MINUTE of MEETING of the SCOTTISH BORDERS COUNCIL held in the COUNCIL CHAMBER, COUNCIL HEADQUARTERS, NEWTOWN ST BOSWELLS on 17 May 2012 at 10.00 a.m.

MEMBERSHIP OF COUNCIL 1. There had been circulated a report by the Acting Returning Officer at the Elections held on 3 May 2012. The report detailed those persons elected to serve as Members of Scottish Borders Council, and highlighted a number of other issues related to the election including resources and media coverage.

DECISION NOTED the list of Members elected, a copy of which forms the Appendix to this Minute.

ELECTION OF CONVENER 2. The Council considered the appointment of the Convener. Councillor Parker, seconded by Councillor Mitchell, moved that Councillor Garvie be elected as Convener. Councillor Scott proposed Councillor Archibald as Convener, but Councillor Archibald declined the nomination.

DECISION AGREED that Councillor Garvie be appointed as Convener of the Scottish Borders Council.

SCHEME OF ADMINISTRATION 3. Councillor Parker, seconded by Councillor Cook, moved that delegated authority be given to the Clerk to the Council in consultation with the Chief Executive to amend the Scheme of Administration to reduce the number of depute Leader posts to one and to add the new titles for the Executive Members. This was unanimously agreed.

ELECTION OF VICE-CONVENER 4. The Council considered the appointment of the Vice-Convener. Councillor Parker, seconded by Councillor Bhatia, moved that Councillor Brown be elected as Vice-Convener.

DECISION AGREED that Councillor Brown be appointed as Vice-Convener of the Scottish Borders Council.

ELECTION OF LEADER 5. The Council considered the appointment of Leader, who would be Chairman of the Executive. Councillor Mitchell, seconded by Councillor Nicol, moved that Councillor Parker be elected as Leader.

DECISION AGREED that Councillor Parker be appointed as Leader of the Scottish Borders Council.

ELECTION OF DEPUTE LEADER 6. The Council considered the appointment of the Depute Leader (Finance), who would be Vice- Chairman of the Executive. Councillor Cook, seconded by Councillor Davidson, moved that Councillor Mitchell be elected Depute Leader (Finance)

DECISION AGREED that Councillor Mitchell be appointed as Depute Leader (Finance)

ELECTION OF CHAIRMAN OF SCRUTINY 7. The Council considered the appointment of Chairman of Scrutiny. Councillor Scott, seconded by Councillor Fullarton, moved that Councillor Logan be elected Chairman of Scrutiny.

DECISION AGREED that Councillor Logan be appointed as Chairman of Scrutiny .

ELECTION OF VICE-CHAIRMAN OF SCRUTINY 8. The Council considered the appointment of the Vice-Chairman of Scrutiny. Councillor Parker, seconded by Councillor Smith, moved that Councillor Torrance be elected Vice-Chairman of Scrutiny.

DECISION AGREED that Councillor Torrance be appointed as Vice-Chairman of Scrutiny.

ELECTION OF CHAIRMAN OF STANDARDS COMMITTEE 9. The Council considered the appointment of the Chairman of the Standards Committee. Councillor Brown, seconded by Councillor Watson, moved that Councillor Nicol be elected as Chairman of the Standards Committee.

DECISION AGREED that Councillor Nicol be appointed as Chairman of the Standards Committee.

ELECTION OF CHAIRMAN OF PLANNING AND BUILDING STANDARDS COMMITTEE 10. The Council considered the appointment of Chairman of the Planning and Building Standards Committee. Councillor Parker, seconded by Councillor Marshall, moved that Councillor Smith be elected as Chairman of the Committee. DECISION AGREED that Councillor Smith be appointed as Chairman of the Planning and Building Standards Committee.

ELECTION OF VICE-CHAIRMAN OF PLANNING AND BUILDING STANDARDS COMMITTEE 11. The Council considered the appointment of Vice-Chairman of the Planning and Building Standards Committee. Councillor Herd, seconded by Councillor Aitchison, moved that Councillor Watson, be elected as Vice-Chairman of Planning and Building Standards Committee

DECISION AGREED that Councillor Watson be appointed as Vice-Chairman of the Planning and Building Standards Committee.

NEXT MEETING 12. Members were reminded that the next meeting of the Scottish Borders Council would be held on 24 May 2012 at 10.00 a.m.

URGENT BUSINESS 13. Under Section 50B(4)(b) of the Local Government (Scotland) Act 1973, the Convener was of the opinion that the item dealt with in the following paragraph should be considered at the meeting as a matter of urgency, in view of the need to keep Members informed.

KIRKING OF THE COUNCIL 14. The Convener advised that the Kirking of the Council would be held in Peebles Old Parish Church in June and the date and time would be reported at the next meeting.
