1.0 The Scheme

1.1 This Statutory Quality Partnership Scheme is jointly made by , City Chambers, George Square, Glasgow (hereinafter referred to as “the Council”) and Strathclyde Partnership for Transport, Consort House, 12 West George Street, Glasgow (hereinafter referred to as “SPT”), both Local Transport Authorities in terms of Section 82 of the Transport (Scotland) Act 2001 (“the 2001 Act”)

The Scheme shall be known as:

The Statutory Quality Partnership Scheme for Glasgow Streamline Quality Bus Routes (hereinafter referred to as “the Scheme”)

1.2 The Council and SPT will provide and maintain facilities (“the Specified Facilities”) as more fully described in Schedule 2, in the scheme area which is delineated in red on the plan produced at Schedule 1 and bus operators providing a local public service as defined in the Transport Act 1985 (“Local Services”) who wish to use the Specified Facilities will undertake to provide such local services in accordance with the specified standard for bus services (“the Operator Standards”) as specified in Schedule 4.

1.3 SPT will act as agents to the Council in all matters relating to local bus service operations excluding roads infrastructure, under the terms of the Scheme.

1.4 The Scheme will come into operation on 16 January 2012 and will continue for a period of 7 years subject to any variation or revocation in accordance with section 9 of the 2001 Act.

1.5 The Scheme applies to the area covered by the routes (hereinafter referred to as “the Streamline Routes”) delineated in red in Schedule 1 attached.

1.6 The individual Streamline Routes consist of linear bus corridors within the Council boundary and a network of routes within the city centre as detailed below and in their corresponding Schedules. 1.7 The Scheme has been made following consultation as specified in Section 5 of the 2001 Act.

1.8 Bus operators of Local Services on Streamline Routes shall, in relation to those services, comply with the Operator Standards described in Schedule 4 from 16 January 2012 unless they are excluded from the Scheme for any reason identified in Schedule 5.

1.9 All other local public transport services using the Streamline Routes and not complying with the Specified Service Standard or not being excluded from the Scheme for any reason identified in Schedule 5 are ineligible to use the facilities specified in this Scheme. No service that picks up or sets down on a “hail and ride” basis may do so at any point other than a specified facility.

1.10 From time to time, subsequent to Scheme monitoring, the Scheme may be varied as considered appropriate by the Council and SPT. Variations to the Scheme may also be proposed by bus operators and all parties will be consulted on such proposed variations. After agreement is reached on any proposed variation, the Council and SPT will give notice of the varied scheme.

1.11 Prior to the commencement of the Scheme, bus operators will be required to advise SPT which vehicles they will use on Local Services operating in the Scheme area. SPT will arrange for those vehicles meeting the Operator Standards to be issued with a vehicle identifier disc to be displayed in the vehicle windscreen at all times that the vehicle is being used on a Local Service operating in the Scheme area.

1.12 Under the Scheme all parties agree to the review and monitoring processes as listed in Schedule 7.

1.13 Under the Scheme all parties agree to the Governance of the Scheme as set out in Schedule 11 (hereinafter referred to as “the Board”). 2 Obligations on the Council / SPT

2.1 The Council and SPT will provide Specified Facilities that assist in the delivery of their respective transport strategies, including improving the quality of bus facilities for passengers on the Streamline Routes, enabling bus operators to deliver more reliable and punctual Local Services thereby encouraging bus travel as a means of limiting congestion and associated adverse environmental impacts. The types of facilities already provided at various locations on the Streamline Routes to support these strategies include the following:

(a) Improved facilities at selected bus stopping places including shelters, poles, raised kerbs, bus boarders, lighting, security CCTV and real time passenger information as specified in Schedule 2.1;

(b) A system of integrated bus priority measures including priority of road space, traffic signal priority for suitably equipped buses, bus pre-signals, CCTV monitoring of routes and enhanced traffic signal control, and bus lane camera enforcement and new bus termini at Easterhouse, Hampden and Summerston;

(c) Traffic Regulation Orders, where reasonably practicable, to provide bus friendly waiting and loading restrictions on the Streamline Routes and Bus Stop Clearway markings and protections at bus stopping places. ( Taxis, licensed private hire cars and bicycles will continue to be able to use existing and additional bus priority facilities provided as part of the Council’s commitment to the Scheme. Proposals are in hand to strengthen local bye-laws regarding the operation of taxis, particularly in respect to improved controls on taxi licensing, to ensure that taxi operations do not cause congestion or hinder bus service movement and general traffic movement in the city centre and on Streamline Routes);

(d) Taxi operations within the Traffic Regulation Condition area and on Streamline corridors will be monitored by appropriate Council staff and SPT service compliance officers who will be given the powers to report taxi drivers to the licensing office for consideration of action;

(e) Appropriately focused decriminalised parking enforcement and enforcement of all traffic orders associated with the Scheme;

(f) Maintenance of Specified Facilities provided for the term of the Scheme in accordance with the standards specified in Schedule 3.

