11 PPrreelliimmiinnaarryy 1.1 Purpose

This Planning Scheme Policy Transport Network Developer Contributions, has been prepared in accordance with the Integrated Planning Act (IPA) 1997.

This Policy covers the entire . Its purpose is to present the developer contributions for the transport network servicing the Mackay City Planning Scheme.

The Policy is supported by the following documents:

• “Mackay Four Level Road Hierarchy” Report (& Accompanying Plans) (Eppell Olsen & Partners, 2003) • “Mackay City Council Bicycle Plan” Final Report (Gutteridge Haskins & Davey Pty Ltd, 1999)

1.2 Philosophy

An applicant shall pay contributions towards the capital cost of the provision of transport infrastructure to meet the demand placed on the network by the development.

Contributions are based on the methodology outlined in the subsequent sections of this Policy.

Such contributions are held by Council and used for the administration, planning and construction of works or the payment of loans to provide a reliable transport network as outlined in the Policy.

1.2.1 Adoption Of Transport Network Developer Contributions Policy The Transport Network Contributions Policy was adopted by resolution of Mackay Regional Council (Council) on 24 June 2009 pursuant to provisions of Integrated Planning Act (IPA 1997) and has effect from 1 August 2009. The provisions of this Policy are subject to review by Council from time to time. This Policy is an update of the original Policy (No. 16.01) adopted by Council on 15 March 2006 and subsequent Policy update adopted by Council on 13 February 2008.

1.4 Existing Development Infrastructure Agreements

Mackay Regional Council is bound by preceding development infrastructure agreements. However where the identified standard of service has increased, Council may impose developer contributions for the difference of the agreed standards of service and the desired standard of service in this Policy.

The entire City of Mackay local government has been identified as representative of demand on the transport network and is covered by this Policy. Maps 1A and 1 B indicating the Council-controlled trunk roads, on which upgrades are proposed to meet the increase in demand, are included in Appendix A.

The growth forecasts which form the demand assumptions on the transport network within the City are presented in Table 2.1. The forecasted demand is measured in terms of trip ends per day (vpd) and includes both the traffic generated by development within the City of Mackay and the traffic generated by external users.

External traffic generation (vehicle movements that commence or end outside of the city boundary) have been obtained from Department of Main Roads (QDMR) and Council traffic counts located close to the city boundaries on Bruce Hwy, Mount Martin Road, Mirani-Mount Ossa Rd, Marian- Hampden Rd, Mackay-Eungella Rd, Peak Downs Hwy and Sarina Homebush Rd. This external traffic generation has been estimated to grow at an average rate of 3.9% per annum and account for up to 5% of the total traffic in Mackay City Planning Scheme over the planning period.

2.2 Desired Standard of Service The Mackay Four Level Road Hierarchy report (Eppell Olsen and Partners, 2003) and its accompanying plans should be read in conjunction with this Policy. This report gives details of the four road hierarchy levels, the objectives, and desired standard of service for the urban and rural road network infrastructure including standard road cross-sections detailing bikeway/ footpath treatments. The Bicycle Network Plan and desired standard of service for bikeways are outlined in the Mackay City Council Bicycle Plan (Gutteridge Haskins & Davey Pty Ltd, 1999).

2.3 Infrastructure Funded By Developer (Infrastructure) Contributions

Level 3 of the Mackay Four Level Road Hierarchy (Eppell Olsen, 2003) is made up of various types of arterial, sub-arterial, and collector roads. Of these, all arterial, all sub-arterial, as well as major collector roads are classified as trunk roads and hence developers are required to contribute to the funding of these roads. With regard to footpaths and bikeways, this Policy only funds those located within the road reserve of a trunk road.

The initial establishment cost on trunk infrastructure identified in the schedules has been used in calculating the infrastructure contribution rate.

Trunk transport network infrastructure items funded by this Policy include:

• Road pavements and surfacing; • Intersections; • Bridges (or culverts); and • Associated works (e.g. traffic signalling, kerb and channel, bike/footpaths, and local drainage).

Existing trunk roads along with the proposed Council trunk roads are shown on Mackay City Planning Scheme Trunk Transport Network Infrastructure Maps 1 A and 1 B in Appendix A. Details of proposed Council trunk roads and upgrades are provided as Appendix B.

It is important to note that this Policy does not fund non-trunk transport infrastructure. Non-trunk transport infrastructure can be described as infrastructure that generally only provides an individual user benefit, and performs the key function of providing direct user connections to the network or the mitigation of impacts on the network.

