Starbucks Corporation dba Starbucks Coffee Company, a corporation of the

State of Washington, having a principal place of business at 2401 Utah Avenue South,

Seattle, Washington 98134 (“Starbucks” or “Opposer”), believes it is being, and will be damaged by the registration of Procesadora Salvic SA de CV’s (“Applicant”) mark

FRIOCCINO shown in Application Serial No. 86298312, and hereby oppose the same.

As grounds for its opposition, Opposer alleges as follows, upon actual knowledge with respect to itself and its own acts, and upon information and belief as to other matters.

Opposer, Its Products and Services, and Its Famous FRAPPUCCINO Trademarks

1. For over 40 years, Opposer has been in the business of offering cafe, restaurant, and coffee-house services, and retail store services store services featuring coffee, tea, and coffee- and tea-based beverages. Over the years, Opposer has been producing, marketing, distributing, and selling an ever-expanding range of products including, among other things, coffee and non-coffee bottled and blended beverages, Notice of Opposition Application Serial No. 86298312

flavoring syrups, coffee beverages, milk, flavored milk, and milk-based food beverages

all under the FRAPPUCCINO mark.

2. Opposer, on its own and by and through its related companies, licensees,

and predecessors in interest, has continuously used the FRAPPUCCINO trademark in

commerce since at least as early as 1991 in connection with, among other things,

coffee beverages, milk, flavored milk, and milk-based food beverages. Sales of

beverages under the FRAPPUCCINO trademark top $1 billion on an annual basis.

3. Over the years, Starbucks has spent millions of dollars advertising and

promoting its FRAPPUCCINO Marks and products to the general public. Starbucks has

widely and extensively promoted its FRAPPUCCINO Marks and products through

virtually every available type of media, including but not limited to print publications,

signage, television, and/or the Internet.

4. With respect to print publications and signage, Starbucks has advertised and promoted its FRAPPUCCINO Marks and products in a wide variety of nationally- circulated magazines and newspapers. Further, the FRAPPUCCINO Marks have been featured on billboards and other signage in various cities, including, but not limited to,

Baltimore, Philadelphia, and New York City’s Times Square. Moreover, Starbucks has promoted the FRAPPUCCINO Marks and products through social media postings, digital advertisements, e-mail messages, websites, and other digital marketing.

5. Starbucks has advertised and promoted its FRAPPUCCINO Marks and products through television commercials, product placement in popular movies, magazine ads, and national television programs.

6. Starbucks also promotes and showcases its FRAPPUCCINO Marks and products on its websites.

7. In addition to its own substantial advertising and promotional activities,

Starbucks and its FRAPPUCCINO Marks and products have received and continue to receive widespread unsolicited media coverage.

8. As a result of its distinctive nature, and thus inherent strength; widespread advertising, publicity, promotion, and sales; and longstanding and extensive use and recognition, the FRAPPUCCINO Marks have been well-known and famous for years.

9. Opposer is the owner of, among others, the following United States trademark registrations for the mark FRAPPUCCINO (collectively the “FRAPPUCCINO

All of these registrations are valid and subsisting. They constitute prima facie evidence, and, as several of the registrations are incontestable, constitute conclusive evidence of

Opposer’s exclusive rights to use the FRAPPUCCINO Marks in connection with the products and services recited in the registrations. Printouts of these registrations from the PTO TSDR database, including assignment information, are attached as Exhibit A.

10. In addition to the above registrations attached as Exhibit A and as a result of its longstanding use in commerce, Opposer has nationwide common law rights in the

FRAPPUCCINO Marks dating back to 1991.

Applicant and its FRIOCCINO Application

11. Applicant Procesadora Salvic SA de CV is a corporation of Mexico with an

address of Colmena 1224, Colonia Mercado de Abasto, Guadalajara, Jalisco 44530,

Mexico.

12. On June 2, 2014, Applicant filed Intent-to-Use Application Serial No.

86298312 under Section 1(b), 15 U.S.C. § 1051(b), to register the mark FRIOCCINO for

“beverages made of coffee; beverages with a coffee base; coffee; coffee; coffee and artificial coffee; coffee and coffee substitutes; coffee based beverages; coffee beans;

coffee beverages with milk; coffee capsules containing coffee for brewing; coffee essences; coffee essences for use as substitutes for coffee; coffee extracts; coffee- based iced beverages; ground coffee beans; iced coffee; instant coffee; roasted coffee

beans” in International Class 30.

LIKELIHOOD OF CONFUSION, 15 U.S.C. § 1052(d)

13. Opposer repeats and realleges each and every allegation set forth in the

preceding paragraphs.

14. Opposer has used its FRAPPUCCINO Marks in commerce since long

prior to the June 2, 2014 filing date of the opposed application, and any date of first use

that may be claimed by Applicant.

15. Opposer’s pleaded registrations issued long prior to the filing date of the

opposed application, any date of first use that may be alleged by Applicant.

16. Applicant’s FRIOCCINO mark is strikingly similar in sound, appearance,

and connotation to Opposer’s FRAPPUCCINO Marks. In addition, the goods covered

by the subject application are nearly identical to the goods and services covered by

Opposer’s above-referenced registrations, and the goods and services advertised, promoted, offered, and sold by Opposer in connection with its FRAPPUCCINO Marks.

17. Applicant’s FRIOCCINO mark so resembles Opposer’s previously used

and registered FRAPPUCCINO Marks, as to be likely, when applied to the identified

goods, to cause confusion, or to cause mistake, or to deceive in violation of Section

2(d), 15 U.S.C. § 1052(d).

18. Opposer repeats and realleges each and every allegation set forth in the

preceding paragraphs.

19. Opposer’s FRAPPUCCINO Marks became famous well prior to the filing

date of Application Serial No. 86298312, and any date of first use that may be claimed

by Applicant.

20. Applicant’s FRIOCCINO Mark so resembles Opposer’s previously used

and registered FRAPPUCCINO Marks, as to be likely to cause dilution of the distinctive

quality of Opposer’s famous marks in violation of Section 43(c), 15 U.S.C. § 1125(c).

WHEREFORE, for the foregoing reasons, Opposer is being and will be damaged

by the registration of the mark shown in Application Serial No. 86298312, and

respectfully requests that this opposition be sustained, and that registration of the mark

in Application Serial No. 86298312 be refused.
