ii/25 EXECUTIVE SUMMARY

1. The 16th quarterly report is covered from 16 November 2011 to 15 February 2012. During the monitoring period, EMO has focused their activities mainly in , Northern and section such as direct observation on public meeting, contract making, and grievance process. Follow up and fine out outstanding issues.

2. DMS of the project was completely done with results totally 3,813 AHs. Among them there are 943 AHs in Poipet section, 318 AHs in Missing Link section, 839 AHs in Northern Line section, 207 AHs in Southern Line section, 1,268 AHs in Phnom Penh section and 238 AHs in station.

3. Until 15th February 2012, there are 3,547 AHs signed their contracts, comprising 931 AHs in Poipet section, 318 AHs in Missing Link, 839 AHs in Northern Line, 207 AHs in Southern Line and 1,252 AHs in Phnom Penh section. 186 BRTOs have signed their contracts which are comprised 147 in Northern Line section and 39 in southern Line section. Rental allowance was also provided to 130 tenants in Poipet section, Banteay Mean Chey province. Among 208 vendors (274 kiosks), there are only 177 vendors (231 kiosks) agreed to sign their contracts and get their payments. Other 31 vendors (43 kiosks) do not yet sign their contracts due to their kiosks are small and temporary.

4. The same as previous quarter, there are 3,514 AHs received their compensation payment, comprising 925 AHs from Poipet section, 318 AHs from Missing Link, 839 AHs from Northern Line, 207 AHs from Southern Line and 1,225 AHs from Phnom Penh section. 186 BRTO (318 AHs in Missing Link, 839 AHs and 147 BRTO in Northern Line, 204 AHs and 39 BRTO in southern line, and 443 AHs in Phnom Penh section), 130 tenants and 177 vendors (equal to 231 kiosks) also received payments for their compensations.

5. The total amount for cash compensation is USD 1,314,033.24, comprising USD 916,515.59 for structures compensation, USD 48,571.65 for tree compensation, USD 290,931.00 for other allowances, USD 45,875.00 for BRTOs, USD 9,750.00 for Tenant allowance and USD 2,390.00 for vendors in "Ra market".

6. On the other hand, EMO also followed up and found some outstanding issues during the monitoring period. Please read in section V and VI for more detailed information.

iii/25 I. INTRODUCTION

A. The Project

7. The Project primarily involves rehabilitation of the existing railway networks consisting of (i) 338 km section of the Northern Line linking Phnom Penh with Sisophon; (ii) 264 km of the Southern Line linking Phnom Penh with the port city of , and (iii) a 6-km branch line from Phnom Penh station to the petroleum depot facilities at Ton Le Sap River. The project works also include reconstruction of another 48 km of the Northern Line – called the “missing line” – from Sisophon to Thai/Cambodia border at Poipet, which was removed during the civil war of 1970s. The reconstructed line will re- establish the railway connection with Thailand.

B. Project Impacts

8. During the PPTA period, it was estimated that about 2,629 Households (AHs) will be affected by the railway rehabilitation project. In addition to the above number of affected households, there are also bamboo rail transport operators that will lose their source of livelihood once the railway lines are rehabilitated; 189 operators are currently operating along the whole line.

9. A survey team was mobilized by the ADB and IRC to survey and consult affected households and prepare Addendum to the approved RP 2006. For this purpose, the tasks of the survey team included the following: (i) reviewing the data base (from the IOL of the 2006 approved RP) of project affected households (AHs) to determine how many AHs would need relocating; (ii) looking for possible relocation sites and assessing their suitability in terms of being able to accommodate all landless AHs in a given locality, availability of public services, ability of the AHs to continue with their present sources of livelihood, environmental stability, etc; and (iii) determining the relocation options of the AHs. The survey team in March and June 2007 located as result in table 1:

In among of 1,418 AHs in Banteay Meanchey, Battambang, Pursat and Sihanoukville who needed relocation. 822 of them were in the master list of AHs of the approved 2006 RP which covers ten provinces and cities; the other 615 were newly identified AH1 but have been ascertained to be living in the COI even before the conduct of the IOL 2006.

11. Table 2 below contains an implementation schedule of the updated RP in Northern Line/Missing Link, Samraong station, Southern Line, Poipet section and Phnom Penh section. The URP in Samraong section is still in process of approval. The detailed activities are described in Annex 1.

