The Council of the Borough of Harrow, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by Sections 6, 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984(a), as amended by the Local Government Act 1985(b) and all other enabling powers hereby make the following order.

1. This order shall come into operation on 1 March 2021 and may be cited as The Harrow (Bus Priority) (Amendment No. 3) Traffic Order 2021.

2. In this Order, the expression “enactment” means any enactment, whether public, general or local, and includes any order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment and any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.

3. Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into effect of this order The Harrow (Bus Priority) Traffic Order 2016(c) shall have effect as though the item in Schedule 1 to that Order numbered 2 there were substituted the items similarly numbered and set out in columns 1, 2, 3, 4 and 5 to this Order.

The Council of the London Borough of Harrow, after consulting the Commissioner of Police for the Metropolis, in exercise of the powers conferred by Sections 6, 7, 124, and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984(a), as amended by the Local Government Act 1985(b), and of all other powers thereunto enabling, hereby make the following order:-

1. This order shall come into operation on 1 March 2021 and may be cited as The Harrow (Waiting and Loading Restriction) (Amendment No. 107) Traffic Order 2021.

2. 1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Harrow on 22 February 2021 made the above mentioned Orders under Section 6, 124 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985 and all other enabling powers.

2. The general effect of the Bus Priority Order would be to extend the existing bus lane in High Road, Harrow Weald, from its junction with the access road adjacent to 350 High Road to its junction with Alma Row. The times of operation will be 7am-10am and 4pm- 7pm, Monday to Saturday.

3. The general effect of the Waiting and Loading Order would be to impose at any time loading restrictions on the east side of High Road, Harrow Weald, between the southern kerb-line of the access road to the car park of 354 High Road, Harrow Weald, and the northern kerb-line of the southern access road to the car park of 350-352 High Road, Harrow Weald.

4. A copy of the Orders, which will come into operation on 1 March 2021, a map of the relevant area and of relevant previous Orders can be inspected until the end of six weeks from the date on which the Orders were made at www.harrow.gov.uk/trafficorders.

5. Persons desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.

The Harrow (Bus Priority) Traffic Order 2016

The Council of the London Borough of Harrow, after consulting the Commissioner of Police for the Metropolis, in exercise of the powers conferred by section 6, 7, 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984(a), as amended by the Local Government Act 1985(b), and of all other powers thereunto enabling, hereby make the following order:-

Commencement and citation

1. This order may be cited as the The Harrow (Bus Priority) Traffic Order 2016 and shall come into operation on 18th July 2016.

Interpretation

2. In this order-

(1) A reference to an article or schedule followed by a number is a reference to the article of, or schedule to this order so numbered.

(2) “causing” includes permitting.

(3) in this order the following expressions shall have the meanings hereby respectively assigned to them :-

“bus”, “buses”, “local bus”, “pedal cycle”, “taxi” and “traffic lane” have the same meanings as given in the Traffic Signs Regulations and General Directions 2016 (c);

“bus lane” means a traffic lane on a length of road which is specified in column 2 of the table in Schedule 1, in respect of which traffic signs are in place indicating the controls specified by this order;

“bus only route” means an area of road which is specified in column 2 of the table in Schedule 2, in respect of which traffic signs are in place indicating the controls specified by this order;

“carriageway” has the same meaning as section 329(1) of the Highways Act 1980 (d);

“dial-a-ride bus” means a vehicle displaying so as to be conspicuous on the outside of the vehicle a logo in a form approved by Transport for London or with the authority of the Council, and which is constructed or adapted for the carriage of disabled person’s and their companions which is being used to provide a service for the carriage of such persons.

“times of operation” means;

(i) in relation to a bus lane item specified in the table in Schedule 1, the times specified in column 3 of that item; (ii) in relation to a bus-only route item specified in the table in Schedule 2, the times specified in column 3 of that item.

“vehicle” includes part of a vehicle.

Bus Priority Controls

3. (1) Except as provided in Articles 4 and 5, no person shall cause a vehicle to be in a bus lane in a length of road specified in an item in column 2 of the table in Schedule 1 during the times specified in that item in column 3 of that item unless that vehicle is proceeding in the direction specified in column 4 of that item and is of a type specified in column 5 of that item.

(2) Except as provided in Article 5, no person shall cause a vehicle to be in a bus-only route in an area of road specified in an item in column 2 of the table in Schedule 2 during the times specified in column 3 of that item unless that vehicle is proceeding in the direction or directions specified in column 4 of that item and is of a type specified in column 5 of that item.