(g) SPT Service Compliance Inspectors will continue to monitor the operation of bus services in Glasgow and their duties will be extended to include monitoring vehicles and services operating in the Scheme area for their compliance with the terms of the Scheme.

2.2 Subject to clause 2.4 the Council and SPT will make the Specified Facilities detailed in Schedule 2 available from 16 January 2012 for the term of the Scheme.

2.3 The Council shall endeavour to ensure that any Traffic Regulation Orders and/or other contractual or other arrangement necessary to deliver the Specified Facilities is made and maintained whilst the Scheme has effect.

2.4 The obligations on the Council and SPT do not apply in relation to any period during which the Council or SPT are temporarily unable to fulfil their obligations due to circumstances beyond their control. In such circumstances, each bus operator shall be notified of the reason and anticipated duration of each individual circumstance as soon as is reasonably practicable.

Specified Facilities

2.5 Under the Scheme, in order to reduce barriers to bus use and enhance the bus journey experience through improved accessibility, security and access to passenger information at bus stopping places, the Council shall make available at selected stopping places on Streamline Routes facilities, which will be implemented in accordance with the Bus Stop Standard Specification for Streamline Quality Bus Corridors, details of which are listed in Schedule 3.

2.6 Details of all stopping places on the Streamline Routes including the level of infrastructure deployed at each stopping place and whether the stopping place is a Specified Facility under the Scheme is given in Schedule 2. Where a stopping place declared as a Specified Facility is an Existing Facility the date of installation of the most recent upgrade of the stopping place is stated.

2.7 The Council has implemented a range of new and modified Traffic Regulation Orders and other enforceable measures on Streamline Routes to assist the movement of buses and operation of bus services. Traffic Regulation Orders and other measures have been implemented on the Streamline Routes for the following specific purposes:

(a) to introduce more restrictive waiting and loading restrictions at various times of the day at congested sections of the routes and on sections of the routes approaching major signalised junctions. Restrictions have also been implemented at minor junctions where parked vehicles can inhibit turning manoeuvres and on sections of carriageway too narrow to maintain two-way traffic flow and support parking. (b) reallocation of road space for priority use by buses by establishing bus lanes and improving the operation of junctions by prohibiting turning movements and the introduction of yellow box road markings. (c) protecting bus stopping places with Bus Stop Clearways and highly visible ‘bus cage’ road markings.

Traffic Regulation Orders implemented on the Streamline Routes and included within the Scheme as Specified Facilities are identified in Schedule 2.

2.8 Under the Scheme, the Council will monitor routine operation of the Streamline Routes and take reasonable measures to enforce conditions placed upon third parties undertaking roadworks on the routes and to enforce traffic regulations operating on the routes through the Council’s decriminalised enforcement powers and in co-operation with Strathclyde Police. Enforcement on the routes shall be carried out in accordance with the ‘Enforcement Standard Specification For Streamline Quality Bus Routes’ as detailed in Schedule 3.

2.9 Under the Scheme, the Specified Facilities and general Streamline Routes will be maintained by the Council for the Scheme term. The Specified Facilities will be maintained in accordance with the ‘Streamline Quality Bus Routes Maintenance Specification’ and the ‘Bus Stop Standard Specification for Streamline Quality Bus Routes’ .The standards are detailed in Schedule 3.

2.10 The Council and SPT will co-operate with bus operators to investigate “hot spots” in accordance with Schedule 7 Monitoring and Evaluation and if deemed necessary promote and enter into Punctuality Improvement Partnerships and other service enhancements in order to further improve the quality, operation and efficiency of bus services operating on the Streamline Routes.

2.11 The Council and SPT will continuously increase the standard of the Specified Facilities on the Streamline and other corridors and work with the Operator in increasing Operator Standards in line with the standard of infrastructure. The supporting Delivery Plan sets out the priorities for implementation and anticipated timescales for delivery.

