Terms & Conditions for Procurement of raw materials of Cattle feed by Cooperative Milk Producers’ Union Ltd. through N CDFI eMarket

Banas Dairy invites bids for eAuctions floated through NCDFI eMarket for procurement of cattle feed ingredients as per the details given below. Bidders, who are interested to participate in the eAuctions are requested to offer their competitive rate as per the requirement provided by Banaskantha District Cooperative Milk Producers’ Union Ltd (Banas Dairy).

G eneral Conditions 1. The price quoted should be on FOR Cattle Feed Plant, & Cattle Feed Plant, Katarwa (Approx Distance from Deesa to Katarva is 25 KM) 2. Banas Dairy reserves the right to accept or reject any bid or to annul the bidding process and reject all bids, at any time prior to award of contract without assigning any reason whatsoever and without thereby incurring any liability to the affected bidder or bidders on the grounds for the Buyer’s action. 3. The bid should be valid for 2 working days from the date of e Auction. 4. The bidders are required to deposit EMD @ 2% of trade value into their respective NCDFI eMarket Escrow account provided to be eligible to participate in the eAuction. 5. The EMD of the unsuccessful bidders will be released within one working day after the eAuction. 6. The EMD of the successful bidder will be released after deduction of applicable transaction charges (0.4% of trade value exclusive GST) on completion of supply by the bidder and receipt of intimation of the same from the buyer. 7. In case of non-execution of the order by the supplier, the EMD will be forfeited and transferred to Banas Dairy by NCDFI eMarket after deducting applicable transaction charges. 8. The concluded prices are on FOR basis, inclusive of all taxes/duties and transportation up to respective Cattle Feed Plant (Net Weight) and are not subject to any conditions whatsoever. This is including unloading charges.

T erms and Conditions for Bidding 1. The bidding system is an internet platform. The site can be accessed through www.ncdfiemarket.com maintained by National Cooperative Dairy Federation of Ltd (NCDFI) which will be the venue for online bid submission. 2. All the registered members of the NCDFI eMarket, on deposit of EMD, are eligible to participate in the bidding. 3. Prior intimation regarding the eAuction will be given to all the registered members by email / WhatsApp alerts/ notifications at the Mobile app. Banas Dairy will not be responsible for any delay in communication in this regard on account of external reasons and therefore vendors are requested to visit the specific website periodically. The NCDFI eMarket mobile application can be downloaded by any member (Android version) which can be accessed in the Google Play Store. 4. The item specified for the procurement is as per the specification set by Banas Dairy. Any doubts in this regard have to be clarified prior to the submission of offer. No dispute after the finalization of bid will be entertained. The Bid Quantity will be fixed by Banas Dairy and bidders need to quote for entire quantity. 5. Anticipated delivery schedule has been mentioned against each item. The bidders should provide their offers keeping the same in their mind. However, finalization of delivery schedule is of the discretion of Banas Dairy depending upon the situation and offer. 6. ‘Location’ mentioned in the bid template is the Plant Location i.e.,

All information should be as per standards of Weights & Measures Act, 1976 & the Standards of Weights & Measures (Packaged Commodities) Rules, 1977 and Food Safety & Standards Act, 2006 and Regulations thereunder.

Goods should be packed in sound / second hand gunny bags, if found any damaged/teared bag used to packing the material, we will deduct Rs. 10/Bag for Gunny Bags & Rs.4/Bag for plastic Bags from your payment.

F orce Majeure:

Should any of the force majeure circumstances, namely act of God, natural calamity, fire, Government of India Policy, restrictions (excluding any stock limits), strikes or lock-outs by workmen, war, military operations of any nature and blockades preventing the Supplier/Buyer from wholly or partially carrying out their contractual obligations, the period stipulated for the performance of the Contract Shall be extended for as long as these circumstances prevail, provided that, in the event of these circumstances continuing for more than three months, either party shall have the right to refuse to fulfill its contractual obligations without title to indemnification of any losses it may thereby sustain. The party unable to carry out its contractual obligations shall immediately advise the other party of the commencement and the termination of the circumstances preventing the performance of the contract. A certificate issued by the respective Chamber of Commerce shall be sufficient proof of the existence and duration of such circumstances. J urisdiction: In case of any dispute arising out of this contract, jurisdiction will be the head quarter of ordering Unions.
