91 APPENDIX C RECOMMENDATIONS OF THE HERITAGE COUNCIL OF NSW

The following recommendations were made to the Minister for Urban Affairs and Planning by the Heritage Council of NSW:

It was resolved that the Heritage Council of NSW:

AUGUST 2000

Heritage Incentives Program for 2000/2001 · recommend to the Minister, pursuant to Section 106 of the Act, that he approve of dollar for dollar funding of up to $22,500 in the current year to enable Leeton Shire Council to purchase the Henry Lawson Cottage at Leeton and dollar for dollar funding of up to $30,000 in 2001/2002 to ensure its long term conservation and to enable community based access to the property.

Continued funding for Movable Heritage Officer Position and Thematic Studies

· recommend that $20,000 be allocated to thematic studies under this years Heritage Incentive Program and $30,000 from the administrative budget.

OCTOBER 2000

Archaeological Delegations to the Department of Urban Affairs and Planning (DUAP)

· recommend to the Minister the approval of the delegation for certain archaeological approvals under section 57 and section 139 of the Heritage Act 1977 to Mr Denis Gojak, Heritage Asset Manager, Department of Urban Affairs and Planning, subject to the following conditions: a) This delegation is made to Mr Denis Gojak, Heritage Asset Manager, Department of Urban Affairs and Planning, hereafter ‘the Delegate’. b) This delegation applies to the following lands only: i) All lands owned by the Corporation Sole (The Minister administering the Environmental Planning and Assessment Act 1979) within the County of Cumberland, and ii) all lands listed on the NSW Department of Urban Affairs and Planning section 170 Heritage Register. c) Approval is delegated for the following specific classes of minor works affecting archaeological relics (under s63 and s141 of the NSW Heritage Act 1977):

i) monitoring (where there is an expectation of only minor archaeological remains and supervision is required primarily to record archaeological information); ii) surface collection (where artefacts are removed or collected without excavation from a context with no stratigraphic integrity); iii) test excavation (where small scale excavation is undertaken on a site to

92 determine the extent and preservation of a larger archaeological resource); iv) where the works are covered by the standard exemptions or by specific exemptions for that site;

d) Major archaeological projects (including large scale salvage or research excavations) must be referred to the Heritage Office for approval. e) Where the delegate is uncertain whether proposed work is major or minor, or where the work may be controversial the matter must be referred to the Director of the Heritage Office. f) The Delegate must ensure applications and permits comply with Heritage Council requirements, guidelines, regulations and conditions at all times. The Delegate may set additional conditions which do not conflict with Heritage Council conditions. Heritage Council conditions may not be waived without the written consent of the Heritage Council. g) The delegation can be used to approve works by DUAP historical archaeologists, external historical archaeological consultants and qualified academics. In cases where the Excavation Director is the Delegate (Mr Denis Gojak), the application must be referred to the Heritage Office for approval. h) The Delegate will promptly report any breach of permit conditions or other breaches of the Heritage Act to the Heritage Council. i) The Delegate shall supply a summary report of all permits issued under delegation, on a quarterly basis, in accordance with a schedule supplied by the Heritage Office. j) One copy of any archaeological assessment supplied with an application and one copy of any final report shall be supplied to the Heritage Office for review purposes and for lodgment in the DUAP library to provide a single collection of reporting on all archaeological work undertaken in NSW. Pending its eventual relocation into the Heritage Council collection. k) Application fees for permits issued by the Delegate are waived by the Heritage Office. The Delegate, at its discretion, may collect fees from applicants. Fees shall not exceed the amount specified in the Regulations to the NSW Heritage Act. This delegation will be subject to review on a two yearly basis, or at such time Mr Denis Gojak ceases employment as the DUAP Heritage Asset Manager.

