between bike path, vehicle and walkers. And it'll show on these pictures that I have sent around here, there's a path for bikes; and next to it is the path for walking and then there's trees and then the cars are separated. And I think that if we could, at this point here forward, require more bike paths on each thing, I think this is gonna be a tremendous development for our future.
COUNCILMEMBER VICTORINO: Thank you. And I want you to understand, too, that as you'll see later on in the presentation, there is a walking path through the subdivision leading to the existing Waikapu Gardens that will lead down to the proposed commercial area which was down in Waiko in the corner there; that's part of the package that were showed to us and then will be shown to you later today. As far as the rest, Mr. Chair, I think we're gonna have to look upon not only the developer, but the County to help us do things like that, because Waiko and Waiale are the two main thoroughfares that come into this area. And, right now, there is enough space to do it, but it'd just be matter of what we wanna do once we wanna expand the roadway to four lanes. 'Cause Waiale will be a connector from Wailuku all the way past Waikapu and come out on Honoapiilani Highway. So just wanna let you know that there is some consideration, but thank you for this information.

MS. NAKATA: Mr. Chair, the next testifier is Vanessa Medeiros; she'll be followed by Doug Spencer.
MS. MEDEIROS: Aloha, good morning. My name is Vanessa Medeiros, and I'm speaking as a private citizen and an advocate of affordable housing. I'm happy to support this project because it is what I call, "appropriate affordable housing", which is housing that is designed or provided for its intended market - in this case, single-family homes for families at a price that those families will be able to afford and still put food on the table. The developer, Jesse Spencer, has a proven track record in providing affordable housing and a deep commitment to the working families of Maui; therefore, I ask you to support this project. Mahalo.

MS. NAKATA: The next testifier is Doug Spencer; he'll be followed by John Surina.
MR. SPENCER: Thank you. Chairman Carroll, Members of the Council, it's a real pleasure and an honor to be able to present this project to you guys today. And Mr. Bagoyo and the other consultants will be giving you all the technical aspects of that project. But I just wanted to get up here, you know, in the beginning, and really tell you and the members of the public, you know, who are here, what the heart of, really, this project is. As people know that my parents have been building affordable housing in Hawaii for a very long time. In fact, they started building affordable housing before people called it, "affordable housing". Their goal was always to build

a quality home that working people could afford to buy. And some of you may or may not know, but my parents came to Hawaii on Oahu in 1964, and they built their first houses there. And at that time, little did we know, that we'd be appearing in front of you guys here today, almost 50 years later, over a thousand homes later, asking to build another 48 homes. And some people would say, well, haven't you built enough homes already? Well, my answer to that is, check with the people who still want a house, the affordable home that working class people need here on Maui. And so that's what we're here to do is to do another project, it's 100 percent affordable. And I don't know, I haven't checked the history, it may or may not be the first 100 percent affordable housing project by a private developer on Maui. I just don't know. I've never heard of one before. And so that's what we're proposing for you today. And I also just wanted to thank the tremendous cooperation we've gotten, you know, from the County on this starting with Jo-Ann Ridao who shares our passion and heart for affordable housing. She's a tremendous asset to the County of Maui. Mayor Arakawa, you know, some of us may have our petty little political differences with the Mayor, but he's a good man with a good heart and he shares our passion for affordable housing. And so they've worked together, you know, to provide this project to you guys. But, ultimately, the decision lies with each and every one of you. You are the ultimate decision makers in this project. And, to be quite frank with you, I think your hearts in the same place ours are. We trust your decision whatever that may be. Whether it's for us or against, we actually trust the decision you're about to make; and we place this project in your very capable hands. And at the end of the day, if you approve this project, the true winners here is not gonna be the Spencer family, it's not gonna be the Mayor, it's not gonna be the Council, it's gonna be the working people of Maui who will have that opportunity to buy a home and raise their families in a quality neighborhood. So my encouragement to you here today is, let's get this thing passed as we have proposed it. If you want changes, come to us, we'll work with you on it. But let's get it passed quickly and let's get this thing built and get families moved in. And thank you very, very much for your time here today.

