Empire Ballpark - Conditions of Entry Definitions • 'Ballpark' means Empire Ballpark • 'Event' means an event conducted at the Ballpark; whether it be a game or other event hosted by Heat; • 'Patron' means any person who enters the Ballpark at any time whatsoever, whether as the holder of a ticket or otherwise;

COVID-19 Conditions of Entry • By entering the Ballpark, Patrons acknowledge that there is a heightened risk of contracting COVID-19 and does not guarantee that it is or will remain a COVID-19 free area. The Patron assumes all risk for any loss or damage caused in this regard while in or around the Venue.

• By entering the Ballpark and providing the information, each Patron authorises Perth Heat or their representatives to collect and store a Patron's personal data, who may share it at any time with relevant authorities for the purpose of contact tracing.

• Patrons may be denied entry to, or removed from the Ballpark for any failure to comply with a direction or request from Perth Heat staff or relevant health authority, including but not limited to, additional health and temperature screenings or subsequent failure to meet satisfactory results from those screenings, or failure to adhere to any social distancing, hygiene practices or other processes, as deemed appropriate by the Manager or Hirer.

• Patrons acknowledge that by entering the Ballpark, they are not currently exhibiting any respiratory symptoms (including but not limited to a cough or shortness of breath) sort throat, fatigue, loss of smell or taste, a runny nose, muscle pain, joint pain, diarrhoea, nausea/vomiting or loss of appetite, or that during the past 14 days, they have not had close contact with a confirmed or probable case of COVID-19, or have lived in or travelled through a COVID-19 hotspot. If one or more symptoms are present, a Patron must not attend the Event or attempt to enter the Venue and should immediately seek medical advice in accordance with the directions of relevant health authorities.

In addition to the COVID-19 Conditions of Entry, entry to the Ballpark is subject to the following conditions:

1. Patrons entering the Ballpark must have a valid game ticket. All Patrons must have their ticket scanned at the entrance gate.

2. Any person entering or attempting to enter the Venue without prior authorisation or not in possession of a valid ticket to attend a event, will be liable for prosecution.

3. Tickets sold, purchased or used in breach of the terms and conditions of sale may be cancelled without refund or the ticket holder may be refused entry. If a Patron holds a ticket acquired in breach of the terms and conditions of sale, including being purchased at a premium or from an unauthorised point of sale, the Patron may be refused admission to the Venue. Patrons purchasing tickets via a third party seller (reseller) in excess of 10% of the face value of the ticket are liable for prosecution. Any issues with tickets purchased via a third party seller (reseller) must be referred to their original point of purchase.

4. A Patron holding a ticket purchased for a ticketed Event at a concessional price must produce their proof of age, or documentation justifying the concession, when the ticket is presented for use or entry.

5. Children 12 and under must be accompanied by a parent/guardian.

6. Patrons who have been issued with a complimentary carer’s ticket must collect the ticket from the Venue’s Ticket Box Office on the day of the Event. The holder of the Government issued Companion Card must be in attendance. The holder must present their Companion Card at the Box Office to receive the complimentary ticket.

7. The Patron must only occupy the seat specified on their ticket (Reserved Seating only).

8. The ticket holder assumes all risk and danger incidental to attendance at the event and the sport of baseball and all warm-ups, practices and competitions associated with baseball, whether such risk and danger occurs prior to, during or subsequent to any such warm-ups, practices and competitions associated with baseball, including specifically (but not exclusively) the danger of being injured by thrown bats, or fragments thereof, and thrown or batted balls, thrown, dropped, or launched items and projectiles, other hazards or distractions and any incidents or accidents associated with crowds of people, and agrees that none of the “ABL Entities” (as defined herein) shall be liable for injuries or loss of personal property resulting from any cause. The ABL Entities assume no responsibility for damage to or loss of any ticket holder vehicle or any contents contained therein. “ABL Entities” shall mean the Australian Baseball League Pty Ltd., the owners and lessees of the facilities in which the Game is played, and each of their respective parents, subsidiaries, affiliated or related companies, agents, players, officers, employees, owners, sponsors and licensees.