DECEMBER 2000

Local Government Delegations

Resolved: that the Heritage Council:

· recommend to the Minister that the revised Ministerial Order: Authorisations for local councils to make Interim Heritage Orders be signed and gazetted; · endorse the delegation of functions of the Heritage Council of NSW to all local councils in NSW and seek the agreement of the Minister to these delegations; · endorse the revised delegation of archaeological functions to Randwick Council and Sydney City Council for a trial period of one year and seek the agreement of the Minister to these delegations.

93 Heritage Incentives Program for 2000/2001

Resolved that the Heritage Council:

· recommend to the Minister, pursuant to Section 106 of the Heritage Act, 1977 that he approve 161 projects totalling $1,057,020 [comprising]: a) $717,520 in 138 grants to local government to undertake the heritage projects set out in the 4 page schedule at Annexure A. b) $309,500 in 11 grants to 5 heritage related agencies as set out in Annexure B c) $30,000 in grants to the owners/managers of 12 items of state heritage significance for the purpose of undertaking conservation management plans as set out in Annexure C.

FEBRUARY 2001

Byron Bay Community Centre Proposed $50,000 Grant

· that the Heritage Council recommend to the Minister, pursuant to Section 106 of the Act, that he approve of funding of up to $50,000 in 2001/2002 to enable the Byron Bay Community Association to reinstate a two storey verandah to the 1907 Byron Bay Community Centre as part of an overall redevelopment of the site to establish a community centre. The grant to be subject to the standard applicable conditions and the following special condition: the exact cost of the verandah project to be subject to a vigorous tender process both inside and outside the local area.

George Proudman Fellowship – Proposed Sponsorship

· that the Heritage Council recommend to the Minister, pursuant to Section 106 of the Act, that he approve of a grant of $20,000 in the 2000/2001 year to the Department of Public Works and Services to establish the George Proudman Fellowship.

RECOMMENDATIONS OF THE STATE HERITAGE REGISTER COMMITTEE

The following recommendations were made to the Minister for Urban Affairs and Planning by the State Heritage Register Committee, as delegate of the Heritage Council:

JULY 2000

Australia Post properties · advises the Minister that the Post Offices at Tamworth, Kempsey, Wingham, Paddington, North Sydney, Orange, Forbes and Wellington are items of State heritage significance; and · recommends to the Minister that the Post Offices at Tamworth, Kempsey, Wingham, Paddington, North Sydney, Orange, Forbes and Wellington be listed on the State Heritage Register.

UNE Forests

1. acknowledges that areas of High Conservation Value Old Growth (HCVOG.) in the UNE Region* are of State heritage significance as defined under the Heritage Act; 2. defers consideration of any areas which may on further investigation contain HCVOG*, on freehold or Crown leasehold lands (including leasehold on State Forests) pending notification to the individual affected property owner or occupier as required by section 33(1)(a) of the Heritage Act; 3. subject to resolution 2 above, recommends to the Minister the listing of HCVOG* within the Upper North East Region, on the State Heritage Register for: a) those parts of National Parks, Nature Reserves and State Forests containing HCVOG*; 4. recommends that, in respect of such of those areas referred to in resolution 2 as the Minister directs be listed on the State Heritage Register, the Minister subsequently makes exemptions under section 57(2) of the Heritage Act for all activities: a) authorised under Integrated Forestry Operations Approvals (IF0As); and b) consistent with the provisions and obligations of approved Plans of Management under the National parks and Wildlife Act, the Forestry and National Parks Estate Act and the resultant Forest Agreements and that of the subsequent NSW and Commonwealth Governments joint North East Regional Forest Agreement; 5. defers a decision on Candidate Old Growth (COG) until further information is available to the Heritage Council; and 6. seeks information on the status of the other regional assessments and agreements and the applicability of this approach for consideration for listing HCVOG* on the State Heritage Register.

For the purposes of this resolution, HCVOG within the Upper North East Region means those areas of land which are:

(i) depicted in the Geographic Information System theme in ESRI grid form, at called "hco vog l~-prtctd" in the sub-directory called "Protected HCVOG" on the CD-Rom, lodged with DUAP and having the volume label "9912211516 (21 December 1999)". and (ii) further described in the corresponding metadata on the CD-Rom.