MR. GRAY: Good morning, Chairman, Members of the Committee. I just wanted to.. .my name's Jeff Gray. I'm a self-employed, tree trimmer here on the islands. I've lived here a long time. Never been able to afford a house. And it'd be nice to afford one. I would like to get one of these houses. But if doesn't happen, I also know a lot of people who've lived in that other Spencer Homes subdivisions. Jesse Spencer and his family have helped a lot of people, and I know a lot of people who just wouldn't have a home if it wasn't for them. And I just kinda looked over the notes here of which you guys were looking at today. A lot of it looks like just permit exemptions and stuff like that...or fee exemptions I should say not permit exemptions, fee exemptions. And I just know, you know, the Spencers; again, I know that they're doing that because they wanna pass on the savings to the people who are going to buy the homes and they wanna make it more affordable. When they asked me to testify, I thought, well, you know, what am I gonna say? But then I thought, well, who could really be against affordable housing anyway. I mean everybody's gonna be for it. So, you know, I just echo Doug's sentiments to you. I know you guys are gonna make the right decision whatever it is, you'll have reasons either way. MR. PATRICK: Good morning. Thank you for your time. My name's Cornelius Patrick, and I've been a registered nurse in the State Hawaii since 1995. My wife is a teacher with University of Manoa, an outreach program on both Kauai and Maui. We've been very interested in affordable housing. I think that the JES Corporation has proven itself worthy. I would just like to say that as I read through this quickly this morning that I agree with Mr. Gray that the proposed exemptions would definitely be passed on. I think that they've proven themselves over and over again in their projects that they do pass these savings on to the people, to the working people of Kauai. We don't see that in a lot of our projects here. We see a lot for profit, you know. And it