3 OBLIGATIONS ON BUS OPERATORS

3.1 Operators of services on Streamline Routes shall on those services comply with the Operator Standards unless the services are excluded from the Scheme for any reason subject to Clause 3.10 (b).

3.2 Each bus operator has the right to vary its standards of provision, provided that any variation continues to meet the Operator Standards. All relevant fleet changes must be notified to SPT no later than 7 working days after entry in to service of any vehicle being used to operate Local Services in the Scheme area.

3.3 As in accordance with the Transport Act 1985 as amended by Transport (Scotland) Act 2001 and standards set out in Schedule 4, every Local Service operating on the Streamline Routes shall be recorded in the Schedule of Local Services detailed in Schedule 6. Bus operators shall provide the required details to SPT to allow the Schedule to be updated by SPT for each change of service registered with the Traffic Commissioner. The revised Schedule 6 shall be available to the Traffic Commissioner and other parties as appropriate.

3.4 Each bus operator providing Local Services on the Streamline Routes shall provide the Council and SPT with a Data Sharing Agreement suitable to permit performance monitoring and setting out the conditions under which the Council and SPT are permitted to use specific journey time and reliability data for public dissemination to report and promote bus travel. The Data Sharing Agreement is detailed in Schedule 9.

3.5 Whilst complying with the Operator Standards, bus operators will use reasonable endeavours to ensure that the Local Services they provide deliver a consistently high standard of ride for bus passengers and positively contribute to the delivery of the benefits sought under the Scheme. Bus operators will co-operate with SPT to investigate using the monitoring and evaluation standards in Schedule 7 and if deemed appropriate, promote and enter into Quality Partnership Agreements, Punctuality Improvement Partnerships and other service enhancements in order to further improve the quality, operation and efficiency of bus services operating on the Streamline routes.

3.6 The bus operators will co-operate with The Council and SPT, as bus infrastructure standards evolve and improvements are made to Streamline and other corridors, the Operators will enter discussions regarding improving the Operator Standards in line with the standard of infrastructure. The supporting Delivery Plan sets out the priorities for implementation and anticipated timescales for delivery.

3.7 Bus operators shall provide timetable, route and fares information for each of their services in their specifically allocated space in the information display panel provided at bus stops and shelters. This information must conform to SPT Guideline Standards.

3.8 Where “split stop” arrangements are provided, bus operators may only use the stop designated for that particular service. Arrangements currently in place with SPT will continue.

3.9 Bus operators providing Local Services on all roads in the scheme area shall provide the following phased introduction of vehicles meeting the following requirements:- I. At least 90% of each operator’s Local Services on streamline journeys within Glasgow City boundary will be operated with low floor buses (step free entrance and kneeling suspension with space for at least one wheelchair/buggy) and full EURO 2 emission standard engines from 16 January 2012. OR alternatively

II. At least 50% of each operator’s Local Services on streamline journeys within Glasgow City boundary will be operated with low floor buses (step free entrance and kneeling suspension with space for at least one wheelchair/buggy) and minimum EURO 3 emission standard engines for particulates (PM10) from 16 January 2012.

III. At least 90% of each operator’s Local Services on streamline journeys within Glasgow City boundary will be operated with low floor buses (step free entrance and kneeling suspension with space for at least one wheelchair/buggy) and minimum EURO 3 emission standard engines for particulates (PM10) from 16 January 2013. (The remaining 10% of such journeys must be low floor buses with full Euro 2 emission standard engines.)

IV. 100% of each operator’s Local Services on streamline journeys within Glasgow City boundary will be operated with low floor buses (step free entrance and kneeling suspension with space for at least one wheelchair/buggy) and minimum EURO 3 emission standard engines for particulates (PM10) from 16 January 2014. N.B. Buses that are fitted with a certified Transport for London approved continuously regenerating trap exhaust system that reduces particle emissions to minimum EURO 3 level will be permitted.

V. From First June 2014 each operator providing Local Services within the Glasgow City Centre Air Quality Management Area (AQMA) will require to operate a minimum of 20% of their total scheduled journeys within, passing through, terminating or originating from this area with buses fitted with full EURO 4 or higher emission standard engines. (This AQMA is bounded by the M8, , Saltmarket/High St, Duke St/John Knox St and part of Royston Rd as shown in Schedule 10)

3.10 A bus operator may only use any of the Specified Facilities if:-

(a) a written undertaking from the bus operator in the form attached at Schedule 8 is provided to the Traffic Commissioner and a copy delivered to the Council and SPT.