9. Perth Heat is responsible for all aspects of an Event. All complaints and claims arising out of or in connection with an Event, including but not limited to, admittance and seating at the Event, shall be directed to staff.

10. If under the legal drinking age, a Patron shall not attempt to purchase and/or consume any alcohol at the Venue. If of legal drinking age, the Patron shall not consume such quantity of alcohol which would be unlawful. As the Ballpark is a licensed premises: • Alcoholic beverages must not be taken from the Ballpark. • No external alcoholic beverages will be permitted entry to the Ballpark. • Intoxicated and/or disorderly persons will be refused entry or evicted from the Ballpark. • It is an offence for minors to purchase and/or consume alcohol. • It is an offence to purchase liquor for, or to supply liquor to a minor. • Persons supplying liquor to minors will be reported to Police. Penalties apply under relevant State legislation.

11. On occasions there will be a requirement for all drinks to be decanted. Patrons are advised that drink spillages could occur in which case the floor may become slippery.

12. Patrons required to show a valid identification (ID) as proof of identity must produce one of the following: • A valid Passport with a photograph • A valid Australian Drivers Licence • A valid State Proof of Age or Photo Card 13. Smoking is prohibited in all areas of the Ballpark. Smoking includes the use of electronic cigarettes and other electronic imitations or simulation devices. Patrons who fail to obey a direction from authorised person/s to cease smoking, may be immediately evicted from the Ballpark.

14. In absolute discretion, searches of Patrons for any items which are prohibited by law or prohibited by these Conditions of Entry will occur. Bag searches are also conducted by Security at the gate. Unless expressly authorised by Perth Heat, possession of the following items is prohibited at the Ballpark: • All professional cameras (those with detachable lenses or telephoto lenses); • Audio/visual recording devices; • Selfie sticks, monopods and tripods; • Drones or other remote controlled devices; • Broadcasting or transmission equipment; • All electronic tablets measuring greater than 170mm diagonally; • Cans, bottles (including glass or metal) and containers; • External/Commercial food and drink. Patrons are permitted to enter with a limit of one (1) sealed 600mL PET bottle of water, per person, except when there is a ‘Full Decant’ policy in place for any given Event; • Alcohol and e-cigarettes; • Illegal or illicit substances; • Chewing gum; • Liquids greater than 100ml (e.g. perfumes and aftershaves etc.); • Large spiked wrist or neck bands, spiked or studded belts; • Knives, weapons, scissors and chains; • Lasers and laser pointers; • Glo-sticks and other such illuminating objects; • Permanent marker or felt type pens; • Aerosol canisters; • Musical instruments including horns, trumpets, sirens or other noise making devices; • Banners, posters, flags or signs larger than larger than 1m by 1m; • Perth Heat has the right to review content and has the right to refuse lewd or offensive material of any items or clothing entering the Venue; • Fireworks or flares; • Motorbike helmets or any face coverings deemed inappropriate by Perth Heat; • Large umbrellas (such as golf umbrellas); • Bicycles, skateboards or skates; • Animals (excluding service animals); and • Any other item deemed by Perth Heat in its absolute discretion, to be inappropriate, illegal, unsafe or hazardous in any way. • Perth Heat reserves the right to, at any time; add items to the prohibited items list.

15. Patrons with any items found to be in breach of these Conditions of Entry may have the items confiscated, be given the option of securing the item themselves, or allowed to leave it with Perth Heat for collection after the event. All items checked will be subject to a security search prior to cloaking. Perth Heat will not be responsible for any items taken.

16. Patrons are responsible for their own personal possessions and must not leave bags or possessions unattended at any time.

17. All Patrons must wear appropriate attire for a public place at all times, including footwear. Any clothing with lewd or offensive writing, images or imprints may not be worn at the Ballpark. Perth Heat reserves the right to determine whether attire and footwear is appropriate to access the Ballpark.