MR. BAGOYO: . . . (PowerPoint presentation). .. Good morning, Mr. Chair and Members of the Land Use Committee. Thank you so much. My name is Vince Bagoyo, and I'm the consultant for this project. I just wanna go over briefly the Project Summary of the proposed affordable housing project. The applicant and the owner is JES Corporation. The owner is here today, Mr. Jesse Spencer, who has developed the first phase of the Waikapu Gardens subdivisions, consist of 411 house-and-lot package. The location is in East Waiko Road in Waikapu. The total acreage, about 10.501 acres for the entire project. As noted earlier by Jo-Ann Ridao, this project is very unique, it's 100 percent affordable housing project, pursuant 201H of the Hawaii Revised Statutes. Fourteen homes will be priced to families earning 80 percent to 100 percent of the median income. And another 14 units for those who are earning 101 to 120 of Maui's median income. And the remaining 20 homes will be priced.. .those earning 121 to 140 percent of the median income. There's no other units above 140 median income. Again, this is a total of 48 affordable housing house-and-lot package, and it will be sold in fee and also consist of a neighborhood commercial stores...or center. The proposed lot sizes, ranging from 5,000 to approximately 9,000 square feet. The current existing land use designation for the current property is State Land Use District Agriculture, Community Plan Agriculture, County Zoning Ag and on the Maui Island Plan, it's under Urban Growth Boundary under protected and Preservation designation. I'm sorry. The approval required is by the Maui County Council, pursuant to 201H of the Hawaii Revised Statutes, Affordable Housing Subdivision. Again, this is the Location Map. It's located in Waikapu. What's unique about this project is actually it's connected to existing residential development within the Waikapu region. This is the aerial photo of the project site. Just for your orientation, this is Waiale Road and this is Waiko Road. The existing subdivision is right here. There's actually an existing park within the Waikapu Gardens Phase I subdivision. It's approximately 10.3 acres of a linear park. The cemetery is located around this area right here. Again, this is the Vicinity Map. Again, it's pretty connected to the existing residential within the Waikapu Gardens and on the lower part of Waikapu Village. It's 48 lots being proposed. This is the preliminary site plan for the project. We had several meetings with the Waikapu Association, and one of the things that they've asked us to do is to make sure that we have a buffer zone. This is the cemetery, the buffer zone between the cemetery and the proposed subdivision right here. And we are providing about 15-foot buffer with a fence as suggested by Councilman Mike Victorino. We also proposing a neighborhood commercial. And the proposed residential access of the subdivision will be through Waiale Drive [sic] right here. During our meeting with the Waikapu Association, they really did not want the developer to...or the subdivision to have access off of Waiko Road. There is a proposed emergency fire lane, as suggested by the Fire Department, right here; and it will be chained. The proposed driveway for the commercial will probably around this area. It hasn't been fully planned yet, and so we're looking at the farthest corner of the proposed commercial neighborhood store. And we're also proposing a driveway off this area, off of Waiko Road. These are the view photos of the project site. The top photo is facing northwest from the corner of Waiko Road and Waiale Roads. Again, this is facing north from the south adjoining property. This is just kinda give you some of the view photos of the project site. I have included this map. Actually, I got this from the County of Maui. 2.96.020 exempts these 100 percent affordable projects from the same fees. I don't see any harm in just leaving it in there. It'll make it clear when you read the exemption list that these fees are exempt rather than having to follow up and see if 2.96 is applicable later on and actually finding the Section of 2.96. Moving on to the second question regarding State of Hawaii Department of Education school impact fees, we believe the Council waiving these fees is a legally defensible position. I would like to point out that all the powers in 201H are granted to a state entity and those powers are then given to the County through HRS 46-15.1. And there is a sentence there that says, you have those powers that may be reasonably construed to be exercisable for a county of...by a county for the purpose of developing, constructing and providing low and moderate income housing. I'll leave that to the body to decide whether or not these can be reasonably construed to be exercisable by a county. I would also like to point out, if you read Section 302A-1603 regarding those DOE impact fees, there's a section Applicability and Exemptions, and they do give an exemption list within that. And I just wanted to point out that 201H projects or 100 percent affordable projects are not included in the specified exemption list for school impact fees. But, again, it's the body's decision. We feel that it's a legally defensible position if you do decide to waive those fees. Similarly, for the State General Excise Tax, we discussed it, same type of analysis. It's a little different in the sense that the 237-29 and 201H-36 talk about the developer providing whatever necessary documents to the corporation, which in our case would be the Department of Housing and Human Concerns for, I guess, passing it on to the State Tax Office. So, I believe, the intent of the developer was just to notify the Council that it will be seeking these types of exemptions in its exemption list. So, again, I don't really see a problem with that section. Moving on. Regarding the commercial center, it is allowed in 201H projects; 201H-44 specifically allows for a commercial-type centers. Also, I believe the developer has agreed to a modification. And they've submitted a modification to the exemption list that would limit develop-ability for that section to those allowed permitted uses in 19.16, Maui County Code, which is the Neighborhood B-1 Business District or something to that effect. And, finally, regarding the Council's authority for State Land Use Boundary Amendments, our office has an opinion from 2005 which essentially says, the Council does have the authority. And that was in relation to 201G. We will say that it carries on and continues to 201H, so the Council would have the authority for those parcels less than 15 acres regarding State Land Use Boundary Amendments. Thank you, Mr. Chair

On the last thing, just to clarify, we can...in this...the question was, may Council legally change the State Land Use District Classification from Agricultural to Urban by adopting the proposed resolution? So if we adopt this resolution, that in effect changes the State Land Use District Classification to Urban or do we have to say, we are going to do that?
MR. UEOKA: Not 100 percent sure if the developer's requesting a change in the State Land Use classification. I believe they're asking for an exemption from the restrictions contained in that classification. So I guess, at that point, it's a moot point.

