Former Hokie Michael Vick, the first player picked in the 2001 NFL Draft, is scheduled to take over the starting quarterback duties for the Atlanta Falcons in 2002. Special Teams are an integral part of Hokie football and one of the units is called “Pride and Joy.” These NFL players are also a source of pride and joy due to their commitment to Virginia Tech on and off the field. Virginia Tech has recently constructed a display in the Hall of Legends in the Merryman Athletic Center to honor such former players. John Engelberger was a dominating defensive end who went from walk-on to four-year starter at Tech, to second-round NFL Draft pick, earning All-America honors and his college degree along the way. Waddy Harvey was a standout who started three seasons at defensive tackle and won the coveted Williams Award for leadership and character before joining the Buffalo Bills. Frank and Cheryl Beamer sponsored Harvey for recognition on the Pride and Joy display. Before starting an NFL career, Jim Pyne, a powerful center in the early 1990s, started 41 games and allowed just one sack in over 2,700 snaps on his way to becoming the Hokies’ first unanimous All-American. Michael Vick was an electrifying quarterback who made a lasting impact on college football while helping Virginia Tech to a national championship game and back-to-back 11-1 seasons before becoming the top NFL pick in 2001. Jim Pyne was the first player chosen overall in the NFL’s 1998 expansion draft. Tech Players in the Pros The following former Hokies are either presently playing or have played in the National Football League or the United States Football League: (players in bold were active as of June 25, 2002) Larry Austin ..................

DEVELOPMENT, EVOLUTION, AND BARGAINING IN THE NATIONAL FOOTBALL LEAGUE Thomas Sisco The National Football League [hereinafter: NFL] is the most popular professional sports organization in the United States, but even with the current popularity and status of the NFL, ratings and the public perception of the on-field product have been on steady decline.1 Many believe this is a byproduct of the NFL being the only one of the 4 major professional sports leagues in the country without a self-controlled system for player development. Major League Baseball [hereinafter: MLB] has a prominent and successful minor league baseball system, the National Hockey League has the American Hockey League and East Coast Hockey League, the National Basketball Association [hereinafter: NBA] has the 22 team development league widely known as “The D- League”, but the NFL relies on the National Collegiate Athletic Association [hereinafter: NCAA] to develop young players for a career in their league. The Canadian Football League and the Arena Football League are generally inadequate in developing players for the NFL as the rules of gameplay and the field dimensions differ from those of NFL football.2 NFL Europe, a developmental league founded by Paul Tagliabue, former NFL Commissioner, has seen minor success.3 NFL Europe, existing by various names during its lifespan, operated from 1991 until it was disbanded in 2007.4 During its existence, the NFL Europe served as a suitable incubator for a 1 Darren Rovell, NFL most popular for 30th year in row, ESPN (January 26, 2014), http://www.espn.com/nfl/story/_/id/10354114/harris-poll-nfl-most-popular-mlb-2nd, .

This Opinion is Not a Precedent of the TTAB Mailed: November 6, 2019 UNITED STATES PATENT AND TRADEMARK OFFICE _____ Trademark Trial and Appeal Board ———— University of Louisiana at Lafayette v. Richards Cajun Foods Corp. ___ Opposition No. 91233876 ___ Blair B. Suire and Robert L. Waddell of Jones Walker LLP for University of Louisiana at Lafayette. Evan D. Brown and Adam K. Sacharoff of Much Shelist, P.C. for Richards Cajun Foods Corp. ______ Before Kuhlke, Adlin and Pologeorgis, Administrative Trademark Judges. Opinion by Adlin, Administrative Trademark Judge: Applicant Richards Cajun Foods Corp. seeks registration of GEAUX CAJUN, in standard characters, for “fresh and processed meat products, namely, sausage; smoked sausage.”1 Opposer University of Louisiana at Lafayette, in its second 1 Application Serial No. 87173267, filed September 16, 2016 under Section 1(b) of the Trademark Act, based on an alleged intent to use the mark in commerce. According to the application, “[t]he English translation of ‘GEAUX’ in the mark is ‘GO’.” Opposition No. 91233876 amended notice of opposition,2 alleges that it is located in the Acadiana region of Louisiana, which is known as “Cajun country,” and that its nickname is the RAGIN’ CAJUNS. It further alleges prior use and registration of the mark GEAUX CAJUNS, in standard characters (CAJUNS disclaimed), for educational and entertainment services, clothing and a “wide variety of licensed goods and services.”3 As grounds for opposition, Opposer alleges that use of Applicant’s mark is likely to cause confusion with Opposer’s mark, including because “[t]he consuming public expects the goods sold and licensed by the University under the University’s GEAUX CAJUNS mark to expand to food and beverage products (including sausage) based on the University’s established history of licensing its marks for use in connection with food and beverage products.” 15 TTABVUE 16 (Second Amended NOO ¶ 31).
