Village of Kohler 2010 Board of Review September 2, 2010 The 2010 Board of Review was called back into session at 5:00 p.m. Board of Review members present: Tom Reilly, John Stevens, Jim Price, John Garland, and John Woodrum. Staff members present: Laurie Lindow and Cindi Gamb. Also present: Village Attorney Paul Dirkse, Village Commercial Assessor Perry Nell, Village Special Attorney Alan Marcuvitz, and Kohler Co. Representative Ed Devine. Business Reconvene 2010 Board of Review to conduct evidentiary hearings and take action upon Kohler Co. Attorney Dirkse explained that the written stipulations were submitted and would be reviewed and then confirmed by each party. The stipulations read as follows: Stipulation & Determination 2010 Board of Review Kohler, Wisconsin Stipulation The undersigned agree to the following change to the 2010 assessment on the property known as Black Wolf Run, Kohler, Parcel No: 675346. From To Change Land $ 1,400,000 $ 1,400,000 $ 0 Improvements $20,960,000 $17,600,000 $-3,360,000 Total $22,360,000 $19,000,000 $-3,360,000 The owner of the above described property understands that Sec. 70.47(12), Wisconsin Statutes, grants the owner the right to receive written notice from the Board of Review that it is changing the assessment on the assessment roll. The owner agrees with the assessment stated above. If the aforesaid assessment is entered on the assessment roll, the owner hereby waives any right to receive further notice of said change from the Board of Review. Also, under Sec. 70.47, Wisconsin Statutes, the owner waives any right to a hearing before the Board of Review to request a reduction in the aforesaid assessment and waives all rights to appeal or otherwise challenge the aforesaid assessment. Each party represents and agrees that the undersigned is empowered to enter into this stipulation, that all procedural requirements have been complied with, and that all procedural irregularities, if any, are waived and shall not form a basis for setting aside this stipulation. Ed Devine stated that Kohler Co. was in agreement with the stipulations as presented, they had no objections, and the Kohler Co. agreed to waive their right for a claim of excessive assessment. Motion by John Woodrum, second by Jim Price to accept the stipulation as presented for parcel no: 675346 Blackwolf Run. Motion carried. Determination: the Board of Review accepts the foregoing Stipulation and sets the 2010 assessment as follows: Land $1,400,000; Improvements $17,600,000; Total $19,000,000.