MR. TAYLOR: So 28,800 is probably not even within the measuring accuracy of the flow meters. I mean to put this project into perspective, build this or don't build this, no one's going to notice the difference even in the.. .in even in the flow meters. It's just too small. So you're really comparing the 16 or 17 million gallons a day we're using out of Tao aquifer, depending on whether you wanna look at it at the high peak or 12-month moving average, to 28,000 additional, it is not...it's a very, very, very small number in relation to the amount we're using and the amount of float that's available.
COUNCILMEMBER VICTORINO: Okay. So we can be confident that as far as water is concerned, this is not gonna put much of a dent into what we using per day in our whole system here...Central system I should say, just for clarification?
MR. TAYLOR: That is correct.
COUNCILMEMBER VICTORINO: And the other question I have here is under K, exemptions from Chapter 14.07, Maui County Code, Water System Development Fees Schedule. It says, 1. An exemption for Chapter 14.07.030, Maui County Code, water system development fees shall be granted to exempt this project from Department of Water Supply development fee schedule. Just so the public understands, what does that specifically mean to this project?
MR. TAYLOR: The fees mentioned are what are commonly referred to as the new meter fees. The fee that for a five-eighths-inch meter up until this past June 30th was $6,030, which this Council agreed with our recommendation and raised those to $12,060 for a five-eighths-inch meter. Those are, as we talked about yesterday in the Budget and Finance Committee meeting, those are the restricted funds that we had a long discussion on yesterday. So 48 units at $12,060 each, comes out to just under $579,000. So that is revenue and these are not fines, these is monies that is used to pay for off-site improvements necessary to support these projects. So if this exemption were granted, we essentially would be short $579,000, which would have to be made up for somewhere. We have some issues with this. The first is a legal question about whether or not this would require you to change the Budget Ordinance. Because there's nothing in the Budget Ordinance that allows meters to go out without money coming in, so that's a legal question. The other question, is also for this body, is a financial question, how do you want to make up the $579,000? Does it just get written off, do we raise rates? That's about a 1 percent rate increase to make up that money for one year. You bring in about 50 million a year, so that's about 1 percent. And transfer it from the end restricted funds. Some philosophical policy questions for you. If you were to waive this, essentially the Department of Water Supply as an enterprise fund, we'd be having to raise other people's meter fees or water rates. So you'd be putting this subsidy solely on the County water users not on anyone else, and so that's a policy decision if you wanna make that. My recommendation would be that if you want to help them with this, then you tap into the County Affordable Housing Fund and pay this money. That keeps the Department of Water Supply finances, as per the Council's previous wishes as an enterprise

I mean just looking at EM's comments for this project, Item E, No. 2, Item E in regards to plans should install...and we're talking about the single-service laterals and advanced risers for each lot. They're asking for, I guess, using double laterals instead of the single laterals. So just kinda wanna know what is that advanced risers mean in relation to the single laterals or double laterals.
MR. MIYAMOTO: Mr. Chair? In general, what we do, is we have...whenever you have a...the County, technically, is responsible for the sewer lateral within the County's right of way. And so, generally, what we have...any new lateral come in, they put a little additional cleanout area right about two feet within the private property. You'll see it's a little four-inch cover, and that gives us access to the lateral and then so we can run a camera or something to clean out that line in the County's right of way. So, generally, it's pretty much required for all residential housing at this point.

mean one of the things we did with this County is all this non-permitted driveways which, in many areas, is less than 30 feet from stop signs which is all illegal by County Code; and, yet, we see 'em everywhere, okay. Even parking in front of stop signs like a parking stall, we see that everywhere. So I am very supportive of the Department being able to have appropriate traffic management requirements, especially for the collector roads. I don't know, I mean I see maybe one for this whole subdivision whether you wanna call it the collector or the road. But I can support the Department's concerns on this, Chairman. Thank you.

