The Kingston upon Thames (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 38) Order 2021 and The Kingston upon Thames (Charged-For Parking Places) (Amendment No. 38) Order 2021.

1. NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kingston upon Thames on 15th February 2021 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended.

2. The general effect of the Orders, which will come into force on 22nd February 2021, will be to continue in force indefinitely the provisions of The Kingston upon Thames (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 20) Experimental Order 2020 and The Kingston upon Thames (Charged- For Parking Places) (Amendment No. 20) Experimental Order 2020 which; (a) in Surbiton Road (on the north-east side); an existing ‘pay & display’ parking place is shortened / re-located and its ‘maximum stay’ period is 1 hour (previously 2 hours) (outside Nos. 45-53); double yellow line “at any time” waiting restrictions apply outside Nos. 53 to 75; a loading restriction (operating between 7 a.m. to 10 a.m. and 4 p.m. to 7 p.m.) applies outside Nos. 53 to 57; and an “at any time” loading restriction applies outside Nos. 59 to 75; (b) in Surbiton Road (on the south-west side); an existing ‘pay & display’ parking place is shortened; a minor alteration is made to the location of a ‘goods vehicles loading only’ parking place (due to the lengthening of an adjacent bus stop); a double yellow line “at any time” waiting restriction and an “at any time” loading restriction apply outside St. Nicholas Court; (c) in Surbiton Crescent (on the north-west side, at its junction with Surbiton Road); a length of existing loading restriction is converted to an “at any time” loading restriction; and (d) in Southsea Road (on both sides, at its junction with Surbiton Road); existing double yellow line “at any time” waiting restrictions are shortened; and existing loading restrictions are removed. Please note; this experimental scheme (KingMap0032) was introduced (see notice dated 26th September 2019) before being modified (see notice dated 30th January 2020).

3. Due to the current Coronavirus pandemic, the Orders and other documents giving more detailed particulars of the Orders (made documents) cannot currently be inspected at Guildhall 2. However, in line with guidance from the Department for Transport, the following alternative arrangements have been made; a) the made documents can be inspected online at https://www.kingston.gov.uk/unmade-traffic-management-orders; and b) copies of the made documents can also be obtained by calling 020 8547 5000 (between 9 a.m. and 5 p.m. on Mondays to Fridays) or by emailing [email protected] (please quote ref. KingMap0032). The made documents will be available until 29th March 2021.

4. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may make application for the purpose to the High Court by 29th March 2021.

STATEMENT OF REASONS

This scheme is brought into permanent effect having been introduced and modified on an experimental basis.

The scheme, which includes innovative cycleway designs*, has been reviewed and has operated safely in the experimental period. There have been no objections and so the traffic management orders can be made permanent.

The experimental scheme provided for the introduction of a two-way segregated cycleway in Surbiton Road (A240) which necessitated amendments to existing waiting and loading restrictions and the removal or re-location of existing parking places.

The scheme was modified (see notice dated 30th January 2020) so as to lengthen an existing ‘pay & display’ parking place and reduce its ‘maximum stay’ period to 1 hour.

* The cycleway along Surbiton Road is part of route C29 of London's core cycle network. It provides a safe and convenient route for cyclists, segregated from motor traffic in line with London's Cycling Design Standards. The scheme supports the Council's sustainable transport strategy. The restrictions and stipulations are required in order for the new cycleway to function while also allowing sufficient on-street loading, parking, loading and waiting concessions to support local businesses and residents and maintaining the road's capacity as a Highway for the passage of traffic, including high frequency bus routes.

The Council of the Royal Borough of Kingston upon Thames, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by sections 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984(a) as amended by section 8 of and Part I of Schedule 5 to the Local Government Act 1985(b), and of all other powers thereunto enabling, hereby make the following Order:-

1. This Order shall come into force on 22nd February 2021 and may be cited as the Kingston upon Thames (Charged-For Parking Places) (Amendment No. 38) Order 2021.

2. In this Order:-

(1) “the Order of 2018” means the Kingston upon Thames (Charged-For Parking Places) (No. 2) Consolidation Order 2018;

(2) the expression “enactment” means any enactment, whether public general or local, and includes any order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment; and

(3) any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.

3. (1) Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, the Order of 2018 shall have effect as though for the map tile attached to that Order and specified in column 1 of the Schedule to this Order, there were substituted the map tile attached to this Order and specified in relation thereto in column 2 of the Schedule to this Order.

(2) The substitution of any map tile referred to in Article 3.1 of this Order will have the effect of revoking any provision provided or designated by a previous version of that map tile and not incorporated into the latest version.