(b) the Local Service is provided to the Operator Standards except for any period during which a bus operator is temporarily unable to do so owing to circumstances beyond his control, provided that the Council and the SPT are notified of the reason and anticipated duration of each individual circumstance as soon as the operator becomes aware of such circumstances.

4 SCHEME BENEFITS

4.1 The Scheme is intended to improve bus service provision standards and encourage passenger growth so that increased bus use can assist in restraining traffic congestion and its associated adverse environmental affects. The Scheme aims to achieve this by providing benefits for both bus users and bus operators in several key areas.

4.2 Facilities The improvement to roads, passenger facilities and the implementation of general traffic management measures aimed at providing higher priority for buses along the majority of Streamline Routes will bring benefits to those using and operating the bus services on the Streamline Routes. Buses will be able to travel the Streamline Routes with a shorter journey time but more importantly, they will be able to provide a more reliable and consistent service with a higher degree of compliance with their registered timetables. Bus users will benefit from being provided with higher quality bus stopping places that are safe and secure with improved service information and easy physical access to buses.

4.3 Standards of Service The provision of bus services to the Operator Standards will bring material benefits to those using them by ensuring that minimum standards are met or exceeded in relation to vehicle condition, driving standards, customer care, service reliability and other factors affecting the bus travel experience. Further environmental and social inclusion benefits will be gained from introducing higher standards for bus emission levels and low floor buses with provisions for the disabled and young families.

4.4 Patronage Growth Improved facilities and standards of service introduced to date have resulted in increased patronage and a growth trend across the city as a whole prior to the recent economic downturn. Implementation of the Scheme is necessary to preserve the benefits already accrued and to protect the facilities providing them. The Scheme will further improve facilities, provide ongoing maintenance and condition Local Services towards compliance with new Operator Standards. It is anticipated that further patronage growth can be achieved. 4.5 Air Quality The Council are satisfied that the provision of the Facilities and the operation of Local Services which are compliant with specified exhaust emission standards will improve air quality.

5 REVIEW AND MONITORING

5.1 SPT shall monitor compliance with the Operator Standards.

5.2 The monitoring and evaluation shall be carried out in accordance with the review and monitoring plan detailed in Schedule 7.

5.3 No later than 15 working days after the end of each six month period, (the first such period to begin on the commencement date of the Scheme), or at such intervals as SPT may so require, bus operators of Local Services using the Specified Facilities shall provide to SPT a written reports giving summary details of their compliance with the Operator Standards as detailed within Schedule 7.

5.4 The information provided through the monitoring procedure shall be evaluated against specific targets as specified in Schedule 7 and shall be considered at bi-annual review meetings between the Council, SPT and Operators for such further action as may be required.

5.5 The Council and SPT will prepare an annual review report of the operation of the Scheme on or around each anniversary of the commencement date which will include assessment of the Scheme’ against its original objectives, criteria and targets. Also, monitor progress against the Delivery Plan. This will be submitted to the Scottish Government within 6 months of the anniversary of the Scheme.

5.6 Operators, SPT and The Council will also have an obligation to report any key issues to the Board on a monthly basis, as listed in Schedule 7 and carry out intermediate monitoring reviews to monitor general progress as necessary.

5.7 Bus operators of Local Services will allow authorised personnel of the Council, SPT or a nominated survey company, access to travel on any Local Service in the Scheme area and provide any reasonable assistance they require exclusively for the purpose of monitoring compliance with the Scheme.

5.8 If any further action is identified by the Council and SPT as being required to maintain the Scheme benefits, the Council, SPT or the bus operator as appropriate shall carry out such action within a mutually agreed timescale appropriate to the action. 5.9 Operators who consistently fail to meet the Operator Standards, will, as a last resort, be reported to the Traffic Commissioner for consideration of regulatory action.

5.10 All data supplied by bus operators to the Council and SPT for the purposes of the Scheme shall be subject to the terms specified in Schedule 9.