18. A Patron shall not transmit or aid in transmitting any description, picture, account or reproduction of an Event without the authorisation of Perth Heat. If the Patron makes such a transmission, description, picture, account or reproduction of an Event which is subsequently confiscated by Perth Heat, it shall become the property of Perth Heat. Perth Heat may utilise the Patron’s image or likeness incidental to any photographic record, live or recorded video display or any other visual or audio transmission or reproduction in whole or in part of the Event.

19. Patrons voluntarily assume all risk of all damage and loss - including property damage, personal injury (fatal and non-fatal), economic and consequential loss - whatsoever and howsoever arising (including by negligence) at the Ballpark including damage or loss caused by the acts or omissions of other Patrons including employees of Perth Heat or any other person or thing present at the Ballpark. The movement of Patrons within the Ballpark and its surrounds will be subject to the monitoring by CCTV cameras, in combination with facial recognition technology.

20. Medical Conditions - If you have a medical condition that requires you to carry medication (i.e. Epi-Pens, insulin pens, syringes etc.) or if you have a medical insert such as a pacemaker, please let security personnel know upon arrival. The Ballpark has a Paramedic team on duty at every Event, should you require medical assistance or observe someone you believe requires medical assistance, please advise a Perth Heat team member immediately. The Venue has a duty of care to its Patrons and staff. Should any Patron require or receive medical treatment while at the Ballpark, it is imperative that the Patron take all reasonable steps to notify Perth Heat of the circumstances of the incident and the treatment required or received. Perth Heat will keep a record of all incidents and treatments, which will be handled confidentially and sensitively. At all times the overriding priority is the health and safety of all Ballpark staff and Patrons.

21. Patrons may not bring animals into the Ballpark other than an accredited assistance animal in the company of its registered owner. Accredited service animals must display a companion vest/lead for ease of identification.

22. Patrons of the Ballpark must not solicit, display, attempt to sell or distribute any goods or advertising, promotional or political materials (or similar) to any other person.

23. The distribution of leaflets, selling of any goods, merchandise tickets or collections at the Ballpark is prohibited without the appropriate license and the expressed permission of Perth Heat.

24. Perth Heat reserve the right to refuse admission to, or eject from, the Ballpark without compensation, any Patron whose conduct is, or is deemed by Perth Heat, to be prohibited, unlawful, dangerous, disorderly or offensive, or who is not entitled to attend that Event – including those who enter a restricted access area or other area of the Ballpark which is generally not accessible to the general public.

25. Perth Heat reserves the right, to add, withdraw or substitute Event participants, and to vary seating arrangements, audience capacity, venues or program times as it deems necessary, and Perth Heat’s exercise of this right shall not entitle the Patron to make any claim whatsoever against Perth Heat.

26. Perth Heat may cancel, delay, interrupt or stop the Event due to dangerous situations, adverse weather or any other causes beyond its reasonable control, and such cancellation, delay, interruption or stoppage of the Event shall not entitle the Patron to make any claim whatsoever against Perth Heat. Perth Heat will contact ticketholders of the cancelled event to arrange a credit towards another event of their choice.

27. No refunds or exchanges are offered except in accordance with applicable laws and where expressly stated on the ticket.

28. A Patron who breaches these Conditions of Entry may be denied access to or evicted from the Ballpark and/or be banned from attending future Events at the Ballpark. A Patron may be asked for identification for the purpose of enforcing these Conditions of Entry, including prosecution or other law enforcement purposes.

29. Spectators may keep any ball hit into the stands as a souvenir. However, fans must not go onto the field, throw objects onto the field or interfere with balls in play. Patrons must not enter other restricted areas without appropriate accreditation or approval from Perth Heat. These areas include players/umpire rooms or any other area deemed as restricted by Perth Heat. Violation will result in immediate ejection and/or arrest and prosecution.

30. Patrons acknowledge and accept that these Conditions of Entry may be amended at any time.

31. By entering into the Ballpark, a Patron consents to these Conditions of Entry.
