Friday, December 11, 2020 No. 3X Contains: House Deadlines; Meetings and Notices; Unsigned Sponsor List; Chair & Vice Chairs HOUSE CALENDAR MEMBERS OF THE HOUSE: Colleagues and friends, I did not anticipate having to write a message to you, believing in full confidence that my friend of the last twelve years would be capably handling this task over the biennium. I am sad to say that is not the case. For the first time in the history of our body, we have lost a presiding officer while we were in session. This is uncharted territory, and we must proceed respectfully, and in a manner befitting the memory of our friend, and the integrity of our institution. The passing of Speaker Richard W. Hinch will affect many of us, in many ways, and there will be resources made available to those that need them. Cathy Thornton from the office of the Employee Assistance Program is available for members and staff to speak to, and she can be reached at 271-4336. The House will be meeting on Wednesday, January 6 at the University of New Hampshire. Among the re- sponsibilities for the day will be to elect a new Speaker, adopt rules for the biennium, introduce bills, and other various tasks. Working with the Clerk, the University, the Department of Public Health, the Senate, and others, we will ensure that this meeting proceeds safely. To that end, permanent seating will not be made at this time so that we can meet in a socially distanced and safe manner. As government continues through pandemics and untimely deaths, we will continue to handle certain admin- istrative tasks until a new Speaker is chosen on January 6th. The House Rules Committee will meet next Wednesday to entertain amendments to the rules for this biennium. Members wishing to submit amendments must have them to the Clerk of the House for proper formatting and development by close of business the day prior to the meeting so that the members will have time to consider them. Standing committee assignments will be made in the coming days, and there may be changes made after the sixth, but it is our hope that we can begin committee work almost immediately after session commences. I know there is concern over how the House may be operating over the next few months, and those plans will be discussed and acted on with your safety, and those of our excellent staff, in mind. I want to echo what Speaker Hinch said in his only notice to the House last week, “We have some significant challenges ahead of us. We need to get the people’s work done in the midst of a public health emergency. It won’t be easy, but I believe we can meet our goals and deadlines while putting health and safety first. Let’s buckle down. Let’s get to work. Let us lead by example. Let’s conquer these challenges together.” Sherman A. House of Representatives O R D E R Seven members of the New Hampshire House of Representatives1 (“Individual Plaintiffs”) and the New Hampshire Democratic Party bring this suit against the Speaker of the New Hampshire House of Representatives. Each of the Individual Plaintiffs has one or more serious health conditions that place him or her at high risk for severe illness or death should he or she contract COVID-19. Plaintiffs allege that the Speaker’s failure to allow the Individual Plaintiffs to participate remotely in House sessions violates Title II of the Americans With Disabilities Act (codified at 42 U.S.C. §§ 12131-12134), Section 504 of the Rehabilitation Act (codified at 29 U.S.C. § 794), the Fourteenth Amendment to the United States Constitution, and Part I, Article 11 of the New Hampshire Constitution. 1 The members’ names are Robert “Renny” Cushing, David Cote, Kenneth Snow, Katherine Rogers, Paul Berch, Diane Langley, and Charlotte DiLorenzo. Cushing sues in both his individual capacity and as the Minority Leader of the New Hampshire House of Representatives. In light of our conversation, I am writing to summarize our accommodation requests as well as the factual and legal context for those requests. We hope to work with you to ensure a safe environment where all representatives are able to fully engage in the legislative process without imperiling their health, including through the use of remote technology for access and participation in the session. COVID-19 Is a Threat to Public Health As you well know, we are in the midst of a global pandemic, and COVID-19 infection and fatality rates have continued to surge across the country.
