I. PURPOSE: University of New Mexico on behalf of its Department of Intercollegiate Athletics, is soliciting formal proposals in response to this Request for Proposal (this “RFP”), from qualified Offerors to assist the University with the following areas: e-Commerce, Merchandising and Licensing. II. BACKGROUND INFORMATION The University of New Mexico The University of New Mexico (UNM) is a public research university in Albuquerque, New Mexico. Founded in 1889, UNM offers bachelor's, master's, doctoral, and professional degree programs in multiple fields. UNM is a nationally preeminent, public research university located in New Mexico's largest metropolitan area. The university today has more than 21,000 students; 7330 faculty and staff; 19 academic units; and 7 campuses located throughout New Mexico. UNM is also home to the UNM Health Sciences Center, the largest academic health complex in the state. The University of New Mexico Lobo Athletics The New Mexico Lobos are the athletic teams that represent UNM. The university participates in the NCAA Division I in the Mountain West Conference (MW). The university's athletic program fields teams in 18 varsity sports. UNM teams have won three national championships. The women's cross-country won the NCAA championship in 2015 and 2017 and the Division I Skiing championship in 2004. Athletic Facilities • Dreamstyle Stadium (UNM Football Stadium) is home to the football team. The Stadium’s seating capacity is 39,000. The facility also hosts concerts, shows, and other assemblies the most notable being the USA Sevens Rugby, Monster Jam World Finals, and the Supercross World Finals. • Dreamstyle Arena (The Pit) is home to the men’s and women’s basketball team. The arena’s seating capacity for basketball is 15,411. The facility also hosts concerts, shows, and other assemblies the most notable being the Professional Bull Riding (PBR) and the New Mexico State High School Basketball Tournament. Dreamstyle Stadium and Dreamstyle Arena have an average annual Special Event attendance of over 1,075,000 attendees within the past five (5) years. • Santa Ana Star Field (UNM Baseball Stadium) is home to the baseball team and seats 1,500 fans. • Softball Field is home to our women’s softball team and seats 750 people. • McKinnon Family Tennis Stadium is a 6-court facility that serves as home to the men’s and women’s tennis teams for outdoor matches. The facility seats approximately 500 fans. • Soccer & Track & Field Stadium is home to our men’s and women’s track and cross- country teams along with women’s soccer. Seating capacity of approximately 5,000. • Johnson Center on the UNM Main Campus is home to Women’s Volleyball • Indoor Football Facility III. SCOPE OF WORK: 1) e-Commerce – The successful Offeror will have the exclusive right to establish and operate the UNM Athletic Department’s Online Store for the purpose of retailing Athletics related New Mexico Lobos merchandise through e-commerce sales via the GoLobos.com online store. The GoLobos.com site is the Department’s currently managed website platform. 2) Merchandising – The successful Offeror will have the exclusive right to provide the UNM Athletic Department with sales and merchandising services for all Athletic locations including, but not limited to, the Lobo Den located in Dreamstyle Arena a.k.a The Pit (Men’s and Women’s Basketball), Dreamstyle Stadium (Football), and the UNM Baseball and UNM Softball Facilities. - Contractor will oversee the overall operation of the Lobo Den handle including all aspects of sales, including personnel. - Contractor will be the sole merchandise vendor for all UNM Athletic events. - Contractor will be the sole merchandise vendor for all other events held at the UNM athletic facilities in which UNM has the right to sell merchandise. - Contractor will accept Master Card, Visa, Discover, American Express, as well as cash upon completion of sales. - Contractor will offer a full range of merchandise to create a retail environment with the excitement of “Game Day.” - Contractor will determine the design, selection and variety of products offered with the input of UNM regarding the correct wording of event. The use of University trademarks, service marks, logos or symbols is subject to being previously reviewed and approved by UNM Athletics and/or its Licensing partner to assure compliance with University's policies and procedures regarding use of marks. UNM and/or its Licensing partner may reject the sale or offering of any proposed product. - All merchandise sold, including memorabilia and apparel will be inclusive of this contract. 3) Licensing – The successful Offeror will have the exclusive right, on behalf of the UNM Athletic Department, to commercialize the Trademarks through third-party licensees who will use the Trademarks on or in association with sundry products and/or promotions pursuant to the Scope of Work. - Offeror will promote the Trademarks by identifying advantageous opportunities and negotiating license agreements to promote the Trademarks through the sale of products which bear or otherwise incorporate the Trademarks. - Offeror will negotiate, grant, and process all licenses on behalf of UNM Athletics. Processing of licenses shall include obtaining insurance certificates and product samples from each Licensee. - Quarterly or monthly royalty reports shall be submitted to Offeror by each Licensee. Offeror will review each quarterly report for completeness of information and correct royalty calculations to ensure contract compliance. - Offeror will investigate all known and suspected cases of infringement and consult with the UNM Athletics to determine an appropriate course of action. Offeror and UNM shall coordinate appropriate action on an individual basis. Any costs incurred pursuing any enforcement action and/or seizure shall be the responsibility of the UNM. - Offeror will review and approve routine products. Offeror will send non-routine and unusual products to UNM Athletics for approval. - Offeror will act as an advisor for the UNM Athletics’ licensing program and shall provide assistance in any other licensing related matters which may arise. IV. TERM The term of Agreement is negotiable, with a maximum term of ten (10) years or as provided for in NMSA 13-1-150 (Multi-Term Contract). V. AWARD UNM is seeking to award to one or multiple vendors who can provide one, a combination of or all aspects of the Scope of Work (e-Commerce, Merchandising, and Licensing). This RFP is designed to provide interested Offerors with sufficient basic information to submit proposals meeting minimum requirements, but is not intended to limit a proposal’s content or exclude any relevant or essential data. Offerors are at liberty, and are encouraged, to expand upon the specifications. All services under the Agreement must be performed and delivered in strict compliance with New Mexico law and applicable NCAA, Mountain West, and UNM rules and regulations, and Contractor Graphics must ensure that all of its employees and agents are adequately instructed and knowledgeable of the applicable rules and regulations, provided that UNM has provided Contractor Graphics with such rules and regulations in advance of Contractor Graphics' performance of services. Contractor Graphics represents that it shall exercise all rights and perform all obligations hereunder in accordance with all applicable laws, rules, regulations and industry standards, including, without limitation, all published policies of UNM (found at https://policy.unm.edu/); all published rules, regulations and by-laws of the National Collegiate Athletic Association ("NCAA"). The University reserves the right to establish and change the schedule of Athletics Events for any reason. .
