INTRODUCTION The subproject “Distribution Efficiency Project (DEP) – the First Phase – Yen Bai Province” is one of sub-projects to be implemented in the first phase of Vietnam Electricity’s Distribution Efficiency Project funded by the World Bank (WB). The activities of subproject include: (i) new construction of 28.267km for a medium voltage transmission line and 42.643km for a low voltage transmission line; (ii) new construction of 29 substations; and (iii) rehabilitation and upgrading of additional 9.500 km of medium voltage and 50.678 km of low voltage transmission line. The subproject involves 23 communes of 7 (districts. City) of Yên Bai Province including: Nguyen Thai Hoc district Yen Bai city, Hung Khanh, Viet Thanh, Quy Mong, Nga Quan district Tran Yen ; Đai Minh, Thac Ba districts Yen Binh commune; Hanh Son, Thach Luong, Cat Thinh, Tan Thinh, Nghia Tam, Thanh Luong districts Van Chan commune; Mau A, An Thinh, Yen Phu district Van Yen commune; Mo De, Pung Luong districts Mu Cang Chai commune; To Mau, Minh Tien, An Lac, Vinh Lac, Minh Chuan districts Luc Yen commune. These activities may cause negative impacts on the local environment and communities during pre-construction, construction, and operation phases. The components shall cover construction of medium voltage (MV) distribution lines (35kV, 22kV) and substations (35/0,4kV, 22/0,4kV) and Low Voltage (LV) lines. The expected component construction period if 06 months since the commencement date of construction. The expected commencement date is May 2012. In order to ensure to recognize and minimize the potential adverse impacts during implementation of the Components and comply with the WB's Environment Assessment Policy (OP/BP 4.01), Environment Management Plan (EMP) of the components are prepared in accordance with the DEP’s guidelines of Environment Management Framework (EMF). This EMP covers Component description, policy frameworks, applicable environmental technical regulations and codes, potential adverse impacts, recommended mitigation measures to be implemented prior to construction, construction and operation, implementation organization. EMP also includes Environmental Codes of Practice (ECOP) to be inserted in the bidding documents and contracts, attached with the environment monitoring documents. The Government’s regulation on EIA requires submission of an Environmental Protection Commitment (EPC) for the subproject. An EPC report has been prepared, submitted to, and approved by District People’s Committee under the Confirmation No.16/TB-UBND, dated March 1st 2012 of Bao Yen DPC .

POLICY FRAMEWORK AND REGULATIONS 1.1 Regulations of Vietnam Government The laws and regulations of Vietnam hereunder are applied to the components, concretely: - Law on Environmental Protection No. 52/2005/QH11 approved by the National Assembly on 29th November 2005 on prescribing responsibilities of individuals and organizations in environment protection. - Law on Forest Development and Protection No. 29/2004/QH11. - Law on Heritage and Culture No. 28/2001/QH10. - Law on Water Resources No. 08/1998/QH10 dated 20th May 1998. - Decree No. 80/2006/NĐ-CP dated 9th August 2006 of the on detail regulations and guidances on implementing some articles of Law on Environment. - Decree No. 29/2011/NÐ-CP dated 18th April 2011 regarding regulations on strategic environmental assessment, environmental impacts and environmental protection commitment. - Circular No. 26/2011/TT-BTNMT dated 18th July 2011 on prescribing details of some articles of Decree No. 29/2011/ND-CP dated 18th April 2011 regarding regulations on strategic environmental assessment, environmental impacts and environmental protection commitment. - Decree No. 106/2005/ND-CP dated 17th August 2005 of the Government detailing and guiding the implementation of a number of articles of the electricity Law on Protection of safety of high-voltage power grid works. - Decree No. 81/2009/ND-CP dated 12th October 2009 of the Government on amendment and supplement of some articles of Decree No. 106/2005/ND-CP of the Government on detailing and guiding the implementation of a number of articles of the electricity Law on Protection of safety of high-voltage power grid works. - Circular No. 12/2011/TT-BTNMT dated 14th April 2011 on managing hazardous waste. - The national technical codes: QCVN01: 2009/BYT – the national technical regulations on quality of portatble water; QCVN02: 2009/BYT – the national technical regulations on quality of domestic water; QCVN08: 2008/BTNMT - the national technical regulations on quality of surface water; QCVN09: 2008/BTNMT - the national technical regulations on quality of underground water; QCVN05: 2009/BTNMT – Air quality- Standards on ambient air quality; QCVN06: 2009/BTNMT – air quality – allowable maximum concentration of hazardous substance in the ambient air. - EVN's guideline No. 2623/CV-EVN - KHCN & MT dated 28th May 2007 on managing and preventing pollution and contact with PCBs. 1.2 WB’s safety policy applicable to the Project An environmental screening was undertaken in line with the guidelines provided in the Environmental Management Framework (EMF) of the DEP project and it showed that the World Bank’s policies on Environmental Assessment (OP 4.01), Indigenous People (4.10), and Involuntary Resettlement (OP 4.12) will be triggered for the subproject. In addition, the Bank’s requirements on public consultation and information disclosure will need to be followed. The implementation of policies OP 4.10 and OP 4.12 will be addressed in other social safeguard instruments.

