Background

The Electoral (Amendment) (Dáil Constituencies) Act 2017 (No. 39/2017) was signed into law by the President on 23rd December 2017 and provides for new Dáil constituencies, which will take effect at the next Irish general election for the 33rd Dáil. The next general election is due by 12 April 2021 at the latest, but may take place before then.

This Act replaced the Electoral (Amendment) (Dáil Constituencies) Act 2013, which defined the constituencies used for the 32nd Dáil (elected in 2016). The 2017 report of the Constituency Commission, an independent body established by the Government of Ireland to review constituency boundaries, proposed several changes to Dáil constituencies. The number of constituencies has been reduced by 1 to 39. It also increased the number of seats in the Dáil by 2 from 158 to 160. These changes were provided for by the Act.

In relation to Tipperary, The Constituency Commission Report 2017 recommended the creation of a "4 seat Limerick City constituency which should include some population from . The rest of county Tipperary (including the part of county Tipperary that is in the existing Offaly constituency) should form a 5 seat constituency." (Constituencies, 2017)

Appendix 1 of this document has a copy of the map (Map 15) and the text from the Constituency Commission Report 2017.

As a result of these recommendations 23 DED’s will move from the Offaly Constituency to the Tipperary Constituency and 3 DED’s will move from the Tipperary Constituency to the Limerick Constituency. These changes will come into effect on the dissolution of the current Dáil.

Furthermore, The Local Electoral Area Boundary Committee No. 1 Report 2018 recommended that Tipperary should be divided “into eight local electoral areas (LEA), to be formed around the towns of Nenagh, Newport, Thurles, and Templemore, Cashel and Tipperary, , Clonmel, and Carrick-on-Suir” (Report, 2018). Statutory Instrument No. 634 of 2018 and Statutory Instrument No. 156 of 2019 refer to County of Tipperary Local Electoral Areas and Municipal Districts Order bring these changes into statutory effect.

This Council has amended its polling register (iReg) to reflect the above changes and the purpose of this report is to show how these changes will affect the polling scheme.

The making of a new Polling scheme is a reserved function under Section 28 of the Electoral Act 1992 and it is recommended that the Council proceed with the making of a new scheme to reflect the changes arising from the above reports.

The following paragraph sets out the procedure to be following prior to making a new polling scheme.

a) A draft must be prepared and circulated, with a summary of any changes proposed, to each returning officer, local authority and member of Dáil Éireann, together with a statement that the Council making the scheme will consider any proposals for alterations which are notified to them within five weeks from the day on which the copy is sent. b) Give public notice in a newspaper of the preparation of the draft scheme and the specified place (one in each town in the county) where the Scheme may be inspected during normal office hours. c) The draft scheme will be available to any person on payment of a fee not exceeding reasonable cost of copying. d) When preparing the draft scheme regard must be given to the 1985 guidelines for the preparation of a polling scheme as follows:- i. No polling district should comprise parts of different constituencies or electoral areas. ii. A polling place must be a location not a building, normally a polling place should serve only one polling district and only one polling place may be appointed per polling district. The location of the polling station should be a recognised centre for the community activities and should have a school or other public building suitable for use as a polling station. In determining the distance which an elector might be reasonably expected to travel to the polling station, regard should be had to the distances normally travelled to school, shops, church or other recreation centres, regards should also be had to the availability of modern means of transportation. In rural areas 3 or 4 miles should not be regarded as excessive. iii. All polling districts should be of reasonable size: 700-1000 electors should be the general aim. Any polling district with less than 350 electors should be explained. iv. As far as possible polling districts in rural areas should comprise complete electoral divisions. v. In cases where the district electoral divisions are too small to form a polling district in their own right 2 or more electoral divisions should be brought together. Splitting of townlands should be avoided where possible. e) After the specified 5 week period the council shall consider any recommendation or proposals made to them. f) The scheme made by the authority shall come into operation on the date specified in the scheme. g) When the scheme has been made, the authority shall give public notice of the making of the scheme and the date it comes into operation.

6 h) Furnish a copy to the Minister and each returning officer, local authority and member of Dáil Éireann for each constituency to which the scheme relates. i) Keep a copy available for public inspection during office hours. j) Forward a copy of the scheme to each Municipal District who must keep a copy for public inspection. k) Furnish a copy to any individual requiring one for a reasonable fee.