6 GOVERNANCE

6.1 The Scheme will be operated following the governance structure set out in Schedule 11.

6.2 The Board roles and responsibilities are listed in Schedule 11.

6.3 In the event of any dispute between the Council, SPT and any bus operator, the parties to the dispute shall attempt to resolve same as amicably and quickly as possible. Should the dispute not be resolved within 14 days, the matter shall be referred to directorate or equivalent personnel of the parties involved who shall endeavour to resolve the dispute. If the matter remains unresolved after a further period of 14 days, the parties may refer the dispute to arbitration with an independent arbiter being appointed by the President of the Law Society of Scotland.

Procedure to be followed in Making Modifications to Specified Facilities

1. The Council and/or SPT shall be responsible for producing the design, construction, completion, testing and commissioning of any modifications to the Specified Facilities.

2. The Council shall provide bus operators with a written six monthly report on progress of modifications to the Specified Facilities and the timescales for completion of such modifications and the estimated timescale for completion of any modifications to the Specified Facilities that have yet to commence. No modification to the Specified Facilities which would adversely impact on the Operator Standards shall be made without the express prior agreement of bus operators. 3. SCHEDULE 3

ENFORCEMENT OF TRAFFIC REGULATION ORDERS AND CONDITIONS SCHEDULE 3.2

3.2.1 The Council shall use the powers available to it (and any extension of those powers subsequently obtained) in respect of enforcement of parking restrictions and traffic regulation orders in order to ensure the maintenance of the anticipated benefits of the scheme.

3.2.2 Waiting and loading restrictions on the routes shall be enforced daily, with coverage varying from once per day at the outermost sections of the routes to three or four visits throughout the city centre area.

3.2.3 Enforcement patrols will be targeted to coincide with the Peak Periods (08.00 hrs to 09.15 hrs and 16.15 hrs to 18.00 hrs) and other known problem times, with additional targeted enforcement of known problem areas by foot and scooter patrol.

3.2.4 The Council will maintain the above levels of enforcement throughout the term of the Scheme. Operators are encouraged to report any problems they encounter to the Council.

3.2.5 The Council has pursued decriminalisation of certain moving traffic offences including illegal use of bus lanes. Decriminalisation of moving traffic offences within bus lanes will give the opportunity for improved compliance through enforcement using cameras. Scottish Government legislation enabling bus lane camera enforcement is planned to come in to force during 2011 and the Council has installed an initial 11 cameras employing Automatic Number Plate Recognition (ANPR) technology at strategic enforcement sites to deter abuse of bus lanes by non authorised vehicles and to assist in bus movement and journey times. Further sites for such enforcement will be identified and additional cameras may be installed.

3.2.6 The Council and SPT will continue to monitor and report on operators’ compliance with Traffic Regulation Condition TR17 which applies within the area of Glasgow city centre bounded by the M8 Motorway, to the north; Castle Street/High Street/Saltmarket, to the east (included within boundary); the River Clyde, to the south and the M8 motorway, to the west, subject to Section 7 of the Transport Act 1985. The condition requires that services:

(a) stop to set down and uplift passengers only at locations recognised and designated as bus stops by the traffic authority. (b) only use bus stops and bus stands, allocated to that particular service, which are determined by Glasgow City Council. (c ) between the hours of 7.30 am and 6.30 pm, may stop at bus stops only for the minimum period necessary for the safe setting down and uplifting of passengers. This restriction does not apply to marked bus stands.

ROADS and ROADS INFRASTRUCTURE MAINTENANCE SCHEDULE 3.3

3.3.1 The Council shall endeavour to undertake road maintenance as follows:

a) Bus Operators shall be provided with 2 weeks' notice where possible and in any event no less than seven days’ notice prior to any works (excluding emergency works) being undertaken in the scheme area or roads adjacent to the area which might affect the maintenance of the anticipated Scheme benefits, together with, an estimate of the anticipated delays, broken down by time period or where such estimates are not practical confirmation that such estimates will not be provided;

b) Signs, lines and lane colouring will be inspected annually by the Council and replaced/repaired as required.

c) All programmed maintenance works shall be discussed with bus operators prior to being undertaken;

d) The Council shall inspect the infrastructure on the streamline routes every 6 months;

e) The Council shall endeavour to ensure that all bus operators complying with the Operator Standards are allowed access to any facilities provided under this Scheme and ensure that all maintenance work takes place outside peak periods as agreed between the parties, wherever possible;

f) In instances where bus operators cannot be provided with access to any facilities in the scheme area for the duration of any maintenance work or such works take longer than expected to complete, the Council shall develop work programmes to minimise bus service disruption and shall provide bus operators with estimates of the time delays caused by such works.

g) Traffic signal faults shall be attended as follows:-

SERVICES EXCLUDED FROM THE SCHEME

Local Services excluded from the Scheme

(a) Registered local services which operate in, terminate in or pass through the Scheme Area for the express purpose of carrying schoolchildren or students between their home and a school or Further Education College and which only operate at the start or finish of the school or college day.