# For the purposes of this resolution the Upper North East Region is the area as described in section 1.4 of the Forest Agreement for the Upper North East Region, Government, 5 March, 1999.

National Trust Properties

· advises the Minister that, the following National Trust of Australia (NSW) properties: Ahimsa, Brough House, Cooma Cottage, Dundullimal, Everglades, Grossman House, Harpers

Nomination of Properties in Municipality of Ku-ring-gai

· recommends to the Minister that he make Interim Heritage Orders in respect of the properties at 9 Macintyre Street, Gordon, 41 Nelson Street, Gordon, and 50 Rosebery Street, Killara, which the Minister considers may, on further investigation, be found to be items of heritage significance.

44 Barden Street, Tempe

· advises the Minister that 44 Barden Street, Tempe is an item of State significance; and · recommends to the Minister that 44 Barden Street be listed on the State Heritage Register with a curtilage that is limited to include the front quarter of the property as shown on the I-IC plan retained by the Heritage Office.

Bong Bong Church and Graveyard recommends to the Minister the making of the following exemptions under Section 57(2) of the Heritage Act: · new interments, including the placement of ashes, provided no relics are disturbed; · the erection of new grave monuments provided they are in keeping with those existing, and do not involve the disturbance of any relics. This exemption does not apply to columbaria, or other development exceeding the erection of monuments associated with individual interments from time to time; · the addition of inscriptions on monuments; · the cleaning of monuments, including relics, using soft, non-abrasive, bristle brushes and a diluted detergent solution; · hand weeding of grave plots; · mowing of lawns and paths, provided monuments are not damaged; · careful spraying of paths with selective herbicide, provided monuments are protected from the chemicals; and · maintenance of any roads, paths, signs, fences, drains, vegetation, and buildings where maintenance means the continuous protective care of existing materials.

State Heritage Register listing of NPWS Estate

· Support listing of whole parks/reserves not pieces/parts. · Recommend to the Minister that he gazette standard exemptions under Section 57(2) of the Heritage Act 1977, for activities which comply with an existing Plan of Management or with the policy document ‘Park Management Prior to Adoption of a Plan of Management’. MANAGEMENT OF THE HERITAGE OFFICE

Director

Rosalind Strong has been the Director of the Heritage Office since its establishment in July 1996 and has led the Office in the implementation of the NSW Government Heritage Policy. This has included significant amendments to the NSW Heritage Act 1977. Mrs Strong’s previous position was Assistant Director-General in the Department of Training and Education Co-ordination, responsible for adult education and vocational training. Mrs Strong has raised the profile of heritage across government, in schools and within local communities. Her long involvement in migrant and multicultural education has also proved invaluable in widening the focus of the Heritage Council and the Heritage Office in relation to the diversity of the State’s heritage. She became a member of the Heritage Council in 1996.

CEO Performance Statement

Mrs Strong is the Heritage Office’s only SES officer. The Minister for Urban Affairs and Planning has indicated his satisfaction with Mrs Strong’s performance throughout the reporting period with regard to the following specific responsibilities:

· knowledge of NSW heritage, its significance and conservation · government leadership in heritage management · local heritage management · value of heritage to the community · conservation practice standards · role and functions of the Heritage Council · support to the Minister and Heritage Council · development of the Heritage Office and its staff.

Assistant Director

In July 1998 Reece McDougall commenced as Assistant Director of the Heritage Office. Mr McDougall began his career as a ranger with the NSW Forestry Commission, and was later a research officer with the National Trust for six years. He moved from the Trust to the Sydney Water Board as a senior environmental scientist and later became principal consultant with AWT Ensight, the commercial arm of the Sydney Water Corporation.

Mr McDougall’s key role is to co-ordinate and supervise the work of the Principal Heritage Officers in reaching the targets of the strategic plan.