Local Electoral Area Boundary Committee No. 1 Report 2018 The Local Electoral Area Boundary Committee No. 1 Report 2018 recommended that Tipperary should be divided “into eight local electoral areas (LEA), to be formed around the towns of Nenagh, Newport, Thurles, Roscrea and Templemore, Cashel and Tipperary, Cahir, Clonmel, and Carrick-on-Suir” (Report, 2018).

SI No. 634 of 2018 and SI No 156 of 2019 refer to County of Tipperary Local Electoral Areas and Municipal Order (Minister of State at the Department of Housing, 2018).

There is a change at municipal district level with the Cahir LEA moving from Clonmel borough district to Cashel-Tipperary municipal district. Table 2 below lists the LEA’s and the municipal districts. Map 2 shows the LEA’s with the new and old municipal districts.

Following visual analysis of the maps and reference to changes made to the polling register (iReg) Map 8 shows the proposed changes to the polling districts of Boher, Ballynahinch and Killoscully.

Ballynahinch polling district is split between the Tipperary Dáil Constituency and the Limerick City Dáil Constituency. The electors in Tipperary vote in Ballynahinch N.S. Booth 2 and electors in Limerick vote in Ballynahinch N.S. Booth 1. These changes are shown in map 9.

Newport Polling District The polling district of Newport is also divided between Tipperary and Limerick. There are 4 polling booths in Newport National School, but it is proposed is to increase this to 5 polling booths. Booth 1-3 is the purple area vote in Limerick and booth 4 the grey area vote in Tipperary. See map 10

Nenagh and Newport LEA The townlands of Rathfalla (25 electors) and Ballintoty (48 electors) in Nenagh Rural polling district are moving to the Newport LEA. This will involve moving 73 voters from Nenagh Rural polling district to Kilkeary polling district. Map 11 below show the polling districts as they are and map 12 shows the proposed change

Templemore-Thurles MD

Latteragh DED There are three polling districts affected by the Local Electoral Area Boundary Committee No. 1 Report 2018 recommendations. These are Toomevara, Kilnaneave and Gortagarry.

Table 6 and map 13 identifies the Latteragh DED townlands that it is proposed to move to a new polling district. Map 14 shows a close up of the affected townlands.

In summary it is proposed to move the identified townlands to Gortagarry polling district voting in Gortagarry National School

Using drive time analysis from google maps this should not increase the drive time. Drive time is under 10 minutes to the three polling stations.

The proposal will decrease voters in Templederry by 83 and Toomevara by 9 and increase the number voting in Gortagarry by 92 (309 to 411)

This polling district is being split between Templemore-Roscrea LEA and Thurles LEA. The electors in the Moyne DED will continue to vote in Moyne Community Hall. The electors in the Longfordpass DED will be split between the Rahealty, Gortnahoe and Two-mile-Borris. Introduction There are 4 DED’s and 6 polling districts affected by the Local Electoral Area Boundary Committee No. 1 Report 2018 recommendations (pg 107) (Report, 2018) . Table 8 and Map 19 identify the DED’s affected.

Tullamain DED Tullamain DED is moving from Carrick to Clonmel

This will affect three polling districts;

 Rosegreen  Coolmoyne  Mocklershill

It is proposed to extend the Rosegreen PD to include all the Tullamain DED townlands. It is also proposed to take 5 townlands in the Magorban DED from the Rosegreen PD and move to the Mockelershill PD voting in Dualla N.S.. This will substantially increase the drive time to the Polling station from 5 minutes to 14 minutes.

Colman DED The entire Colman DED is in the Fethard Polling District. It is estimated that there is 320 voters in this DED.

It is proposed to split the townlands in this polling district between Lisronagh polling district and Ballyclerihan polling district. Map 23 shows the current polling districts of Fethard, Lisronagh and Ballyclerihan.

Tullaghmelan, Ardfinnan and Newcastle polling district

The polling district of Tullaghmelan has three polling places, Grange, Newcastle and Ardfinnan. (See map 28)

It is proposed to reduce the number or polling places from 3 to 1. The townlands currently in Tullaghmelan polling district voting in Newcastle (270) should move to the Newcastle polling district and the townlands voting in Ardfinnan (195) should move to Ardfinnan polling district.