IV. STATUS OF ACCOMPLISHMENT DURING THE MONITORING PERIOD

4.1 EMO’s Activities:

13. In the 16th quarter (from 16th November 2011 to 15th February 2012), EMO carried out their activities in Poipet, Northern Line and Phnom Penh section as following activities: - Direct observation on Public Meeting for relocation process; - Direct observation on Contract Making process with relocated AHs; - Direct observation on Grievance process with relocated AHs; - Follow up and fine out the outstanding issues on Resettlement Site; - Followed up and fine out the outstanding issues of DMS, Contract and Payment, particularly in Poipet and Phnom Penh section;

4.1.1 Direct observation on Public Meeting for relocation process

14. On 30th November 2011 at 14:30, there is a consultation meeting between IRC WG and AHs at meeting hall of Khan Reussei Kaev. There are 274 participants, comprising from IRC representatives, local authorities and 248 AHs. The meeting was chaired by H.E. NHEAN Leng, IRC Chairman/MEF. In Sangkat The 248 AHs are coming from 4 Sangkats, namely Sreah Chak, Tuol Sangkae, Reussei Kaev and Kilometer#6. The main purpose of the meeting is to discuss with AHs about the relocation to RS, specially all AHs have residential land less than or equal to 30m2, they have right to choose one of both options: 1) relocate to RS, they will receive one residential plot (105m2) and get the ownership after living there permanently 5 years; and 2) continue to living at the current place, but have to shift back out COI (3.5m from the railroad

4/25 centerline) and cannot get ownership on the land, because it is ROW belonging to state land. In result, all AHs in Sangkat Sreah Chak agreed to relocate to RS. 41 AHs (comprising 21 AHs from Sangkat Reussei Kaev, 10 AHs from Sangkat Kilometer #6 and 10 AHs from Sangkat Tuol Sangkae) refuse to move to the RS, they prefer to stay at the current place. Other 31 AHs can not decide in that time, because they need more times for discussing in among their household members. After the meeting, IRC WG will go directly to every Sangkat to discuss on the issues with AHs are not yet decided.

Meeting at Khan Reussei Kaev on 30th November 2011

15. On 27th December 2011 at 8:00 am, at Neakvaon pagoda, Khan Dau Penh, there was a meeting, chaired by Mr. Sim Samnang, deputy director of resettlement department/MEF. The meeting purpose is to discuss with AHs about their relocation to RS. There are 94 participants, comprising from IRC representatives, local authorities and 71 AHs. The 71 AHs are coming 20 AHs from Khan Daun Penh and 51 from . Mr. Samnang explained that the first relocation is priority to AHs who lost their houses more than 25%, but this time is included all AHs who have the remained residential land less than or equal to 30m2 will have right to move to RS if they want. Otherwise, they can continue to live at the existing place. He also mentioned about infrastructures were setting up at the RS: road access, water supply system, electricity supply, toilets and drainage system. In addition, people will get the ownership after permanent living there for 5 years.

16. On 28th December 2011 at 8:30 am, at meeting hall of Khan Reussei Kaev, there was a meeting, chaired by Mr. Sim Samnang, deputy director of resettlement department/MEF. The meeting purpose is to discuss with AHs about their relocation to RS. There are 124 participants, comprising from IRC representatives, local authorities and 108 AHs, coming from Sangkat Tuol Sangkae, Khan Reussei Kaev. Samnang explained that the first relocation is priority to AHs who lost their houses more than 25%, but this time is included all AHs who have the remained residential land less than or equal to 30m2 will have right to move to RS if they want. Otherwise, they can continue to live at the existing place. He also mentioned about infrastructures were setting up at the RS: road access, water supply system, electricity supply, toilets and drainage system. In addition, people will get the ownership after permanent living there for 5 years. He added IRC WG will go directly to every house for making a contract. The schedule will be informed by LA. Therefore, everybody can have enough time to discus the issue with their household members.