COUNCILMEMBER COUCH: Thank you, Mr. Chair Mr. Goode, on the...one of the other exemptions that they're looking for at 18.04.030, Administration, there's a lot of stuff in there under that one chapter. I was just curious if you're okay with that request for exemption or you have some concerns?
MR. GOODE: For 18.04.030, Subdivision Code, the Administration, this subsection really deals with what we call, "the consistency issue". Is the community plan designation and the zoning and the State designation all in alignment so we can process the subdivision? And, generally, I guess that wouldn't be the case here 'cause that's Ag and I don't know what the community plan is. Plus, you got this 201E on top of everything with small lots. So without the 201E, we'd get an application. If they came in for this subdivision, we'd just reject it. So, yeah, it's a long subsection as you know, but it basically it's all about making sure that there's these consistencies. So I think it's a reasonable request --

MR. GOODE: --as long as this passes.
COUNCILMEMBER COUCH: And along that same line, you have 18.16.020, Compliance. And that's a really short one, but it is really all encompassing. I'm just curious. I'll just read it to the Members. It says, subdivision shall conform to the General Plan and shall take into consideration preliminary plans made in anticipation thereof. Subdivision shall conform to the requirements of State law, Department of Public Works, State Department of Health, State Department of Transportation and Board of Water Supply requirements and the standards established by this title. So I mean that's a big net.
MR. GOODE: Yeah, and thank you for bringing this up. But, first of all, what you read was the old code.

COUNCILMEMBER HOKAMA: And so, you know, from that standpoint, I can say, you know, it makes sense and I can be supportive. But, you know, I grew up in a time when Waikapu was Waikapu. And you know of my concern. I am not into one megalopolis where Kahului, Wailuku, now Waikapu potentially. I guess we could throw in Happy Valley eventually, Waiehu, Waihee. But I don't wanna see blurred community lines. I think our people and our towns are special enough that they should keep their identities. And so, you know, I'm just wondering with this more potential, more projects like this with the project across Tropical Plantation, is this what the Administration is gonna push for, to just have one sprawl, a sprawl, a small sprawl or whatever we wanna call it. But it's like nut grass, you know, once it gets invaded in your yard, it kinda takes over.
MR. SPENCE: Sure. And I don't think that's anything that this Administration's going to push for. During the Maui Island Plan and actually I've met with any number of the members of the Waikapu Community Association, and they're very concerned about exactly what you're talking about with Wailuku Heights blending into Waikapu across the hillside...

MR. SPENCE: Yeah. Until there is no distinction between the communities. And that has been...I mean that was a major topic of discussion during the Maui Island Plan. And you see some of the proposed projects with conditions on them, how to keep it separate, et cetera.
COLTNCILMEMBER HOKAMA: So is there planning tools you could recommend to us? If we wanted to move this project forward, are there planning tools or planning practices that can try and still help maintain some identity for the Waikapu community instead of just be swallowed up by Wailuku?
MR. SPENCE: Yes. Some of those things are already in the plan. I mean there was a lot of buffers put in, those kinds of things. Some of it's just going to be working with the landowner when they come in for their zoning, I mean, and following the things outlined in the plan.
COUNCILMEMBER HOKAMA: Are there things that you would recommend to us as part of verbiage for modification, I guess, would be the way to state it that we, you know, you have some ideas that we might wanna entertain and present to the proposer, developer as a way of helping out on multiple fronts? Because that, you know, I cannot tell how much it's an important priority for me to maintain community character.
MR. SPENCE: I think, I mean, it's filling it in, it's filling in the space already that is separating the communities. So I think that's.. .I mean for this particular project, I think that's unavoidable. I think one thing we could do which, you know, the Chair had asked previous directors, would you like to add anything? I think what I would like to do is, when they go...assuming the Council grants the request for commercial, I would like to have the opportunity to work with the landowner and with the community on the design of that commercial, so it doesn't just become a space in the middle of, you know, that area where, you know, you could just build a rectangular box with a sign on it, and we don't want that. You know, we would like...
COUNCILMEMBER HOKAMA: I had hoped you would've come up with how to...that project could enhance the existing commercial of Waikapu town.
MR. SPENCE: It could.
