The publication of this document is the fourth formal stage in preparing the Local Plan Part 2. The main anticipated stages and timetable for preparing the Local Plan Part 2, including those stages already completed, are as follows: Stage Timetable Consultation on Issues and Options and January 2016 (completed) Sustainability Appraisal Scoping Report Further Options Consultation February 2017 (completed) Consultation on Preferred Housing Sites October 2017 (completed) Publication of draft Local Plan Part 2 May 2018 Submission of draft Local Plan Part 2 to July 2018 the Secretary of State Public examination of draft Local Plan Part September 2018 2 Adoption of Local Plan Part 2 December 2018 2. This is the Publication version of the Local Plan Part 2: Land and Planning Policies Development Plan Document, prepared to satisfy Regulation 19 of the Town and Country Planning (Local Planning) (England) Regulations 2012 (“the Regulations”). This means that it is the Local Plan Part 2 in the format which the Council wishes to submit for public examination (in accordance with regulation 22 of Regulations) and then to be adopted as part of the statutory development plan for Rushcliffe. 3. The rest of the document is therefore written as if it is that final document: i.e. the one the Council wants to adopt. This gives everyone the opportunity to read the Local Plan Part 2 and consider if they wish to make representations on its contents. 4. The representations will be considered alongside the Local Plan Part 2 when submitted for public examination. It is estimated that it will then be examined by a Planning Inspector starting in September 2018. Following on from examination, it is currently expected that the Local Plan Part 2 will be adopted in December 2018. i Local Plan Part 2: Land and Planning Policies 5. The Planning and Compulsory Purchase Act 2004 (as amended) states that the purpose of the examination is to consider whether the Local Plan Part 2 complies with legal requirements and is ‘sound’. Representations submitted therefore should relate to the requirements of legal compliance or the ‘tests of soundness.' The legal requirements require the Local Plan Part 2 to: be prepared in accordance with the Local Development Scheme (i.e. the Council's timetable) and in compliance with the Statement of Community Involvement and the Town and Country Planning (Local Planning) (England) Regulations 2012; be subject to a sustainability appraisal; be prepared in accordance with the Duty to Cooperate; and have regard to national policies and advice in guidance issued by the Secretary of State. 6. The tests of soundness will be considered by a Planning Inspector at public examination and require that in order to be 'sound' the document should be: Justified – founded on a robust and credible evidence base and is the most appropriate strategy when considered against reasonable alternatives Effective – deliverable, flexible and able to be monitored Consistent with national policy How to respond 7. Detailed guidance on how to make representations is available on the Council’s website (www.rushcliffe.gov.uk/planningpolicy), at the Rushcliffe Community Contact Centre on Rectory Road in West Bridgford and at libraries within Rushcliffe. 8. The representation period will end at 5pm on Thursday 28 June 2018. 9. Representations can be made against the whole of Local Plan or any part of it, including individual policies and proposals. Ideally, all representations should be made via the Council's online consultation system at http://rushcliffe-consult.objective.co.uk/portal or on representation forms, which are available at www.rushcliffe.gov.uk/planningpolicy, at Rushcliffe Community Contact Centre on Rectory Road, West Bridgford, or at local libraries. ii Local Plan Part 2: Land and Planning Policies 10.