Exemptions - Bus Lanes

4. (1) The controls specified in Article 3(1) shall not apply so as to prevent a vehicle being in a bus lane if and for as long as necessary:-

(a) to enable a person to board or alight the vehicle; or

(b) to enable goods to be loaded on to or unloaded from the vehicle, providing the activity is not prohibited by the provisions of any other order.

(2) The controls specified in Article 3(1) do not apply in respect of a vehicle which is being used for a purpose which is within an exemption to a restriction or prohibition imposed by any other order or which is permitted by any other order.

(3) The controls specified in Article 3(1) do not apply in respect of a vehicle crossing a bus lane to get to or from a road adjacent to the bus lane or any vehicular access to premises adjacent to the bus lane.

5. (1) The controls specified in Articles 3(1) and 3(2) shall not apply so as to prevent a vehicle being in a bus lane or a bus-only route if the vehicle is being used whilst in that bus lane or bus only route for the purposes of:-

(a) collecting refuse from properties or locations adjacent the bus lane;

(b) statutory duties whilst collecting or delivering letters or mail whilst visiting an address adjacent the bus lane or bus only route;

(c) the removal of any obstruction to traffic from within or adjacent the bus lane or a bus-only route;

(d) the maintenance, improvement or reconstruction of any road or footway adjacent the bus lane or a bus-only route;

(e) the maintenance, improvement or construction of any street furniture including bus stop infrastructure, adjacent the bus lane or a bus-only route;

(f) any building operation or demolition at properties or locations adjacent the bus lane;

(g) the erection, alteration or repair in or near the bus lane or bus only route of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunications apparatus as defined in paragraph 1(1) of Schedule 2 of the Telecommunications Act 1984 (e) if the vehicle cannot be used for that purpose without being in the bus lane or the bus-only route and in so far as the activity is not prohibited by the provisions of any other order.

(2) The controls specified in Article 3(1) and 3(2) shall not apply, in respect of a vehicle being in a bus lane or bus-only route:-

(a) so as to avoid an accident;

(b) to allow a person to get or give help in consequence of an accident or emergency or otherwise take action for public safety;

(c) to such an extent and for such a time as is needed to comply with any requirement resulting from highway works in any part of the road, or road adjoining the bus lane or bus-only route;

(d) if it is being used for ambulance, fire brigade or police purposes.

(3) The controls specified in Articles 3(1) and 3(2) do not apply in respect of anything done with the permission or at the direction of a police constable in uniform or a traffic warden.

The Council of the London Borough of Harrow, after consulting the Commissioner of Police for the Metropolis, in exercise of the powers conferred by Sections 6, 7, 124, and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984(a), as amended by the Local Government Act 1985(b), and of all other powers thereunto enabling, hereby make the following order.

Interpretation

3. (1) In this order, except where the context otherwise requires:-

“the Council” means the Council of the London Borough of Harrow.

“disabled person's badge” has the same meaning as in The Disabled Persons (Badge for Motor Vehicles) (England) Regulations 2000(c).

"enactment" means any enactment, whether public general or local, and includes any order, bylaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment.

"goods" means goods of any kind whether animate or inanimate and includes postal packets of any description, whilst "delivering” and "collecting" in relation to any goods includes checking the goods for the purpose of their delivery or collection.

"hackney carriage" means a hackney carriage in respect of which there is in force a licence granted under section 6 of the Metropolitan Public Carriage Act 1869(d).

"kerb-line" means an imaginary line which is the projection of the line formed by the edge of the carriageway.

“mechanically propelled vehicle” means a vehicle not to be treated as a motor vehicle having the same meaning as given by Section 140 of The Road Traffic Regulation Act 1984.

“parking place” means any length of highway within the London Borough of Harrow designated as a parking place by an order made under Section 6 or 45 of the Road Traffic Regulation Act 1984, that may contain within that parking place, any number of parking spaces.

“parking space” means an area of highway within the London Borough of Harrow that is within a length of carriageway designated or described as a parking place by an order made under Section 6 or 45 of the Road Traffic Regulation Act 1984, and, bound by traffic sign diagram 1028.4 or 1032 of the Traffic Signs Regulations and General Directions 2002.

"prescribed hours" in relation to a restricted street specified in Schedule 1, means the time specified in column 2 of Schedule 3 that relates to the letter set out in column 1 of that Schedule, which corresponds respectively with the letter set out in column 3 of Schedule 1 for that restricted street. Prescribed hours in Schedule 3 that fall on a public Bank Holiday shall apply on that public Bank Holiday.