Conditions (in addition to conditions requiring contributions under this policy) may be imposed by Council independent of this Policy, for the supply of infrastructure for one or more of the following:

• Upgrading works on existing non trunk roads on the frontage of the land subject to a Development Application; • Networks internal to the premises; • Connecting the premises to the existing transport infrastructure network; • Protecting or maintaining safety or efficiency of the infrastructure network of which the non-trunk infrastructure is a component. The developer is responsible for the cost of any road intersections required to connect the development to a trunk road.

2.4 Costing Assumptions

This Developer Contributions Policy identifies the establishment cost of providing suitable quality trunk transport infrastructure for the Mackay City Planning Scheme. Establishment costs include:

• Ongoing administration costs of preparing, maintaining and administering infrastructure contributions; • For future infrastructure: − Planning, survey, geotechnical investigations & design costs; − Financing costs; − Construction: and − Land for trunk road purposes. • For existing infrastructure: − Current replacement value – i.e. the cost of reconstructing the same works using contemporary materials, techniques and technologies; and − Land acquisition costs (post 1990) taken as the present value (March 2009) of the amount paid in acquiring the land.

It should be noted that the maintenance, rehabilitation or replacement cost of existing aged or obsolete components of the transport network are not included in the developer contributions.

Other costing assumptions that form part of this Policy are: • Costs are exclusive of GST; • Inflation rate of 2.83% (Real) for all construction related costs; and • Discount rate of 5.95% (Real) for Cost of Capital. • Base year for escalating and discounting is 2008-2009 (Year 0).

2.4.1 Trunk Assets

Existing trunk assets are expressed in terms of ‘Current Replacement Cost’, as recorded in Council’s Asset Registers. Accordingly, the value of existing trunk assets are neither escalated nor discounted.

Future trunk assets are originally expressed in terms of ‘Current Construction Cost’, then escalated by a long term construction cost inflator and discounted by a long term cost of capital rate. Accordingly, the following equation is applied to calculate the ‘Present Value’ of future trunk assets.

2.4.2 Demand

Existing demand is expressed in terms of ‘Present Value’. Accordingly, the value of existing demand is neither escalated nor discounted.

Future demand is originally expressed in ‘Nominal’ terms, which is then discounted by a long term cost of capital rate. Accordingly, the following equation is applied to calculate the ‘Present Value’ of future demand.

3.1 Apportionment of Developer Contributions

New development shall pay for its proportion of the cost of proposed and existing trunk transport infrastructure in the Mackay City Planning Scheme. This trunk infrastructure is shown on the Infrastructure Maps in Appendix A.

Development in the entire City of Mackay contributes towards the use of all existing and proposed Council arterial, sub-arterial and major collector roads (and associated infrastructure). This was considered a reasonable representation of the benefited catchment for transport infrastructure.

It should be noted that the entire City of Mackay also contributes towards the ongoing administration costs of this policy.

The developer contribution presented in Table 3.1 has been apportioned using the following formula:

DC = DC (INFRASTRUCTURE) + DC (ADMIN)

Where:

DC is the total transport network development contribution ($/vpd) for the entire City of Mackay.

DC (INFRASTRUCTURE) is the development contribution ($/vpd) towards all Council trunk (i.e. arterial, sub-arterial and major collector) road and path infrastructure calculated as the sum of the net present value of the establishment cost of all existing and future Council trunk infrastructure, divided by the net present value of the total (existing and future) demand on this infrastructure in vehicle trips per day (vpd).

DC (ADMIN) is the developer contribution ($/vpd) towards the ongoing administration cost of this Policy. The applicable rate is set at 2% of DC (INFRASTRUCTURE) .

Value of the replacement cost of existing trunk road infrastructure is $116,976,390. The present value of the future trunk road infrastructure identified in Appendix B, inflated at 2.83% (Real) and discounted at 5.95% (Real) is $77,151,364, taking the present value of all trunk road infrastructure to $194,127,754 and the charge to $365 per daily trip end.

Appendix B provides a brief description; estimated timing of construction, and future cost for each of the proposed trunk infrastructure items and upgrades over the planning period (2008-09 to 2020-21).

3.2 Calculation of Developer Contributions

The calculation method for determination of the transport network developer contributions for a development or redevelopment is a two-step process. First, the number of additional trip ends generated by the development is calculated and then second, the contribution per trip end is applied.

It should be noted that credit will be given for existing lawful uses of an allotment when calculating additional demand generated by the development/ redevelopment. In such cases, the vpd credit given will be the greater of:

• The number of vehicle trips attributable to the existing lawful use (see Section 3.2.2 ); or • 6.5 vpd/lot This vpd credit is applied in Step 1 of calculating the transport network developer contributions for a development or redevelopment as demonstrated in the Worked Example in Section 3.2.3.

