    Definitions Under California Law Violations of California law constitute University policy violations and University policy violations also may constitute a violation of California law. Note the following definitions under the California Penal Code: Rape California Penal Code Section 261 (relevant excerpts) (a) Rape is an act of sexual intercourse accomplished with a person not the spouse of the perpetrator, under any of the following circumstances: (1) Where a person is incapable, because of a mental disorder or developmental or physical disability, of giving legal consent, and this is known or reasonably should be known to the person committing the act. (2) Where it is accomplished against a person's will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another. (3) Where a person is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance, and this condition was known, or reasonably should have been known by the accused. (4) Where a person is at the time unconscious of the nature of the act, and this is known to the accused. As used in this paragraph, "unconscious of the nature of the act" means incapable of resisting because the victim meets any one of the following conditions: (A) Was unconscious or asleep. (B) Was not aware, knowing, perceiving, or cognizant that the act occurred. (C) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator's fraud in fact. (D) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator's fraudulent representation that the sexual penetration served a professional purpose when it served no professional purpose.

LYNCH SUMMARY* Immigration The panel granted Roberto Lopez-Valencia‘s petition for review of the Board of Immigration Appeals’ decision finding that his California state petty theft conviction constituted an aggravated felony theft offense as defined by 8 U.S.C. § 1101(a)(43)(G). The panel held that a California theft conviction, including any offense for which the underlying substantive offense charged was a violation of California Penal Code § 484, is not a categorical theft offense. Applying the methodology established by Descamps v. United States, 133 S. Ct. 2276 (2013) and Rendon v. Holder, 764 F.3d 1077 (9th Cir. 2014), the panel held that California’s theft statute is both overbroad and indivisible, and that it does not match a generic federal theft offense or a theft offense as defined in 8 U.S.C. § 1101(a)(43)(G). June 16, 2021 Memorandum 2021-09 Draft of Death Penalty: Report and Recommendations At its May 2021 meeting, the Committee voted to recommend that California repeal the death penalty and that the Governor, Attorney General, local prosecutors, and the Legislature take other steps to remove people from death row. The attached draft of the report, which builds on earlier staff memorandums, presents the Committee’s recommendations about the death penalty as well as extensive background on the issue. The data referenced throughout the draft report is not final and should not be relied upon for any reason. The Committee now needs to decide whether to approve the attached draft of the report, with or without changes.     CALIFORNIA'S AGGRAVATED KIDNAPPING STATUTE -A NEED FOR REVISION William B. Enright* I. INTRODUCTION Under existing California law, one who demands money from a female victim, and who thereafter "helps" her upon a bed and criminally assaults her, has committed the crime of aggravated kid- napping.' As such, the activity so described is, and has been held, sufficient to warrant the imposition of the death penalty. Section 209 of the California Penal Code provides: Any person who . kidnaps . .. any individual to commit robbery ... shall suffer death or shall be punished by imprison- ment... for life without possibility of parole... in cases in which the person . subjected to such kidnaping suffers . bodily harm, or shall be punished by imprisonment.., for life with possi- bility of parole in cases where such person or persons do not suffer 2 bodily harm. It is difficult to conceive a situation in which the victim of a robbery does not make some movement under the duress occasioned by force or fear. In their interpretation of this statute, the California courts have stated that it is the fact of forceful movement, not the distance moved, which constitutes the statutory kidnapping. Hence, the coerced movement of a robbery victim, no matter how slight the distance, would conceivably be sufficient to place the typical robbery within the scope and provisions of the aggravated kidnapping statute. Then too, the simple taking of any article of personal property at any time before, during or after a sexual or other type of assault by its perpetrator, accompanied by movement of the victim, has been held sufficient to constitute kidnapping-for-robbery, thus bringing into play the penalties of death or life imprisonment without the possibility of parole.