PROJECT DESCRIPTION AND SCOPE OF WORK 1.3 Project Objectives The DEP- Yen Bai Province to be launched shall embody following objectives: - To prevent overload for grid in the project area’s communes; - To reduce power loss, improve the stable power supply quality to the area to serve for production, business and living purposes of the rural areas. - To meet the demand of power consumption for the current and future socio-economic development of the communes in the project site; - To contribute to the Government’s poverty elimination program in rural areas by providing basic infrastructure, especially power; - To facilitate the improvement of physical and spiritual life of local communities in remote areas in the North. The components of DEP- The first phase – Yen Bai province is one of components to be implemented in the first phase of EVN’s DEP funded by WB. The sub-projects are constructed in 23 communes (wards and towns) under 07 districts (cities) of Yen Bai Province.

1.5 Project description 3.3.1. The medium voltage wirelines energize the newly built transformer stations. a) Medium voltage wireline Medium voltage DZ line is 30.785 km long. Generally, the MV lines pass the rice paddy fields, some sections trepass the mixed tree hills. In Dao Thinh commune – Tran Yen district, the line trepasses the cemetery area from G1 terminal to the sub-station. In addition, some routes trepass the springs, some ditches and small ponds in communes of Nga Quan, Dao, Viet Thanh, Nghia Tam, Thach Luong, Dai Minh, To Mau, Minh Tien, Vinh Lac and Mo De. At the bypass of Cua Ngoi Transformer Sub-station (G1 terminal to the substation) under To Mau commune – Luc Yen district, the route passes the Chay River. b) Transformer sub-stations The sub-stations are located in the corner of cultural house (in Nguyen Thai hoc, Hanh Son, Tan Thinh district), nearly Yen Bai City's Public Security (in Nguyen Thai hoc district). Others are located in rice paddy field. (Althought, the line passes the hill but sub-stations are not located in here). c) Low Voltage Wirelines Rehabilitation of the current lines: It would pass the old route; disqualified wires, beams, insulators or poles shall be replaced. New construction of the lines: It would mainly pass the removed lines. Some of them would be completely newly constructed, inserting into alleys, bypasses or along the village paths connecting with newly built routes. The completely new routes would be used to energize some households who are minor ethinic people (Tay, Dao, Nung, Thai, Muong, San Diu and Cao Lan) residing in small villages far from the center and the Power industry is unaffordable to invest in the power grid to energize them. Because the occupation area of the LV foundation is insignificant, the LV lines would cause small impacts on households. However, for trees in the unsafe route corridor as stipulated in the power grid safety codes shall be cut off and the local people shall receive proper compensation, accordingly.

The special vehicles are selected in accordance with the goods packaging specifications as stipulated in the contracts. + The long-distance haulage from the Project Owner’s warehouse to the site is conducted by 5  7.5ton trucks, loading by 5 ton cranes. IV. SUMMARY OF NATURAL AND ENVIRONMENTAL CONDITIONS OF THE PROJECT SITE a) Geological position and natural area: Being a mountainous provice deeply located in the continent, Yen Bai is one of 13 Northern mountainous provinces lying between the and Northwest areas. Its North borders with Lao Cai province, its South borders with Phu Tho province, its East borders with two provinces of Ha Giang and Tuyen Quang and its West borders with Son La province. Yen Bai is the home of 9 administrative units (1 city, 1 town and 7 districts) with total 180 communes, wards and towns (159 communes and 21 wards and towns). Its total natural land area is 688,627.64 hectares, In which 583,717.47 hectares, 51,713.13 hectares and 53,197.04 hectares of agricultural land area, non-agricultural land area and unused land area, making up 84.76%, 7.51% and 7.73% of natural land area, respectively. b) Topography, climate and hydrography: * Topography: Being is situated in the Northern mountainous area, Yen Bai is characterized by gradually high topography from the to Northwest and formed by 3 large mountain ranges with the same direction from Northwest to Southeast: Its West is characterized by Hoang Lien Son - Pu Luong range between Hong River and Da River, the next is the Con Voi ancient mountain range between Hong River and Chay River; whereas its East has limestone mountain range between Chay River and Lo River. In spite of relatively complicated topography, it is possible to divide into 2 large areas namely high and low areas. The high