(b) Bus routes registered as local services which originate at least 15 miles away from the Scheme Area and/or which are registered to observe only four or fewer Stopping Places in each direction upon any Streamline Route within the Scheme Area.

(c) Registered local services terminating in or passing through the Scheme Area which operate at a service level of 1 per hour or less. These services will also be exempt from the requirements of Clause 3.9 V in 2014. Multiple registrations for a number of such services registered by the same operator or registered in co-ordination by a group of operators which would be recognised by bus passengers as being one and the same service, will be regarded as registrations for services which come within the scope of the scheme.

(d) Registered local services which operate at a service level of 3 buses per hour or less and which have less than 15% of their total end to end route mileage on Streamline Corridor(s).

(e) Registered local services which operate at a service level of 2 buses per hour or less and which have less than 20% of their total end to end route mileage on Streamline Corridor(s).

(f) Registered local services which operate at a service level of 3 buses per hour or less and which do not enter the Glasgow City Centre TRC area AND which have less than 50% of their total end to end route mileage on Streamline Corridor(s).

(g) Additional vehicles required for timetable augmentation of a regular, every 30 minutes or better, all year round local service during the tourist season from start of April to end September.

(h) A service registered as a “local excursion or tour”.

(i) A service registered as a “Works Service”.

MONITORING and EVALUATION PLAN

S7 Introduction

S7.1 In order to assess the ongoing effectiveness of the Specified Facilities and Operator Standards introduced under this Scheme in delivering and sustaining the required benefits and identify areas for potential improvement a regime of monitoring shall be implemented. This will track operation of the Scheme against key outputs and associated targets.

S7.2 The key outputs to be monitored will be: x Punctuality and reliability of bus services; x Bus patronage; x Bus service quality and passenger satisfaction; x Route traffic performance.

S7.3 The information provided under Paragraphs S7.4 to S7.13 of this Schedule shall be derived from the bus operators' electronic ticketing machine data and such other journey time data as shall be obtained from manual monitoring or such alternative sources as the bus operators shall from time to time undertake or use. The bus operators shall use their reasonable endeavours to ensure that their drivers key in the relevant data in relation to timing points along the route to ensure that monitoring data is available.

S7.4 Bus Punctuality and Reliability Upon request by SPT, the Bus Operator shall record the following times. Where possible use will be made of electronic ticketing machine data analysis already provided by operators to Transport Scotland and SPT:

a) Departure time at the start of the journey from the terminus or journey starting point; b) Departure time from the agreed registered timing points within Glasgow; c) Arrival time at the last or other agreed bus stop at the end of the route;

All data will be disaggregated by direction of travel and by time of day and week as follows:

Direction of travel: Origin to city; Through city centre from Origin to Destination; City to Destination.

Day Time Periods: 06:00 – 09:00; 09:00 – 16:00; 16:00 – 19:00; 19:00 – 22:00. Days of week: Mon – Fri; Saturday; Sunday

Public Holidays are to be excluded from all data collection.

S7.5 Based upon the above data the SPT will report the following information: a) Service reliability trend information for bus services operating to or through Glasgow City Centre. b) Service reliability trend information for streamline corridors.

S7.6 Bus Patronage Each bus operator will provide to SPT such information on patronage on each of its routes in the scheme area as the bus operators and SPT shall from time to time agree. The information provided shall be sufficient to identify average net index increases or decreases in patronage at route level over a period of time.

S7.7 Bus Service Quality Operators shall supply to SPT a statement as required by clause 3.2 listing each bus intended to be used on Streamline Routes within the scheme area by registration and fleet number, its Euro compliance emission standard and accessibility compliance. The statement shall also indicate the number of drivers employed and used in the scheme area who have and have not met the prescribed training and customer care requirements in accordance with the Standard of Service or their status in receiving training.

S7.8 Route Fleet Check SPT will undertake a route fleet check during one specified day per 6 month period. The selected day will be specified to the Operator within one week of it occurring. Operators must supply a full list of the fleet on the Streamline routes at 0830 hours on that specified day using the pro forma in S7.19.

