FCPA/Anti-Corruption Developments: 2019 Year in Review January 21, 2020 FCPA/Anti-Corruption Developments: 2019 Year in Review Lucinda A. Low and Brittany Prelogar (eds.)1 Introduction US Foreign Corrupt Practices Act (FCPA) enforcement authorities announced a steady stream of individual and corporate enforcement matters throughout 2019, some with eye-popping fines. Overall, the Department of Justice (DOJ) and Securities and Exchange Commission (SEC) reported 50 FCPA-related actions (including 31 by the DOJ and 19 by the SEC) over the course of the year. The $2.9 billion in total fines, penalties, and disgorgement imposed in corporate FCPA settlements in 2019 nearly matched the record-breaking $2.91 billion imposed in 2018 in such matters. The DOJ also announced a slew of new charges against individuals and racked up a number of trial victories in existing cases. Mega settlements reached by two companies made up nearly two-thirds of the $2.9 billion total corporate penalties imposed in 2019. In the first quarter of the year, Mobile TeleSystems PJSC (MTS) agreed to pay $850 million in penalties and disgorgement to resolve charges against it, joining the ranks of fellow companies Telia and VimpelCom among the top FCPA fines to date for conduct relating to the Uzbek telecommunications sector. In a strong book-end to the year, Telefonaktiebolaget LM Ericsson (Ericsson) and its subsidiary, Ericsson Egypt Ltd. (Ericsson Egypt), agreed to pay more than $1 billion in penalties and disgorgement to resolve DOJ and SEC investigations for conduct in multiple countries. Enforcement against individuals, especially by the DOJ, was also particularly robust in 2019. -

MalaysiaKini.com 14 Februari 2018 Has Malaysia softened its stance on Israel by allowing the latter's high- ranking officials to enter the country, questioned an Amanah lawmaker today. Kuala Terengganu MP Raja Kamarul Bahrin Shah Raja Ahmad in a statement said the government's "unannounced" move had caused shock and sadness amongst many Muslims in the country. "Have we pawned the pride of Muslims in matters concerning Israel just for the sake of money and trade? “Just days after the deputy prime minister sent home 12 Uighur Muslims back to China on the pretext of maintaining "good relations" between the two countries what has become of Muslim dignity and pride in the country?" he asked. Kamarul Bahrin was responding to news reports that a delegation of Israeli diplomats had attended the recent week-long ninth Urban World Forum in Kuala Lumpur. The delegation was reportedly led by David Roet who was formerly Israel's deputy ambassador to the United Nations. Kamarul Bahrin urged Malaysia to state clearly, its current position on Israel. "Is this a product of the wasatiyah concept practised by (Prime Minister) Najib (Abdul Razak) or upon the advice of the 'Global Movement of Moderates' led by Nasaruddin Mat Isa and which had caused the government's change in attitude and policy? The rakyat wants to know. "Or is Najib so eager to follow in the footsteps of the Saudi Arabian government which reportedly has close ties to Israel? Is Malaysia having an 'affair' with Israel'?" he asked. -

Pemecatan tersebut telah melahirkan satu gelombang penentangan masyarakat Melayu Terengganu terhadap UMNO-BN. UMNO telah mengalami Ilyas Abdullah prestasi terburuknya dalam pilihan raya tersebut. Kajian ini juga dilakukan Fakulti Sains Sosial Dan berdasarkan kepada berlakunya pola ketidaktentuan pengundian yang ditunjukkan Kemanusiaan, Universiti dalam empat siri pilihan raya yang terakhir di Terengganu melibatkan PRU tahun Kebangsaan Malaysia, Bangi, 1999, 2004, 2008 dan PRU tahun 2013. Hal ini kerana pertembungan dua parti Malaysia Melayu-Islam utama iaitu UMNO dan PAS sangat sengit. Keputusan pilihan raya Email: pasca PRU-10 menunjukkan bahawa Terengganu bukan lagi menjadi negeri selamat [email protected] buat mana-mana parti politik yang bertanding. Setiap parti dilihat mempunyai peluang yang seimbang untuk membentuk kerajaan di Terengganu. Hasil kajian menunjukan bahawa pembangunan merupakan faktor utama yang mempengaruhi pembentukan budaya politik Melayu di Terengganu sebelum dan selepas PRU ke-10. -

The Practice of Public Accounts Committee in the Parliament of Malaysia Siti Fahlizah Padlee* Abstract The Public Accounts Committee (PAC) of Malaysia is a permanent committee made up of members from Malaysia’s House of Representative, the Dewan Rakyat, and has grown in function since its establishment in 1959. The PAC initially served as a financial oversight body to check the financial procedures and performance accountability of executive bodies. Then, it started to pursue a series of reforms to make it more effective and accountable. Therefore, this research explores the current practices of the PAC in the Parliament of Malaysia pertaining to the appointment of its Chairman. It also analyses the implementation of two types of new meetings and identifies the relationship between the PAC with other stakeholders. The research employed a case study with an exploratory, descriptive approach using data collected from published reports of PAC meetings from 2017 to 2020, the PAC’s official website, interviews with a parliamentary officer-in-charge of handling the PAC, as well as international and local newspapers such as The Straits Times and The Edge. The research found that changes in the appointment of the Chairman have not affected the PAC reports as the core task of a Chairman is to set the committee’s agenda with consultation from the committee and Auditor General, as well as to ensure that the reports are released. The two new types of meeting (i.e. verification meeting and response reporting meeting) are crucial to enhance the PAC performance. Furthermore, the seven ex-officio possess prominent roles to provide and check the validity of data.