"restricted hours" in relation to a street specified in Schedule 2, means the time specified in column 2 of Schedule 3 that relates to the number set out in column 3 of that Schedule, which corresponds respectively with the number set out in column 3 of Schedule 2. Restricted hours in Schedule 3 that fall on a public Bank Holiday shall apply on that public Bank Holiday.

"restricted street" means any extent of street within the London Borough of Harrow specified in Schedule 1 and Schedule 2, but excluding any extent which falls within any parking space that is located within a parking place designated by any order made or having effect as if made under Section 6 or Section 45 of the Road Traffic Regulation Act 1984.

"Schedule" means a Schedule to this order.

"street" includes any part of a street.

“electronic communication network” has the same meaning as in the Communications Act 2003 (e).

(2) For the purpose of this order a vehicle shall be deemed to wait;

(a) in a restricted street if any point in that restricted street is below the vehicle or its load (if any) and the vehicle is stationary; or,

(b) for more than a specified period in the same place in a restricted street if any one point in that restricted street is below the vehicle or its load (if any) throughout a period exceeding the specified period whether or not the vehicle is moved during that period.

(3) Any reference in this order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.

(4) Any reference in this order to a length of street shall, unless otherwise specified, be construed as a reference to the whole width of that length of street.

4. The restrictions, prohibitions and requirements imposed by this order are in addition to and not in derogation of any restriction, prohibition or requirement imposed by any other enactment. Any exceptions or exemptions are subject to the provisions set out in Part III and Part IV of this order.

PART II

RESTRICTIONS

Restrictions applicable to streets specified in Schedule 1 and Schedule 2

5. (1) No person shall cause or permit any vehicle to wait during the prescribed hours in any restricted street, except for so long as may be necessary for the purpose of delivering or collecting goods, or loading or unloading the vehicle at premises adjacent to the street, providing the duration of such activity does exceed 40 minutes.

(2) No person shall cause or permit any vehicle to wait for the purpose of delivering or collecting goods or loading or unloading a vehicle in a restricted street specified in Schedule 2 during the restricted hours.

PART III

EXCEPTIONS AND EXEMPTIONS FROM RESTRICTIONS

Persons boarding or alighting from vehicles

6. (1) Nothing in Article 5 of this order shall render it unlawful to cause or permit a vehicle to wait in a restricted street during the prescribed hours for so long as may be necessary for the purpose of enabling any person to board or alight from the vehicle, or to load or unload their personal luggage;

(2) except where the said person is suffering from any disability or injury which seriously impairs their ability to walk, or is blind or visually impaired, no vehicle shall wait in the same place for a period exceeding two minutes during the prescribed hours in that restricted street.

Excepted vehicles

7. The restrictions imposed by Part II of this order shall not apply in relation to the following vehicles, that is to say:-

(a) a mechanically propelled vehicle controlled by a pedestrian;

(b) public service vehicles operated by or on behalf of Transport for London, any subsidiary body of theirs, or any operator providing a public bus service within the London Borough of Harrow, whilst waiting at an authorised stopping place or at a terminal or turning point; (c) vehicles when used for fire brigade, ambulance or police purposes;

(d) vehicles when used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such powers or the performance of such duties for the vehicle to wait in the place in which it is waiting;

(e) hackney carriages whilst waiting upon any duly authorised cab rank;

(f) vehicles whilst waiting in any restricted street for so long as may be necessary in connection with the taking in of petrol, oil, water or air, if such taking in cannot be effected unless the vehicle waits in the place where it is waiting.

Furniture removals and other exceptional loading or unloading

8. (1) Nothing in Article 5 of this order shall apply so as to restrict the loading or unloading of any vehicle while the vehicle is in actual use in any street in connection with the removal of furniture to or from one office, dwelling house or any repository adjacent to that restricted street from or to another office, dwelling house or depository;

(2) Without prejudice to the provisions of the last foregoing paragraph, nothing in Article 5 of this order shall apply so as to restrict the loading or unloading of any vehicle while the vehicle is in actual use in any restricted street in connection with the collection or delivery of goods from or to premises in or adjacent to that street if those goods cannot reasonably be loaded outside the restricted hours or within the time (if any) allowed in relation to that street, as the case may be, if notice is given twenty-four hours in advance to the Council, their consent is obtained, and such reasonable conditions they may impose are complied with and met.