3.2.1 Developer Contributions Table 3.1 specifies the developer contribution for the transport network that applies in the City of Mackay in dollars per vehicle trip ends per day, ($/vpd).

The developer contribution reflects the contribution relating to the trunk transport network only.

The developer contributions for the transport network will automatically be adjusted for inflation each quarter according to movements in the Road and Bridge Construction Index - Queensland (RBCI-Qld) published by the Australian Bureau of Statistics ((Producer Price Indexes (PPI) 6427.0 - Tables 15 and 16). The contribution will be adjusted to the applicable charge rate at the time of payment. The indexes for the period March 2004 to December 2008 are presented as Table 3-2 The indexation of applicable charge rates will be applied on the first day of the month following the publication of the relevant index by the Australian Bureau of Statistics. Updated indexed contribution rates are effective on 1 February (December index), 1 May (March index), 1 August (June index) and 1 November (September index).

3.2.2 Assessing Infrastructure Contributions. An assessment for an infrastructure contribution will be triggered by an application for any of the following:

• Reconfiguring a Lot, • Material Change of Use, • Combined reconfiguring and material change of use, • A building application, or • Operational works.

3.2.2.1 Reconfiguring a Lot

The daily trip generation rates in Table 3.3 will be used for assessing the infrastructure contribution for reconfiguring a lot.

3.2.2.2 All other applications

The daily trip rates identified in Table 3.4 of Section 3.3.3 will be used for assessing infrastructure contributions for all other applications.

3.2.3 Traffic Generation Rates by Development Type Table 3.4 sets out the various traffic generation rates for different development types in vehicle trip ends per day (vpd). If the development type is not listed in Table 3.4 the vehicle trip/s attributable to the development will be assessed based on a traffic impact assessment or best estimates of traffic generation for the development.

It should be noted that linked trip discounts have been applied where the trips generated by a development are short local trips and where they are often made as part of an overall journey involving more than one trip leg. The Net Trips per Day (See Column 2 of Table 3.4) for the appropriate development type should be taken as the traffic generation rate for the development when calculating developer contributions. These traffic generation rates were taken from various sources according to their suitability to the (see Appendix C).

3.2.3.1 Economic Development Strategy

All contributions will be calculated, in the first instance, under this policy. However, Council may from time to time adopt a subsidy scheme whereby, in order to pursue economic development or other public interest objectives, the Council itself will assume part of the contributions liability for particular types of development, thus reducing the net amount payable by a development applicant in respect of development to which such a scheme applies.

3.2.4 Worked Example The following are worked examples of how to calculate the developer (infrastructure) contribution for various assessable developments

Example 1: A Material Change of Use application for a development permit to create six multiple dwellings: A developer proposes to develop a parcel of land within Mackay City Planning Scheme currently containing 1 detached dwelling unit into 6 multiple dwelling units.

Step 1 - Calculate the number of additional vehicle trips per day (vpd) generated by the proposed development. From Table 3-4 “detached dwelling unit” (6.5 vpd/dwelling unit) & “multiple dwelling units” (5.0 vpd/dwelling unit). Therefore,: Number of additional vehicle trips per day (vpd) = 6 dwelling units x 5.0 vpd/dwelling unit - 1 dwelling unit x 6.5 vpd/dwelling = 30 – 6.5 vpd = 23.5 vpd

Step 2 – Calculate the developer contribution for the development. Table 3.1 specifies a transport network developer contribution for Mackay City of $ 365 /vpd (excluding the adjustment index).

Therefore: Transport Network Developer Contribution = 23.5 vpd x $ 365 /vpd = $ 8,577.50 (excluding the adjustment index).

Example 2: An Application for Reconfiguring a Lot: A developer proposes to subdivide a parcel of land within Mackay City Planning Scheme into 10 lots (5 lots @ 3500m² and 5 lots @ 5000 m²). The current zoning of the land is Industrial (High Impact). The proposed use is unknown at this stage and there is a single existing dwelling on the property

Step 1 – Calculate the number of additional vehicle trips per day (vpd) generated by the parcel of land From Table 3-4 “Industry – All zones” ( 50 vpd per lot ) and “Urban Residential” (6.5 vpd per lot) Therefore,: Number of additional vehicle trips per day (vpd) = 10 new Lots x 50.0 vpd per lot - 1 Urban Residential unit x 6.5 vpd per lot = 500 vdp – 6.5 vpd = 493.5 vpd

The developer infrastructure contributions for the transport network apply to all applications for new developments, or extensions to existing developments (except for a residential dwelling) on or after the adoption date of this policy (in the case of single detached residential subdivision it applies to the number of additional lots being created) that generate additional demand (vehicle trips) on the Mackay City Planning Scheme transport network.

