Brazeau with security in the amount as may be specified on Schedule “B” hereto attached to ensure compliance by the Hauler with each of the terms, covenants and conditions of the Agreement to be performed or carried out by the Hauler. The security to be provided by the Hauler to Brazeau pursuant to this Agreement shall consist of a bond, cash, certified cheque or letters of credit issued by a Chartered Bank or Treasury Branch in the favor of Brazeau in such form

25 as may be required by Brazeau. 21 Conditions of RUA

3. The Hauler shall provide repairs to the road(s) as may be required upon request by the Municipality. The said repairs are to be completed within thirty‐six (36) hours of notification by the Municipality. Failing compliance with the request for the repairs, the Municipality may draw on all or part of the security to repair the road if required.

4. The Hauler, while operating within Brazeau, shall at all times comply with all relevant statutes, regulations, bylaws and resolutions, including without restricting the generality of the foregoing, all permits, licenses and approvals issued by Brazeau and the directions from time to time issued by Brazeau.

5. The Hauler shall at all times ensure that all servants, employees, agents, licensees and independent contractors hired or contracted by the Hauler abide by and comply with the terms and conditions of this Agreement and in the event that any of the Hauler’s servants, employees, agents, licensees and independent contractors shall fail to abide by the terms and conditions of the Agreement, Brazeau shall be entitled to utilize, implement or carry out any of the remedies hereinafter contained.

6. Brazeau reserves the right to impose load limits and enforce partial or total road bans on all or any part of the Brazeau Roadways. The Hauler shall comply with any load limit and total or partial road bans or restrictions so imposed by Brazeau. Brazeau reserves the sole right to refuse issuance of the said permit in its inherent discretion. Permits for all loads over the posted weight restricts can be obtained by contacting (780) 542‐7711 Public Works Department prior to moving.

7. The Hauler’s operation is intended to utilize various Brazeau Roadways from time to time in the normal course of the Hauler’s operation that shall herein after be referred to as “Destination Roads”. On specific Brazeau Roadways, the Hauler’s operation is channeled or condensed and these specific Brazeau Roadways are indicated in Schedule “C” hereto attached and shall hereinafter be referred to as the “Haul Route”.

8. All previous Dust Control Haul Routes compromised by the operations of the Hauler shall be chargeable to the Operator. Areas of the Haul Route on Brazeau Roadways that have been deemed dust control or stabilization shall be maintained, and all costs associated with the application and maintenance of said product may be charged to the Hauler at Brazeau County’s municipal cost plus gst tax.

9. The Hauler shall ensure that a water truck is available to dampen these portions of road prior to commencement of hauling and during the hauling procedure when hauling is being conducted at a rate of ten or more units per day.

10. The haul route will be maintained at the Hauler’s cost by a grader unit authorized by Brazeau on an as needed basis and shall be restored to a condition satisfactory to Brazeau at the completion of every workday.

22 Conditions of RUA 11. When required by Brazeau, temporary spot gravelling on severely damaged portions of the haul route will be administered, throughout the overall hauling period from a particular site. The Hauler shall also regravel and restore all designated haul roads upon completion of construction.

12. Scheduled bus times and routes shall be monitored to ensure that dust control and surface conditions are in as safe and reasonable a condition during these scheduled bus times.

13. The Hauler agrees to repair and rectify damage to destination roads that result from the Hauler’s use of the destination roads. The Hauler also agrees to apply for a multiple load permit (MLP) when six (6) or more loads per site per day will be hauled on the same section of destination roads. The Hauler also agrees to be responsible for the application of dust control agents, as required, on Brazeau Roadways that may be required as a result of the Hauler’s use of the Brazeau Roadways.

14. In the event that the Hauler shall fail to comply with any of the terms and conditions of this Agreement to be performed and carried out by the Hauler pursuant to this Agreement, Brazeau shall be at liberty to serve a notice upon the Hauler requiring the Hauler to cease hauling and upon the service of such notice by Brazeau to the Hauler, the Hauler shall cease all hauling activities within Brazeau and the Hauler’s rights under any permit or license issued by Brazeau to haul goods and materials within Brazeau on Brazeau Roadways shall be suspended. Lifting on such suspension shall be at the sole discretion of Brazeau.

15. This Agreement shall not be transferred or assigned by the Hauler without the consent in writing of Brazeau.

IN WITNESS WHEREOF, Brazeau and the Hauler have hereunto executed this Agreement as of the day and year first above written.