S7.9 Route Traffic Performance The Council will provide information concerning the traffic operation of the Streamline Routes to identify general traffic trends on the Routes and capture the context within which the performance of the Scheme is being reviewed. The following information will be provided:

a) bi-annual review of accident rates along route; b) bi-annual review of traffic flows at key locations on a cordon c) bi-annual summary of major disruption events on route (utility works, developments, diversions and such like which may have impacted on bus services) d) bi-annual summary of changes to infrastructure on route; S7.10 Hot Spots The Operator shall, on a bi-monthly basis, issue a list of locations on the Streamline network where significant delay is experienced or where the infrastructure is not performing to standard. This should be circulated to the Board.

S7.11 Journey Times Further to identification of these Hot Spots defined in S7.10, SPT may request the Operator to provide journey time data between two specified locations at specified times, utilising on-board data collection equipment.

S7.12 Passenger Satisfaction Annually, SPT shall undertake a programme of passenger satisfaction surveys. The Operator shall assist in facilitating the survey through typical methods such as display of material or permitting surveyors on board vehicles, at no cost.

S7.13 Faults The Operator shall highlight in a monthly report any faults or maintenance issues with the Infrastructure on the Streamline routes, to be circulated to the Board.

S7.14 Inspections SPT Service Compliance Officers will undertake a programme of inspections of the Streamline routes. Operators should ensure that Drivers cooperate and are courteous with Inspectors.

S7.15 Targets Provisional scheme benefit targets have been set to provide initial benchmarks.

Initial targets applicable for reviewing the monitored outputs shall be the following: a) Timetabled services – 95% of buses to depart from terminal point “up to 1 minute early or up to 5 minutes late” and 95 % of all services to arrive at the final destination point no more than 5 minutes late. b) Frequent services – Six or more buses to depart within a period of 60 minutes and the interval between consecutive buses not to exceed 15 minutes. Excess waiting time does not exceed 1.25 minutes at the registered timing points. c) Bus Patronage: Average net patronage growth +3% per annum

DATA SHARING UNDERTAKINGS

CONFIDENTIALITY/DATA SHARING

S9.1 The Council and SPT shall not save as provided in paragraphs 9.2 and 9.4 divulge or communicate to any person, or use or exploit for any purpose, any of the trade secrets or confidential knowledge or information or any financial or trading information or data relating to any bus operator which is supplied by the bus operator either directly or indirectly to them as a result of the Scheme. This is in accordance with Section 10(3) of the Transport (Scotland) Act 2001.

S9.2 Notwithstanding the provisions of paragraph 9.1 the Council and SPT shall be entitled to use information and data provided by the bus operators for the following purposes:-

1 for the purpose of the Council and the SPT mutually sharing the information only for the purposes of monitoring and enforcing the Scheme; 2. for the purpose of monitoring compliance with the requirements of the Scheme; 3. for the purpose of monitoring and assessing the benefits delivered by the Scheme. 4. preparation of reports using aggregated statistics for reporting requirements. 5. reporting to the Traffic Commissioner, V.O.S.A., the Police or any other regulatory authority. 6. reporting to Strathclyde Partnership for Transport, Glasgow City Council and bus operators participating in the Scheme. 7. reporting on the Scheme to the Scottish Government. 8. subject always to agreement with the bus operator for the purpose of promoting bus travel. S9.3 These restrictions and prohibitions on use, exploitation, communication and disclosure set out in clauses S9.1 and S9.2 shall continue to apply after the expiration or earlier termination of the Scheme without limit in point of time, but shall cease to apply to any data information or knowledge which may properly come into the public domain through no fault of the person receiving the same or which the receiving party can demonstrate was known by it prior to its receipt of such information.

S9.4 Notwithstanding any other provision of this Schedule 9 a party receiving information to which this Schedule 9 applies may disclose the same to the extent required by law or regulation, in particular the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004 provided that, where practical and lawful to do so, the party receiving the request for information provides prompt written notice of the request to the party who provided the information.

S9.5 Bus operators, the Council and SPT shall each ensure that its employees are aware of and comply with the provisions of paragraphs 9.1, 9.2 and 9.4.

S9.6 The Council and SPT acknowledges that all intellectual property rights in the data provided by any bus operator shall belong to and remain with the bus operator provided however that the bus operator hereby agrees to licence the same to the Council and SPT at no cost for the purposes described in paragraph 9.2.