This area is characterized by scattered population, high potential on land, forestry products, minerals and socio-economic development. While the low area has the elevation of under 600m, mainly low mountainous terrain, apron valley, accounting for 32.44 % of natural area of the province. * Climate: - Yen Bai is located in the tropical moonson climate range with average temperature of 22 - 230C; average rainfall of 1,500 – 2,200 mm/year and average humidit of 83 – 87%. Yen Bai can be divided into 5 climatic subregions by climate and topography factors. Mu Cang Chai subregion is characterized by average elevation of 900m, average temperature of 18 – 200C which sometimes reduce to under 00C in winter. Van Chan – Nam Van Chan subregion is characterized by average elevation of 800m, average temperature of 18 – 200C. Its North is the heavy rain subregion and its South is the least rainfaill region in the province. Van Chan – Tu Le subregion has average elevation of 200 – 400m and average temperature of 21 – 320C. Subrehion of the Southern Tran Yen- Van Yen, Yen Bai city, Ba Khe has average elevation of 70m and average temperature of 23 – 240C which has the most frequent drizzle rain in the province. * Hydrography: There are two main river systems namely Hong River and Chay River which share the same flow direction of Northwest and Southeast. In addition, approximately 200 canals, large and small springs are available with the lake and damp system c) Population and administration structure: * Population: In 2010, total population of the province was 752,22 persons. The average population density was 109 persons/km2, concentrating in some urban areas such as Yen Bai city, Nghia Lo town, and other towns and districts. According to the survey, Yen Bai was the home of up to 30 minor ethinics including 7 ethnics with population of over 10,000 persons. 2 ethnics had from 2,000 – 5,000 persons, 3 ethnics had from 500 -2,000 persons, including, 49.6%, 18.58%, 10.31%, 8.9%, 6.7% and 1% of Kinh, Tay, dao, H’Mong, Thai, cao Lan and others, respectively. d) The cultural and social fields: * Healthcare: In 2010, the province was the home of 45 healthcare facilities with 1,744 beds. Rate of bed/10,000 persons was 35.35/10,000 people. Total communes qualfied with the national standard on healthcare was 141, accounting for 83.33%. Total medical officials were 3,113 persons. Rate of doctors was 6.8 doctors/10,000 persons. V. POTENTIAL IMPACTS The Project shall pay an essential role in electricfication and poverty elemination program in 13 communes of 10 districts of the Project. It also strengthens the industrialization and modernization to create a development premise in rural poor areas. When the power supply lines are constructed, the local people tend to remove to reside in the energizing areas. The local authority must launch stabilization plans, including: road expansion, residential areas, industrial and agricultural development, etc. Communes, districts and provinces shall carry out such plans. The social- economic benefits offered by the Project are significant, this is detailed in the general statement volume of the feasibility study report. Moreover, the project may cause

In any cases, all construction materials should be treated at the site by the Contractor. - Used grease should be transported out of the site to the approved oil recycling company. - Used grease, lubricant and cleaning substances, etc from maintaining plants and equipment shall be collected into proper closed container and conclude a contract with the hazardous waste collection and treatment facility.

8. VIII. IMPLEMENTATION OF ENVIRONMENTAL MANAGEMENT PLAN AND CAPACTY BUILDING 8.1. Responsibilty of Implementing the Environmental Management Plan 8.1.1. During preparation of detail design and bid invitation document During preparation of detail design and bid invitation document, the Project Management Unit (PMU) should incorporate the Environmental Management Plan or proper parts of such plan (such as mitigation measures, responsibility for implementing of the Contractor) as an integral part of Appendix attached with the bid invitation document and contract with the Contractor. The engineer-in charge of detail design also refer the findings in the EPC and the Environmental Management Plan to ensure the fully consideration of environmental issues in the final design. While bid invitation document and contract are prepared, the Contract should receive all information about their responsibilities and obligations in implementing the mitigation measures and compliance commitment. 8.1.2. During construction: The PMU shall assigne the Construction Consultant Supervisor (Supervisor) and/or field engineer to conduct daily supervision of implementation of the Contractor’s safety measures. The Terms of Reference (TORs) for the Supervisor is described in Appendix 1 (TOR for Construction Supervisor); Construction Consultant and/or field engineer shall conduct main tasks as follows: - Before commencement, confirmation of damages compensation for affected persons should be conducted. - During construction, close supervision of implementing mitigation measures should be carried out. - It is supposed to confirm the compliance with the Environmental Management Plan and check any damages caused by the Contractor. Minutes should be prepared to request the Contractor to compensate/recover the construction site as stipulated in the Contract, if any. The Contractor’s implementation of environmental safety issues shall be incorporaed into the Components’ progress report. CONSULTATION AND INFORMATION DISCLOSURE During preparing the Project (2011), 05 works hereunder were conducted: Work 1: Site survey, working with the local authority on route and substation position agreement. Work 2: Site survey and preparation for Environmental Impact Accessment Report (EIA) and EMP. Work 3: Community consultation on the Project.