Additional Conditions for Gravel/Aggregate RUA:  The hours of operation for hauling on Brazeau roadways to and from the pit is Monday to Saturday from 7 a.m. to 7 p.m. No operations are to occur on Sundays or statutory holidays.  Special permission may be granted to the LOCAL contractors to operate on Sundays and statutory holidays. A separate pre- authorized permit of 6 or fewer loads can be obtained from the Brazeau County office or the Brazeau County on-call person. Hours of operation for the said permit(s) would be from 9 a.m. to 4 p.m.  The County reserves the right to institute a Community Aggregate Payment Levy as per the provisions of Alberta Municipal Government Act Regulation 263/2005, the Community Aggregate Payment Levy Regulation. Multi Load Permit (MLP) MLP is one of the conditions of the RUA and is obtained by calling PWI or providing the completed form upon request (as attached). MLP is required for >6 loads per day. There are standard set of conditions and based on existing ban order, road conditions, County provides alternate route details and issues the permit for a specific period for specific number of loads. MLP is key to RUA execution/implementation and provides better control over road use and maintenance. 30 26 31 27 Associated Permits – e.g. Multi Load Permit (MLP) & Miscellaneous Move (MM)

Miscellaneous Move (MM)  MM permit is issued to companies who are hauling/trucking/heavy load for 1 to 5x use of County roads. It’s obtained by calling PWI.  Issuance of MM is based on the current road ban order and road conditions. The County provides route details and issues the permit for a specific period for specific number of loads (up to 5).  MM is required for every overweight/capacity load.  The conditions of MM are defined based on the road conditions and obtain verbal agreement with the applicant.  Unlike other counties, there is no charge for issuance of MM. 32 28

1. TOPIC DEFINED

Executive Summary/Key Issue(s)/Concepts Defined:

Under Brazeau County's FIN-13 Council Electronics Policy councillors are provided with a County- purchased laptop to conduct council business during their term of office. At the October 26, 2017 orientation meeting, Administration presented Council with options for laptops or surface pros. At the meeting, some councillors expressed interest in purchasing their own laptops to use for council business and directed Administration to bring back more information to the November 23, budget meeting.

If Council chooses to allow for the purchase of personal laptops to be used for council business, there are several steps that our IT department will need to take to get the computers set up, as well as to ensure the security of the laptops.

Access to their Brazeau County e-mail is a necessity for councillors. In order to facilitate access to the Brazeau County e-mail system on personal laptops a copy of Office 2013 will need to be installed, which allows for the proper Outlook e-mail access. Brazeau County does not currently use Office 2016, because it has not been fully tested with our existing systems. Administration has confirmed that we have enough existing licenses to fulfill the requirement for councillor computers.

Until Office is installed on the laptops councillors may use the Brazeau webmail In order to access e-mail. In order to access the webmail councillors will need an internet connection and a current

In order to safeguard Brazeau County's digital data, all computers in the Brazeau County Administration office have a data protection antivirus and encryption solution installed through Dell. The IT department is currently working with Dell to find a solution to provide remote antivirus and encryption support to personal laptops used for council business. Until that solution is finalized and implemented, a temporary antivirus will need to be installed on all council laptops by our IT department to make sure it meets our requirements.

To ensure laptops are kept up-to-date and functioning to the best of their abilities the Brazeau County IT department will coordinate with councillors to have laptops brought into the office twice a month for antivirus, maintenance and Windows updates. The IT department will do its best to assist councillors with troubleshooting for problems with Office and Windows, but issues with computers not purchased by Brazeau County may not be able to be addressed in house if they are outside the expertise of staff. Additionally, any problems with the laptop itself will need to be handled by the councillor under the manufacturer's warranty that came at the time of purchase, or at the point of purchase.

If Council chooses to allow for the purchase of personal laptops for council use, Administration will update FIN-13 Council Electronics Policy and bring it back to Council for review early in 2018.

b. Council rejects the request as - Council chooses to purchase their own electronic submitted devices. - Councillors are provided a one-time allowance for the purchase of computer hardware and software.

3. IMPLICATIONS OF RECOMMENDATIONS

Organizational:

Administration will update the FIN-13 Council Electronics Policy and bring it back to Council for review.

Laptops will be purchased, if required. If Council chooses to purchase their own laptops/tablets, Council would need to determine the allowance that would be provided to each councillor. Administration will set up a schedule for installation of necessary antivirus, as well as a twice­ monthly maintenance schedule for regular updates.

Financial:

The Brazeau County purchase of laptops for councillors is included in the approved 2017 budget in the amount of $15,400. If Council chooses to purchase their own laptops/tablets, Council would need to determine the allowance amount that would be provided to councillors for the purchase of hardware and the necessary software. Administration is waiting on an estimate for the purchase and maintenance of remote antivirus and encryptions support that is necessary to ensure the security of Brazeau County information.