Table 3.1 details the contribution amount that applies to the entire City of Mackay.

The Contribution is levied on the basis of additional ‘primary’ daily trips. A primary trip is one which has been discounted for diverted trips or drop in trips related to another primary trip purpose.

The contribution is levied on a “per additional vehicle trip per day (vpd)” basis. Thus, an estimate of the additional traffic generated by the development is needed to calculate the contribution. Residential, commercial and industrial developments are all considered to generate traffic, and should therefore pay contributions.

4.2 Payment of Developer Contributions 4.2.1 General The developer contribution is payable:

• If the contribution applies to reconfiguring a lot that is assessable development - before endorsement of the plan of subdivision; or • If the contribution applies to any other application (i.e. material change of use) - before the issue of a Building Works or Operational Works (associated with a Material Change of Use) Development Permit or before the new use commences, whichever is the earliest; or • On the day stated in the Decision Notice or Negotiated Decision notice. Payment of the contribution will be at the rate applicable at the time of payment (including the adjustment index). 4.2.2 Staged Developments Staged developments and complexes for which developer contributions are payable, will be approved subject to a condition requiring that contributions be paid regarding the total ultimate vehicle trips generated in vehicles per day (vpd) by the development as per this Policy.

As each stage is developed, the vehicle trips generated by the stage will be assessed and the developer contributions will be payable in accordance with Section 4.2.1, at the rate applicable at that time.

The Applicant for a staged building development may be required to either provide security or enter into an infrastructure agreement as determined by Council.

4.2.3 Security Council may require a security bond in the following circumstances:

• As a condition of development with respect to staged building developments/ complexes. • To allow Council to program and construct works with an assurance that the developer contributions will be available; • Deferred payment schemes as approved by Council from time to time where the development is released prior to the payment of contributions, as determined by the Council.

The amount of the security bond required to be lodged shall be determined by the Council based on the best available information regarding the development.

The security bond shall be lodged at the time stated in the Infrastructure Agreement, or in the absence of an Infrastructure Agreement, as determined by Council.

Security bonds lodged in respect of this Policy shall either be in cash or in the form of an irrevocable Bank Guarantee from an approved Trading Bank, and shall state the purpose of the guarantee and the Real Property description of the development to which it applies. The Bank Guarantee shall be open- ended with no lapse time, unconditional and activated solely on demand by the Council. 4.2.4 Contribution Credits for the Construction of Works Where Council approves the provision of trunk transport works identified in Appendix B of this PSP, by the developer pertaining to this Policy and determines that an allowance will be made for the developer to offset the costs of the works against developer contributions.

Where the total cost of constructing the works is greater than the assessed developer contribution for the transport network - Council may at its discretion:

• Meet the additional costs, if the infrastructure item was planned in the near future; • Require the developer to construct the infrastructure at the developer’s cost, if the infrastructure item was not planned in the near future. In this case, Council will endeavour to ensure that the developer is reimbursed for the additional cost from the transport network developer contributions received from other developers that connect to the network for up to five (5) years from approval of Council. (As the timing and level of contributions payable by other developments are unknown at the time of approval, Council cannot assume a binding legal obligation to reimburse any specific amount at any specific time. Interest will not be considered and the developer contributions will be reimbursed at the agreed number of vpd credits at the rate applicable at the time of reimbursement.)

Council will not permit the transfer of credits for the same network between different developments .

4.3 Council Contributions

The total value of trunk transport network infrastructure proposed over the planning period is $194.13 million. Developer contributions made over this period are estimated as $35.89 million. Mackay Regional Council (and State and Federal governments) will make up the shortfall of $158.24 million, which represents the use of the network by existing and external users.

4.4 Expenditure of Funds Collected

Monetary payments of the charge will be administered according to the provisions of the Integrated Planning Act (IPA) 1997 . The monies collected will be expended on the infrastructure items identified in the Transport Network Developer Contributions Policy according to the estimated timeframes indicated within the Policy.

Timing cannot be determined exactly and hence, Council reserves the right to modify the timing of expenditure to reflect faster or slower than anticipated growth. Council may also choose to modify the expenditure in terms of the infrastructure items to be provided only if the modification will result in the same or an increased standard of service for the community from which contributions for the particular item have been collected.
