    Marketing Privacy Ian Ayrest Matthew Funktt Unsolicited solicitations in the form of telemarketing calls, email spam andjunk mail impose in aggregate a substantial negative externality on society. Telemarketers do not bear the full costs of their marketing because they do not compensate recipients for the hassle of, say, being interrupted during dinner. Current regulatory responses that give consumers the all-or-nothing option ofregistering on the Internet to block all unsolicited telemarketing calls are needlessly both over- and under­ inclusive. A better solution is to allow individual consumers to choose the price per minute they would like to receive as compensation for listening to telemarketing calls. Such a "name your own price" mechanism could be easily implemented technologically by crediting consumers' phone bills (a method analogous to the current debits to bills from 1-900 calls). Compensated calling is also easily implemented within current "don't­ call" statutes simply by giving "don't-call" households the option to authorize intermediaries to connect calls that meet their particular manner or compensation prerequisites. Under this rule, consumers are presumptively made better off by a regime that gives them greater freedom. Telemarketing firms facing higher costs of communication are likely to better screen potential contacts. Consumers having the option of choosing an intermediate price will receive fewer calls, which will be better tailored to their interests, and will be compensatedfor those calls they do receive. Giving consumers the right to be compensated may also benefit some telemarketers. Once consumers are voluntarily opting to receive telemarketing calls (in return for tailored compensation), it becomes possible to deregulate the telemarketers-lifting current restrictions on the time (no night time calls) and manner (no recorded calls).

He wakes up the next day and he receives on his phone a message from Cart- man and he writes ‘’Douchebag, Douchebag you need to come quick to my house we have a new idea to play with the boys come quick this is an emergency .’’ (Cart- man hangs up the phone) Douchebag doesn’t hesitate and runs to Cartman’s house. When he arrives at Cartman’s house he saw Cartman arguing with Kyle and Stan about what they are going to play next because, The New Kid had saved South Park twice now and the boys really want to play with Douchebag. But they knew that Douchebag had a name but he never talked he just played along with the other fourth graders. They began writing everything down that come up what they can play with all of town.

During the final season of Seinfeld, Elaine gets a new phone number that used to belong to her recently deceased elderly neighbor. She soon begins receiving up to six calls a day from the neighbor’s grandson, who’s looking for his Gammy. Elaine quickly gets fed up and breaks the news to him: “Good- bye, Bobby. Don’t call anymore. I’m dead now. Gotta go.”1 Unfortunately, many consumers share this frustration over getting repeated calls intended for someone else. This is especially true in the case of robocalls to reassigned numbers. Today, when you change your phone number, you probably don’t notify everyone who’s called you in the past, including businesses to which you’ve given permission to call. So when your old number is reassigned, the new holder of that number may get calls intended for you. These misdirected calls are a nuisance to the consumers that receive them. And at the same time, legitimate businesses, through no fault of their own, waste their time and effort calling the wrong consumers while subjecting themselves to potential liability under the Telephone Consumer Protection Act (TCPA). What can the FCC do to tackle this reassigned numbers problem? As the D.C. Circuit unanimously recognized last week,2 we’ve been exploring ways to reduce unwanted robocalls to reassigned numbers. And today, we take another step toward developing a solution. Specifically, we propose to ensure that businesses have access to one or more databases that contain the comprehensive and timely information they need to avoid calling reassigned numbers.

This problem subjects the recipient of the reassigned number to annoyance and wastes the time and effort of the caller while potentially subjecting the caller to liability. 2. Consumer groups and callers alike have asked for a solution to this problem. We therefore propose to ensure that one or more databases are available to provide callers with the comprehensive and timely information they need to discover potential number reassignments before making a call. To that end, we seek further comment on, among other issues: (1) the specific information that callers need from a reassigned numbers database; and (2) the best way to make that information available to callers that want it.