Policy Statement

Brazeau County recognizes that Council members, in the performance of their duties, require access to electronic information and to communicate with each other, residents, stakeholders, and County staff in a timely and efficient manner. In support of this, Brazeau County shall provide each Council member with a computer and email resources during their term of office.

This Policy establishes guidelines for the provision and use of computers (i.e. personal computers, laptops, tablets, etc.) and email resources for Council members.

Definitions

"Computer" means a personal or desktop computer, laptop, tablet or other such electronic device as provided by the County to a Councillor in order to conduct the business of the County. The type or nature of the computer shall be determined at the sole discretion of the Chief Administrative Officer, unless otherwise dictated by Council policy or resolution.

"Council" means the body of elected officials serving on Brazeau County Council.

"Councillor" means a sitting elected official serving on Brazeau County Council.

"County" means the municipal or corporate entity known as Brazeau County.

"Chief Administrative Officer" means the individual appointed to the position of Chief Administrative Officer by County Council; or the designate of the Chief Administrative Officer; or the department.

"Email Resources" means email address and access as provided by the County.

Policy Guidelines/Principles:

1. Upon being elected, Council members shall be provi^d with a computer and a Brazeau Countyemail address, subject to their signed'^^<5Kp<5wledgement of the terms and conditions of this Policy.

The County provides a communication allowance under the Council-1 Policy to cover the cost of internet services.

3. Brazeau County staff shall be responsible for:

a. Selecting the computer and associated software; b. Setting up the computer and email service; and c. Providing technical support for issues with the computer, installed software or email service that are directly related to County business.

4. Upon request, Council members shall make the computer available to Brazeau County staff for regular maintenance, software installation and updates, etc.

5. The loss or damage of a computer shall be reported immediately to the Chief Administrative Officer.

6. Council members may use the computer and email resources for personal use provided that such use does not result in increased costs to the County and complies with this Policy.

7. Brazeau County shall not be responsible for the loss or corruption of personal information contained on a Councillors computer.

8. Acceptable computer and email use and activities by Councillors are those that conform to Brazeau County's purpose and vision, and shall:

a. Respect and uphold the law, including provincial and federal laws and regulations and the laws of other jurisdictions; b. Comply with the County's stated policies, procedures and standards; c. Be used responsibly and for the uses for which they were intended; d. Be courteous and follow accepted standards of etiquette; and e. Protect others privacy and confidentiality

9. Brazeau County shall not be held liable for Council member's unauthorized, inappropriate or illegal use of the County's computer, installed software and email

resources.

10. Upon expiry of their term of office. Council members si^^ll discontinue using the County's email resources; and shall be provided tf>eopp(5rtunity to purchase the computer provided by the County.

Subject to availability, as determined by the Chief Administrative Officer, Councillors may purchase the computer at any time during their term or, if they are no longer a sitting Councillor, during their first month following completion of their term, for the computer's residual value determined as follov^ing:

a. During year one (1): Full purchase price including costs of upgrades if any b. During year two (2): 40% depreciation from purchase price c. During year three (3): 70% depreciation from purchase price d. Subsequent to year three (3): 90% depreciation from purchase price.

12. All Councillors are required to sign the Acknowledgement provided in Schedule A prior to being provided with computer or other approved services outlined in this Policy.

UPDATE On September 19, 2017 Council directed Administration to table the Hannl Off-site INFORMATION: Levy Bylaw 265-96 review to the November 23, 2017 budget meeting. Council also directed Administration to delay the public consultation scheduled for October 2017 until after the 2017 municipal election.

What is an Off-site Levy? It is one of the several financing sources municipalities use to recover capital costs incurred for infrastructure improvements required to support new development or growth. Off-site levies are charges developers pay to help with the cost of eligible off-site infrastructure which includes new or expanded roads, storm water infrastructure, sewer, water and associated lands for each, as outlined in Alberta legislation.

What is Eligible for an Off-site Levy? An off-site levy helps pay for roads and municipal utility systems required outside or "off" the site of development or subdivision to serve that development. Off-site levies can only be used to pay for new infrastructure or the expansion of existing infrastructure required because of development. It includes the following categories: • New or expanded facilities for the storage, transmission, treatment or supply of water; • New or expanded facilities for the treatment, movement or disposal of sanitary sewage; • New or expanded storm drainage facilities; • New or expanded roads required for or impacted by a subdivision or development; and • Land required for or in connection with any of the above described facilities.