Meeting at Khan Reussei Kaev on 28th December 2011

17. On 29th December 2011 at 8:30 am, at meeting hall of Khan Reussei Kaev, there was a meeting, headed by Mr. Sun Sokny, Chief Office of Multilateral Project of Resettlement Department/MEF. The meeting purpose is to discuss with AHs about their relocation to RS. There are 85 participants, comprising from IRC representatives, local authorities and 68 AHs, comprising 40 AHs from Sangkat Reussei Kaev and 28 AHs from Sangkat Kilometer #6, Khan Reussei Kaev. Mr. Sun Sokny reported that the Railway project is covered 10 Provinces and Municipality. Only Phnom Penh, there are 1,268 AHs, among them 161 AHs are landless or have residential land less than 30m2. The 161 AHs have right to choose one of both options: 1) relocate to RS, they will receive one residential plot (105m2) and get the ownership after living there permanently 5 years; and 2) continue to living at the current place, but have to shift back out COI (3.5m from the railroad centerline) and cannot get ownership on the land, because it is ROW belonging to state land. He added IRC WG will go directly to every house for making a contract. The schedule will be informed by LA. Therefore, everybody can have enough time to discus the issue with their household members.

4.1.2 Direct observation on contract making process with relocated AHs

18. From 30th December 2011 to 19th January 2012, IRC WG jointly with PRSC of Phnom Penh City (9 members) has registered AHs, who have residential land less than or equal to 30m2, with result as states in table below:

Remark: During the mission, there are some remarkable issues as following: 1- There are five AHs, namely Mr. Teat Hai in Sangkat Phnom Penh Thmei, Mr. Tauch Seak, Mr. Sok Samnang in Sangkat Kilometer#6 and Mr. Kheav Nun, Mr. Kheng Phally in Sangkat sreah Chak, have received cash compensation payment from IRC for their lost properties and relocated to other places without any information. 2- In Sangkat Reussei Kaev, there are two AHs who have double (repeat) name in the registered list, therefore IRC WG have cleaned it. HH Head’ names of the two AHs, namely Mr. Lou Yun and Mr. Chea Kim Sreang. 3- In Sangkat Sreah Chak, there is one village center of village Bei is affected by the project. After checking, the remained land is available for reconstruct the center. Therefore, the affected village center will be paid by IRC, but IRC will not provide to village chief a plot at RS. The village chief’s name is Mr. Duong Sim.

7/25 4.1.3 Direct observation on Grievance process with relocated AHs

19. On 27th January 2012 at 8:30 am, there is a consultation meeting between IRC WG and AHs (who have no answer, to move to RS or not) at Tuol Sangkae pagoda, in Tuol Sangkae village/Sangkat, Khan Reussei Kaev. There are 17 committee members, comprising from IRC representatives, local authorities and 70 AHs, comprising 59 AHs from Sangkat Tuol Sangkae, 10 AHs from Sangkat Boeung Kak II and 1 AH from Sangkat Sreah Chak. The meeting was chaired by Mr. SIM Samnang, deputy director of resettlement department/MEF. Mr. SIM Samnang reported in the second relocation, there are 247 AHs entitle to move to the RS. Up to now, there are 98 AHs agreed to move to the RS, 66 AHs agreed to stay at the existing place and 60 AHs have no answer. He added IRC give more time to the 60 AHs for ten days to decide to go to the RS or not. If not move to the RS, you have to shift back your structure from COI.

20. On 8th February 2012 at 8:30 am, there is a consultation meeting between IRC WG and AHs (who have no answer, to move to RS or not) at Tuol Sangkae pagoda, in Tuol Sangkae village/Sangkat, Khan Reussei Kaev. There are 6 committee members, comprising from IRC representatives, local authorities and 59 AHs from Sangkat Tuol Sangkae. The meeting was headed by Mr. Chheang Chhor Line, TL of IRC WG of resettlement department/MEF. Mr. Chheang Chhor Line confirmed to participants if they agreed it means they will move to the RS. If they do not, it means they are staying at the existing place, so they have to move out from COI. In result, there are only two AHs agreed to move to the RS, other rest do not.

21. On 9th February 2012 at 8:30 am, there is a consultation meeting between IRC WG and AHs (who have no answer, to move to RS or not) at Neakvaon pagoda. There are 6 committee members, comprising from IRC representatives, local authorities and 10 AHs from Sangkat Boeung Kak II. The meeting was headed by Mr. Chheang Chhor Line, TL of IRC WG of resettlement department/MEF. Mr. Chheang Chhor Line confirmed to participants if they agreed it means they will move to the RS. If they do not, it means they are staying at the existing palce, so they have to move out from COI. In result, nobody agreed to move to the RS.