From 3rd September 2011 to 26th September 2011, the meeting was organized with local persons at 13 communes of the Components to consult on EMP. The representatives of the Project Owner also involved in following contents: - Description of Components, route direction, substation position and necessity of Components; - Potential impacts on environment; - Mitigation measures of impacts on environment. Participants: Representatives of the Communal People’s Committee, Farmer Association, Women’ Associatio, other mass organizations, leaders of villages and representatives of affected households and Consultant Opinion Summary of Representatives: The local authority and people all supported the Project and wished the Project to be launched as soon as possible and released some recommendations for project performance as follows: Opinions of local people: - All local people agreed to implement the Project. However, they required quick construction, limited delay, prolong extension and cleaniness for environment and work quality. - In order to minimize impacts on community and living activities of the local people, the Project should be quickly conducted and completed with its phase to minimize the unscheduled construction activities. - Unit price for compensation should be notified in public such as quantity and area to be compensated. Proper compensation should be offered to the local people before commencement in accordance with the regulations of the State. - The Contractor should fulfill his commitment on minimizing impacts of project implementation and outperform the environment quality and survey management. - The local people suggessed to apply penalties or even unilaterially contract termination with the Contractor if he failed to comply with the commitment. Opinions of local authorities: - They agreed in terms of the State’s guideline on constructing the Project as well as mitigation measures. The Project Owner was required to strictly fulfill the adverse impact minimization of the Project as well as environment quality and survey management. - They agreed with the mitigation measures offered by the Project Owner. - Local labor should be employed for proper works. - They supported and assisted the Project Owner in site clearance. Minutes of Community Consultation are attached in Appendix 6. All relevant issues as well as recommendations of the local people were recognized by the Consultant and Project Owner and considered during designing the Components and launching the EMP of the Components.

ANNEX 1 ------TERMS OF REFERENCES FOR MONITORING OF EMP IMPLEMENTATION FOR CONSTRUCTION SUPERVISING CONSULTAnt Background The construction supervising consultant will deliver technical services (“Services”) to ensure efficient implementation of the EMP for the project. Scope of services: Services provided by the supervising consultant will include reviewing and monitoring of construction activities to ensure mitigation measures described in the EMP for the project are correctly complied with and negative environmental impacts are minimized. On behalf of the PMU, supervising consultant undertakes the following duties: - Conduct frequent field inspection; - Review the implementation of environmental protection measures described in the EMP and contract documentation; - Review the effectiveness of the mitigation measures and environmental performance of the project; - If necessary, validate the acceptability of construction methods with regards to environmental compliance (for temporary and permanent items), relevant design plans and other submitted documents. If necessary, the supervising consultant will seek for and recommend methods with less environmental impacts with consultation with the design consultant and the PMU; - Validate inspection results with regards to any non-conformance to environmental performance and effectiveness of any countermeasures; - Provide audit results for the leading engineer of the contractor in accordance with non- conformance handling procedure described in the EMP; - Direct the contractor to take corrective actions within a specific time period and exercise additional monitoring if necessary, as per the requirements of the contract in case of non- conformance and complaints; - Direct the contractor to take actions to mitigate impacts and comply with the EMP in case non-conformance is found; - Direct the contractor to stop any activity resulting negative impacts and/or in case the contractor does not fulfill requirements of the EMP, to take corrective actions. - For contracts that need Site Environmental Management Plan (SEMP), the supervising consultant will conduct a final review and approve all environmental plans at the site that may affect environment. This work includes but not limited to: dredging areas, material quarries and dumping areas and worker houses. The supervising consultant will review and approve such SEMP submitted by the contractor. If such plans are found non-compliant to the EMP, EPC or RAP, the supervising consultant will work with the PMU and contractor for a proper solution. - Complaint handling: Complaints from local residents will be collected by site officer of the contractor, which may include violations to noise level, dust concentration and traffic