Brazeau County — Report to Council — Off-site Levy Bylaw Update Page 1 of 3 47 The Hamlet Off-site Levy Bylaw review would directly impact the following hamlets: Rocky Rapids, Buck Creek, Cynthia, Lodgepole and Violet Grove. Public consultation has not been held with these communities to date. If Council decides to continue the Hamlet Off-site Levy Bylaw review, Administration would conduct public consultation with each of these communities to go over the impacts and talk to the residents about how this affects them. Attached to this report are the materials Administration would distribute to each community to receive feedback at a scheduled public open house. The Hamlet Off-site Levy Bylaw review includes infrastructure investments made by the County in each hamlet community since 1996. In some hamlets, there have been significant investments by the County for new or expanded water treatment plants, sewage lagoons, or new water and sewer lines. These investments have either already occurred (e.g. new water treatment plant in Rocky Rapids) or are within the approved 10 year capital budget. These additional investments result in higher off-site levies in some hamlets. Below are examples of development in each hamlet and the corresponding off-site levies under the current bylaw and under the expected new bylaw.lt is important to note these numbers may change depending on methodology to· calculate off-site levies, benefitting area, etc. Rocky Rapids Under the current bylaw, a development such as Twin Ravines with 468 proposed dwelling units would result in an off-site levy of $146,250 for water and $292,500 for sewer. Under the expected new bylaw the off-site levy would be $2,416,352 for water and $879,372 for sewer. Lodgepole Under the current bylaw, a manufactured home would result in an off-site levy of $500. Under the expected new bylaw the off-site levy would be $924 for sewer and there are no municipal water services in Lodgepole. Cynthia Under the current bylaw, a 50 seat Restaurant/Saloon would result in an off-site levy of $10,452.50 for sewer and a flat rate of $1,000 for water. Under the expected new bylaw the off-site levy would be $9,548.50 and a flat rate of $8,642.58 for water. Buck Creek Since there have been no infrastructure investments in Buck Creek since 1996, the offsite levy would remain the same. For a manufactured home it would result in an off-site levy of $417 for sewer and there are no municipal water services in Buck Creek. Violet Grove Since there have been no infrastructure investments in Violet Grove since 1996, the offsite levy would remain the same. For a manufactured home it would result in an off-site levy of $335 for sewer and there are no municipal water services in Violet Grove.

You are receiving this letter to notify you of a potential update to the Hamlet Off-site Levy Bylaw 265-96 for Buck Creek. At this time, Council has not passed a new Bylaw and the purpose of this open house is to talk with Hamlet residents about off-site levies and potential changes to the off­ site levy bylaw.

An off-site levy charges properties benefitting from water and sewer infrastructure built by the County. The current Off-site Levy Bylaw came into effect in 1995 and only charges for water and sewer infrastructure built earlier than 1995. In some Hamlets, the County has made improvements to water and sewer services since 1995. The purpose of the new Off-site Levy Bylaw is to recover a portion of these costs which have expanded/improved this service and not been offset by Grants or previous levy payments.

The current off-site levy for a house in Buck Creek is: $417 for sewer and currently the hamlet does not have municipal water.

Council has requested Administration to meet with landowners from each Hamlet affected by an update to the Off-site Levy Bylaw. The map on the following page shows which properties have already paid the off-site levy and which properties have not. If your property is shown in green, you will not be affected since off-site levies can only be taken once and have been paid. If your property is blue or red you are encouraged to come out to the public consultations in October since off-site levies have not been paid on your property. You are only required to pay off-site levies at the time of development or subdivision. The open house for Buck Creek will take place as follows:

Date: Tuesday, October 3, 2017 Time: 4:00pm- 7:00 pm location: Buck Creek Hall {5302 50 Ave, Buck Creek)

UPDATE Council on November 7 th, 2017 adopted motion 1256/ 7 "Moved INFORMATION: Gressler that we request Administration to look into p of garbage collection of some sort for whatever areas for Brazeau County."

Since Council meeting November 7th , 2017 Administration has reached out to Enviro-Pak who undertakes curbside garbage collection for the Town of Drayton Valley. The initial response from Enviro-Pak suggest that on a case by case bases the charge per month per household could be in the order of $25 - $30. This amount includes supply of one garbage bin per household. Administration will complete a full scope of County wide garbage collection cost estimate by November 23r d, 2017.

Administration respectfully request Council's consideration of the County wide garbage collection options to be discussed during budget deliberations on November 28t h or 29t h, 2017.

UPDATE Council on November 7th , 2017 adopted motion 1326/17 " INFORMATION: Wheale to direct Administration to develop a cost estimate to retrofit the old public works shop for November 23, 2017 considering the Agricultural Society activities requested during their presentation November 7, 2017."

On November 14t h, 2017 Administration in conjunction with the Agricultural Society conducted an onsite review of the building's suitability and adaptability for the potential use by the Agricultural Society.

Administration respectfully requests that Council afford Administration the opportunity to compile a complete scope and cost estimate between November 16th and 22 nd , 2017 for Council's consideration on November 28th or 29th, 2017 budget discussions.