4.1.4 Follow up and fine out the outstanding issues on Resettlement Site

Phnom Penh Section:

22. On 14th February 2011 at 14:30, EMO has visited the RS locates in Ork Roduol village, Sangkat Samroang Kroam, . The RS is approximately 7 ha (1st time: 2.77 ha and 2nd time: 4.24 ha). 148 AHs have received residential plots at the RS. 113 AHs are living at the RS. Other 29 AHs just constructed their houses, but they leave to Phnom Penh for their business. 147 AHs have received allowances for their connection fee of electricity (KHMR 77,100) and water supply (KHMR 64,000), except one AH of plot #51 refuse to get the allowance, because she request more amount. The drainage system and toilets are functioned well.

General situation of RS in Samraong/Phnom Penh

Poipet section (Poipet RS):

23. On 18th February 2012, there was a FGD started at 9:00 am and finished at 10:30 am at Poipet RS. The meeting was moderated by Mr. Nhean Bona and Mr. Cheng Sara, as a note taker with 5 female and 3 males who are living at the RS. The meeting was focused on their living condition at the RS. Some problems were identified during the group discussion: 1) Drainage and toilet system are not functioned well. It causes to erode access road; 2) Traveling in wet season is difficulty, because the access road is mud and slipping; 3) Garbage, which is collected from Poipet town, is through away and burned near the RS. It produces smoke and stink smell that is very dangerous for health.

24. Refer to the three issues, IRC responded as follow: 1- The RS responsibility was transferred to LA since September 2011. Therefore, all infrastructures are under community or LA responsibility for both repair and maintenance; 2- In this year, LA will construct a concrete road for the access road to the RS; 3- At the time IRC has bought the land for RS improvement, there is no garbage around the area. LA just permits the private investor to establish landfill nearby the RS. IRC has tried many times to discuss with the Poipet town Governor to solve the problem. The solution is in process.

General situation of RS in Poipet

Northern Line (Pursat RS):

25. During the field visit at Pursat RS, EMO found some issues: i) Water tank is well organized, but water pump is not good installed. It causes to the water quality (mud); and ii) access road was eroded by flood during the last wet season. It is very dangerous for children to go to school in rainy season.

26. Refer to the three issues, IRC responded as follow: 1- The water is used for all people around the area, not only the relocated household in the RS. The community or LA can improve the water pump condition by themselves, because the RS was transformed to then since September 2011; 2- The access road was already repaired by IRC, but it still broken for every wet season. Therefore, the community or LA have to find the way to fix it by them self, because IRC is not any more responsible for the RS.

28. - Contract making process: Until 15th February 2012, there are 3,547 AHs signed their contracts, comprising 931 AHs in Poipet section, 318 AHs in Missing Link, 839 AHs in Northern Line, 207 AHs in Southern Line and 1,252 AHs in Phnom Penh section (see table 3 above for more detailed results).

Among 208 vendors (274 kiosks) in “Ra” market, there are only 177 vendors (231 kiosks) agreed to sign their contracts and get their compensation payments. 30. - Payment process: The same as previous quarter, there are 3,514 AHs received their compensation payment, comprising 925 AHs from Poipet section, 318 AHs from Missing Link, 839 AHs from Northern Line, 207 AHs from Southern Line and 1,225 AHs from Phnom Penh section.

31. 186 BRTO (318 AHs in Missing Link, 839 AHs and 147 BRTO in Northern Line, 204 AHs and 39 BRTO in southern line, and 443 AHs in Phnom Penh section), 130 tenants and 177 vendors (equal to 231 kiosks) also received payments for their compensations.

32. The total amount for cash compensation is USD 1,314,033.24, comprising USD 916,515.59 for structures compensation, USD 48,571.65 for tree compensation, USD 290,931.00 for other allowances, USD 45,875.00 for BRTOs, USD 9,750.00 for Tenant allowance and USD 2,390.00 for vendors in "Ra market". 33. In Poipet section, there are 6 AHs do not yet get their compensation amounts (please see in table 9). Mr. Chheang Chhor Line, TL of IRC WG, explained they will get their cash compensation amount when construction work is starting there. At the moment, the payment cannot be done, because there is a critical place where people can easier encroach into the COI and it is difficult to protect them.