Exemption for disabled badge holders

9. Not withstanding the foregoing provisions of this order, a disabled person's vehicle which lawfully displays in the relevant position a disabled person’s badge issued by any local authority, may be left in a restricted street during prescribed hours, but not during restricted hours.

Miscellaneous exemptions

10. (1) Nothing in Part II of this order shall render it unlawful to cause or permit a vehicle to wait in any restricted street:-

(a) while postal packets addressed to premises adjacent to any such street in which the vehicle is waiting are being unloaded from the vehicle or, having been unloaded, are being delivered;

(b) while postal packets are being collected for loading on the vehicle from premises or posting boxes in or adjacent to any such street in which the vehicle is waiting or, having been so collected, are being loaded thereon;

(c) while the vehicle is being used in connection with any building operation, demolition or excavation in or adjacent to any such street, the removal of any obstruction to traffic in any street, the maintenance, improvement, reconstruction, cleansing or lighting of any street, the laying, erection, alteration or repair in or adjacent to any street of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any electronic communication network, or the placing, maintenance or removal of any traffic sign, or legal statutory duties such as the erection or removal of notices, if the vehicle cannot conveniently and lawfully be used for that purpose in any street not being a restricted street or outside the prescribed hours;

(d) while any gate or other barrier at the entrance to premises, to which the vehicle requires access or from which it has emerged is being opened or closed, if it is not reasonably practicable for the vehicle to wait in any other place while such gate or barrier is being opened or closed;

(e) where the person in control of the vehicle is required by law to stop, or is obliged to do so in order to avoid an accident.

(2) Nothing in Part II of this order shall apply to anything done on the direction of a police constable in uniform or with the permission of a parking attendant.

(3) Nothing in Part II of this order shall render it unlawful for a person who is licensed by the Council of the London Borough of Harrow to sell goods from a stationary vehicle on a pitch in any restricted street to cause or permit a vehicle to wait on that pitch for that purpose.

PART IV

ADDITIONAL PROVISIONS

Duty to move on

11. Notwithstanding any exception or exemption contained in this order, the person in control of a vehicle waiting during the prescribed hours in any restricted street shall move the vehicle on the instructions of a parking attendant or police constable in uniform whenever such moving may be reasonably necessary for the purpose of preventing or removing obstruction.

Restrictions on methods of loading or unloading vehicles

12. (1) No person shall cause any goods to be loaded onto or unloaded from any vehicle in any street in the London Borough of Harrow otherwise than in accordance with the following conditions, that is to say -

(a) no such goods shall be deposited on any carriageway or footway except on the carriageway immediately at the rear of the vehicle and no goods shall remain on any carriageway before the arrival of or after the departure of the vehicle;

(b) no part of any rope, chain, wire, apparatus or machinery used in connection with such loading or unloading, and no load suspended from a vehicle shall be less than 4.88 metres above a carriageway, except when over any vehicle being loaded or unloaded or less than 2.74 meters above the footway;

(c) no such goods shall be passed from hand to hand across any part of any carriageway or footway;

Provided that nothing in this Article shall apply in relation to:- (i) any vehicle specified in sub-paragraph (c) or sub-paragraph (d) of Article 7 of this order or any vehicle while it is being used as mentioned in paragraph (1)(c) of Article 9 of this order; or

(ii) anything done at the direction of a police constable in uniform or with the permission of a Civil Enforcement Officer.

(2) Nothing in sub-paragraph (1)(b) of this Article shall apply to any pipe, apparatus or machinery being used in connection with the loading of any petrol, water, oil or liquid fuel onto or from any vehicle in any street or from any premises adjacent to any street, provided that all necessary means are taken to give adequate warning of any possible obstruction.

Restriction on street trading

13. No person shall, on any day other than a Sunday, sell, offer or expose for sale goods from a vehicle which is in any restricted street unless:-

(a) that person is licensed by the Council of the London Borough of Harrow to sell goods from a stationary vehicle on a pitch in that street and sells goods from that pitch; or

(b) the goods are immediately delivered at or taken into premises adjacent to the vehicle from which sale is effected.

Restriction on advertising

14. No person shall, in any restricted street, either wholly or mainly for the purposes of advertisement, ride, drive, conduct, use or employ or cause to be ridden, driven, conducted, used or employed any animal or vehicle of any kind, or wear or cause to be worn any fancy dress or other costume.
