Journal' to our esteemed readers. The Journal contains articles, transcription of talks and papers by Hon'ble Judges of the Allahabad High Court, Faculty Members of J.T.R.I. and also scholars of Law. We are deeply Indebted to Hon'ble the Chief Justice, Hon‘ble Mr. Justice Govind Mathur and all the Hon'ble Judges of the Allahabad High Court including Hon'ble Judges of the Lucknow Bench who have always been a constant source of guidance, inspiration and encouragement to us and to this Institute. We are highly obliged to Hon'ble the Chief Justice, Hon‘ble Mr. Justice Govind Mathur and Hon'ble Mr. Justice Pankaj Kumar Jaiswal, Senior Judge, Lucknow Bench and Judge in-charge J.T.R.I. for His Lordship‘s guidance and motivation. The preceding year has been full of activities and hectic for the Institute. The Institute also in compliance of the directions of the Hon‘ble Apex Court has been organizing various training related exercises on different topics. In this process a Special Training Programme, pertaining to the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection Act), 1994 has been/is being organized in terms of the directions of the Hon‘ble Supreme Court passed in the matter of Voluntary Health Association of Punjab v. Union of India & others [Writ Petition (Civil) no. 349/206 with SLP (Crl.) no. 5800/2013 and W.P. (C) no. 575/2014]. There is a strong transformation happening in Judiciary with adoption of technology. The Institute is involved in organizing mandatory courses in Induction and Refresher programmes on ‗Ubuntu 16.04 & CIS 2.0‘ for Judicial Officers and Refresher Training Programme on ‗Ubuntu 18.04-CUM-CIS 3.0‘ for Master Trainers (Judicial Officers) under the guidance and directions of Hon‘ble e-Committee, Supreme Court of India and Hon‘ble Steering Committee, Allahabad High Court of Uttar Pradesh. The Institute has been making its level best to provide quality training to the judicial officers and in this process has been able to conduct various training related exercises, under the able guidance and encouragement provided by the Hon'ble Judge In-charge and with the unflinching cooperation of Faculty Members and staff of the Institute. In this regard, Training Officers- Mr. Anurag Singh, Mrs. Archana Sharma and Ms. Sabiha Akhtar deserve appreciation for successful accomplishment of different training and other programmes organised and conducted by the Institute. We hope that we would be able to accomplish the future tasks successfully and to develop appreciable professional skills in the participants of different training programmes. D. Cornell University 2009 Commentators have frequently suggested that India is going through an “age of intolerance” as writers, artists, filmmakers, scholars and journalists among others have been targeted by institutions of the state as well as political parties and interest groups for hurting the sentiments of some section of Indian society. However, this age of intolerance has coincided with a period that has also been characterized by the “deepening” of Indian democracy, as previously subordinated groups have begun to participate more actively and substantively in democratic politics. This project is an attempt to understand the reasons for the persistence of illiberalism in Indian politics, particularly as manifest in censorship practices. It argues that one of the reasons why censorship has persisted in India is that having the “right to censor” has come be established in the Indian constitutional order’s negotiation of multiculturalism as a symbol of a cultural group’s substantive political empowerment. This feature of the Indian constitutional order has made the strategy of “seeking offense” readily available to India’s politicians, who understand it to be an efficacious way to discredit their competitors’ claims of group representativeness within the context of democratic identity politics.

Object of Bail u/s 437 or 439 CrPC : It has been laid down from the earliest time that the object of Bail is to secure the appearance of the accused person at his trial by reasonable amount of Bail. The object of Bail is neither punitive nor preventive. Deprivation of liberty must be considered a punishment unless it can be required to ensure that an accused person will stand his trial when called upon. The remedies include fast-tracking the implementation of Goods and Services Tax (GST) and easing of FDI (foreign direct investment) regulations in aviation and other sectors. Addressing a press conference on 5th June 2012, CII President, Adi B. Godrej, said that the primary concern for the nation was its GDP growth rate which was a mere 5.37 per cent in the last quarter was lowest in nine years. Tehelka investigators had captured on spy camera the president of the BJP, Bangaru Laxman, the Samata Party president, Jaya Jaitly (described as the ‘Second Defence Minister’ by one of the middlemen interviewed on videotape), and several top Defence Ministry officials accepting money, or showing willingness to accept money for defence deals. · This they had managed to do through a sting operation named Operation West End, posing as representatives of a fictitious UK based arms manufacturing firm. · Tehelka claims it paid out Rs. 10,80,000 in bribes to a cast of 34 characters. · Among the shots forming part of the four-and-a-half hour documentary are those of Bangaru Laxman accepting one lakh and asking for the promised five lakhs in dollars! He did not deny accepting the money. Bangaru Laxman resigns as BJP president. · Even before screening of the tapes at a press conference at a leading hotel here was over, the issue rocked both Houses of Parliament forcing their adjournment with the opposition demanding an immediate government statement on the issue. · The Union government says it is prepared for an inquiry into the tehelka.com expose of the alleged involvement of top politicians and government officials in corrupt defence deals. At an emergency Union Cabinet meeting George Fernandes reportedly offers to resign but the offer is rejected by the Prime Minister.
